Ordinance 1942-76 MILK ORDINANCE
Ordinance regulating the sale or distribution of milk and
milk products within the Village of Yorkville and its police juris-
diction.
Be It Ordained by the President and Board of Trustees of
Yorkville, Illinois:
Section 1., License to sell or distribute milk. No person,
firm, or corporation shall engage in the sale, delivery, or disttib-
ution of milk or milk products within the Village of Yorkville with-
out first obtaining a license therefor as herein provided.
License Fees. Persons desiring to engage in the sale, de-
livery or distribution of milk or milk products within the Village
of Yorkville shall make written application to the Village Clerk of
the Village of Yorkville, who shall have the power to issue a license
upon the presentation of satisfactory proof that the applicant has
complied with the terms of this ordinance and is entitled to such
license.
The annual fees for. the various licenses for engaging in
the business of the sale, delivery, and distribution of milk and milk
products in the Village of Yorkville shall be as follows:
1. For each vehicle transporting milk or milk products for
delivery in the Village of Yorkville, the sum of 1`5...x=
2. For each store, depot, or stand selling milk and milk

Such fees shall be reduced proportionately where operation
commences after the first of the license year.
All licenses shall expire on the 30th day of April each
year.
Revocation of Licenses. Any license issued herewith may
at any time be suspended or revoked by the President of the Board of
Trustees of the Village of Yorkville upon recommendation of the Health
Committee for violation of any of the provisions of this Ordinance.
Notice in writing signed by the said President shall be delivered
immediately to the licensee of such suspension or revocation; provided
the licensee shall, after complying with such suspension or revocation,
have the right to appeal to the Village Board of said 'pillage of York-
ville, whose action thereon shall be final.
Section 2. Definitions.
Milk and Milk Products. Milk and milk products shall be
taken to mean and include milk, cream, sour cream, homogenized milk,
vitamin D milk, buttermilk, skimmed milk, milk beverages and skimmed
milk beverages.
Gracie A Raw Tai lk. Grade, A raw milk means unpasteurized
milk, the average plate count of which does not exceed 50,000 per
cubic centimeter and the average reduction time of which is not less
than eight hours, and which is produced upon dairy farms conforming
with all the provisions for sanitation set forth in the Act of the
Legislature of the State of Illinois, entitled, "An Act in R @lction to
Grade A Milk and Grade A Milk Products." , approved July 11, 1941.
Pasteurized Milk. Pasteurized milk means milk pasteurized
in accordance with the Act of the Legislature of the State of Illinois,
entitled, "An Act regulating the Handling, Processing, Labeling, Sale
and Distribution of Pasteurized Milk and Pasteurized Milk Products. " ,
approved July 24, 1939.
Section 3. Labeling. All bottles, cans, packages and
other containers enclosing milk and milk products defined in this
ordinance shall be plainly labeled or marked with
1. the name of the contents;
2. the grade of contents if graded;
3. the word "pasteurized" if the contents have been
pasteurized;
4. the word "raw" if the contents are raw or unpasteurized;
5. the name of the producer if;ithe contents are raw; and,
6. the name and post office address of the plant at which
the contents were pasteurized, if the contents are
pasteurized.
Section 4. Milk and Milk Products Which be Sold.
From and after (3) three months from the date on which this ordinance
takes effect, no milk or milk products shall be sold to the final con-
sumer or to restaurants, soda fountains, grocery stores, or similar
establishments except Grade A raw Milk- and Milk products, or pasteur-
ized Milk and Milk products.
Section 5. Milk Tests. Milk received at the pasteurization
plant shall be tested at least once a week by the plant operator. The
Methylene Blue Reduction Test shall be used and a record kept of the
results in abound record book. Each producer's test shall be ident-
ified by name or number. The average reduction time of any four con-
secutive samples from each producer shall not be less than 6 hours.
Section 6. Penalty. Any person who shall violate any pro-
visions of this ordinance shall be fined not more than $200.00 at the
discretion of the court. Each day a violation continued shall const-
itute a separate offense.
Section ,71 The Village of Yorkville may at any time inspect
the premises and the herds where and from which milk products sold by
any licensee hereunder are produced, pasteurized, or otherwise processed.
Section 8. Repeal and Date of Effect . All ordinances and
parts of ordinances in conflict with this ordinance are hereby repealed;
and this ordinance shall be in full force and effect immediately upon
its adoption and its publication, as provided by law.
Section_ 9. Unconstitutionality Clause. Should any section,
paragraph, sentence, clause or phrase of this ordinance be declared
unconstitutional or invalid for any reason, the remainder of said ord-
inance shall not be affected thereby.
