MINUTES OF THE REGULAR MEETING OF THE YORKVILLE PLAN COMMISSION 28 JANUARY 197 �t} t, Chairman Leo Anderson called the meeting to order. Those in attendance i were Mr. Anderson, Mr. Olsen, Mr. Kenton, Mr. Clark Bartell and Mr. Roger Simmons. Mr. Olsen moved to approve the minutes of the November meeting and was seconded by Mr. Anderson, All voting aye. Motion carried. 75.02 Route #47 By Pass Report Mr. Anderson read a letter sent to Clarage & Associates from the Illinois ! Department of Transportation, Highway Department which stated that Kendall County is now under the jurisdiction of the Ottawa office. They stated a desire to establish a working relationship with all officials of the county, but said they were in no position to speak of definite locations of the by—pass at this time. I Mr. Bartell stated he had had no further correspondence with that agency. l 75.03 Rte #34 Corridor Study Report Mr. Anderson read from the minutes of the January 23rd meeting of the city council. Mr. Roger Simmons from the city council and Mr. Harold Feltz of the J planning commission were appointed to the Rte #34 corridor commission. The next meeting will be held at the Kendall County Annex on 29 January 1975 and meetingsthereafter will be held on the third Wednesday of each month. fi 75.01 Tom Curnes Re—zoning Petition — See Attachment I for Legal Description i Mr. Tom Curnes owner of the property was asked by Mr. Anderson to describe f" the future use of the property. Mr. Curnes replied that he wished to lease the building to Carl Middlegge who would use a portion of the building for a j body shop, a portion for a showroom for his antique cars and the remainder for dealer preparation. Mr. Anderson then read a letter from Clarage and Associates who recommended that the zoning change not be approved. See attached letter. Mr. Curnes then stated that he had talked with several residents adjacent F to the property who stated they had no objection to the proposed use as a body shop. Mr. Anderson read a letter from Mr. Herb Tripp, a nearby resident, who '1 stated an objection to the zoning change from B-2 to M-1 because of possible i I 4 Jr future uses of the property. Mr. Anderson stated that he had also received several telephone calls objecting to the re-zoning of this property and said that some people felt that wrecks might be lined up in front of the building. Mr. Anderson stated that the M-1 classification was too wide. It may possibly be all right now for a body shop but future use is questioned. Mr. Bartell stated he could see no justification for M-1 zoning in a residential neighborhood. Mr. Anderson said that residents of near-by property do not seem to be concerned about the property being used for a body shop but do object to M-1 zoning as far as future uses are concerned. Mr. Kenton moved to deny the N-1 zoning and was seconded by Mr. Olsen. P All present voting aye. Motion to deny was carried.. Mr. Bartell felt the petitioner could request zoning for special use and retain the B-2 zoning. Mr. Curnes would have to file an application for special use with the city clerk. Mr. Anderson indicated the planning commission could have this request on the agenda for the February meeting. Mr. Curnes, howeverg requested that the planning commission immediately make a recommendation to the city council regarding this special use. The planning commission was requested to recommend that B-2 zoning be retained for the property in question but recommend granting special use for automobile paintings upholsteringt repairing, reconditioning and body and fender repairing, when done within the confines of a structure if this recommendation is deemed legal by the-city attorney. A roll call was then taken. Mr. Anderson - no. Mr. Olsen - yes. Mr. Kenton - no. The planning commission voted two to one against making this recommendation to the city council. 75.04 Subdivision Control Ordinance Report Although an application has been filed for federal fundsg no response has been received. Because of the urgent need for such an ordinace, it was recommended that Clarage and Associates contact Mayor Coleman for discussion regarding this ordinance. Mr. Kenton made a motion to adjourn the meeting and was seconded by Mr. Olsen. All present voting aye. The subject property has single family zoning on three sides and business zoning continuing to the south. Most of the permitted uses in the M-1 `. classification are incompatible with residential j districts and should not be encouraged in these areas. r^ Both the zoning map and the comprehensive plan indicate the areas where ,manufacturing is encouraged, and the subject property is not in one of these i locations. 2.
