Ordinance No. 2016-� AN ORDINANCE OF THE UNITED CITY OF YORKVILLE, KENDALL COUNTY,ILLINOIS,APPROVING A SPECIAL USE FOR A SMALL RELIGIOUS INSTITUTION AT UNIT A 210 BEAVER STREET WHEREAS, the United City of Yorkville (the "City") is a duly organized and validly existing non home-rule municipality created in accordance with the Constitution of the State of Illinois of 1970 and the laws of the State; and, WHEREAS, under section 11-13-1.1 of the Illinois Municipal Code (65 ILCS 511-1-1, et seq.), the Mayor and City Council of the City (collectively, the "Corporate Authorities")may provide for the classification of special uses it its zoning ordinances; and, WHEREAS, pursuant to the United City of Yorkville Zoning Ordinance (the "Zoning Code"), any person owning or having an interest in property may file an application to use such land for one or more of the special uses provided for in the zoning district in which the land is situated; and, WHEREAS, Unified Faith in Christ Church ("the Lessee") is leasing Unit A of the property located at 210 Beaver Street, legally described in Section 2 of this Ordinance (the "Subject Property"); and, WHEREAS, under the authority of the Zoning Code, the Subject Property is located in a designated M-1 Limited Manufacturing District, and a small religious institution is allowed in this district with a special use permit; and, WHEREAS, the Corporate Authorities have received a request from the Lessee for a special use permit for the Subject Property to allow a small religious institution; and, WHEREAS, a legal notice of publication regarding a public hearing before the Plan Commission on the proposed special use permit was duly published in a newspaper of general circulation in the City, not more than thirty (3 0) nor less than fifteen (15) days prior to the public hearing; and, WHEREAS, notice to property owners within 500 feet of the Subject Property identified for the special use permit was delivered by certified mail; and, WHEREAS, the Plan Commission convened and held a public hearing on the 10th day of February, 2016, on the question of the special use application; and, WHEREAS, the Plan Commission reviewed the standards set forth in Section 10- 4-9(F) of the Zoning Code; and, Ordinance No. 2016-o9(o Page 2 WHEREAS, upon conclusion of said public hearing, the Plan Commission recommended the approval of the special use for the Subject Property for a small religious institutional use of the Subject Property. NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of Yorkville, Kendall County, Illinois, as follows: Section 1: The above recitals are incorporated herein and made a part of this Ordinance. Section 2: That the Corporate Authorities hereby approve a special use of the Subject Property, legally described as: The existing Unit A of the building on Lot 5, Block 1 of Fox Industrial Park, Unit 2, in the City of Yorkville, Kendall County, Illinois, PIN 05-04-152-004, for use as a small religious institution. Section 3: That the special use granted herein shall be constructed, operated and maintained in accordance with the following plans, diagrams and conditions: A. That the parking stalls located along the western side of the building be restriped in compliance with the current standards in the Yorkville City Code, and B. That the owner of the Subject Property includes language in all other leases of portions of the building acknowledging that there is shared parking for the tenants of the building. Section 4: This Ordinance shall be in full force and effect upon its passage, approval, and publication in pamphlet form as provided by law. MAVOR Ordinance No. 2016-a6 Page 4 Exhibit A Legal Description of Subject Property The existing Unit A of the building on Lot 5, Block 1 of Fox Industrial Park, Unit 2, in the City of Yorkville, Kendall County, Illinois, PIN 05-04-152-004 RIDER "A" 1. Pastor William Shore and The United Faith in Christ Church(The Lessee)agree to lease A-Bay at 210 Beaver Street,Yorkville 1L. 60560.A-Bay consists of all the space from the front of the building to the 15' demising wall with the exception of the common access from the front of the building to the common restrooms. All tenants of the building shall have clear access to the restrooms at anytime through the front door. 2. Lessee shall rent the space "AS IS ". Furnace and A/C units will be in working order at lease signing. 3.Any repairs or service work under$500.00 will be the responsibility of the lessee. Landlord will pay everything above and beyond the initial$500.00 for any repairs or service work during the term of this lease. 4.Any signage must be approved in writing from the landlord and is subject to village codes. 5. Lessee share pay their proportionate share of any and all utilities expenses during the term of this lease. 6.Any modifications,painting and repairs to A-Bay must be approved in writing by the landlord. 7. Lessee shall not interfere with, limit or disrupt the parking requirements of existing and future tenants of 210 Beaver Street. 8. Lessee shall give Landlord 60 days advanced written notice of their intention to terminate this lease or if they intend to extend this lease agreement. 9. 151 and last months rent plus 1 month security deposit is due at lease signing. 10, ls'year rent is$1200.00 per month plus utilities with the 1'6 months rents discounted to$1000.00 per month plus utilities. 11.
