MINUTES OF THE REGULAR MEETING OF THE YORKVILLF PLAN COMMISSION DECEMBER 1978 .
Chairman Robert Coleman called the regular meeting of the Yorkville Plan
Commission to order. Those in attendance were Dr . Coleman , Mr. Mahoney ,
Mr . Langland, Mr . Feltz , Mr. Woodworth , Mr. Dollman and Mr. Clarage .
Mr . Mahoney moved to approve the minutes of the November meeting and was
seconded by Mr . Feltz . All present voting aye . Motion carried.
78 . 32 Petition for Annexation - Clarence Holdiman , Ruth Holdiman,
Sharon Bazan (Ron Westphal Chevrolet) Tabled from November .
1978 meeting .
In the absence of his attorney, Mr. Atwell , Ron Westphal presented the
exhibits referred to in the Petition for Annexation Agreement_ The property
lies approximately 1/5 mile north of Route 34 and east of Route 47 in the
area of the metal utility building on Route 47 .
Dr. Coleman asked if auto and body repair work would be involved. Mr.
Westphal responded that the primary operation would be in the sales
capacity. A secondary operation would be repair work with 25-30% needing
body shop work and the remaining percentage would be mechanical repairs
only. Any wrecked vehicles could be provided with a screened area if the
City should require it. There will be no over-the-road tractor or
truck repair and the only truck repair will be 10' s to 30 ' s only.
Mr . Dollman asked about signs . Mr. Langland stated that signs were
controAed by City Ordinance and Mr. Westphal is now only asking for
zoning and annexation.
Mr . Mahoney asked where the entrance to Countryside Center was located
in relationship to the property. Mr . Langland stated the entrance
to Countryside Center was north of the property.
Mr. Mahoney asked if the property was beingiannexed as being contiguous
to Countryside Center with an afirmative answer being noted.
Mr . Woodworth asked if water and sewer are available . Mr. Langland
responded that if and when the City runs it across Route 47 they
could most likely hook on at that time .
Mr . Feltz read from the zoning Ordinance the business authorized in
B-3 zoning. Auto sales & service is allowed. Mr . Langland stated
it was probably taken for granted that body work is to be included, but
to what degree would have to be determined when the building permit was
issued .

Mr . Dollman asked about towing services and it was noted that it
would be included in a service capacity.
Mr. Mahoney moved that we recommend to the City Council approval of
B-3 Zoning and annexation of Holdiman , Holdiman & Bazan' s Petition
Agreement, seconded by Mr. Langland . All members present voting .
Motion was carried.
78 . 33 Foxwood Estates — Subdivide to sixteen lots . Within one and
one half miles of city limits .
Dr . Coleman Stated the parcel is part of the original Ben Price farm
west of the P.N.A. camp on River Road. Topography maps were passed out.
James Olson stated there has been county approval with the stipulation
that every other lot share a common driveway in place of sixteen (1_6)
separate driveways . Mr. Olson further stated there will be a rear
set-back on lots to prevent building in steeper areas . It is closer
to the river on lots 3 ,4 & 5 because of springs and the flood plain is
only about four (4) feet above the river .
Mr. Olson stated Dr. Davis , one of the buyers , is building on lot 16
which is a larger lot than the rest.
Mr. Olson stated there will be no septic fields due to the slope and
sand filters will replace septic fields . Each lot will have its own
private well .
Mr. Olson stated 35 feet from the center of the road will be dedicated
for right-of-way and that the property is ,.already zoned residential.
Mr . Olson stated the covenant will call for a minimum of 2500 sq. ft.
ranch homes and over 3000 sq. ft. for 2 story or more homes .
Mr . Langland moved to recommend to the City Council approval based on
the restrictions set by the County as follows :
1. Common driveway for every 2 lots .
2 . Rear set backs .
3 . Dedicated right-of-way to be 35 feet from the center of River Road.
4 . Use of sand filter system.
The motion was seconded by Mr . Dollman. All members present voting aye .
Motion carried.
78 . 34 Countryside Center - Resudivide Block 1 , Unit I .
Jack Purcell and Roy Deane passed out plats showing existing buildings
in dark shading and parking lots in light shading . Lots to be subdivided
are lots 1 ,2 . 3 ,4,5 :& 6 . Anything else is contained in Lot 7 which is the
shopping center itself.
Mr. Langland asked if it was all one lot before and were they requesting
it be divided into 7 lots . Mr. Purcell responded that nothing has
changed except the lots require platting in order to be sold. Mr. Purcell
noted the Bank of Yorkville building was not originally a part of it and
McDonald ' s has since been sold . Requests for free standing buildings

cannot materialize With.,qut platting and selling the lots individually.
Mr. Langland then asked Mr. Purcell if one lot was being split into seven
lots to which Mr. Purcell answered affirmatively.
Mr. Purcell noted that sewer and water are available .
Mr. Mahoney asked .if the the entrance to lots 3 ,4 & 5 '.would be from
the inside or from the outside of the shopping center. Mr. Purcell
responded it would be from within rather than out on the boulevard.
Mr . Clarage asked if the parking on lot 1 was required parking for the
shopping center itself . Mr . Purcell responded that its main purpose was
for employees and guests and not for customers . Mr. Clarage then
asked what would happen if lot 1 was sold and a building put on the
parking lot. Mr. Purcell responded that it would be impossible as their
lease with the merchants forbid it. If the bank were to buy the parking
lot the lease would also go along with it . Mr. Langland asked if this
same agreement was true of all existing parking lots in the shopping
center. Mr. Purcell answered affirmatively.
Mr. Clarage requested the driveway easements be indicated on the plats .
Mr. Woodworth noted the streets within the shopping center are not
dedicated to the city. Mr. Clarage stated the streets could be
dedicated if brought up to city standards . Mr. Langland noted that
if they were dedicated they would be there for all to use .
Mr. Mahoney stated an entrance to lot 3 from Center ?arkway would be the same
problem as with the Pizza Hut entrance with the median strip present.
Dr. Coleman asked if it would be possible to enter Lot 3 from the south-
east corner by Hornsbys , but noted that it was a badly congested corner
for an entrance . Mr. Olson stated the possibility of a common driveway
entrance for lots 3 & 4 off Countryside Parkway across from Palmer Court
and also an entrance for lot 5 off the -shopping center street from the
east. Mr . Clarage stated he felt no curb cuts should be allowed for
lots 2 , 5 & 6 nor a common '.cut for lots 3 & 4 . Mr. Clarage suggested
a frontage road for lots 3 ,4 & 5 . Mr. Langland responded he could see
no need for another road.
Mr . Langland noted Lot 7 must be cross to gain access to Lot 2 as well
as to Lot 5 . Mr. Clarage stated access easements would have to be
recorded.
Lot 6 is the major entrance problem. Mr. Woodworth stated that a cut
on Route 47 would have to be approved by the state highway department
for lot 6 . Mr . Mahoney stated that if would be to Mr. Purcell ' s
benefit to have an entrance from within the shopping center for Lot 6
across from Lot 5 to generate more shopping center traffic and business .
Mr. Purcell noted he would personally object to a cut on the Center
Parkway median strip for Lot 6 .
Mr. Dollman stated the adversity with lots 3 ,4 & 5 seemed to be in a
cut in the median strip and with the heavy traffic and there may be
a need for another road.
Mr . Feltz noted having a common drive for lots 3 & 4 across from Palmer
Court made sense to him.

Mr. Clarage noted the median strip must have been installed in the
first place for the purpose of limiting cuts .
Mr. Dollman inquired about delivery truck routing with no rear delivery
accesses inside the mall . Mr. Purcell responded that each lot would be
self-contained and must all be approved before a building permit was
issued. He stated also that it was impossible to know what types of
businesses it would generate. He further stated Countryside Center is
more strict on this matter than the City Ordinances.
Mr. Clarage stated that restrictions could be put on the plat for no
curb cuts and designate where there can be no curb cuts .
Mr. Dean stated that an entrance for Lot 6 off the mall across from lot 5
would discourage any buyer if it were the only entrance/exit. Mr. Feltz
noted that Lot 6 could be left for the buyer to come back before the
City with some specific plan for approval as to where the entrance would
be located. Mr. Purcell stated that this would be making a sale contingent
on a plan and he felt it should be contingent on a building permit. Mr.
Clarage responded negatively and stated that Mr. Purcell was asking to
resubdivide the original shopping center and in turn- we are asking for
certain conditions be met and it is only a fair exchange .
Mr. Deane suggested an alternative for Lot 6 providing a dead-center cut
to Countryside Parkway going east to be one-way as at the Pizza Hut.
Mr . Dollman moved to recommend to the City Council approval of the
Preliminary Plat of the Resubdivision of Block 1 , Unit 1 , Countryside
Center subject to the following :
1. 00Center cut on Countryside Parkway for Lot 6 .
2 . No access off Countryside Parkway on Lot 4 and provide a
common drive entrance for lots 3 & 4 to line up with the
center curb cut on Countryside Parkway by Palmer Court.
3. Draw easements on the plat as discussed.
4. No cuts on Center Parkway for Lots 1 & 2 .
The motion was seconded by Mr. Mahoney. All members present voting Aye.
Motion carried.
