Ordinance 1933-84 TORKVILLE MALT BEVERAGE DEALERS ORDINANCE
An ordinance to regulate and license the sale of malt beverages.
BE IT ORDAINED Br TIE PRESIDENT Ar'D BOARD OF TRUSTEES OF THE; VILLAGE
OF °ORKVILL% ILLINOIS:
Section 1. Name.This ordinance shall be known as the Malt Beverage ,!
Ordinance.
Section 2. Malt Beverage shall be defined as a non-intoxicating malt
or fermented liquor, fit for beverage purposes, commonly called beer
containing more than one-half of one per centum or more alcohol and
not more than 3.2 per cantum of alcohol by weight.
'SALT BEV'PRAGE' RITSINESc shall mean any establishment (other than a
place used exclusively for a home) in which malt beverages are sold,
exhhugged, or given afay.
Beer Store shall mean any store selling malt beverages not to be
consumed on the premises.
Beer Parlor shall mean any store, catering to the general public,
wb ose principal business is the sale of malt beverages for consumption
on the promises. ``
Motel shall mean any establishment offering sleeping accommodations to
the public and whose business includes the serving of food to be consumed
on the promises.
Ice Cream Parlor shall mean any store maintaining a soda fountain and
selling and serving ice cream and soft drinks

Section 3. Licenses A class "A" license shall entitle the person receiving
the license under this ordinance to sell malt beverages for consumption
on the premises. A class "B" license shall entitle the person receiving
the license under this ordinnnce to sell malt beverages ,. not tp be
consumed on the premises.
Yo person, firm, partnership, club, association or corporation
shall conduct a MALT B'TtTIAGF BUSINESS in any stand, room or rooms or
other enclosure unless he skail: or they shall have secured a license for
the same and paid to the Village Clerk the license fee for such establish-
ment as hereinafter set forth.
The semi-annual license fees for class "A" licenses shall be as

All licenses shall expire on the let day of January and the let day of July
of the next succeeding calendar year and the license fee shall be reduced '
in proportion to the full calendar months which have expired in the year
prior to the issuance of the license.
Section 4. Applications for License. Any person desiring a license under
this ordinance shall make application to the Village Clerk upon blanks
prepared and furnished by the Village, such application shall be sworn to

3. That he is a resident of the Village of Yorkville, Illinois.
4. That he has never been convicted of a felony.
5. That he is of good moral character. ,

n, . Each person desiring a Class "A" license 1hall execute
a penal bond in form and with security satisfactory to the license comm-
ittee, conditioned upon the faithful observance of the provisions of
the Law of the State of Illinois and:of this ordinance. Such bond shall
be in the sum of $200.00 and shall 'upon approval be filed in the office
of the Village Clerk.
Section 6. Investigation-Rejection or Approval of License.
The President of the Board shall appoint-a commmittee of three members of
the board who ,shall be known as-the Malt Beverage License Committee.
The Village Clerk shall refer applications for class "A" AND "B" licenses
to said committee and said committee shall investigate and report at the
next meeting of the Board of T rostees the approval or rejection of such
application. In the event the Board of Trustees directs the granting
of the license applied for, the President shall. forthwith, upon the
posting of bond as above provided in Class "A" licenses and upon the
payment, in advance of the license fee, direct the Clerk to issue a license
to such applicant. t
Section 7. Bear Parlor "losing time, and Opening. r?o beer parlor shall ,
remain open between the hours of 12 o'clock P. M. of any weak day and 6
o'clock A. M. of the next succeeding day.
Section 8. Certain Acts Prohibited. Yo colored glass, curtains,drapea
or partitions shall be hung or used behind or in connection with the street
windows or doors of any bear parlor to exclude the public gaze therefrom.
All bare or tables of any beer parlor or other establishment dealing in
malt beverages to be consumed on the premises must be in full view from
the street and no curtain or partition shall be used within the inside
of any beer parlor for the purpose of concealing or hiding anv person
within or patron of such place from the gaze of other persons within or
patrons of the same.
Section 9. Gambling Devices prohibited. No gambling device shall be kept '
or used for the purpose of gambling in anv beer parlor.

or under the influence of intoxicating liquor shall be permitted to
loiter or remain in or about any beer parlor. Any person selling or
giving away a malt beverage to a person under the age of 18 nears or to

any person under the influence of intoxicating liquor shall be subject to
the penalties hereinafter provided and the person having the license shall
be subject to suspension or revocation.
• Section 11. Revocation. of License. The Board of Trustees may suspend or
revoke any license issued under this act for violation of any of the
provisions of this ordinance or for the permitting any disorderly or
immoral practices upon the premisaa where the licensee is licensed to
sell malt beverages.
Section 12. Any ordinances in conflict with the provisions of this
ordinance are hereby repealed.
Section 13. All monies received undsr this act shall be used to enforce
the provisions of this ordinance and the overplus if any paid into the
General Fund of said Village.
Section 14. Whereas, it is necessary for the immediate preservation of
public lth and oaf sty, an urgency for its immediate passage is hereby �
declared to exist, this ordinance shall therefore take offset ten days
from and after its passage, signing and publication.
