Preliminary Plan Comments reviewed by Joe Wywrot, City Engineer of
preliminary plan dated 1112106 and received

• The plan should be submitted to IDOT, Yorkville-Bristol Sanitary District, and
Bristol-Kendall Fire Protection District for review.
• Submit a stormwater management report for review. We have not received the
report yet,which is needed to address offsite flows,the detention basin sizing and
outfall, etc. It is important to have at least a preliminary report at this time that
adequately addresses these issues. Until this report is reviewed and approved,
the preliminary plan should not be sent to City Council for approval.
• Prepare and submit a field tile survey for review.
• Add a note stating that approval of all private lot developments shall be handled
separately.
• Add a note stating that hydrant, valve, and manhole locations, as well as
watermain sizing, sewer sizing, and easement dimensions shall be addressed
during final plan design.
• The embankment slopes of the detention basins appear to be 4:1. The maximum
allowable slope is 5:1.
• The top of the detention basin embankment slopes should be at least 10 feet from
the ROW line.
• Add a note stating that the existing driveway and access to Route 47 shall be
abandoned after the new roadway is constructed.
• Show depressed curb running through the 4 driveway entrances near Stations
104+00 and 105+50.
• The streetlight near at Sta. 102+00 should be moved to the common lot line
between Lots 12 and 13. The streetlight near Sta. 105+00 should be moved to the
east to also provide to light to the proposed driveway entrances.
• Storm sewer trunk lines should not flow through curb drains. Revise to show the
storm sewer extending east from Sta. 106+00 to the storm sewer crossing the road
near Sta. 107+00. Delete the storm sewer draining to the north basin from the set
of curb drains near Sta. 106+00.
• This property is proposed to be located in the same water pressure zone as
Raintree Village. The anticipated water pressures on the first floors will be in the
72-76 PSI range.
• Call for a valve to be cut into the existing 12"watermain on Route 47 between the
two connection points for the new watermain.
Preliminary Landscape Plan reviewed by Laura Haake ofpreliminary landscape
plan dated 519106
1. All Acer x fremanii `Autumn Blaze' and Acer x fremanii `Morton' must be
removed from the plan and substituted with an approved species.
2. Indicate the location of all freestanding electrical equipment(i.e. street lamps and
parking lot lights) as well as fire hydrants on the landscape plan. All parkway
trees shall be a minimum of 20' (twenty feet) from these items.

Background:
1. Plan Commission reviewed the annexation, rezoning and Concept PUD
plan July 12, 2006 and acted as follows:
• Annexation—unanimously recommend approval
• Re Zoning to PUD - unanimously recommend approval subject to staff
comments and to comply with current City zoning standards
Staff Comments:
- This should move forward to City Council August 8, 2006 for a Public
Hearing on Annexation request(Concept PUD only requires a public hearing
at Plan Commission).
- The property is currently zoned A-1. Based on the mix of land uses proposed
for this property,the PUD zoning classification would be appropriate.
- The City has requested this property owner to annex to the City of Yorkville.
The zoning appropriate for this property is PUD based on the mix of uses
recommended by the Comprehensive Plan.
- This property consists of approximately 175 acres and includes the land area
between the Rob Roy Creek and Rt 47 (west of 47).
Comprehensive Plan Recommendations
The Comprehensive Plan Land Use Plan recommendation is Commercial north of the
Commonwealth Edison power lines and Transitional Neighborhood(gross density up to
3.5 units per acre) south of the power lines with Park/Open Space along the
Commonwealth Edison property.
Concept Plan Comments
1. The Concept Plan is substantially consistent with the Comprehensive Plan.
2. The Total number of units should be 506 (not 810 as depicted on the plan
submitted)with the units proposed per land use type area.
3. The density is incorrect at 3.8 units per acre. With the unit count proposed and
the acreage amounts depicted the correct gross density is 5.16 units per acre
4. The most intense zoning classification is currently R-4 which permits 8 units per
acre. At the time the City began discussions with this property owner,the Zoning
Ordinance permitted 12 units per acre in R-4 classifications. The proposed 18
acre multi-family/condo area is proposed with 16 units per acre.
5. Stormwater will be managed offsite by the Raymond Regional Stormwater
Facility(to south of property). This allows more developable land on the property
and would enable the property to sustain a higher density.
6. The gas station is a Special Use permit and should NOT be permitted as part of a
Concept PUD Plan. In the event a gas station is proposed for this property, a
Special Use permit would require an additional public hearing process.
Staff Recommendation—approve the concept plan with the removal of"gas
station" from the commercial area.

and requested additional information which will be reviewed July 26,
2006.
Staff Comments:
- This should move forward to City Council August 8, 2006 for a Public
Hearing on Re-zoning request and Preliminary PUD plan(Concept PUD only
requires a public hearing at Plan Commission).
- The property is currently zoned A-1. Based on the mix of land uses proposed
for this property,the PUD zoning classification would be appropriate.
PUD Concept Plan Comments
Staff Recommendation:
An appropriate land use between the proposed commercial area and the exiting single
family detached neighborhood(Kylan's Ridge)would be Transitional Neighborhood as
defined by the Comprehensive Plan.
Staff recommends permitting a transitional land use for the proposed residential
with a maximum density of 3.5 units per acre.
Preliminary PUD Plan Comments:
Following the July 12, 2006 Plan Commission meeting,the petitioner was delivered the
following items to address prepared by Chairman Tom Lindblom by the July 26th Plan
Commission meeting:
1. Stormwater concerns
a. Staff advised petitioner to explain the stormwater facility and
address the EEI June 16th comments regarding stormwater.
2. Provide a second access to Lot 51
a. This is the northwestern townhome area.
3. Minimize traffic on Cannonball.
a. Petitioner is recommending an additional access point from
development to Cannonball Trail to allow traffic to exit closer
to Route 34 to alleviate some traffic from Cannonball Trail—
EEI is reviewing this alternative and will report their
recommendation separately.
4. Lighting to be minimized.
a. Staff advised petitioner to address how this will occur by
providing the required photometric plan.
5. Creation of truck routes during construction and thereafter
a. Staff advised petitioner to designate Beecher as truck
entrance/delivery route with signage.
6. Distances between townhomes (50')to narrow.
7. Reduce overall density.
a. Staff advised to reduce density by eliminating some townhome
units (possibly on lot 52 which would also address the distance
between buildings and parking issue.
The Preliminary Plan substantially complies with the proposed Concept PUD Plan

Comprehensive Plan Recommendations
The Comprehensive Plan Land Use Plan for the area predominately recommends
Commercial with Transitional Neighborhood at the eastern and southern fringes of the
property. The B-3 zoning classification requested is appropriate and supported by
the Comprehensive Plan for this property.
The Comprehensive Plan also recommends an east to west street connection from Rt 47
across the property to the property adjacent to the east. The proposed plan provides
this street connection.
General Comments
Route 47 Improvements:
Route 47 improvements including an additional two lanes (for a four lane cross section)
between Corneils Road (south)to Baseline/Route 30 (north)has been proposed by the
City and endorsed by IDOT. The conceptual design for this improvement has been
prepared by EEI along with right-of-way delineation necessary for the improvements.
Phase I and Final Engineering are the next steps and subject to funding. The annexation
agreement for this property should include some language/provisions regarding a
contribution toward this funding—the petitioner has been working with staff to arrive at a
fair and equitable contribution toward this end.

INTERGOVERNMENTAL AGREEMENT
BETWEEN
COUNTY OF KENDALL
AND
THE UNITED CITY OF YORKVILLE
This Agreement is made as of ,2006,by and between the COUNTY OF KENDALL,
a body corporate and politic and a unit of local government of the State of Illinois ("Kendall
County', and the UNITED CITY OF YORKVILLE , a body corporate and politic and a unit
of local government of the State of Illinois("Yorkville').
Recitals
This agreement is based upon the following recitals:
(1) Article VII, §10 of the 1970 Illinois Constitution, as well as the Intergovernmental
Cooperation Act(5 ILCS 220/1 et seq.)permit units of local government to contract and jointly
exercise, combine or transfer any power,privilege, function,or authority among themselves.
(2) Kendall County and Yorkville,under their respective general powers,may otherwise
agree between themselves as to development of land located within Yorkville.
(3) Road planning by Yorkville contemplates the construction of a new roadway(named
"Beecher Road")near the western boundary of the current Kendall County governmental
complex on the South Side of U.S. Route 34 in Yorkville, as more specifically set forth on the
attached Exhibit"A"(Plat of the new Beecher intersection).
(4) To facilitate the construction,the roadway will fall upon approximately .82 acres of land
currently owned by Kendall County,which will be conveyed to Yorkville under the authority of
this agreement, for the mutual benefits of the parties to this agreement.
(5) As additional consideration to Kendall County under this agreement, Kendall County
shall be relieved and any obligation for improvements of the intersection of U.S. Route 34 and
the new Beecher Road, or the construction of Beecher Road along the western boundary of the
Kendall County governmental complex.
(6) As additional consideration to Kendall County under this agreement,Yorkville shall
provide for the construction of a storm water outfall under Beecher Road generally in a
southwesterly direction to be used by Kendall County, at no cost to Kendall County.
(7) As additional consideration to Kendall County, Yorkville agrees to allow a connection to
Beecher Road from the Kendall County governmental complex at some future date,the
construction of said connection shall be borne by Kendall County.
For the mutual benefits contained herein, the sufficiency of which is hereby
acknowledged, the parties hereto agree as follows:
A. The recitals, above, are hereby incorporated herein by this reference, and shall be
considered material and binding provisions of this agreement.
B. Kendall County agrees as follows:
(i)It shall convey to Yorkville by deed, or plat of dedication (to be determined solely at
Yorkville's discretion)the area owned by Kendall County described on Exhibit"B" (legal
description of the .82 acre parcel to be conveyed to Yorkville).
(ii) It shall be responsible for any costs associated with any future connection to Beecher
Road, and will cooperate with Yorkville and the adjoining land owner to the west to locate the
future access to provide for safe and efficient traffic flow while serving the needs of the property
owners and Yorkville.
(iii) It shall not be monetarily obligated, other than as described in(ii) immediately
above, for any improvements to the U.S.Route 34 and Beecher Road intersection or the
extension of Beecher Road along the western boundary of the government complex.
C. Yorkville agrees as follows:
(i) It will except the conveyance of the .82 acre parcel to by used for roadway, and if
necessary other City infrastructure needs.
(ii) It shall not collect, nor attempt to collect any monetary amount from Kendall County
for the improvement of the U.S. Route 34 and Beecher Road intersection or the extension of
Beecher Road along the western boundary of the government complex, acknowledging that
Kendall County shall be responsible for the cost of any future connection to Beecher Road as
agreed in Section B(ii), above.
(iii) During the construction of Beecher Road, it shall provide an appropriate outfall
pipe under Beecher Road for stormwater conveyance from the Kendall County governmental
complex to the land west of Beecher Road, and furthermore cause said outfall to be incorporated
into the stormwater management plans of any development to the west of Beecher Road.
However, it is understood and agreed by Kendall County that it must adhere to Yorkville
stormwater standards in connection to the outfall pipe.
D. Miscellaneous
(i) This agreement constitutes the entire agreement and supersedes all prior agreements and
understandings, both written and oral,between the parties hereto with respect to the subject
matter hereof, and no party shall be liable or bound to the other in any manner by any
representations or warranties not set forth herein.
(ii) This agreement and the rights of the parties hereunder may not be assigned(except by
operation of law), and the terms and conditions of this agreement shall inure to the benefit of and
be binding upon the respective successors and assigns of the parties hereto.Nothing in this
agreement,express or implied, is intended to confer upon any party, other than the parties and
their respective successors and assigns, any rights, remedies,obligations or liabilities under or by
reason of such agreements.
(iii) This agreement may be executed in one or more counterparts, each of which shall for
all purposes be deemed to be an original and all of which shall constitute the same instrument.
(iv) All notices required or permitted hereunder shall be in writing and may be given by(a)
depositing the same in United States mail, addressed to the party to be notified,postage prepaid
and certified with return receipt requested, (b) delivering the same in person,or(c)telecopying
the same with electronic confirmation of receipt.

or at such other address or counsel as any party hereto shall specify pursuant to this section from
time to time.
(v) Time is of the essence with respect to this Agreement.
(vi) In case any provision of this agreement shall be invalid, illegal or unenforceable, it shall,
to the extent possible,be modified in such manner as to be valid, legal and enforceable but so as
to most nearly retain the intent of the parties, and if such modification is not possible, such
provision shall be severed from this agreement, and in either case the validity, legality and
enforceability of the remaining provisions of this agreement shall not in any way be affected or
impaired thereby.
(vii) No right,remedy or election given by any term of this Agreement shall be deemed
exclusive but each shall be cumulative with all other rights,remedies and elections available at
law or in equity.
(viii) This agreement shall be in full effect and legally binding at such time as an ordinance
or resolution authorizing its execution has been passed and approved by both parties. A certified
copy of such ordinance or resolution entering into this agreement shall be filed by each party at
the office of the other within 30 days of passage and approval.

SOUTH AREA JOINT ENGINEERING FUNDING AGREEMENT
NOW COMES the United City of Yorkville,hereinafter referred to "CITY"and
(insert names of owners and developers) "OWNERS/DEVELOPERS",who in
consideration of entering into this SOUTH AREA JOINT ENGINEERING FUNDING
AGREEMENT and the mutual benefits provided to each of them,the sufficiency of
which is hereby acknowledged, agree to the following terms and conditions:
WITNESSETH
WHEREAS, OWNERS/DEVELOPERS seek to annex certain land to the City
and develop certain land depicted on the map attached hereto and incorporated as Exhibit
"A"(hereafter"THE DEVELOPMENTS"),and
WHEREAS, OWNERS/DEVELOPERS desire to expedite the preparation of
engineering design for the water works system and sanitary sewer system improvements
that will extend to serve the developments (hereinafter"ENGINEERING DESIGN") ,
and
WHEREAS, CITY and OWNERS/DEVELOPERS anticipate that the
ENGINEERING DESIGN will be useful in the obtaining final funding for the water and
sanitary sewer improvements
WHEREAS, OWNERS/DEVELOPERS agree to provide funding for said
ENGINEERING DESIGN in the amounts and under the conditions set forth herein.
WHEREAS, the City has agreed to permit OWNERS/DEVELOPERS to expedite
the preparation of said ENGINEERING DESIGN prior to any approvals being made or
guaranteed, conditioned, however, upon OWNERS/DEVELOPERS agreeing to hold the
City, its agents and assigns, harmless from claimed or actual any loss, liability or
damages in connection with OWNERS/DEVELOPERS' activities in obtaining the
engineering design, and
WHEREAS, OWNERS/DEVELOPERS, the City and Engineers agree that all
physical data, design layouts and plans, blueprints, surveys, reports and any other work
product created by Engineers for said water works system and sanitary sewer system
improvements shall be the property of the City.
WHEREAS, it is the City's intention to work with the Owners/Developers to
issue bonds for the funding of the construction of the water works system and sanitary
sewer system and CITY and OWNERS/DEVELOPERS anticipate that the
ENGINEERING DESIGN will be useful in the obtaining final funding for the water and
sanitary sewer improvements, and
WHEREAS, if said funding via issuance of bonds occurs, City anticipates
providing for reimbursement to Owners/Developers of the amounts paid for the
ENGINEERING DESIGN as defined and described in this Agreement.
NOW, THEREFORE, in consideration of the sum of One Dollar ($1.00) and
other good and valuable consideration, the receipt and sufficiency of which is hereby
acknowledged,the parties hereto agree as follows:
1. The recitals are material to this Agreement and are incorporated as part of
this Agreement by this reference.
2. Attached hereto and incorporated herein as Exhibit"A" is a map depicting
the OWNERS/DEVELOPERS' property, which it seeks to develop (THE
DEVELOPEMENTS).

3. OWNERS/DEVELOPERS shall pay all costs incurred with Engineers in
connection with the ENGINEERING DESIGN of said water works system and sanitary
sewer system improvements. OWNERS/DEVELOPERS shall pay the specified initial
deposit to the City, and continue to pay in advance to the City the amount specified by
Engineers for further development of said water works system and sanitary sewer system
improvements, and pay in accordance with the Water and Sanitary Sewer Improvement
Expenditure Schedule attached hereto and incorporated herein as Exhibit"AAA"
4. OWNERS/DEVELOPERS and the City agree that the initial phase of the
water works system and sanitary sewer system improvements shall include, but not be
limited to:
a. G.1 —5.0 MG Stand Pipe Water Storage Tank
b. G.2—Well No. 10 (Shallow Well)
C. G.3 - Well No. 11 (Shallow Well)
d. GA—Well No. 12 (Deep Sandstone)
e. G.5 - Wells No.10, 11 and 12 Water Treatment Plant
f. G.6—Route 47 Water Main
g. Contract No. lA Sanitary
h. Contract No. 2 Sanitary
i Contract No. 3 Sanitary
j Contract No.4 Sanitary
k. Contract No.5 Sanitary
1. Additional system improvements and phases as may be required by
the City to accommodate the OWNERS/DEVELOPERS' proposed
plans.

5. OWNERS/DEVELOPERS and the City agree and guarantee that any reports, test
results, concept plans, design plans and specifications, drawings and any other work
product of Engineer for said ENGINEERING DESIGN of the water works and sanitary
sewer system improvements shall be the property of the City and shall be turned over to
the City upon the City's request, provided, however that OWNERS/DEVELOPERS is
furnished copies of said reports, test results, concept plans, design plans and
specifications, drawings and any other work product of Engineer for said water works
and sanitary sewer system improvements.
6. No representation or agreement has been concluded by the City
guaranteeing the annexation, zoning or planned development district approval of the real
property (THE DEVELOPMENTS) of OWNERS/DEVELOPERS.
7. In the event that annexation or other approvals to allow development of
the property are denied by the City or third parties, the parties agree that no refund or
reimbursement shall be made by the City to OWNERS/DEVELOPERS for any work or
payments made on said projects.
8. If the City issues bonds, or obtains funding for the water works and
sanitary sewer system improvements, then the City intends to obtain funding in an
amount sufficient to reimburse OWNERS/DEVELOPERS for the amounts paid pursuant
to this Agreement.
9. OWNERS/DEVELOPERS acknowledge that it is proceeding at its own
risk in proceeding prior to any approvals being granted to the property.
10. All exhibits attached hereto are incorporated herein by reference.
11. The final annexation agreement between OWNERS/DEVELOPERS and
City shall, if entered into between the parties, supersede this Agreement in its entirety.

12. Due to the number of parties signing this agreement, counterparts may be
individually signed and assembled by the City,which shall be deemed one Agreement.
IN WITNESS WHEREOF, the parties have executed this Agreement this
