THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS
HELD AT THE KENDALL COUNTY BOARD ROOM
MAY 17, 1989 7:00 P.M.
Chairman Feltz called the regular meeting of the Plan Commission to order and
introduced the subject of changing the meeting night from the third Wednesday
to either the first or second Wednesday of the month. After discussion evidenced
the fact that there would be conflicts, it was decided to table the issue for
another month in order to get input from more of the Commission members, many
of whom were not able to attend this meeting.
For the benefit of the visitors in attendance for the Public Hearing, Chairman
Feltz reviewed the agenda and announced that the petition to rezone Corneils Rd.
by Stanley Zepelak would not be presented; it was canceled and would be re-
scheduled for the June meeting.
Attendance was recorded as follows:
Present: Harold Feltz, Larry Langland, Dave Greiter, Sandra Adams
Absent: George Stewart, Clarence Holdiman, Don Ament, Rick Doetschman,
Larry Bretthauer, Kevin Collman, Don Schcenfielder, Dan Laube
The minutes from the April meeting were presented. The motion to approve was
made by Larry Langland, the second by Sandra Adams. The meeting was then
adjourned to conduct the Public Hearing scheduled. The meeting then resumed.
PC89-14 -- PETITION TO ANNEX & ZONE KENDALL COUNTY A-1 TO CITY OF YORKVILLE
R-2 -- FOXFIELD SUBDIVISION, FIRST ADDITION - 6 LOTS - TERI LANE -
BARRY NILES
Jim Clarage noted that only zoning was requested at this time, even though the
exhibit presented was actually a preliminary plat. He stated that he found no
technical problem with the petition as presented.
Mayor Davidson commented that there was a problem at this time with extension of
water mains in Yorkville. In answer to Mr. Niles question, the Mayor said that
he hoped it was a temporary situation. It would, however, prevent Mr. Niles from
any immediate procedures.
Dave Greiter questioned whether the water supply on the existing line would be
adequate, especially with consideration to Prairie Lanes subdivision recently
annexed. Mayor Davidson confirmed that all necessary plans for looping, etc. ,
would be followed.
It was verified through discussion that the request tonight was for approval of the
Preliminary Plat as well as for annexation & zoning. Mr. Langland stated that the
the motion could be stated to cover both.

Larry Langland then made the motion to recommend approval of the zoning, annexation
and preliminary plat of the Foxfield Subdivision, first addition, Barry Niles,
subject to proper notification having been sent to adjacent property owners.
The second was made by Dave Greiter. Voice vote carried as follows:
Feltz - yes Langland - yes Adams - yes Greiter - yes
PC89-15 -- ZONING CHECK LIST
Chairman Feltz asked for the addition of a signature block to show who filled out
the form and also the signature of the chairman. It is anticipated to be able to
put this into use in the near future.
NOTES FROM MAYOR DAVIDSON --
1. The Council has determined that they would like to see any property within
1-1/2 miles of the city limits be subject to the city subdivision
ordinances. Any differences must be in the form of a variance. There can be
variance for sewer & water on an acre lot; it is to be considered on
a case by case basis only & granted only as deemed necessary.
The Sanitary District is in agreement with the above.
2. It is to be noted that the City of Yorkville is on a restricted status
as far extension of water mains is concerned.
A brief discussion followed regarding the check list & the advantage in getting it
into the hands of area attorneys involved in numerous petitions. Hopefully, it
might encourage necessary information to be made readily accessible & save time
during proceedings.
Chairman Feltz recognized Mr. Mitchell from the Plano Plan Commission & agreed
to speak with him after the meeting with regard to a letter received today.
The motion to adjourn the meeting was made by Larry Langland; the second was by
Sandra Adams. Meeting adjourned at 7:45 P.M.

Chairman Feltz opened the Public Hearing with the swearing in of those in
attendance wishing to state their opinions during the hearing. Plan Commission
members present are listed in the regular minutes; interested citizens are listed
on the sign-in sheet filed with the minutes.
PETITION TO ANNEX & ZONE KENDALL COUNTY A-1 -TO CITY OF
YORKVILLE R-2 -- FOXFIELD SUBDIVISION, FIRST ADDITION
6 LOTS - TERI LANE BY BARRY NILES
The petitioner Barry Niles stated that the proposed lots were located directly
north of the existing property & were 94' x 2111 . The road extension would be
2821 . He further stated that the original engineering for the existing subdivision
had taken into consideration the inclusion of the additional lots.
Mayor Davidson asked if the EPA permits had been obtained; Mr. Niles stated that
it was his intent to get direction from the Commission before proceeding.
Larry Langland questioned whether the proper notification was sent out to adjacent
landowners. His concern was with the legality of the Public Hearing should such
notice be lacking. Chairman Feltz stated that the Commission would assume that
proper procedures had been followed. Should it become a matter of discrepancy
later the Public Hearing would have to be held again.
The Public Hearing was closed in order to resume the regular Plan Commission
Meeting.
