Ordinance 1908-86 3 _ -1- WATERWORKS ORDINANCE. An Ordinance providing for the necessary reconstruction, repairing, enlarging, and extending the existing waterworks system of the village of Yorkville, Illinois, and for the payment of such improvements and fixing the rates at which water may be sup- plied for private purposes. SECTION I. Whereas, in order to obtain and maintain a sufficient supply of water for fire protection, and public and private use in the village of Yorkville, it 'is now necessary to change, replace, repair, enlarge and extend the present system of water-works of said village, and the money required to pay for such proposed improvement is not on hand and cannot be raised by ordinary taxation in any one year, and that the public interests will be promoted by the prompt making of said proposed improvement. It is therefore hereby ordered, that said proposed im- provement be made as soon ,as practicable, consisting of a suitable Cement Reservoir with a capacity of about Sixty-five thousand gallons sufficient to supply water for said purpose, with pumping engine and other necessary apparatus; laying new iron pipes to take the place of old wooden pipes, and elsewhere, making necessary changes, and repairs, and enlarging and extending said water-works system. Said proposed improvement to be made as nearly as prac- ticable according to the plans and specifications made by H. S. Hallet , a Civil Engineer, and acting Engineer for said village, now on file in the Clerk' s office of the village of Yorkville, to which reference is hereby made for greater particularity, and certainty. -2- SECTION II. It is hereby ordered that the sum of Seven Thousand Dollars, or so much thereof as may be necessary for said improvement be authorized to be paid out of the "Water Fund" of said village as hereinafter stated. SECTION III. That the money necessary to pay the cost of said improvement shall be raised by issuing and selling Certifi- } cates of Indebtedness of said village of Yorkville to an amount not exceeding Seven Thousand Dollars. SECTION IV. Said certificates shall be of the denomi- nation of One Hundred Dollars, and be due and payable according to the tenor and effect of each certificate, with interest thereon at five per cent per annum from the respective dates thereof. Said certificates and interest shall be payable at the office of the Treasurer of the village of Yorkville. SECTION V. Said certific:�.tes shall be of a suitable form and be signed in the corporate name of .the village of York- ville by the president of the Board of Trustees thereof, and be at- tested by the village clerk thereof, and have the corporate seal of said village impressed thereon, and when sold shall be dated and countersigned by the treasurer of said village. SECTION VI. That when saw certificates have been duly executed they shall be deposited with the said treasurer for sale by him for cash, for not less than their face value. The money arising from such sale shall be kept by said treasurer in a separate fund to be k;Ilown and called the "Water- works System Enlarging and Extending Fund" , and shall be expended only in the improvement of said water-works system, as before stated y SECTION VII. That the entire proceeds arising from the operation of the water-works system so improved shall be paid into a fund known as the"Water Fund" to be kept for the sale purpose of paying said certificates of indebtedness and the necessary op- erating expenses of said water-works system. SECTION VIII. That the rates for supplying water for private purposes under this ordinance shall be the same as are now provided by ordinance of said village passed and apr roved"November 25, 1887 ; and such rates shall not be reduced until all of the said c-ertificates and interest thereon shall have been fully paid. SECTION IX. This ordinance is drafted in accordance with an act entitled "An Act authorizing cities, towns and villages to build, purchase ar extend water-works systems for public and domestic use, and to provide for the costs thereof. The village of Yorkville hereby reserves the right to pay any of the certificates that may be issued under this ordinance at any time after one year from the date of such issue. SECTION XI. This ordinance shall be in full force and effect from and after its passage, ap-?roval and due publication for three successive weeks, pursuant to mid "statute.
