Price Steve Franks MINUTES OF THE REGULAR MEETING OF THE YORKVILLE PLAN COMMISSION 25 APRIL 1978 PUBLIC HEARING — WORSLEY ADDITION KELLETT AND WEIS Chairman Robert Coleman called the public hearing to order. Those in attendance were Dr. Coleman, Mr. Mahoney, Mr. Feltz, Mr. Langland, Mr. Dollman, Mrs.Price, Mr. Kenton, Mr. Woodworth, Mr. Bushing, Mr. Simmons, Mr. Beach and Mr. Madden, Attorney Tom Grant, representing the petitioners, Michael Kellett and Jack Weis, submitted a Petition To Re—Zone Real Estate to all plan commission members. They wish to have Lot 1 and the easterly 20 feet of Lot 2 in Block 1, Worsely's Addition rezoned from R-1 to R-3 in order to construct a three unit apartment building. The lot site is approximately 1$,792 square feet. He stated that notice had been sent to the four adjoining land owners and he submitted certified receipts of mail. He stated the property was located adjacent to Mr. Feltz's which had recently been rezoned to allow construction of a four unit building and that they planned on using the same sewer line as Mr. Feltz. Mr. Woodworth stated he did not want to see the whole area become multi—family. He said another property owner in the area has the same idea in mind - to rezone to R-3. He also said the comprehensive plan did not show this as being a multi—family area. Attorney Grant stated that these lots are not useable for R-1 zoning and that they are offering optimum useage for land in town. Mr. Woodworth stated that construction of more multiple un3.ts in town should be curtailed as Mr. Gable is now putting in 88 units and Countryside Center also has zoning for multi—family housing. Mr. Grant stated there is a residence on lot 7 and they plan on leaving lot 6 vacant as there is too much of a drop off to bring the sewer line down. Mr. Kellett stated they planned on constructing a quality unit that would look more like a duplex than a project type development. Mr. Woodworth said he had talked with residents of the area who had not liked the re—zoning of Mr. Feltz's property and were now very concerned about this possible rezoning. They were concerned that this would become a multi—family corner. Mr. Kellett stated that Worsley Street could be considered a natural dividing line. Alice Woodworth, a resident of the area, stated that it is now a single family neighborhood and they want to keep it that way. She said the McHugh property could also become multi—family, but they want the area to remain for single family residences. Mr. Grant said this would not look like a 212 or 3 story unit, but that it would look like a large home. Dumpsters would be screened. He said that Kellett and Weis planned to own the property for a considerable length of time. Jim Hayden, an area resident, stated that these re—zonings will set a precedence for the area and that he is worried about the future of the McHugh property. Sue Hayden stated she was objecting to the fact that there would be more than one family living in the housing and that a number of people all felt the same way. Dale Woodworth stated the entire corner could grow to multi—family units. Mr. Kellett said it was a fact there was going to be a four unit building there and said he desired to add another three family unit. Mr. Bud Hayden stated a big mistake had already been made by spot zoning there once. Mr. Feltz said he hoped his building would not detract from the neighborhood — that he will have a garage for each unit, the garbage will be located to the rear of the building, and that the alley will be installed. 2 _ Apri1. 1978 Meeting .- Mr. Grant said the two properties will be toe to toe and that they have almost identical densities. Their building will also be kept back on the property, the garbage will be in the back and they also will develop the alley. Sue Hayden asked if they would be rental units. If soy she said the residents would not be home owners and she felt this wgpl.d make a difference as to the upkeep of the property. Mr. Grant stated it was up to the landlord to maintain the property. Mr. Woodworth stated that Worsley Street looks more like a private lane than a public street. He also wondered what we would tell the next person who comes in asks for a re—zoning and wondered if we would tell him that Worsley Street was the natural dividing line. He further stated that with only one unit in we could stop itv but if we allow two unitsv we may not be able to. Mr. Kellett stated we should not think of this as a domino theory. Mr. Weis stated the highest and best use for the land would be R-3 zoning. Bill Molitor who presently lives in Carpentiersville, stated that he had purchased a lot from Mr. Woodworth after he had looked very hard in this area. He said that he was paying a premium price and expected housing costs to run between $75,90Y000. Multi-family housing where he now lives is common and he felt it detracted from the subdivision. He said there is no possible way to control three or four families in one unit. Mr. Kellett said we were talking only about two individual buildings and that he did not feel he was wrecking the neighborhood. Mr. Dollman then moved to adjourn the public hearing and was seconded by Mr. Langland. All present voting aye. Dr. Coleman then called the regular meeting of the Yorkville Plan Commission to order. Mr. Mahoney moved to accept the minutes of the March meeting and was seconded by Mrs. Price. All present voting aye. Worsley Addition - ReZone Real Estate - Kellett and Weis Mrs. Price inquired about the present width of Worsley Street. Although thirty feet in width, it is not fully paved. Mr. Woodworth asked where the line would be drawn for rezoning in this area. It was noted that Mrs. Merkle was the only adjacent property owner. Mr. Dollman then moved that the Yorkville Plan Commission forward to the city council a recommendation against rezoning the property from R-1 to R-3. Seconded by Mr. Woodworth. A roll call vote was taken as follows Mr. Mahoney - yes; Mr. Feltz — abstain; Mr. Langland — yes; Mr. Dollman — yes; Mrs. Price — yes; Mr. Kenton — yes; Mr. Woodworth — yes; Dr. Coleman — yes. Motion carried. Final Plat — Casimir Bassak — Rte. 71 Dr, Bassak passed out a final plat to all members and stated that other than a name change from Pavillion Acres to Arcadia Acres, there were no other changes made. It was noted that lots 1 and 3 had direct access to Rte. 71 and lots 29495 and 6 had access to Legion Road. Dr. Coleman asked if there were any questions regarding the final plat. Mr. Langland then moved to recommend approval of the final plat of Arcadia Acres and was seconded by Mr. ,Dollman. A roll call vote was taken as follows; Mr. Mahoney — yes; Mr. Feltz — yes; Mr. Langland — yes; Mr. Dollman — yes; Mrs. Price — yes; Mr. Kenton — yes; Mr. Woodworth — yes; Dr. Coleman — yes. Motion carried. Pre—Application Conference — Blaine Harker Attorney Tom Grant, representing Mr. Harker, submitted a preliminary sketch of Harker Hills to the plan commission. He-stated they would be as'.zing for ten lots f r _ � t s 3 — April 1978 Meeting r t all zoned M-1 and said the average lot size was about 201000 plus square feet. The lots would meet all set back requirements. He said the property where the dwelling house is now located was not included in this. He said they will ask for annexation in the future and that they intend to install all improvements according to the subdivision control ordinance. He said they foresee the need for a frontage road, but do not want to destroy the house at this time. When asked what types of businesses he expected to attract., Mr. Harker responded that to did not know at this time. Mr. Woodworth stated that something would have to be worked out regarding the frontage road. It was noted that with a sixty foot right of way, about thirty—two feet would be left for pavement. Mr. Langland stated that he agreed with the proposed zoning, but felt the width of the right of way would pose problems. Mr. Feltz noted that we had discussed this same problem with Jim Stark regarding his proposed development. One possibility suggested to Mr. Harker was that the sketch be re—drawn showing the road on the end rather than through the middle and make all the lots deeper. By the time frontage was taken off the present design, there would not be much left. Mr. Langland noted a buyer would probably have to purchase two lots as it was now designed. Mr. Mahoney stated Mr. Harker might consider making the lots long and narrow so there would be only one lot per manufacturer. Mr. Dollman then moved to adjourn the meeting and was seconded by Mr. Langland. All present voting aye. Meeting ajourned. i
