Chairman Groner called the regular meeting of the Plan Commission to order.
Those in attendance were Mr. Ament, Mr. Beaudry, Mr. Feltz, Mr. Groner, Mr.
Holdiman, Mr. Kenton, and Mrs. Price. Also present were Jim Clarage, Larry
Jennings , Robert Davidson, Dan Patrick, Jim Hayden, and Mike Thanepohn.
Mr. Feltz made a motion to approve the minutes from the January 22 , 1985
meeting. Mr. Ament seconded the motion. All members present were in
favor. Chairman Groner reminded members to file their economic interest
statements .

Chairman Groner stated that the agenda for tonight's meeting would be to
consider the petition of John and Alice Conover requesting to annex and
rezone to R-3 and B-1. He then asked for any discussion. There will also
be a Zoning Board of Appeals meeting on April 24, 1985 to consider
variances on the Subdivision Control Ordinance on sidewalks and curbing.
Chairman Groner questioned whether everyone was familiar with the property
being considered to rezone. It is not currently in the city limits. There
is property to the south that is developed. Sunset St. is in the city
limits. Mr. Clarage inquired as to whether there is a preannexation agree-
ment. Chairman Groner stated that he had not received one. Mr. Feltz
stated that on the drawing it looked as if there was more area to be
rezoned that what was described in the legal descriptions. Chairman Groner
felt that there should be a preannexation agreement. Chairman Groner
temporarily adjourned the plan commission's regular meeting to proceed into
the public hearing at 7 : 30 p.m. . All members were in favor.
The regular meeting of the Plan Commission reconvened at 7 :55 p.m.. Mr.
Clarage stated that the lots were originally 80 ft. and 100 ft.. The lots
are 95 ft. on the north side of the road which would be no problem. The
duplexes allow for 70 ft. The lots south of Leisure St. have 83 ft. and 85
ft. widths. If they wanted to build single family homes, they would have
to apply for a variance. The ordinance calls for 90 ft. sphere will be
basically duplexes put on the lots. The lots are deeper south of the
street. The lots by Leisure St. are all over 12,000 ft.
Mr. Clarage stated that the public notice was a summary of the legal des -
cription and the total legal was not included in the public notice. The
public notice does not define specifically what is to be commercial and
what is to be residential. Mr. Clarage felt that there should be con-
tinuity between the two so as not to cause problems in the future.
Attorney Grant stated that when the property is annexed, it will come in
under an ordinance which will provide all the legals .
Mr. Feltz inquired as to whether they would include the variations on the
lot widths in the preannexation agreement or whether they would do them one
at a time. Attorney Grant stated that they would wait until they have
buyers for the lots .
Mr. Clarage questioned about the storm sewer. Attorney Grant stated that
the water goes under the road and empties out into Blackberry Creek. There
is au easement under the road. Mayor Davidson stated that at the inter-
'Wection on Game Farm Road, the State plans to hook an 18- inch or possibly
bigger storm to the east side of Game Farm Road so that other storm sewers
may be hooked up.
Attorney Grant stated that the base on Leisure Street has been down for
approximately ten years. Mr. Feltz inquired as to what type of street
surface it will have. They will be asking for a variance on the street
surface , so that they may have a tar & chip surface .
Mr. Clarage stated that the petitioners appeared to be down zoning from
county b-3 to city b-1. It is a very light commercial use. The property
is also along a major highway. The petitioners are backing up commercial
with single family and duplexes which would serve as a buffer. He, there-
fore, could see no problems with granting the petition. He also felt
that there would have to be various waivers done by the city council to
make their tax base economically feasible.
Mr. Kenton made a motion to pass their approval along to the City Council
with the notations that had been made. Mr. Feltz seconded the motion. A
roll call vote was taken.

The motion carried unanimously .
Mr. Kenton inquired as to whether the commission had been working on a
comprehensive plan. Mr. Clarage stated that there had been some work done
on it. Workbooks had been passed out to the members , and there was dis -
cussion of breaking down the committee into groups for each different
project. Mr. Kenton stated that he had received several inquiries on
it .
A motion was made and seconded to adjourn the meeting. All members were in
favor. The meeting was adjourned at 8 : 20 p.m. .

PETITION OF JOHN AND ALICE CONOVER TO ANNEX AND REZONE TO R-3 6 B-1

Chairman Groner called the public hearing to order at 7:30 p.m. to consider
the petition of John and Alice Conover for annexation and zoning to R-3 and
B-1. Plan Commission members in attendance were Mr. Ament, Mr. Beaudry,
Mr. Feltz, Mr. Groner, Mr. Holdiman, Mrs. Price, and Mr. Kenton. Also in
attendance were Jim Clarage, Larry Jennings, Mayor Davidson, Dan Patrick,
Jim Hayden, Mike Thanepohn, Attorney Tom Grant, Gary Conover, and several
residents of Conover ' s subdivision .
Attorney Grant presented the petition. He felt that it would be the desire
of the property owners in Conover's subdivision to have a mixed blend of
zoning. They would also like to annex the property into the city limits.
They would like to zone the property to what they would perceive to be the
best use by having the northern portion for office zoning and try to work
out a blend with residential as it works to the south. There is presently
residential property to the south. They wished to put some type of buffer
between the business section and existing residential area. Attorney Grant
inquired as to whether the adjacent property owners present at the meeting
had seen a map of the property and where they intended on rezoning. They
are asking for B-1 zoning along sunset behind the present office building
and the rest be zoned residential with single family or duplexes. There
presently is a gravel road through the property called Leisure Street.
There have been some permanent improvements in the area with the storm
sewer. They will be asking for a variance on streets and curbing. The
petitioners are asking that the commission recommend favorably the
annexation of the property into the city and as it is brought in to rezone
it to the suggested business and residential uses.
Chairman Groner inquired as to whether there were any questions. An
adjacent property owner questioned whether there would be apartment
buildings or duplexes. Attorney Grant stated that R-3 zoning would
permit single family or duplexes , and that they would not have 4 or 6 unit
apartment buildings.
Attorney Grant stated thay they are seeking a variance from the Zoning
Board of Appeals on the hard blacktopped surface on the streets. They
would like to make the lots larger with high quality construction. Mr.
Conover stated that Leisure St. to North St. is presently zoned for
business , and that they wish to take some of the business away and replace
it with residential. Attorney Grant stated that there would be attractive
office buildings put in the business area. They will not break the lots up
until they have buyers. They will come before the Plan Commission when
they begin to do the subdividing.
There was concern about the traffic in the subdivision. Attorney Grant stated
that there may be stoplights put in at the intersection on North St. and
Rt. 34. Mayor Davidson stated that in 1986 the State may start construc-
tion on Game Farm Road and the widening of Rt. 34. There will be a side-
walk that will run along the east side of Game Farm Road and also on the
south edge of the nursing home. The stoplights will be installed regard-
less of whether Conover's subdivision is annexed. Mr. Jennings stated
that he would not be in favor of the rest of Conover's subdivision coming

-intor the city limits due to the cost of maintaining streets, police protec-
tion, and garbage pick up. The State will be widening the road to help
with vision problems. Attorney Grant stated that he would like to see the
lights there due to the heavy traffic and the safety for children cros-
sing .
Chairman Groner inquired as to whether there were any further questions.
He stated that the Plan Commission can only make a recommendation to the
City Council. He also stated that there were 33 letters sent out to the
adjacent property onwers notifying them of the public hearing. There was a
motion made and seconded that the public hearing be closed. All members
were in favor. Chairman Groner invited all present to attend the regular
meeting of the Plan Commission at which time a decision would be made re-
garding the proposed petition. The meeting was adjourned at 7 : 55 p.m. .
