MINUTES OF THE REGULAR MEETING YORKVTT.TF PLAN COMMISSION 27 FEBRUARY 1979
Mr. Harold Feltz moved to elect Robert Mahoney acting chairman of the Yorkville
Plan Commission and was seconded by Mr. Woodworth. All present voting aye.
Chairman Mahoney opened the public hearing — Petition for R—Zoning and Annex-
ation — Ron Westphal Chevrolet.
Mr. Ron Cobb, contractor for the petitioners, showed a rendering of the proposed
structure. He stated the shop area contained 14,000 square feet and the office and
showroom area contained 4,000 square feet. Part of the front area will be paved
in asphalt and a green area will be left in front. They have already met with the
state regarding a front entrance. They are proposing a forty foot entrance which
would have to be approved by the city and/or county. The entrance would be north of
the existing culvert and metal barricade. The entrance to Countryside Center is
located approximately six hundred feet north of this property's north boundary. Mr.
Robb stated the state wanted to retain the green area and swale as it was a collector
for the culvert.
Chairman Mahoney asked if any objectors to the proposal were present. There
were no objectors present.
Mr. Mahoney stated that our previous comments related to: 1) entrance 2) under cover
body shop and towing service and 3) preservation of frontage road on Rt #47• The
frontage road now comes off the Demetralis property. If it were to be continued at a
later date, it would create a problem as the agency shows only a one hundred foot
setback. Mr. Dollman noted that we should consider the Rt #34 Corridor Study in
determining future development of the area.
Chairman Mahoney then closed the public hearing as there were no objectors present.
Chairman Mahoney then opened the regular meeting of the Yorkville Plan Commission.
Those in attendance were Mr.. Mahoney, Mr. Feltz, Mr. Dollman, Mr. Woodworth and
Mr. Dick Alexander from Clarage & Associates. Mr. Feltz moved to approve the minutes
of the January meeting and was seconded by Mr. Woodworth. All present voting aye.
79.5 Petition for Annexation and Re—Zoning — Ron Westphal Chevrolet
The property consists of 6.162 acres to be rezoned from agriculture to B-3 —
Business Service District. It will consist of a full service Chevrolet agency,
including offices, garage and sales room. They are seeking a rezoning and annexation
to the city.
Mr. Feltz noted that Rt. #47 has been bored for sewer and water and that both are
available on the west side of Rt. #47.
Mr. Dollman stated if the building was set back 100 feet, it would interfere with
extension of a future frontage road.
Mr. Ron Westphal asked if there were a frontage road, would it extend from the Y to
Kennedy Road. It was noted this was a possibility. Mr. Westphal stated they now propose
to locate 215 feet from the center of Rt. #47 and they would prefer being closer.

Mr. Feltz noted that Clarage and Associates' long range plan showed commercial
development of the area to Kennedy Road.
Mr. Cobb stated he felt the existing entrance to the frontage Road (Y entrance)
was not desirable as it was opposite a median strip. He felt a more logical place
would be opposite the entrance to Countryside Center.
Mr. Feltz stated that possibly a•traffic light would be installed at Countryside
Center's entrance and that an entrance to a frontage road could be located directly
across Rt. #47• He said that now was the time to work it out before the Chevrolet
agency was built. He said the city has been strong on the frontage road concept
as evidenced south on Rt. #47 by the industrial park.
Mr. Dollman then moved to approve the petition for annexation and rezoning from
A to B-3 with the additional comment that future implications of- a frontage road
should be a definite concern. Seconded by Mr. Woodworth. All present voting aye.
Motion carried.
79.6 Review Final Plat _ Yorkshire Woods (Mezger)
Attorney Tom Grant, representing the petitioners, stated they had appeared before
the plan commission in May 1978, and that they now wish to submit a final plat to the
county but must appear before us as the property is located within the one and one half
mile limit of the city. Mr. Grant stated that the county superintendent and their
engineer have worked out grade requirements as there are steep grades on the property.
He then submitted to the Plan Commission a .'restrictive covenant as requested by the
city which stated that the lot owners would annex to the city if requested to do so,
if the development would become contiguous to the city within ten dears.
Mr. Feltz inquired if the diameter of the cul-de-sac met the requirements of the
subdivision control ordinance. Mr. Grant responded that the plat showed sixty feet
rather than sixty five feet as required and that this would be changed before the final
plat was authorized.
Mr. Feltz noted that Dr. James Garnett had stated that the area would not be serviced
by school buses and that the children would have to walk down Van Emmon to school.
Mr. Feltz felt that this should be made clear to all residents of the subdivision.
Mr. Feltz then moved that the plan commission approve the final plat noting
the change from sixty to sixty five feet for the cul-de-sac and authorizing Dr. Coleman
to sign the final plat if approved by the city council. Seconded by Mr. Dollman.
All present voting aye. Motion carried.
Attorney Dan Kramer, representing Robert Loftus, requested an informal discussion
regarding a proposed development to be rezoned to B-3 west of Fox Industrial Park
and south of Elizabeth Street. They are proposing construction of two buildings for
small offices and small retail businesses. _ It will have an eight foot green area and thirty
foot setbacks. An alley would be constructed to the rear of each building. They
will have an eighty foot wide entrance street and would have a cul-de-sac or T turnaround
at the end of the entrance road.
Mr. Feltz noted the master plan for the area has both industrial and commercially
zoned property.
It was noted there was a severe drop off on the property and that there must be
some type of water detention area.
Mr. Feltz noted that citizens of the area would be very interested in the problem
of water control.

Mr. Dollman stated that Mr. Hinman had said at one time that a lake big enough
to hold all the water could not be built.

Mr. Feltz raised the question of a frontage road possibly extendint to Rt. #71•
Mr. Dollman suggested that the petitioner secure a soil and water conservation
report from Mr. Hinman's office.
Mr. Woodworth then moved to adjourn the meeting and was seconded by Mr. Feltz.
All present voting aye. Meeting adjourned.
