Plan Commission Minutes 1985 01-22-85 4 t ' MINUTES OF THE PLAN COMMISSION OF THE CITY OF YORKVILLE HELD AT CITY HALL ON JANUARY 22: 1985 ---- -- ---- ---- -- ------- -- -- - Mr. Feltz called the meeting to order. Mr. Feltz acted as chairman in the absence of Jerry Groner. The following members were in attendance: Mr. Stewart, Mr. Beaudry, Mr. Feltz, and Mrs. Price. Also present were Jim Clarage, Larry Jennings, Dan Patrick, Cliff and Justine Jahp, Dick and Mary Warpinski, Franklin Brewe, and Ronald Stibbe. Mr. Feltz inquired as to whether there were any additions or corrections to be made to the November 27, 1984 minutes as published. The minutes stood as written. 1985-1 Petition for Special Use under R-1 Zoning by Mary B. Warpinski at 208 W. Fox Street . Mr. Feltz stated that the commission would discuss the petition of Mary B. Warpinski as heard in the public hearing and then would make their decision. Mr. Feltz questioned Mr. Clarage as to whether he had any comments or sug- gestions. Mr. Clarage recommended as a technical basis to change the zoning from R-1 to R-2. He also felt that the drop off area should be planned so that there is no backing up of vehicles. He suggested having a circle drive for the drop off area. The east side of the property does have 10 foot hedges. There would be a fenced in play area. Mrs. Warpinski stated tht there must be 75 square feet per child of play area. Mr. Clarage asked how close the fence would be to the sidewalk. Mr. Warpinski stated about 10 feet. Mrs. Warpinski stated that there would be a park area there, so it would be a distance away from State Street. Mr. Clarage suggested !laving a green chain link fence. Mr. Feltz inquired as to the possible density of the students. Mrs. Warpinski stated that she would not be allowed to have no more than 17 students. Mr. Feltz inquired as to what changes will be made on the inside. Mrs. Warpinski stated a toilet is needed per every 10 children, so another toilet and sink would need to be added. She would also install fire alarms and possibly an emergency exit. Hard core steel doors would also need to be put up at the entrances to the kitchen. Mr. Feltz inquired as to whether it would still have the residential characteristics. Mr. Warpinski stated that it would, so if they wish to sell it in the future, it would still be sold as a residential house. Mrs. Warpinski stated that the dining room and living room are attached, so this would serve as their main activity room. Dan Patrick questioned as to what type of heat the house has. Mrs. Warpinski stated that it is gas. Mr. Stewart inquired about the outside lighting. Mrs . Warpinski stated they had planned only for the outdoor porch light . Mr. Stewart felt that some type of lighting should be provided near the parking area, so that it may be controlled by a switch, so that the light does not shine in the neighbors window. Mrs. Price felt that the cars should approach the parking area from the north side. Mrs. Warpinski stated that each child's parents are required to sign their child in at the beginning of each day, so the parents would be walking their child to the door. Mr. Jennings stated that there is a book of state guidelines that Mrs. Warpinski must follow in order to get her license. Mr. Jennings felt that if she conforms to the book that he could see no problems concerning the safety of the children due to the fact that the state is very restrictive. Mr. Clarage felt that the proposed fence should be compatible to the City's future fencing ordinance. The fence would only be allowed to be a maximum height of three feet due to its location. He suggested that the fence be moved back, so that it may be higher. Mr. Clarage also suggested that the parking area be paved. Mr. Feltz stated that the commission could recommend that the parking area be paved and that ' the fence conform to the proposed fencing ordinance. He also felt that the fence should be 4 feet high for the safety of the children. Mr. Stibbe stated that he would object to having the parking area paves due to the fact that it would make the property look like an institution rather than a residential house, and it may ruin the character of the neighborhood. Mrs. Warpinski stated that she would rather not blacktop it, because it would be harder to change the property back as it was if they wished to sell it. Mr. Feltz asked for anymore comments or questions. Mr. Stewart felt that the front gravel area on Fox Road should be removed due to the fact that it would be used as a convenience to parents in a hurry rather than the parking lot on State Street . Mr. Feltz stated that the commission can make recommendations with their approval to the City Council. Mr. Beaudry made a motion to recommend to the City Council their approval of the petition for a special use for the purpose of operating a day care center by Mary B. Warpinski at 208 W. Fox Road with the following recommendations : Remove the gravel area on Fox Road currently used as parking and enlarge the gravel drop off area on State Street for parallel parking and provide sufficient lighting. Also, change the fence line so that it complies with the set back requirements of 30 feet from the property line on State Street to allow them to go to 4 feet on the height. Mr. Stewart seconded the motion. A roll call vote was taken . Mr. Stewart - yes Mr. Beaudry - yes Mrs . Price - yes Mr. Feltz - yes The motion carried unanimously. The petitioners thanked the commission for their time. Mr. Feltz inquired as to whether there was any additional business. Mr. Jennings stated that he would not bring back the fencing and swimming pool ordinances until the February 26, 1985 meeting. There was no additional business . WARPINSKI FOR A SPECIAL USE PERMIT - -------- -- ---- -- --------- --- - ------- --- ------ Mr. Feltz called the public hearing to order. Mr. Feltz acted as chairman in the absence of Jerry Groner. Plan Commission members present were Mr. Feltz, Mr. Stewart, Mrs. Price, and Mr. Beauddy. Also in attendance were Jim Clarage; Dick and Mary Warpinski, the petitioners; Franklin Brewe, Attorney; Ronald Stibbe, adjacent property owner; Cliff and Justine Jahp; and Dan Patrick. Mr. Feltz stated that the commission would hear all those wishing to speak during the public hearing concerning the petition of Mary B. Warpinski. The commission will then discuss and make a decision in the regular meeting of the Plan Commission. Mr. Feltz stated that Mary B. Warpinski is applying for a special use permit under R- 1 zoning for the purpose of operating a day care center at 208 W. Fox Street . Attorney Brewe spoke in behalf of the petitioner. He stated that the location of the proposed day care center is at the intersection of 208 Fox Road and State Street. The property has been vacant for four years. The closing is scheduled for February 4, 1985. They wish to apply for a special use to operate a day care center. The property is zoned R-1 according to their realtor. The provision under Subsection 11 of the Zoning Ordinance of the City of yorkville would allow for a day care center under R-1 zoning. Mrs. Warpinski will be applying for a license for 10 students with a maximum of 19 students. Mr. Brewe presented a drawing of the property. Mrs. Warpinski went to various adjacent property owners (list is attached to petition) to have them sign a paper approving a day care center at 208 Fox Road. Mrs. Warpinski was planning on installing a driveway so that parents may drop off their children. However, The Department of Children and Family Service were not in favor of dropping off children in a driveway. There will be a parking area off of State Street sufficient for four cars. Mrs. Warpinski does not have her license yet , but she will be employing someone that does. The increase of traffic would be from six to eight care in the morning and the afternoon, and they felt that four spaces for parking would be adequate for parking needs. Mr. Brewe inquired as to whether there were any questions. Mr. Beaudry inquired as to how high the fence would be. Mrs. Warpinski stated that it would be 4 feet. Mr. Feltz stated that certified letters had been sent to all the adjacent property owners and the returned receipts had been received from all but two of the property owners. Mr. Hall's has not been received,but Mrs. Hall did sign Mrs. Warpinski's paper approving the day care cetner. Mrs. Taylor is deceased now, and the property is in an estate. Receipts were received from Mr. & Mrs. Ronald Stibbe, 605 S. Main; Mr. & Mrs. Timothy Lorang, 608 State; Mr. & Mrs. Roland Talsma, 505 State; Kendall County Human Services, 501 S. Main; Mr. & Mrs. Michael Hardecopf, 608 State; Mr. & Mrs. Jessie Kechum, 207 W. Fox; Mrs. Theodore Wilkinson, Sr., 505 State; Mr. & Mrs. Edwin Olson, 605 State; Mrs. Margaret Beckley, 507 W. Fox. A copy of the notice of the public hearing was sent to all the above. Mrs. Price inquired as to whether the petitioner considered the fact that there would be more than one child per family attending the day care center. Mr. Brewe stated that she anticipated that there would be multiples in families , so there would be two or three children per car. Mr. Feltz questioned whether any of the other guests wished to speak. Mr. Ronald Stibbe, 605 S. Main, stated that he was concerned with the possible use of the alley next to his property. He felt that the alley has enough traffic passing over it now and would be concerned with the safety of it. He stated that 1 r there are two families presently living off of the alley. Mr. Warpinski stated that a letter could be sent to all the parents stating that they would not be allowed to use the alley. There is also an empty lot between the alley and the two lots that Mrs. Warpinski will be using. The lot that the petitioner will be using is approximately 99 feet away from the alley. Mr. Feltz stated that the petitioner will be using the northly 33 feet of lot 3. current stakes that are up on the property show where the three lots are. Mrs. Warpinski stated that she would suspect that 90% of the parents would be using Fox Rd. Mr. Stewart questioned whether her car and her employee's car would be parked in the proposed parking lot. Mrs. Warpinski stated that they would, so there would be two spaces left for parents to park to drop off their children. She also stated that there is a gravel area in front of the house that is currently used for parking. Mr. Stewart stated that if the gravel area is there, the parents would use it rather than the parking area on State Street. Mrs. Warpinski stated that Oswego's day care center only has parking for three, and it seems to be sufficient. Mr. Stewart inquired as to the City use of the gravel area on Fox Road and whether Mrs. Warpinski would need to get an approval from the City to use that area as parking. Mr. Brewe stated that it is currently used as parking. Mrs. Warpinski stated that there will be a difference in time when parents drop their children off, so there will not be any heavy traffic all at one time. Mrs. Price inquired as to whether she will be living in the house. Mrs. Warpinski stated that she would not. Mr. Beaudry stated that according to the City maps the property is zoned R-2 or R-3. Mr. Brewe stated that all three would apply to special use under R-1 zoning. Mr. Feltz asked whether anyone had anymore comments in the public hearing. Mr. Stibbe questioned what days and time would the day care center be in operation. Mr. Brewe stated that the hours would be Monday through Friday from 6 : 00 a.m. to approximately 5 :30 p.m. Mr. Feltz closed the public hearing and invited Mr. Stibbe and the petitioners to take part in the regular meeting of the Plan Commission if they wished due to the small crowd.
