MINUTES OF THE PLAN COMMISSION OF THE CITY OF YORKVILLE
HELD AT CITY HALL ON APRIL 24, 1984 at 7:00 P.M.
Chairman Jerry Groner called the meeting to order. Roll call was taken with
the following members present: Mr. Ament, Mr. Groner, Mr. Stewart, Mr. Holdiman,
Mrs. Price, and Mr. Feltz. Also in attendance were Jim Hayden, Jim Olson, Jim
Clarage, and Curtis Medin. A quorum was established. Mr. Stewart moved to approve
the minutes as written. Mr. Holdiman seconded the motion. All present voting
aye.
Foth Subdivision - 1984.3
Chairman Groner stated that Mr. Jim Olson wished to be put on the agenda in behalf
of Mrs. Foth, who is requesting that she may subdivide her property located off of
Van Emmon, between the Baseball Diamonds and the Fox River, as individual plats.
Chairman Groner stated that Mr. Olson had already talked with the Public Works
Director, J.T. Johnson, and the City Attorney, Dan Kramer. The driveway is also
partly in her ownership. It is a private road. Mary Kay Price questioned about
sewer and water. The driveway is on an easement.
City Attorney Kramer was favorable to these plans.
The only real concern with the commission was with the flood plain.
Mr. Feltz stated that it would not comply with the City's Subdivision Ordinance as
of date. If one house burnt down, could the owner rebuild another house on the
property.
Jim Hayden stated that he could see no problems with the plans.
Mz. Feltz thought that it was more of a legal question than anything.
Jim Clarage arrived at 7:20 p.m. Clarage inquired as to what the zoning on the
property was. The zoning of the property is R-1 non-conforming. Jim Clarage
did not see any problems with the plans.
Mr. Stewart made a motion that the commission accept the plans for consideration,
as they were submitted, to the City Council. Mr. Ament seconded the motion. A
roll call vote was taken. All members present voting aye.
Fences and Swimming Pool Ordinances
Chairman Groner stated that the next item of business would be discussion for a
rough draft of fences and swimming pool ordinances. He questioned whether any
of the members had any specific additions or deletions they would like to make
to the Romeoville Fencing Ordinance. Mr. Stewart felt that the peach pamphlet
from Romeoville basically covered all aspects of fencing needs. Jim Clarage
stated that additions and deletions to Romeoville's fencing ordinance could be
made in the future to suit the City of Yorkville's needs.
Mr. Stewart was concerned about corner lots and that they should have larger set
back lines and adjustments in height. He was also concerned about hedges on
corner lots. All members were concerned with the visibility on corner lots.
Mr. Feltz thought that we needed to leave open a space for the zoning officer
to use his good judgement.
Mr. Hayden felt that parts of the present fencing ordinance should be included
in the new ordinance.
Mr. Feltz inquired as to who's responsibility it would be for the maintenance
of the fence. If the fence is on the owner's lot, it would be his responsibility.
If the fence is on the lot line, it would be both owners' responsibility.
Mr. Feltz inquired as to whether there was anything on lot lines in the present
ordinance. It would be the discretion of the zoning officer of where the boundary
lines actually are.
Mr. Stewart felt that hedges should be planted within the owner's lot lines
by a few inches, so in the future, when the hedges are fully grown, they do
not pretude over the lot line.
Jim Hayden commented that there may have to be regulations for owners with
fences right next to each other so as not to have a"collection pit" between
the fences.
Chairman Groner felt that the main concern should be with fences around
swimming pools. The members felt that these type of fences should be in
a different section from the regular fences. Another concern by members was
that there are no specifications for above ground pool fences.
Mr. Feltz felt the main concern was with the existing areas in town rather
than the new subdivisions due to the way the land is.
Chairman Groner inquired as to whether we should delete what is in our present zoning
ordinance book on fences and make a new section to be added to it to aid and
assist the zoning officer when giving guidelines to citizens, and also make
a separate statement on swimming pool fences.
Mr. Stewart also felt that we should take into consideration public swimming
pools for in the future. Mr. Clarage stated that the committee should be
strict in making the ordinance now, so they do not have to revise it when
a problem comes up in the future. He stated that the ordinance may be amended
in the future if needed.
Jim Hayden felt that we should go ahead and refer the section about fences
around swimming pools from the blue pamphlet from Palos Heights to the City
Council. Jim Clarage felt that above ground pools should have some kind of
protection around them to be referred to the City Council. Mr. Feltz suggested
that we refer the whole pamphlet to the City Council, and Jim Clarage suggested
having the City Attorney read over it for legal aspects.
Mr. Stewart questioned whether a..permit would be required to install a pool.
Both Feltz and Stewart thought that a permit would be needed.
Members agreed on a $25 minimum for a building permit. Mr. Hayden felt this was
high.
Members also agreed that life saving equipment would be a recommendation to the
person installing the pool.
The members agreed that the swimming pool ordinance from Bollingbrook should
be referred to the City Council after additions and deletions were made by
Jim Clarage where he felt necessary following what was discussed tonight. They
also felt that he should do the same with the fencing ordinance (peach pamphlet)
from Romeoville. They suggested that he rearrange the information, so it would
be easier to understand, and that he also include a statement about hedge con-
trol concerning set back lines. Fences could come up to the property lines,
but not on it. They would all like to see an ordinance formed to where the
zoning officer could easily give guidelines to citizens.
A motion was made by Mr. Feltz to adjourn, and Mr. Ament seconded it. All
members voting aye. The meeting was adjourned.

Note: Harold Feltz turned over his booklet of minutes from the Plan Commission
for the past ten years to the City of Yorkville. Alderman Hayden stated
that he would turn them over to the City after reading over them.
The next meeting is May 22, 1984 at 7:00 p.m. The agenda will include
review of the rough draft of the swimming pool and fence ordinances.
If time permits, there will be discussion on the comprehensive plan.
