MINUTES OF THE PLAN COMMISSION OF THE CITY OF YORKVILLE
HELD AT CITY HALL ON JUNE 24, 1986 AT 7:00 PM
Chairman Groner called the meeting to order. Roll was called with the
following members in attendance: Mr. Ament, Mr. Groner, Mrs. Price, and
Mr. Feltz. A quorum was not present. Chairman Groner questioned whether
the members present wished to proceed with the meeting. It was the commis-
sion's opinion to continue without a quorum since the petition to be dis-
cussed is outside of the city limits, and the City would only be making
recommendations to Kendall County. Also present at the meeting were
Jim Clarage, Robert Davidson, Attorney Peter Krantz, Jim Johnson, Larry
Jennings, Mike Thanepohn, and Jim Michels.
Mr. Feltz made a motion to approve the minutes of the April 22, 1986 Plan
Commission meeting as written. Mr. Ament seconded the motion. All members
present were in favor.
PC-86-6 - Petition to Rezone Section 34, Bristol Township, from A-1 to R-1
by Mike Bollweg (Kendall County #8606)
Chairman Groner stated that the order of business would be to consider the
rezoning on a portion of section 34 in Bristol Township from A-1 to R-1 east
of the city limits on the north side of the River. It is also east of
Woodworth's Subdivision and is on Quinsey Road. The road extends to Fox
River Gardens. Maps were sent out on the proposed property.
Attorney Krantz was present to represent the petitioner. Attorney Krantz
presented an aerial photo of the property. The petitioner wants to buy
the proposed property subject to its rezoning for 5 residential lots. There
are 17 1/2 acres, so the lots would be approximately 3+ acres. The property
is wooded and is not conducive for agriculture purposes. He felt the most
economical use would be residential. They did not feel that they would be
upsetting the nature, drainage, etc. of the property. Quinsey Subdivision
is along the river. The access comes off a private road which is only
15 ft. wide. It runs approximately 4600 ft. , and they would only be using
1300 ft. along with the residents in Quinsey Subdivision. Mike Bollweg is
Attorney Dan Kramer's client. However, Attorney Kramer cannot work on this
petition due to conflicting interest with the City of Yorkville. Attorney
Kramer will represent him in the future. They have discussed the proposed
property with representatives from Quinsey Subdivision. The residents put
money together to maintain the road. The petitioner has elected to come in
on the north side of the property at the east end and run the road along the
north side. They will not be using the private roadway where it goes down
in front of the houses on the east. They will provide a wider road west of
where they are. They will not be involved with widening the access or pro-
viding additional access to the existing situation. The road will be
widened for safety purposes. They are proposing a road on the north side
of their property. They have included the provision that before they sell
any lots, that as they are sold, the owner of each lot will be required to .
contribute to the maintenance of the road. They will be using 30% of the
road. The Quinsey residents pay $100, and they will contribute $30 for
their portion. They discussed with the County possible drainage difficulties
forsurface water and septic systems, and the County does not have a problem
with leaving the rear portion of the property as it is in its natural state
for an approximate distance of 100 ft. . The water will be absorbed on the
lots.

Chairman Groner inquired as to whether there has been thought given to
dedicating the private road going to the access. He was concerned with the
future development continuing ' to the city limits. He would not like
to see a private road coming into the city. The road will go down to the
eastern portion of the property and will be close to joining into Fox River
Gardens. He felt that they should consider having the road continue.
The road goes to the farm and then south and then the road is all private.
Attorney Krantz stated that it would be to Bollweg's advantage to have the
road turned into a dedicated road. However, they do not own the property,
and he does not know whether the owner would be willing to dedicate it. If
the road is dedicated, 66 ft. is usually required and they do not have that
much.
Mr. Feltz felt that there should be a public road and should set a pattern
so that it could be tied into the other roads.
Mayor Davidson felt that the road should be widened and raised.
Attorney Krantz checked the plat for Fox River Gardens and on some of the
lots there is no room for an access. He spoke to a resident of Quinsey
Subdivision, and she would be opposed to a road extending east.
Mr. Ament questioned as to whether a plan could be worked out so that on
the bottom edge of the lots another loft be given.
Mr. Feltz inquired as to why the present lane couldn't be widened and make
a temporary turn around. Mayor]Davidson stated that the hill is too steep.
Mayor Davidson would like a regular septic system put in. There is also
alot of storm water that comes off of Quinsey Rd. from the field which
washes about 4 in. deep into the road. He felt that something should be
done to control this.
Mr. Clarage stated that the proposed private access road to the north stops
at lot 4 and 5 and does not extend the 300 ft. east to touch Fox River
Gardens plat. He felt that this should be extended. If it isn't, there
will be a dead end street that goes more than 1800 ft. . There should be
more of an easement provided at the end then the 30 ft. easement. There
should be a turn around of some sort. They are asking for rezoning only
at this time. However, there are many technical things that should be
addressed. The City can require that the road improvements meet city
specifications. They should allow a 30 ft. easement on the south side
of the property for future access for the lots to the south.
Alderman Thanepohn questioned as to whether there would be an impact on
Main St. going into the city if the road joins Tuma Rd. . Many people
will take the back road rather than go to Rt. 34. Mrs. Price felt that
some of the residents on Tuma Rd. may not want the road to join.
Jim Clarage suggested that 1) a septic system be required and not the
mechanical discharge type 2) that a provision for an access easement on
the south line of the property to allow for future road access expansion
or correction of the subdivision to the south--an additional 30ft. should
be provided 3) that Quinsey Road, westerly of property, be improved in

regard to pavement and storm water drainage to meet township requirements
4) the proposed private access road to the north be either extended across
lot 5 to the Fox River Garden Subdivision or a cul-de-sac with turn around
provisions be made 5) they concur to leaving the southerly part of the
5 lots of approximately 100 ft. in natural form 6) consideration be given
that the road might be used to service the land to the north if it is sub-
divided in the future.
Mr. Feltz made a motion to recommend the approval of the rezoning subjeet
to the previous 6 considerations made. Mr. Ament seconded the motion. A
roll call vote was taken.
Price - yes Groner - yes
Ament - yes Feltz - yes
The motion carried unanimously.
Mr. Feltz felt that the discussion may aid the County in some of their
decisions.
Chairman Groner requested that the minutes be forwarded to the County
Plan Commission for their meeting on June 25, 1986 at 7:30 pm.
Attorney Krantz thanked the commission for addressing their concerns and
hoped to make the property something that the City would be proud of.
There was question as to whether the petition would come back for the final
plat. Mr. Clarage believed that it would have to for signatures on the
final plat.
Mayor Davidson apologized that the city representative, Dennis Fahrlander,
could not be present at the meeting.
Mayor Davidson stated that Conovers have approached him with the suggestion
that the curb be waived, and in return, he would put in the 3 in. of asphalt
on Leisure. Jim Michels has looked at the water and retention. The first
10 lots should not cause any trouble. Mr. Conover is close to making a
decision.
Mayor Davidson stated that there may be a new business coming to town. The
Westphal property may be tentatively sold. He will know within 60 days.
Mayor Davidson stated that the City may see more activity and improvements
within the next 6 months. Building is up.
Mayor Davidson stated that he has been approached by Don Holt of the Kendall
County Economic Development. There may be a big firm interested in locating
in the area. The site must be near rail. He recommended the Rt. 34 and
Cutt off Rd. area. They are requesting sewer and water. The rail easement
would be close enough. There will be highway access. He asked the
commission for their suggestions. Mayor Davidson stated that it would be
an office type of industrial park.
Mrs. Price moved to adjourn the meeting. Mr. Feltz seconded the motion.
All members present were in favor. The meeting was adjourned at 8:22 pm.
