Ordinance 1948-64 WEED ORDINANCE of the VILLAGE OF YORKVILLE BE IT ORDAINED BY THE PRESIDENT OF THE BOARD OF TRUSTEES OF ThE VILLAGE OF YORKVILLE. Section One:- That any weed defined as a noxious weed by virtue of the laws of the State of Illinois, and other weeds of like kind or any vege- table growth which exhales unpleasant or noxious odors or any high or rank vegetable growth which may conceal filthy or decaying deposits growing upon any lot, block, piece or parcel of land within the limits of the Village of Yorkville is hereby declared to be a nuisance. Section Two:- It is the duty of the owner, occupant or person in charge of any lot, block, piece or parcel of land in the Village of Yorkville to cut down and remove any such weeds or vegetable growth as above specified, upon notice to do so from the Village Board of Yorkville, or the health committee of said Village and any owner, occupant or person in charge of any lot, block piece or parcel of land who shall fail to comply with the provisions of this paragraph within five days after being notified so to do as aforesaid, shall be deemed guilty of maintaining a nuvsance, (and each day of such main- tainance shall constitute a separate offense) . Section Three:- For the purpose of carrying the foregoing provisions into effect it shall be the duty of the health committee or such other officer as may be deputized by the President to ascertain and cause all nuisances under this ordinance to be abated, and notice shall be given owners or occupants of premises to remove or abate such nuisance; and in case of the failure or refusal to comply with said notice, the Village or Officers shall abate the same and report the expenses to the Village Board and upon approval of the amount of such expense by the Village Board and upon the filing of a notice in the Recorder' s Office of Kendall. County, Illinois containing; a description of the premises from which the nuisance was removed or abated and, the amount of such expenses approved as aforesaid, the said amount shall become and be a lien upon said premises, to be collected by foreclosure, suit, or otherwise, in addition to any fine or penalty herein provided. Section Four:- No person shall refuse to obey any order of decission of the Village BoG:rd or Health Committee or officer requiring such per- son or persons to abate or remove any nuisance from his premises. Section Five:- Every person, firm, or corporation who violates any of the prov- isions hereof shall be fined not less than $10.00 or more than $100. for each and every offense and each day they or it violate or fail to comply with the terms and provisions hereof shall. constitute a separate offense. Section Six:- The invalidity of any part , section or sentence of this ordinance shall not affect the remainder thereof. Section Seven: This ordinance shall be in full force and effect from and after its due passage, approval and publication, according to law. Passed this 3 P D day of May, A.D. 1948.
