Plan Commission Minutes 1987 03-31-87 400e • MINUTES OF THE PLAN COMMISSION OF THE CITY OF YORKVILLE HELD AT CITY HALL ON MARCH 31, 1987 AT 7:00 PM Chairman Groner called the meeting to order. Roll was called with the following members in attendance: Mr. Groner, Mr. Stewart, Mr. Ament, Mrs. Price, and Mr. Feltz. A quorum was established. Also present were City Attorney Dan Kramer, Michael Thanepohn, Dennis Fahrlander, Robert and Mary Jane Burke, Kirk and Susan Hoffman, Jim Olson and Rose King. Minutes Chairman Groner inquired as to whether there were any additions or corrections to the February 24, 1987 minutes. A correction was made. The roll call vote for PC87-11 (KENDALL COUNTY-Zoning A-1 to R-3 - Rt. 34 along Fox River - Timber Ridge Subdivision) read YES for Mr. Feltz and it should have been a NO vote. Mr. Feltz made a motion to approve the minutes as corrected. Mr. Stewart seconded the motion. All members were in favor. PC87-10 - Petition by Burke/Hoffman to Resubdivide & Rezone 6 acres located at the end of Olsen Street (known as McNelis Subdivision) from R-1 to R-2. Mr. Jim Olson represented the Burkes and Hoffmans. He stated that there was a correction. The property is not 6 acres, it is 3 acres. Mr. Feltz inquired if there was city sewer and water on this property, and the Burkes and Hoffmans informed the commission that there was city sewer and water on the property, and also informed the commission that there was a drive way down the center of the property, except for 50 feet in the back, for emergency vehicles use if needed. Mr. Jim Olson informed the commission that a drainage ditch will be at the west edge of the property running along the northern edge to the creek. He also stated that easements for street purposes at the west end are currently existing from the McNelis Subdivision. They were put in to accommodate Yorkshire Estates at one time. Mr. Feltz questions the size of each lot, and Mr. Olson informed him that each lot is 1.6 acres and they would not be divided any more at any later date. Mr. Goner questioned if the drive way turn around would be adequate for emergency vehicles. Mrs. Hoffman informed the commission that it will be adequate for emergency vehicles and that they will maintain this driveway. Mr. Olson inquired if zoning is 1 acre minumum, and Mr. Goner stated that zoning for R-2 is 1 acre with a width at the zoning line not less than 120 feet. Mr. Feltz made a motion to recommend to the City Council to rezone this property at the end of Olsen Street from R-1 to R-2. Mr. Stewart seconded the motion. A roll call vote was taken. Groner - NO Feltz - YES Stewart - YES Ament - YES Price - YES 3/31/87 Page 2 PC87-12 - KENDALL COUNTY Petition by Bryan & Patty Harbin to rezone from A-1 to R-3 a parcel of land located on Kennedy Road for the Purpose of const- ructing one home. Mr. Jim Olson represented Bryan and Patty on this petition. He stated that the property is the first house on Kennedy Road after turning off Route 47. Mr. Ament made a motion to recommend that the city council acdept the petition as presented. Mr. Feltz seconded the motion. A roll call vote was taken. Groner - YES Feltz - YES Price - YES Ament - YES Stewart - YES City Attorney Dan Kramer explained and outlined each property that will be annexed into the city. Some of the property starting at the Roger Simmon's house and going north on the west side of Rt. 47, all way out to the intersection of Rt. 34, a couple of properties on the east side Of 34, the old Y-Mart property north of the intersection, plus a couple on the south end of Yorkville. Attorney Kramer also explained that the properties being annexed into the city will be B-3 zoning, which is the same class as they have with county at this time, except all the automotive uses from B-3 is put into B-4 now. The city is offer- ing free water and sewer hook up to a 1 inch meter, with a 15 year time limit. Changes and restrictions on the annex petitions are as follows: PC87-14 - Gary and Dorene Rice have been allowed to keep their original sign for R & R Supplies, which gives them 2 square feet more display area. PC87-16 - The City Council agreed if this property,which is the old Pine Village Restaurant, is ever turned back into a restaurant, only a liquor license for a restaurant will be issued, not a package store or tavern license. PC87-21 - The property belonging to Kenneth Johnson, Dale Butts, and Dean Sleezer will be zoned B-3 - None performing use. The following petitions have agreed to the annexation agreement: PC87-13 - Petition by Kyle & Martha Price to Annex & Zone to B-3, a parcel of land located along Rt. 47 - Annexation Agreement. PC87-14 - Petition by Gary & Dorene Rice to Annex & Zone to B-3, a parcel of land located at 807 N. Bridge St. - Annexation Agreement. PC87-15 - Petition by John & Alice Conover to Annex & Zone to B-3, a parcel of land located on the east side of Rt. 47 - Annexation Agreement. PC87-16 - Petition by Luella Liakakos Garling to Annex & Zone to B-3, a parcel of land located on the east side of Rt. 47 - Annexation Agreement. PC87-17 - Petiton by Fred & June Dollman to Annex & Zone to B-3, a parcel of land located on Rt. 47 - Annexation Agreement. PC87-18 - Petition by David & Mary McAuslan to Annex & Zone to B-3, a parcel of land located on Rt. 47 - Annexation Agreement. PC87-19 - Petition by GoTane Service Inc. to Annex & Zone to B-3, a parcel of land located on the S/E corner of Rt. 47 & Rt. 34 -Annexation Agreement. 3/31/87 Page 3 PC87-21 - Petition by Kenneth Johnson, Dale Butts, & Dean Sleezer (Yorkville Equipment Company) bo Annex & Zone to B-3, a parcel of land located south of the corporate limits on Rt. 47 - Annexation Agreement. The following petition has not agreed to the annexation agreement at this time. PC87-20 - Petition by Oswego Community Bank Trust #86 to Annex & Zone to B-3, a parcel of land located on the N/E corner of Rt. 47 and Rt.34. Mr. Stewart made a motion to pass the 8 annexations as stated by Attorney Dan Kramer. Mr. Feltz seconded the motion. A roll call vote was taken.
