Ordinance 1952-49 PEDDLER' S AND SOLICITORS ORDINANCE
An ordinance prohibiting peddler' s, hawkers,
Itinerant merchants and transient venders of merchandise
from eb,gaging in the sale of goods, wares and merchandise
without having first obtaining a license therefor and
prohibiting the entry upon private residence by solicitors
without invitation of the owners or occupants, for the pur-
pose of soliciting orders for personal services and/or for
the sale of goods, wares and merchandise, and providing a
penalty for the violation thereof.
Be It Ordained by the President and the Board of
Trustees of the Village of Yorkville:
Section One.
It shall be unlawful for any person, firm or cor-
poration to engage in the business of peddling, hawking, or
vending merchandise, article, or thing without first obtain-
ing a license therefor.
Section Two.
Applications for such licenses shall be made to the
Village Clerk, and shall state thereon the number of vehicles,
if any, intended to be operated, the kind of article or mer-
chandise to be peddled and the permanent address of the peddler.
Section Three. - -
The fee for such licenses shall be for peddlers
using a cart, wagon, automobile or other vehicle, $50.00 for
each such vehicle for an annual license and V20.00 for each
such vehicle for a daily license. For peddlers not using any
such vehicle the feelshall be 420.00 for an annual license per
person and $5.00 per person for a daily license.
Section Four.
Any licensed peddler who shall be guilty of any
fraud, cheating, or misrepresentation whether through himself,

or through an employee, while acting as a peddler in the Village
or who shall barter, sell or peddle any goods, wares or merchan-
dise other than those specified in the applications for a license
or who shall remain in a private residence or on the premises
thereof after the owner or occupant thereof shall request him
to leave or any peddler who enters into a private residence with-
out the express invitation of the owners or occupants shall be
fined not less than $5.00 nor more than $200.00 for each such
offense and the Presidnnt of the Village shall revoke his license
for such offense and such revocation shall be in addition to any
fine imposed by virtue of this ordinance.
Section Five.
Entering a private residence in the Village of
Yorkville by a solicitor for the purpose of soliciting orders
for the sale of goods, wares or merchandise or personal services
without the express invitation of the owner or occupant thereof;
or remaining in a private residence or on the premises thereof
after the owner or occupant shall request any solicitor to leave,
is hereby declared to be a nuisance and punishable as such.
Section Six.
The police department of the Village of Yorkville
is hereby requested and directed to surpress and to abate such
nuisance as described and prohibited in Section Five of this
Ordinance and any person convicted of perpetrating a nuisance
upon conviction therefor shall be fined not less than $5.00
nor more than 0200.00 and costs of prosecution.

section Seven.
Any person, firm or corporation violating any of
the provisions for this article shall be fined not less than
$5.00 nor more than 4200- .00 for each offense and a separate
offense shall be deemed committed on each dqy during or on
which a violation occurs or continues.
Section Eight .
All ordinances in conflict herewith are hereby re-
pealed, except that nothing herein contained shall be deemed
to in any wise repeal or affect an ordinance of the Village
of Yorkvlls regarding vehicles carrying foodstuffs as passed
and approved April 2, 1951.
Section Nine.
Should a court of competent jurisdiction declare
any part of this ordinance invalid, such decision shall not
affect the validity of the remainder.
Section Ten.
This ordinance shall be in full force and effect
from and after its passage and publication as provided by
law.
