Ordinance 1907-01 AN O R D I N A N C E.
Providing for the construction of certain Cement Side-
walks and for the payment thereof.
BE IT ORDAINED by the President and Board of Trustees
of the Village of Yorkville, Kendall County, State of Illinois:
Section 1. That cement sidewalks shall be constructed
in the said village of Yorkville upon and along the several parts
of streets hereinafter mentioned and to be of the width and con-
structed in the time and manner hereinafter specified.

That the foundations of said sidewalks shall be laid
with their inside edge one foot distant from the street line of the
lot 'or parcel of land abutting same, wherever practicable to do so,
and shall be of the width of five feet six inches for sidewalks of
five feet in wdthh . and four feet six inches for those of four feet
In width, and may be excavated to the depth of twelve inches when
necessary to maintain a uniform grade.
That the sub-grade of said` sidewalks shall be of the
width of five feet' six inches, and four feet six inches , respect-
ively, according as the sidewalk is to be five feet, or four feet
wide, and be prepared by filling or excavating as the case may be,
as may be necessary to bring the same to a true, firm and uniform
surface, conforming as near as practicable to the surface of the
abutting land.
Said sidewalks shall be constructed in the manner fol-
lowing: That upon such sub-grade shall be placed a layer of cin-
ders, clean gravel , or broken stone, in sufficient quantity to
leave a uniform thickness of eight inches after being wet and well
rammed and tamped in place, and thoroughly settled. Upon such
foundation shall be placed a layer of cement concrete five feet in
width for such sidewalks of that width, and four feet in width for
those of that width, and full four inches in thickness.
Said concrete shall be aompUed- of one part of American
Portland Cement, three parts of clean sharp torpedo sand, and
five parts of clean and clear gravel, or broken stone, by volume,
which shall be carefully measured. The cement and sa .shall be
thoroughly mixed dry, being turned twice with shovels or other
mechanical mixers, after which it shall be moistened sufficiently
by sprinkling water thereon while the material is being turned

twice with shovels or other mechanical mixers, and made into a
stiff mortar. The gravel or crushed stone, after being sprinkled
with water, shall be incorporated in the mortar and the mass shall
be thoroughly mixed together by turning over with shovels, hoes
car, mechanical mixers sat least three times, and 'then placed on the
foundation and rammed until prefectly solid, and after being so pre-
pared and''set`tled in its place, shall be of a uniform thickness of
three inches. On this concrete, before it shall have time to set,
shall be placed a wearing surface, one inch in thickness, composed
of one part of the best quality of Portland cement and one part
of clean torpedo gravel, which shall be well mixed. This top layer
shall be floated perfectly smooth on the upper surface and to a
true plane with no depressions.
The walks shall be laid in sections of four feet each; each
section to be entirely separate from the adjoining section, so that
any section may be removed from the work without injury to the ad-
jacent ones. The joints shall be smooth and straight and plumb
through their depth, and at right angles ' to the line of work.
Each walk shall have a uniform downward slope of one-
fourth inch to the foot toward the center line of the street.
The materials to be used in the construction of said side-
walks and the construction thereof shall be under the supervision,
direction and subject to the approval'of the Street' and Alley
Committee of said village of Yorkville.
Any good brand of cement may be used which must be equal
in quality to "American Portland Cement."
All mixing to be done on water-tight platforms.

All timbers used in the construction of said sidewalks
must be full four inches deep, in order to secure a uniform thick-
ness of four inches for each block of walk,
Work shall be done 'in a first�cl.ase, workmanlike
manner and when completed subject to the official approval of the
President and Board of Trustees of said 'pillage of Yorkville.
Any person building any part of said sidewalk will be
held to have constructed the same under the provisions of this or
dinance and not otherwise.
Section 2. That the owner of any such lots or parcels
of land herein described, fronting or abutting upon the line of said
proposed sidewalks, is hereby required to construct •a sidewalk in
front of and along the side of his respective lot or parcel of
land where a sidewalk is ordained to be built by this ordinance, in
accordance with the specifications herein set forth., within thirty
days after the legal publication of this ordinance, and in .default
of such construction the necessary materials are to be furnished
and the sidewalk is to be constructed by the said tillage of York-
ville, under the supervision of the Street and Alley Committee of
said village, and when so constructed by said village shall be paid
for, one-half out of the general fund of said village raised by
general taxation and already appropriated for that purpose, and one-
half by special taxation of con'tig_UAU.0 property, levying one-half
the cost of the said walks upon each lot or parcel of land fronting
or abutting upon such walk.
Section 3. In case of the default of the owners of any
such lots , tracts or parcels of land in the construction of said
sidewalks, and in the construction of the same, or any portion
thereof by said village under the provisions of this ordinance a
bill of the costs of'such -sidewalk so constructed by said village,
showing; in separate items the cost of grading, materials, :laying
down, and gupervision of the same in, front of or abutting each of
such lots or parcels, certified by the Street and Alley Camttee,
shall be filed by said committee in the office of the village clerk
of said village, together with a list of the lots or parcels of land
along which-the same shall be so constructed, with the names of the
respectivv owners and the number of feet so constructed; being one-
half' of the cost thereof ` as provided in Section 2.
The Village Clerk shall thereupon prepare a special tax
list against each of such lots- or parcels of land, ascertaining by
computation the amount to be charged against each of them on account
of the construction of such sidewalk by said village, according to
the rule` herein- fixed for the levy, of such -special tax, which list.
shall thereupon° 'be' filed in the office offs such village clerk. And
the Village Clerk shallthereuup'on issue° a: warrant directed to the
treasurer of said village for the 'collection of the amount of the
special tax .so ascertained and appearing from said special tax list
to be due from the lots at` parcels of land toughing upon said side-
walks , or the owners thereof; and the. treasurer of said village
shall demand, collect and receive the amount due upon said warrants
from the parties owning the same; and in case he shall be unable
to collect the money due upon said warrants or either or- any part
thereof, he shall then make return thereof together with the money
collected on said warrants to said village clerk within sixty days
from the date of their issue, and,-the said Till- clerk..,,,shah.
thereupon pay the money thus received over to the village treasurer
of the village of Yorkville.
Section 4. That upon the failure to collect such special
tax as her provided in this ordinance, said village clerk
shall , on or before the thirtieth day of March next after the pas-
sage of this ordinance, make return of said special tax as delin-
quent to the county treasurer and ex-officio county collector of
Kendall county, Illinois, in the manner prescribed by law, who shall
thereupon proceed:to apply for judgment against such lots or par-
cels of land, upon :which said special tax shall be unpaid, and shall
collect the same according to the statute in such case made and pro-
vided.
Section 5. In case the owner of any lot shall construct
such videwalk in accordance with this ordinance he shall file with
the village clerk an itemized statement of the cost of the sidewalk
so constructed by him, verified by affidavit', together with a cer-
tificate of the said 'street and alley Canute® that such sidewalk
has been constructed and fully completed by such owner in accordan-
ce with this ordinance, and the board of trustees of said village
shall thereupon at the first meeting thereafter, if satisfied with
such statement, allow and :order to be issued to such owner, an order
an the treasurer of said village for the amount of one-half of the
cost of construction of such sidewalk and the same shall be paid out
of moneys now appropriated for such purpose.
If any owner does not wish to construct his own walk, he
may immediately waive the right to do so, and thereupon the village
of Yorkville will proceed without waiting said thirty days allowed
such owner, and cause such walk to be constructed as soon as practi-
cable.
Section 6. This ordinance is drawn under. the power of an
act of the general assembly of the State of xllixQis, entitl:.ed "Axi'
act to provide additional means for the construction of sidewalks
in cities, towns and villages." approved April 15 , 1875. Provided,
however, this ordinance shall not be construed to empower any offi-
cer of said village of Yorkville to enforce those provisions of the
above mentioned act of the general assembly which authorizes the
cost of sidewalks or any part thereof to be recovered of any lot
owner or owners by actions at law against such owners respectively,
or that authorizes the seizure by warrant issued by the village
clerk of the personal property of the owner in satisfaction of said
special tax.
Section 7. The village of Yorkville hereby reserves the
right to require from any person, firm or corporation entering into
contract with it to construe any portion of the sidewalk herein
provided for, a bond with sufficient and satisfactory sureties re-
siding in said Kendall county, to be approved by the President and
Board of Trustees of said village, in the penal sum of not less than
double the amount of such contract, conditioned that the work done
shall be in a first-class workmanlike manner and to make good any de
fects appearing therein during the space of five (5) years from
the completion and acceptance thereof, due to improper or- defective
materials used in, or faulty workmanship employed in and about the
construction of the same.
Section g. This ordinance shall be in full force and
effect from and after its legal passage, approval and publication.
