Additional Business Page 1 of 4 PUBLIC SAFETY COMMITTEE YORKVILLE CITY HALL CONFERENCE ROOM DRAFT Thursday, March 9, 2006 Committee Chairman Rose Spears called the meeting to order at 6:30 p.m. Present Alderwoman Rose Spears, Aldermen Dean Wolfer, Jason Leslie and Jim Bock, and Police Chief Harold Martin. Guests Mayor Art Prochaska and Heather Gillers from the Beacon News. 1. Minutes for Approval/Correction—Minutes from the Nov. 10, 2005 meeting were approved. However the minute taker's name needs to be added to the minutes. Minutes from the Jan. 12 and Feb. 9, 2006 meetings were approved without revision. 2. PS 2006-09—Police Reports for February 2006 Police Chief Harold Martin said the department is on track as for as overtime for a department of its size. He said the department cut back significantly on overtime when it went to 12-hour shifts. Chairman Spears noted increases in sex offenses and the number of uninsured motorists. There was one reported sex offense in 2005, yet in 2006, there already have been six, she said. Chief Martin said most of the cases have been domestic issues. Likewise, Spears noted the number of tickets for uninsured motorists was 437 in 2005 and already there have been 116 tickets issued in 2006. Mayor Art Prochaska said the volume of tickets for that offense isn't a reflection on Yorkville. Most of the tickets issues are to people who live in other communities. The committee agreed to move the February Police Report to the Committee of the Whole to be placed on the consent agenda. 3. PW 2005-16 Heartland Circle Construction Traffic The committee revisited the issue as to whether construction traffic should be rerouted from Heartland Circle to Spring Street. Spears said when the issue was last discussed the committee wanted to see the original agreement. There was a lot of controversy when the Heartland Circle development was proposed to the city and the city tried to please the developer and current residents on Spring Street by coming up with the traffic agreement. She said the understanding is that the construction traffic would be routed through Heartland until construction of Heartland Circle was complete. However, the developer was under the impression that as long as most of the construction was completed, the Spring Street ban could be lifted, she said. Wolfer said the Public Works Committee looked at the issue and voted to honor the original agreement. Spears said she agrees with that decision and said the city should Page 2 of 4 stick to the original agreement. The committee agreed. It was decided to have the city attorney draft a letter to inform the homeowner's association about the decision of the two committees. Mayor Prochaska asked to discuss the handicapped parking update and the smoking ban issue before he had to leave. The agenda was changed to discuss those items. 4. Handicapped Parking Update Chief Martin said signs have been ordered to post the new $250 fines for parking in handicapped parking spots. Mayor Prochaska said the city should make sure the signs are clearly posted in the proper places. The Public Safety Committee agreed there would be a zero-tolerance policy and that all offenders would receive a fine rather than a warning. Additional Business Mayor Prochaska said the city might start looking into smoking bans for restaurants and taverns, but that the city would need to move very cautiously on the issue. Leslie said the city would need to look into what control it might have over the issue. He said it might be something home-rule communities can do easier. The committee decided to explore the issue more fully next month. 5. PC 2005-13 Countryside Parkway—Address Changes Because the center of the city is shifting, Countryside Parkway isn't the divider and for public safety issues, the addresses of those who live or operate businesses on that road would have to change. Chief Martin said it isn't a public safety issue yet, but it could be in five to 10 years. He said it would be nice to get the addresses changed, yet he understands it would be a burden for those who live or own businesses on the road. It also would be a financial burden for the city, which would incur the costs of the address changes. About four homes and a medical building would be affected. Spears said she'd like to meet with the individuals that would be affected to get their opinions. She also would like to know what the actual cost to the city would be. For now, the committee decided to send the matter back to the Public Works Committee to get a checklist on what would be involved and get a more definite idea of the potential cost. 6. PS 2006-10 Swanson Lane Estates—Address Changes Chief Martin said he didn't have any information other than what was in the letter. He said he'd need more information before he made a recommendation. The letter came from the city's engineering assistant Jennifer Fischer stating that there are two existing homes in the Swanson Lane Estates Subdivision. The letter suggested that the addresses of those two homes be changed to a number and name consistent with the other homes surrounding them. The letter asked that the item be discussed at the Public Safety meeting. Page 3 of 4 Chief Martin said he would get more information and the matter might go to Public Works before it came back to Public Safety. Spears suggested that the developer pay for the costs of changing the addresses, not the city. 7. PS 2006-11 Request for Out of State Conference Chief Martin said the request comes from Officer Jon Helland, the school resource officer, to attend the National Association of School Resource Officers conference in Pal Springs, California. Martin said the conference would be beneficial and he recommended the request be approved. The committee agreed to approve the request. Also, Spears suggested the officer rent a larger car for the trip. The committee agreed to upgrade the car in a unanimous roll call vote. Leslie, Wolfer, Bock and Spears all voted yes. 8. PS 2006-12 Records Request Fee Schedule Chief Martin requested the police department be allowed to charge fees for those who request certain records. He said the fees are in range with what other police departments charge. The committee agreed to the fee schedule. Spears also suggested the fees be posted so residents know what they are. 9. PS 2006-13 Request to Purchase—Squad care DVD recording server Chief Martin said the department would like to purchase a DVD recording server to store DVD recordings and improve on the system it already has. Right now, the only way the department has to back up the DVD is to burn the recordings. A bid for the server was submitted by Software Performance Specialists, Inc. for $9,858. Spears said this particular request doesn't have to go out for bid, but she suggested that in the future, the department seek competitive bids. The committee agreed to move forward with the purchase. 10. PS 2006-14 Budget Request—Policing Software—Fiscal Year 06/07 Chief said if there's any money left in the budget, he requests that the purchase of New World Software be a priority. In the request, the chief noted the purchase of the software would allow Yorkville officers and records to share information such as names, histories and cases with other departments. Also, with the system, record keeping and retrieval would be more productive. Spears agreed that the purchase of the system is very important and yet it keeps getting placed on the back burner. She said she would be in favor of approaching the city council about adopting a public safety fee or finding other means to fund the purchase. Chief Martin said he would keep the committee updated on ways to finance the purchase. Page 4 of 4 11. PS 2005-11 Skate Boards and Motorized Scooters Update Wolfer said he would get information from other communities and bring the issue back to the committee. 12. Overnight Parking Update Chief Martin said the department is working on the appropriate forms to correspond with the ordinance. He says the ordinance states that 100 percent of residents on a cul-de-sac would have to give their approval for a cul-de-sac opt out petition. However Spears mentioned maybe an 80 percent approval would be more appropriate. Chief Martin said he hasn't issued tickets to people that are in difficult situations and are trying to work with the city. The committee agreed to recommend changing the ordinance to 80 percent approval. Spears also said that the city should have a petition for overnight parking. Chief Martin said that in some cases id a hardship is determined the city would allow overnight parking for up to a year. 13. Additional Business *Wolfer said he's continuing to work on bringing a 9-1-1 camp to Yorkville. *Spears said Mayor Prochaska asked the committee to look at limiting the number of stores that can sell liquor. She said that issue would be discussed next month. * Chief Martin said the department is continuing to work on a business registration form. Without your extensive research, evaluation and communications with neighboring communities and Waubonsee Community College this program may never have been considered. The Police Cadet Program has proven to be a very successful, cost savings program that provides a strong link to assist the Yorkville Police Department in providing a safe community. It is evident that the extremely successful Yorkville Police Cadet Program will expand and continue for many years. The current price is $2,495.00. Currently, Aurora Police Department is the only agency,that I am aware of,that owns this equipment. I have asked for their assistance on two separate crashes, in Yorkville, where this data greatly helped me in my investigations. In summary, almost all new vehicles these days are being equipped with the ability to record certain data during a crash. A lot of this data is retrievable. Some of this data includes the status of seat belt usage during the crash, vehicle speed at time of crash, as well as speed five seconds prior to the crash, braking status,time from initial impact to time of air bag deployment, as well as a lot of other important factors. As I earlier mentioned, I have needed this information on two separate cases I worked on. One case, it provided me with a speed of one of two vehicles that struck nearly head-on on Rt.47 by Corneils Road. In this case, one driver could not recall his speed and the other retained an attorney who would not let me talk to his client. Without a speed from either vehicle, and no pre-impact skid marks, there was no applicable speed analysis formula I could use. However, once I obtained the CDR reading from one of the vehicles,thus a speed, I was able to use a math formula(In-Line Linear Momentum)to determine all the things I wanted to know regarding the crash. I also used this information for a double fatality crash, on Rt. 47 south of Cannonball Trail, to get a Crash Pulse reading on a vehicle and seat belt use indicator reading. Again, I had two deceased individuals in one vehicle and no pre-impact skid marks from their vehicle. This made it a bit difficult to get their version of the events prior to the crash. This data was also used in a fatality crash, approximately three years ago, by the Illinois State Police while investigating a Reckless Homicide on Rt.47 in Yorkville. The Trooper investigating this crash utilized this evidence also. A: There are two types of air bag module (SDM) recorded crash events. The first is the non-deployment event. A Non-Deployment event is an event severe enough to "wake up"the sensing algorithm but not severe enough to deploy the air bag(s). It contains Pre-Crash and Crash data. The SDM can store up to one Non- Deployment Event. This can be overwritten by an event that has a greater SDM recorded velocity change (Delta-V). This event will be cleared by the SDM after the ignition has been cycled 250 times (about 60 days of normal driving). Q: What is a Deployment Event? A: The second type of SDM recorded crash event is the Deployment Event. It also contains Pre-Crash and Crash data. LICENSEE: Any person who procures from the City a license sticker for a bicycle or three wheel bicycle. OPERATE: The word "operate" or any form or tense thereof shall mean and refer to the use, putting into action or causing to function of a bicycle or three wheel bicycle by a person mounted thereon. RENTAL AGENCY: Any person engaged in the business of offering for rental and renting bicycles (including three wheel bicycles) for hire by the public. THREE-WHEEL BICYCLE: Means and includes a vehicle with three (3) wheels, any one of which is at least twenty inches (20") in diameter, with solid or pneumatic tires, having a steering bar or wheel and propelled by human power. This term shall be included in each instance in this chapter where the term "bicycle" is used. In addition to the above definitions any applicable definitions of the traffic ordinance shall be deemed to be included herein. 10-5-2 REGISTRATION AND LICENSE REQUIREMENTS: (A) Registration: License Sticker: The City of Plano, acting trough its Police Department will register bicycles at no cost to the person registering the bicycle. This is done at the station of Plano Police Department, Plano, Illinois. (B) Application: Application for registration for a bicycle shall be made by the owner in person, in writing, in triplicate, upon blank forms furnished by the Police Department. Such application shall be signed by the owner, and if the owner is a person under eighteen (18) years of age, the signature shall be witnessed by a parent of the owner, or by the legal guardian of the owner. The application shall state the full name and address of the owner of the bicycle, the name of the manufacturer, the serial number of the frame, the approximate date when the owner obtained title thereto, and if not new when obtained, the name and address of the person from whom it was obtained. Such application shall be presented to the Police Department or any of its authorized representatives. The bicycle to be registered and licensed shall be brought to the station at the time of presenting the application for the purpose of examination. The Chief of Police or any of his authorized representatives shall examine the bicycle, and if he finds the mechanical condition thereof such that it can be safely operated, and that it is equipped with attachments as herein provided, and further finds that the statements made in the application are true, he shall mark the application "approved" and attach his signature. If he finds the equipment to be faulty or deficient, he shall require the necessary corrections to be made before issuing a license. When the bicycle has been found to be in proper condition and the application to be correct, the Chief of Police or any of his authorized representatives shall deliver to the owner a copy of the bicycle registration card which shall contain the name and address of the owner and the description of the bicycle contained in the application. The applicant shall affix his signature to the registration card when issued in the presence of the Chief of Police or any of his authorized representatives, who shall, with said certificate, also issue to the owner a license sticker which the word "Plano" and the number of the license. The registration card and the license sticker shall have the same number. The license sticker shall be attached to the bicycle at the location prescribed by the Chief of Police or his representative. After the issuance of the registration card and license sticker the Chief of Police or any of his authorized representatives shall endorse upon all copies of the application the date of issuance and the number thereof. The original and one duplicate application shall be kept on file in the office of the police department. (C) Term of License: Each license shall be issued to a bicycle for it's life or until ownership is transferred. (D) Loss, Sale, or Destruction of Bicycle; Surrender of License: When any bicycle which has been registered and licensed, as herein provided, is sold or is otherwise disposed of or destroyed, the licensee shall immediately surrender to the Chief of Police or any of his authorized representatives, the registration card and the license sticker issued therefore, with the name and address of the new owner, if any, written on the face of the registration card; and the Chief of Police or any of his authorized representatives shall immediately make proper endorsements thereof on his records and retain the card and license sticker. A new card and license sticker shall be issued to the new owner upon proper application being made by the owner. (E) Loss of License Sticker: The licensee shall report immediately to the Chief of Police or any of his authorized representatives, the loss or destruction of the license sticker of the licensee, and the circumstances surrounding the loss or destruction thereof. With the approval of the Chief of Police or any of his authorized representatives, a duplicate license sticker shall be issued. In the event that repeated requests are made for duplicate licenses for the same bicycle, the Chief of Police may require payment of one dollar ($1.00) for such duplicate license to defray the cost of furnishing duplicate licenses. 10-5-3 RULES FOR RIDING OPERATING: (A) Riding Abreast Prohibited: When more than two (2) persons in a group are operating bicycles on a roadway, they shall ride single file. (B) Clinging to Vehicles: No person operating a bicycle shall cling or attach himself or the bicycle to any other moving vehicle. (C) Extra Passengers: No bicycle shall be used to carry more persons at one time than the number for which it is designed and equipped. (D) Emerging From Alley, Driveways, and Garages: The operator of a bicycle emerging from an alley, driveway, garage, or private sidewalk shall stop the bicycle immediately prior to driving into or across a public sidewalk line projected across an alley, and shall exercise extreme care in making such movements. (E) Intoxication, Drugs, or Physical Inability: No person shall operate a bicycle while under the influence of liquor or drugs or while physically or mentally unfit to safely operate the same. (F) Lights: No bicycle shall be operated within the period from sunset to sunrise without having a properly lighted headlight attached to the front of the bicycle, visible under normal atmospheric conditions from the front thereof for a distance of not less than five hundred feet (500'), nor without having a red light or a reflector attached to the rear of the bicycle which is clearly visible in the headlight beam of a motor vehicle for a distance of not less than two hundred feet (200') to the rear of the bicycle. G) Mechanical Condition: No person shall operate a bicycle which is not in such mechanical condition so that it can be safely operated. (H) Operating On Sidewalk: Bicycles may be operated on sidewalks in public parks and in residential districts but in single file only. Under all circumstances, the rider shall yield the right of way to pedestrians using the sidewalk, and due and proper care shall at all times be exercised by the rider for the pedestrians. When approaching a pedestrian on the sidewalk, the speed of a bicycle shall be reduced to a speed which is not greater than necessary to continue the operation of the bicycle without the rider dismounting and shall not be increased until the pedestrian has been passed. (I) Parking Bicycle: It shall be unlawful to park any bicycle along buildings in such a manner as to interfere with pedestrians, or along roadways where they may interfere with traffic, or with persons getting into or out of motor vehicles. No person other than the owner or operator shall move or in any manner interfere with any bicycle properly parked, nor shall any person interfere or in any manner hinder any person from properly parking a bicycle, except that members of the Police Department and Fire Department may move, or, in proper cases, prevent the parking of the bicycle when, in the judgment of the policeman or fireman, his action is necessary in order to properly safeguard persons or property. Bicycles can be parked at permitted bicycle racks. (J) Right; Keep to: All bicycles when operated on roadways shall be kept to the right and shall be operated as near as practicable to the right hand edge of the roadway. (K) Speed: No bicycle shall be operated at any time faster than is reasonable or proper, and every bicycle shall be operated with reasonable regard to the safety of the rider and of other persons and property. (L) Traffic Regulations: Every person operating a bicycle shall strictly observe all traffic signs and signals and all other traffic rules and regulations applicable thereto, and shall obey the orders and directions of every officer of the City authorized to direct or regulate traffic. (M) Trick Riding: No person shall, while operating a bicycle, indulge or engage in any kind of trick or unsafe riding. (N) Turns: Starting; Stopping: The operator of a bicycle on a roadway when making a right turn, shall follow the right hand edge of the roadway, and the operator of a bicycle on a roadway when making a left turn shall approach the point of turning in the traffic lane nearest the center of the roadway. No operator of a bicycle shall start, slow down, or stop or attempt to turn without first indicating such movement as provided by law. 10-5-4 SKATE BOARD, ROLLER WHEEL and SIMILAR DEVICES: (A) The use of skateboards, roller skates, ice and ski roller skates, or any other such roller wheel device is prohibited on the streets, roads, sidewalks and parking lots in any business, commercial or manufacturing district in the City of Plano. (B) SIGNS: Municipal authorities of the City of Plano are hereby authorized and required to place and maintain, or cause to be placed and maintained, signs prohibiting the use of the above referenced roller wheel devices in any business, commercial or manufacturing district in the City of Plano, such signs to be located in such position and to be provided with letters of a size that can be clearly legible. 10-5-5 RENTAL AGENCIES : (A) Registration and Licensing: It shall be unlawful for any person, firm or corporation to rent or offer to rent any bicycle without first complying with the provisions of section 10-5-2 of this Chapter relating to registration and licensing of bicycles. All such bicycles rented by the agency shall be licensed as therein provided. (B) Equipment: Bicycles offered for rent by a rental agency shall be equipped with the lights and other equipment required by this chapter and shall be kept in good and safe working condition. Rental agencies shall comply with all the provisions of this chapter and shall be responsible for the condition of the bicycles they rent. (C) Inspection: The Chief of Police or any of his authorized representatives shall make periodic inspections of the rental agencies to ensure compliance with the provisions of this chapter. 10-5-6 OTHER PROVISION: (A) Inspection: Any member of the Police Department is authorized to inspect any bicycle at any reasonable time for purposes of making a checkup of the license number and serial number and for the purpose of determining the mechanical condition of the bicycle. (B) Removal of Serial Number or License Plate: It shall be unlawful for any person, willfully or maliciously, to remove, destroy, mutilate, or alter the serial number of any bicycle licensed hereunder, or to remove, destroy, mutilate any license sticker or registration card during the time in which the license sticker or registration card is in force. The Chief of Police or any of his authorized representatives are hereby authorized to stamp numbers of the frame of a bicycle in a legible manner for identification purposes upon which no serial number can.be found or upon which the serial number can be found or upon which the serial number is illegible or insufficient for identification purposes. (C) Use of Bicycle Without Consent of Owner : It shall be unlawful for any person to use or operate any bicycle within the city without the consent of the owner. (D) Bicycle Without Serial Number: It shall be unlawful for any person residing in the city, or any dealer in bicycles operating in the City, to purchase, receive in trade or otherwise acquire any bicycle from which the serial number on the frame has been removed, destroyed, mutilated or altered without first reporting the same to the Chief of Police or any of his authorized representatives. (E) Applicability: The provisions of this chapter, except those pertaining to registration and license requirements, shall be applicable to all bicycles operated in the city. 10-5-7 ENFORCEMENT: (A) Police Department to Enforce: The Police Department shall enforce the provisions of this Chapter. (B) Suspension of License: The Police Department may suspend any bicycle license for a period of thirty (30) days for a violation of any of the provisions of this Chapter or any applicable provisions of the Illinois Compiled Statutes relating to traffic. (C) Fines: In addition to the above enumerated penalties, a fine of not less than ($5.00) nor more than fifty ($50.00) may be ordered by any Court having jurisdiction for any violation of the provisions of this chapter. A separate offense shall be deemed to have been committed on each day that a violation permitted to exist or continue. The attached Zoning Ordinance amendment has been drafted to lesson the driveway width restriction in order to allow residents more flexibility and options for off-street parking. In addition to residential driveway considerations,several other concerns with the current off street parking regulations arose including the fact that there is no regulation difference between residential drives and commercial drive regulations,the lighting requirements are out of date with current engineering practices and the screening requirement may become too restrictive for small parking areas, especially as the City is encouraging more off-street parking to occur. Issues• Driveway Width The zoning ordinance currently limits driveway widths"at the street"to 25 feet wide. This limits certain properties,particularly in older sections of the City with shallower front yards,from having a wide enough driveway to park more than two cars. Access Management Driveways,especially for commercial uses,need to be regulated for safety. Consistent curb cut widths are important from a safety standpoint to control the access points along the street. Consistent and limited width access points allow motorists to anticipate where traffic is entering and to know where they can exit the roadway. Driveways of varying widths can confuse drivers, allow motorist to enter and exit at unpredictable locations,resulting in less safe roads. This becomes more of a problem in higher traffic volume areas along the roadway as well as higher volumes entering/exiting the driveway. Front Yard Parking The current ordinance does not permit off street parking in the front yard area with the exception of B-3 zoned areas. This has created somewhat of a hardship for features such as amenity centers/clubhouse facilities. The Landscape Ordinance requires ample screening for parking areas regardless of location and increased screening for parking along public streets resulting in a questioning of the need for this particular regulation. Lighting The current ordinance does not include any specific requirements for the design of off street parking areas. The `dark sky' concept has been promoted by the engineering department as development plans are reviewed and most developers have used this concept and guidelines offered by the engineering department as common practice. Recommendations: • Establish separate regulations for residential uses and commercial/non-residential uses. • Allow wider driveway widths for residential uses where setbacks limit the amount of offstreet parking area to less than enough distance to allow for double stacking in the driveway. • Base commercial/non-residential driveway width on traffic volume of the driveway. • Increase the amount of parking allowable without required screening for parking areas. • Increase the maximum number of accessory parking spaces allowable for residential uses. • Identify appropriate lighting design standards for off street parking areas and include in the ordinance. • Increase the amount of off street parking spaces allowed prior to requiring screening from four(4)spaces to six(6)spaces. • Remove the front yard restriction for off street parking areas. Open And Enclosed Parking Spaces: Accessory parking spaces located on the same lot as occupied by the use served may be open to the sky or enclosed in a building. Accessory parking spaces located in a residence district elsewhere than on the same lot occupied by the use served shall be open to the sky except when otherwise allowed as a special use. 2. Aprons: Driveway aprons shall not widen the driveway more than five (5) feet in total width when measured at the curb/street edge. 3. Distance to Existing Street Intersections: Residential driveways shall be a minimum of sixty(60) feet when measured from the driveway edge to the nearest intersecting street right-of-way line. Driveway Edge/Curb Radius: The maximum radius for a driveway edge/curb for a driveway entrance is 20'. Maximum Radius 20' Q} driveway 0 CD 5. Surfacing: All open off street parking areas, except parking space accessory to a one-family dwelling, shall be improved with a pavement meeting state of Illinois standard A-3 or equivalent. 6. Screening And Landscaping: All open automobile parking areas containing more than€exf(4) six(6)parking spaces shall be effectively screened on each side adjoining or fronting on any property situated in a residence district or any institutional premises by a wall, fence or densely planted compact hedge not less than five feet(5')nor more than seven feet(7') in height. Such required screening shall conform with the front and side yard setback requirements of the district in which the parking is located. 7. Lighting: Any lighting used to illuminate off street parking areas shall be directed away from residential properties and public highways in such a way as not to create a nuisance. The City of Yorkville promotes the"dark sky"concept. Lighting fixtures should be full cut-off, and the use of wall packs on buildings should be minimized. The average foot-candle intensity should be 2.0—2.5 footcandles. The average to minimum light intensity ratio should be no more than 6:1, and the maximum to minimum light intensity ratio should be no more than 20:1. The ratio of maximum veiling luminance to average pavement luminance should not be more than 0.3:1. The lighting intensity at the property line shall be zero footcandles. 8. Signs: Directional and regulatory signs only are permitted on parking areas. 4 DRAFT 4/10/06 9. Repair and Service: a.No motor vehicle repair work of any kind shall be permitted in conjunction with accessory off-street parking facilities provided in a residence district. b. The sale of gasoline and motor oil in conjunction with accessory off-street parking facilities is not permitted in any residence district. F.Number Of Spaces: 1. Maximum Number Of Spaces: The total number of accessory parking spaces provided for one-family,two-family or multiple-family dwellings shall not exceed that required by this Title for such use or for any equivalent new use by more than fifty percent(50%)or€suf{4)six(6) spaces,whichever number is greater. 2. Determination Of Number Of Spaces: When determination of the number of off- street parking spaces required by this Title results in a requirement of a fractional space, any fraction of one-half(1/2)or less may be disregarded,while a fraction in excess of one-half(1/2) shall be counted as one parking space. G.Location Of Accessory Off-Street Parking Facilities: The location of off-street parking spaces in relation to the use served shall be as prescribed hereinafter. All distances specified shall be walking distances between such parking spaces and a main entrance to the use served. 1. For Uses In A Residence District: Parking spaces accessory to dwellings shall be located on the same zoning lot as the use served. Spaces accessory to uses other than dwellings may be located on a lot adjacent to, or directly across a street or alley from the lot occupied by the use served,but in no case at a distance in excess of three hundred feet(300') from such use. 2. For Uses In Business And Manufacturing Districts: All required parking spaces shall be within one thousand feet(1,000')of the use served,except for spaces accessory to dwelling units (except those located in a transient hotel)which shall be within three hundred feet(300') of the use served. However,no parking spaces accessory to a use in a business or manufacturing district shall be located in a residence district unless authorized by the Board of Appeals in accordance with Chapter 14 of this Title.
