Olsen Richard Groner Harold Feltz Fred Dollman Dale Woodworth MINUTES OF THE REGULAR MEETING OF THE YORKVILLE PLAN COMMISSION 23 SEPTEMBER 1975 i Chairman Robert Coleman called t e meeting to order. Those in attendance were Dr. Coleman, Robert Mahoney, D e Woodworth, Harold Feltz, Clark Ba.-tell, Bert Ericksen, Larry Beach and Elden Madden. Mr. Mahoney moved to accept the minutes of the August, 1975 meeting and was seconded by Harold Feltz. All present voting aye. Motion carried. 75.22 Review Yorkville Subdivision Control Ordinance Dr. Coleman stated that the city council had referred the ordinance back to the plan commission for several revisions. Alderman Beach presented from the city council a "Proposal to Amend the Proposed Yorkville Subdivision Ordinance of the United City of the Village of Yorkville in the following manner:" See Subdivision Control Ordinance. Under Section 8.07 — Street Lighting— the following two paragraphs are added. 8.07.03 The Subdivider shall bear all the necessary expense and responsibility of providing all street lighting materials per the current existing specifications or requirements of the Commonwealth Edison Company and/or City of Yorkville. 8.07.04 The Subdivider shall bear all expense and responsibility for any street lighting alteration or corrections needed to insure the maintenance acceptance agreement by Commonwealth Edison Company. Under Section 9.03 — Variations — the entire first paragraph is amended to read as follows: Where the Plan Commission finds that extraordinary hardships or particular difficulties may result from the strict compliance with the ordinance, the zoning board of appeals is hereby empowered to consider such matters after receiving written application from the subdivider. If applicable, the zoning board of appeals may 'recommend in writing to the city council variations or exceptions to the regulations subject to specified conditions, so that substantial justice may be done and the public interest secured, provided that such variations or exceptions shall not have the effect of nullifying the intent and purpose of this Ordinance or the Comprehensive Plan. Paragraph 3 of Section 9.03 — Variations — is also amended to read as the Zoning Board of Appeals shall not recommend variations, etc. rather than the Plan Commission. Mr. Mahoney inquired as to whether the plan commission was being eliminated entirely from the section dealing with variations. Mr. Beach stated that the plan commission had authority under the earlier paragraphs in Section 9.03. I f Mr. Mahoney made a motion to accept the recommendations of the city council pertaining to the revisions of the Yorkville Subdivision Control Ordinance pending legal council by the city attorney. Seconded by Mr. Woodworth. All present voting aye. Motion carried. Alderman Beach noted that the Fence Ordinance would be under study by a committee of the city council and at a later date would be referred back to a the plan commission. Route #34 Corridor Study Mr. Harold Feltz passed out minutes from the 16 July and 20 August meetings of the Route #34 Corridor Study group. He stated that a meeting would be held on 21 October 1975 where they hoped to have all city council, plan commission, county, and corridor study members present to discuss an interim report. On 29 October, 1975 an open meeting for the general public is to be held and on 19 November the last planned corridor group meeting is to be held. Mr. Feltz stated that he would have copies of the interim report for all members before the 21 October meeting so that the plan commission members could familiarize themselves with the report. Chairman Coleman asked for a motion for adjournment. Mr. Harold Feltz moved to adjourn the meeting. Mr. Robert Loftus then asked to present material before the plan commission. Dr. Coleman indicated that he had not requested to be placed on the adgenda for September. Mr. Loftus stated that he thought this was automatic as the city council had referred him to the plan commission. Dr. Coleman stated this was not an automatic process. He also indicated the plan commission could vote to have him placed on the adgenda. As there was already a motion to adjourn, Mr. Mahoney seconded 'the motion and all members voted aye.
