Plan Commission Minutes 1989 09-20-89 r t MINUTES OF THE PLAN COMMISSION OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS HELD AT THE KENDALL COUNTY BOARD ROOM SEPTEMBER 20, 1989 7:00 P.M. The September meeting of the Plan Commission was called to order by Larry Langland, acting Chairman in the absence of Harold Feltz, with the following members present: George Stewart, Clarence Holdiman, Larry Langland, Sandy Adams Rick Doetschman, Dave Greiter Absent: Harold Feltz, Don Ament, Larry Bretthauer, Kevin Collman, Don Schoenfielder, Dan Laube Others in attendance included Mayor Davidson, Fran Klaas, Jim Clarage, Attorney Tom Grant, Petitioner Gary Conover and interested citizens as listed on the sign-in sheet on file with the minutes. The minutes from the August meeting were approved as written. The motion was made by George Stewart, the second by Sandy Adams. PC89-32 -- PRELIMINARY PLAT - HICKORY LANE ESTATES SUBDIVISION - RT. 34 & CANNONBALL TRAIL - KENDALL COUNTY The petition was presented by Attorney Tom Grant. The following points were highlighted: 1. The preliminary plat is the same as the original zoning sketch, which was approved with no apparent problems. 2. The intent is to have this handled the same as with Ivy Subdivision -- if approval is recommended, it should include that as long as the final plat complies with the preliminary and is accepted by the County, then approval is also recommended to the City. 3. Basically, tonight's issue is to make certain that the plan complies with all subdivision ordinances with respect to engineering. 4. With regard to variations, it is believed that both the Zoning Board of Appeals and the City Council will approve the variations in the same manor as was done with Ivy Subdivision. The variations would include: a. No requirement for public sanitary sewer or water b. No sidewalks on the interior; lots #5, 4, 3, on the Rt. 34 side to be improved when Ivy Subdivision is improved with sidewalks on the same lot numbers. C. Street lights -- they are asking for a variation, but do expect a request to be made for the installation of a street light in the cul-de-sac area. This is agreeable and will be located in agreement with the city engineer and to be installed at the time development begins. Tonight's discussion will include the roadway to the north. The Conover's are agreeable to either the continuance of the road through both subdivisions.or a cul-de-sac. • PLAN COMMISSION MINUTES -- SEPTEMBER PAGE 2 If this is done, the name will be changed to "Hickory Lane" through both sub- ,�.divisions. If the decision is to include a cul-de-sac instead, that is also acceptable. Jim Clarage questioned the no access strip along Rt. 34, the curbs, and the utility easement and noted that all three were present. Rick Doetschman questioned the drainage and it was stated that there would be a storm sewer which would be diverted to open detention area. Attorney Grant also mentioned that the main- tenance of the drainage areas had been worked out and approved by the County. Mr. Clarage gave his opinion that the preliminary was sufficiently complete to have both the preliminary and. final to be included in the recommendation to approve if the board so decides. Attorney Grant asked that those in attendance be allowed to voice their concerns. Mr. Langland allowed Kyle Price to act as a spokesman for the group and state the major areas of concern. Copies of the relative statements were given to each plan commission member to review (on file with the minutes) . The basic position of the landowners who would be affected by the final decision was that the cul-de-sac should be allowed rather than a through street. Reasons given included: safety factors, economic advantages for resale, security of dead end streets, and environmental concerns. Statements of concern were also presented by Arthur Crawford and Don Garbe. Dave Greiter gave his views concerning problems with getting emergency vehicles in and out of areas such as this. Mayor Davidson stated that a through street was preferred by the School District, the Fire Department, the Yorkville_'Pb_ ice Chief and Sheriff Randall. This subdivision was built before present ordinances; now there is a choice whether or not to make a second entrance. There are no statistics reported, but the viewpoints of the above departments have been voiced to the Mayor. Mr. Price stated in summary that those individuals present tonight should not be targeted in view of all the existing cul-de-sacs in Yorkville, many of which were recently approved. Their concerns in keeping their dead end street should now be given deeper consideration. Jim Clarage stated the following concerns that had been addressed: 1. Street light at cul-de-sac. 2. Waive sidewalks except as listed on lot #5, 4, 3. 3. Sewer and no access easements were provided. 4. The name change to Hickory should the street go through is provided. 5. Additional street light on Cannonball Trail will be installed if required. Mayor Davidson suggested that any motion made state that the issue of sidewalk, sewer & water be waived dependent on the decision of the Zoning Board of Appeals. Rick Doetschman asked for Mr. Conover's opinion on the issue. He replied that the cul-de-sac would be the most desireable; however, he would go either ,ray to get the development approved. Attorney Grant agreed that all indications to date suggested a through street. PLAN COMMISSION MINUTES -- SEPTEMBER PAGE 3 Further discussion followed -- Plan Commission member Greiter stating concerns with getting emergency vehicles, snow removal vehicles, disposal trucks, school buses, etc. , in and out of the area; those in attendance presenting their ar- guments and views. Larry Langland suggested that ample time had been given to the presentation of relative facts and opinions and asked for a recommendation from the Plan Commission keeping in mind that the final decision rests with the County. Clarence Holdiman made the motion to recommend to the City the approval of the Preliminary Plat provided that a cul-de-sac rather than a road going through to Hickory Lane is shown; if such change is made, the recommendation is to include the approval of final plat also. The second was made by Rick Doetschman. Roll call vote carried the motion as follows: Stewart - no Holdiman - yes Langland - yes Doetschman - yes Adams - yes Greiter - no The motion to adjourn was made by Larry Langland and seconded by George Stewart. Ellertson, Recording Secretary PLAN COMMISSION MEETING L oZL� - SIGN-IN SHEET NAME ADDRESS 21 121e, G, _ o >n. 1 The benefits of acting upon the suggestions from concerned parties relative to the development of the Conover Property located directly south of the Oak Knolls Subdivision off Cannonball Trail. 1. Have Gary Conover a long-time local builder happy to make the best possible use of the land for future generations. 2. Have a county that will be happy with the use of the land. 3. Have a city that will be happy with the use of the land. 4. Have present citizens be happy with the use of the land. 5. Have future citizens be happy with the use of the land. To accomplish the above mentioned objectives the following should be considered: 1. With the recently changed zoning of the Conover Property, the present residents ' lifestyles should be affected as little as possible. 2. Each subdivision should remain as a separate subdivision. To accomplish the two above objectives the following would be a solution: 1. Since Ivy Lane has already been approved as a Lane name, continue the Lane into the Conover Property and make a cul-de-sac. Ivy Lane could serve as entrance and exit for those 10 houses in both the combined Ivy and Conover subdivisions. By doing this the following would be accomplished: 1. The two lots at the north end of the Conover property could be larger. 2. The developer would save money in the development by not having to put in at least 250 feet of Asphalt and Curbs and those responsible for maintenence also would save by not having to maintain the extra unnecessary road area. 3. Oak Knolls could remain a separate subdivision using the existing lane that is there. This would still keep the Oak Knolls subdivision a quiet, secluded, attractive location. Property values would not be decreased. 4. By not connecting a much wider asphalt Ivy Lane with curbs to a narrower oil and chips Hickory Lane with a Country Look, the continuity and the personality of each subdivision could be maintained and not appear to be mismatched where the proposed joining would be. This would also allow the 30 Year Old Pin Oak Tree to remain standing in all its DIGNITY. 5. Since there is Ivy Lane to use for an entrance and an exit, this would be a good compromise instead of making an entrance Off of U. S. Route 34. 6. All subdivisions would benefit by having attractive features such as quiet streets, cul-de-sacs, and the beauties of nature. (See Attached) 7. Nature, and wildlife, and the present trees could all be left in their present setting without major changes. 8. The SAFETY SAFETY SAFETY SAFETY SAFETY SAFETY SAFETY SAFETY of the current residents and the future residents would be protected by not having a through street resulting in extra unnecessary traffic. We ask that you help us with this plan for the benefit of all the parties involved.
