Price Steve Franks MINUTES OF THE REGULAR MEETING OF THE YORKV= PLAN COMMISSION 26 JUNE 1979 Chairman Robert Coleman called the regular meeting of the Yorkville Plan Commission to order. Those in attendance were Dr. Coleman Mr. Feltz, Mrs. Pricer Mr. Kenton, Mr. Woodworthq Mr. Clarage, Mr. Behrens and Mr. Beach. Mr. Woodworth moved to approve the minutes of the May meeting and was seconded by Mr. Feltz. All present voting aye. Motion carried. Dr. Coleman noted that he had met with Mayor Thanepohn and Mr. Madden and they had decided that all correspondence will go through the Water Department office. In the future,, all applications will have to submitted by the date set by the ordinance. 79.16 Application for Amendment to Planned Development — Sawasko and Whalen — Former Mulhern Property) Attorney James Wilsonv representing the petitionersq stated that his clients had purchased Lot 3 from Mr. Brain Mulhern. The planned unit development currently provides for construction of one 12 unit apartment building and a single twenty unit building. His clients propose to construct two 12 unit condominiums and one 8 unit condominium for a total of 32 units. Mr. Wilson stated the buildings would be 35 feet in height with eaves at 25 feet and a gable roof. He stated that he had conferred with fire chief Russ Devick who said .the department had a thirty foot ladder and that if the eaves were at 25 feet there would be no problem with the 35 foot height. Mr. Wilson stated the PUD provided for brick construction from ground to roof but that their design called for 90� brick construction with some good decorative features. Mr. Feltz asked if the fire department was in complete accordance with this plan- Attorney Wilson responded that they were. Regarding height, Mr. Whalen stated it would be a 3 story building three full floors above grade plus roof — totalling 35 feet with a three foot overhang. Mr. Clarage stated that there was only twenty feet between buildings and accounting for balconies and overhangs, there would only be 14 feet which would be an extremely narrow space between three story buildings. He felt it would not meet the BOCA code. He also said at one corner, there would only be about five feet between eaves. Mr. Whalen responded this would be at only one corners that the space widensl and that there were no windows on that wall.. Mr. Clarage stated that with a PUD, full landscaping plans and lighting plans would have to be submitted and approved by the plan commission. Mr. Whalen stated they were seeking general approval of the plan tonight and would return with all plans pertaining to a PUD. Mr. Whalen stated they were trying to keep as much area as possible for patios and yards. Mr. Clarage said he felt it would be better to have more room between buildings and that with only 20 feet between the front and back building there would be noise and not much sun. He said he felt the concept of having three buildings was good but felt the BOCA code would not approve the'-space between the rear buildings. He also said that for condominiums, the city should see a declaration regarding maintenance procedures, common areasv etc. because of possible conplaints the city might receive from residents in the future. Mr. Whalen stated all this would follow pending preliminary approval of their plan. Mr. vlarage then suggested several methods by which the plan might be opened up. Mr. Whalen stated they need to proceed with their plans and could not afford — 2 — JUNE 1979_ the time to return month after month. He said they could easily combine the two rear buildings but that they felt three buildings would be preferable. Mr. Clarage felt more thought should also be given to the parking areas and garages. Vx, Woodworth aksed what were the city's feelings regarding three story buildings. Alderman Beach responded their only concern regarded the fire department's ability to handle all emergencies. Mr. Clarage stated he would like to have a copy of the original PUD agreement. It was noted the original PUD agreement had a 25 foot maximum height and called for brick construction from ground to roof. Mr. Clarage noted the plan commission could give a tentative approval of their concept tonight. Mr. Feltz then moved that we tentatively accept the application for amendment based upon final submission fulfilling all PUD requirements and upon approval of the plan by the fire department and further recommending a preliminary submittal of the plan to BOCA. Seconded by Mr. Kenton. A roll call vote was taken with all members voting aye. Motion carried. It was noted that the petitioners should secure a letter with copies from the fire chief stating acceptance of the three story plan. Mr. Woodworth moved and was seconded by Mrs. Price that the plan commission recommend the following revision in the Subdivision Control Ordinance (Page 17) regarding widths of certain streets.
