Committee Chairman Wanda Ohare called the meeting to order at 6:30 p.m.
Present

1. Minutes for Approval/Correction--Minutes from the Sept. 8, 2005 meetings were
approved.
2. PS 2005-009—Gift Basket Liquor License
Ohare said there's been a request to the city for a gift basket liquor license. It would
allow businesses such as gift shops to put wine into gift baskets for the holidays. Ohare
said the class of license needs to be determined, as does an application fee. The fee for
packaged beer and wine is $1,000 under the D class license, so it might fall under that
category, Wolfer said.
Ohare suggested city attorney John Wyeth look at it and determine what would be the
appropriate license. The request would go to the Dec. 6 Committee of the Whole
meeting.
3. PS 2005-010 Parking Ordinance
Ohare said the city's parking ordinance was too broad and the city is looking to separate
some of the issues. Two of them are commercial and overnight parking.
Chief Martin said the city would need to get a clear definition of commercial vehicles.
The current definition of commercial vehicles doesn't fit what the committee is seeking
and would be too restrictive.
Resident Sandra Adams who attended the meeting to learn more about the parking issue
said she doesn't have a problem with trucks and trucks with signs on them parked in
driveways. She doesn't want to see big equipment parked on the streets.
The proposed ordinance prohibits overnight parking between the hours of 1 to 6 a.m.,
except on streets that don't have curbs. The ordinance also allows the police department
to temporarily allow parking to a resident if the restriction poses a hardship.
Wolfer said the city needs to be careful as it drafts the ordinance because it doesn't want
to hinder residents who are trying to make a living. He said he likes the idea of people
being able to park B and D plated vehicles on the side of the house as long as the parking
area is paved or graveled.

The proposed ordinance also allows people to opt out of the ordinance if, for instance,
there's 100 percent agreement among property owners on a street or block to allow the
overnight parking, Ohare said.
Ohare said overnight vehicle parking especially of the larger vehicles is a safety issue.
She said the matter needs to be addressed or it will get worse.
The proposed ordinance will go to the Dec. 6 C.O.W. meeting and the Dec. 13 City
Council meeting.
4.PS 2005-011 Skateboard and Motorized Scooters
Ohare said this is the first time it has come to the Public Safety meeting,but it's
something that really needs-to be addressed.
Chief Martin said he'd like for the city attorney to draft a proposed ordinance governing
the rules of skateboards and motorized scooters and bring it back to the committee. He
said he doesn't want either allowed on the city's streets.
The issue will be brought back to the committee once a proposed ordinance is drafted.
5. Heartland Circle Construction Traffic
Wolfer said the Public Works Committee discussed the issue of construction traffic along
Spring Street traveling too fast. City Engineer posed a question to the committee
wondering whether the construction traffic restriction on Spring Street should be lifted
since a substantial portion of the public infrastructure in Heartland Circle is done. The
city has received several requests from residents on Heartland to stop the detour of
construction traffic through their streets.
On the topic of speed, Chief Martin said his department could put out tubes to determine
the rate of speed. He also said that sometimes there's a perception that vehicles are going
faster than they actually are. Either way,he said the issue would be addressed. Chief
Martin said he would bring back the results of the speed study.
Alderman Joe Besco, chairman of the Public Works Committee, said the agreement in the
PUD is to reroute traffic through Heartland until the build out of the subdivision is
complete. The complete build out is defined as when the housing is complete. The
provision was agreed to as a way to protect resident that already lived in the community
when the Heartland development was made. He said he's told people from Heartland and
residents of Spring Street that the city won't go back on its word.
Meanwhile Chief Martin said he'd bring the results of the speed study back to the
committee.
6. PS 2005-003 Bruell Street Emergency Weather Warning Siren Update

Chief Martin said the city is purchasing a refurbished weather siren to put up near Bruell
Street. The siren would serve the residents of Heartland Circle and some other areas not
already covered. Previously,the city couldn't get power to the area. But now that the lift
station is in,the city has the ability, Chief Martin said.
Ohare said the ultimate goal is to have warning sirens to cover the whole town.
7.PS 2005-005 Cadet Program Update
Chief Martin reported the cadet program is going well. The cadet recently started his
second session of classes. So far,he said the cadet is a straight A student,works 20 hours
a week for the police department and is doing a great job. An evaluation will be brought
to the Public Safety meeting in January.
The cadet will be with the department for two years. Wolfer said he'd like to the police
department to interview another candidate so that when this one leaves, another cadet
could be hired. Ohare agreed saying the police department needs to report that the
program is going well so that it can be added to the city's budget.
8. PS 2005-001 Police Reports for September and October 2005
Chief Martin said the department has cut back on the number of miles driven in light of
gas price increases. Instead,the offices do a 15-minute walk of their area every hour. It's
worked out well,he said.
Ohare commented that the officers continue to complete a lot of training hours,which she
is glad to see.
Chief Martin also said two city officials have completed and passed the NIMS
compliance test online. The rest of the city officials also need to take the test. Ohare said
she would put a memo in everyone's box.
9. PS 2005-002 Request Approval to use $1,000 in CPAT Funds for Regional Air
Support Service
Chief Martin said the chief from the Countryside Police Department has put together a
regional air support program. A helicopter was donated to the program,but it doesn't
have any federal funding. The Countryside chief is asking as many communities as
possible to support the program through a$1,000 one-time donation. The Public Safety
Committee would need to approve the donation to come out of CPAT funds.
Ohare said it's a very good service. The city never knows when a helicopter might need
to be called in. However, she said she needs more information.
The matter will come back to the committee at the Dec. 8 meeting.
10. Grande Reserve Weather Warning Siren Update
Chief Martins said the developers of Grande Reserve are in the process of installing the
warning siren as per the agreement with the city.

11. PS 2005-06 Business Registration
Ohare said there's nothing in the packet on the issue. Chief Martin said the city attorney
still needs to finish the ordinance. The matter will be brought to the Dec. 8 meeting.
12. False Alarm Ordinance
Chief Martin said the ordinance is in place and the department hasn't received any
negative feedback.
He added the city attorney is working on a form letter to mail to repeat offenders.
13. 2005-008 Liquor License Application
Chief Martin said the city attorney just finished the new application form. He said it's
more condensed and has the additional information Ohare requested. Ohare said she had
a chance to look at it and thought it looked good. Chief Martin said he needs the Public
Safety Committee's approval. Ohare said she'd ask Wyeth if a consensus vote would be
okay. She could then call all of the members who weren't at the meeting to get their
votes.
14.Additional Business
Chief Martin said the Public Works Administrator Eric Dhuse hasn't devised a way to
cover the air conditioning units to help damage in case of a chemical attack. Dhuse is
concerned any type of covering generating heat and hampering the circulation of air.

Committee Chairman Wanda Ohare called the meeting to order at 6:30 p.m.
Present
Alderwoman Wanda Ohare, Alderman Dean Wolfer,Alderwoman Rose Spears, and
Police Chief Harold Martin.
1. Minutes for Approval/Correction—None.
2. PS 2006-01—Police Reports for December 2005
Police Chief Harold Martin said the number of miles driven per police vehicle is up
because of the increase in population. Also,the department plans to hire additional police
officers because of the increase in population. Usually there are about 2.5 officers on per
shift and the city would like to increase that number to 4 officers.
Alderman Dean Wolfer noticed that some of the vehicles have a lot of miles on them and
he wondered if they're safe to drive. Chief Martin said administrators and detectives
drive the vehicles with more than 100,000 miles on them. The squad cars all have lower
mileage and are part of a regular replacement program.
3. PS 2006-02 Holiday DUI Enforcement Program
Chief Martin reported five DUI arrests and one arrest for driving under the influence of
drugs/alcohol were made during the recent Holiday DUI Enforcement Program. Also, a
number of citations and warnings were issued. The program ran from Dec. 19, 2005 to
Jan. 1, 2006.
4. PS 2006-03 Request to Hire Two Patrol Officers
Chief Martin said his department would like to hire four additional police officers. The
first two are already in the budget, but he would like to hire two additional officers. He'd
like to hire two officers right away and hire two more in March
The committee agreed to move the matter forward to the Feb. 7 Committee of the Whole
meeting.
5. FY 2006/2007 Budget Requests
Chief Martin said he'd like to get input from the committee members about the proposed
budget.
Alderwoman Wanda Ohare, committee chairman, said she'd like to see funding for the
cadet program. It's turned out to be a valuable program for the department, she said.
Wolfer asked the chief if there was anything else he needed in the budget. Chief Martin
said he'd like to have money for the New World Software Program. The reporting system

software costs about $125,000 and it's the same one that other departments in the county
and state have. Alderwoman Rose Spears said it should be a priority for the city to be in
the same database as other communities.
6. PC 2005-12 Police Reports for November 2005
The police reports for November 2005 were approved and more forward.
7. PS 2005-02 Request Approval to Use $1,000 in CPAT Funds for Regional Air
Support Service
Chief Martin said the department is requesting to use $1,000 in CPAT funds for the
ability to use a regional air support service. The focus of the unit will be anti-terrorism,
counter drug and other public safety uses. Professional volunteer pilots and police
officers would staff the helicopter. The money would help fund the operational costs for a
regional helicopter. Ohare said the fee is extremely reasonable.
The committee agreed to allow the chief to use the funds.
8. PS 2005-13 Countryside Parkway Addresses
Chief Martin said that City Engineer Joe Wywrot suggests a need to change some
addresses on Countryside Parkway due to the fact that the city's zero grid line is Route 47
and no longer Center Parkway.
If addresses are changed, it would affect five locations: one on the south side of
Countryside Parkway and four are resident s on the north side of the street.
Spears said she's reluctant to approve any changes until she knows the cost involved. She
also wants to know if the proposed changes are really necessary.
Martin said as the city grows and new officers are added, it could slow some officers in
getting to a call if they're confused about an address.
Ohare suggested sending a registered letter to the residents who would be affected by the
addresses changes. She said the letter should list reasons for the proposed changes and
invite residents to come to a meeting to discuss the issue. Chief Martin said he's met with
Wywrot about drafting a registered letter to mail.
Wolfer said it also would be a good idea to find out what's involved such as changing
legal descriptions etc.
The issue will come back to the Public Safety Committee.
9. PW 2005-16 Heartland Circle Construction Traffic
Chief Martin said Wywrot is asking if construction traffic could go on Spring Street
rather than through the Heartland development. However, he said he said the city agreed
it wouldn't allow construction traffic on Spring Street.

Wolfer said the city needs to abide by the agreement it made with residents. Spears,
however, said that there is some discrepancy as to what the original agreement was.
Ohare suggested asking Wywrot to find a copy of the original agreement and to bring it
to the February Public Safety Committee meeting for discussion.
10. PS 2005-09 Gift Basket Liquor License
Ohare said the request to sell liquor in gift baskets came to the city before the Christmas
season, but there wasn't enough time to get it done by then.
The owners of Carnage I wanted to sell wine in gift baskets for the season.
Ohare said City Attorney John Wyeth needs to draft a letter outlining what classification
of liquor sales this would fall under. She suggested the mater be discussed at the February
meeting after the letter has been drafted.
11. PS 2005-06 Business Registration Update
This issue will have to come back to the city.
12. PS 2005-11 Skate Board and Motorized Scooters Update
Ohare said the city is seeing a lot more of the motorized scooters and some sort of
regulations need to be in place. The city needs an ordinance keeping skateboards and
motorized scooters off sidewalks in commercial areas. She said residential areas are
another matter.
The issue will come back at a future meeting.
13. Additional Business
Spears asked if the city could increase fines issued to those who park in handicapped
spaces. She suggested the city seek the maximum allowable penalty of$350.
Wolfer suggested that rather than increasing the fines because of the cost involved in
purchasing new signs,the city adopt a strong zero-tolerance policy. He said the city could
put in its newsletter that no warnings will be issued to those illegally parked in the
handicapped spots.

The meeting was called to order at 6:30pm by Mayor Art Prochaska.
The Mayor asked Alderwoman Rose Spears to be Chairperson of the committee as senior
alderman and senior committee member. Ms. Spears accepted that position and thanked
the Mayor.
1. ApprovaUCorrection of Minutes: November 10, 2005 and January 12, 2006
The committee could not formally approve the minutes since there was no quorum. Ms.
Spears noted,however, that there was no minute taker's name on the November 10t'
minutes.
2. PS 2006-07 Overnight Parking Ordinance—Long Term Parking
Chief Martin acknowledged the presence of guests Mark and Barbara Gilmour in regards
to the overnight park ordinance. He said three situations have arisen with the new
parking ban, one of which was at the Gilmour residence. Former Alderwoman Ohare had
spoken with the Gilmour's with no resolution reached. Their particular problem is
finding a place to park their track/trailer on Bruell Street and their neighbors have taken
issue with their parking in the front.
Mr. Gilmour has attempted to find other locations for their vehicles with no success. One
spot he had found was $150 a month plus insurance. Chief Martin had previously told
Mr. Gilmour that if no solution was found,the matter would be taken to the City Council.

Mr. Gilmour said he felt the truck/trailer was more of an aesthetic issue than a safety
issue. The trailer is 18 feet long plus the length of the truck for a total of 30 feet. The
trailer is hooked to the truck when it is parked on the street because the ordinance
requires that. He said he has been parking it away from the driveway of his neighbor
across the street so that it does not pose a problem for the neighbor. If he parked in the
driveway, his trailer would cover the sidewalk.
The Mayor asked if Mr. Gilmour could park the trailer on the side of the garage. This
would require Mr. Gilmour to cut down two of his trees, it would be too close to his
neighbor and that area is on a slope. The trailer usually contains new golf equipment
that he sells. He would be willing to park the truck/trailer away from his residence if the
City found a place. He said he has parked at the former Lion's pool, however, the area is
not secure. He has also spoken to a local farmer, but he would then need to purchase a
car to travel to that location. He also cannot park the truck/trailer at his office since it is
in Hampshire(45 minutes away).
Chief Martin suggested that maybe a commercial fenced-in lot might offer him a reduced
rate. However,the trailer cannot be disconnected from the truck with a load of
equipment. Locations in the industrial park and other sites were also discussed. The
Gilmour's also said they are seeking alternative real estate where they could move. The
Mayor and Chief both said they do not want the family to have to move and would give
them temporary permission to park at their home since a solution is being sought.
Alderwoman Spears suggested providing a list of possible names/solutions and the
Mayor will contact Lynn Dubajic for suggestions.
The discussion of the Gilmour's situation concluded at 6:55pm and Mrs. Gilmour said
she appreciated the City's efforts on their behalf.
Ms. Spears said she had received a call from the Engelhardt's in her ward who also have
a parking situation due to the number of vehicles they own. The Mayor said the City
must have flexibility in these cases and this constitutes a"hardship" in any future request
for a variance. Currently, there are a handful of"hardship"type cases and the committee
agreed that they are obligated to find a solution. A long-term permit (6 months to 1 year)
was suggested and it would be issued to a specific vehicle.
Chief Martin said a resident of Teri Lane (a cul-de-sac) has drafted a petition to allow
parking on that street. Petitions are also available at the City and the Chief noted that in
many cases,the situation is a long-term one. It was noted that petitions would not be
issued for seasonal vehicles. However, parking a seasonal vehicle in a paid location puts
an undue burden on the resident according to Alderman Wolfer. Mayor Prochaska
added that the City must be careful about dictating peoples' lives.

Committee members will speak with Bill Dettmer regarding the ordinances and it was
noted that the covenants of some subdivisions prohibit parking certain types of vehicles
in the driveway. The Mayor also said that this matter should be discussed at Public
Works. Alderman Wolfer said the committee should make a clear recommendation and
address this situation before March 1St
This matter will be moved to C.O.W. for input from the other Council members.
Language will also be added to the ordinance that states"...long term permits will not be
issued to homeowners who use their garages for other than vehicle storage." Ms. Spears
said that information should be put in the newspaper after the ordinance passes. This
will move to the February 21St C.O.W.

8. PS 2005-09 Gift Basket Liquor License
An amendment to the Liquor Control Ordinance was drafted by Attorney Wyeth and it
includes a classification for Gift Basket Sales. A Yorkville business owner requested
this to be able to sell liquor inside gift baskets to be taken off premises. The liquor
cannot be sold separately and it must be for delivery only. This moves to C.O.W. on
March 7th.

At this time a resident, Dervin Allen,joined the meeting. He stated his son had been
issued a"failure to yield"ticket on the prior Tuesday at a yield sign at Pleasure and
Prairie. Mr. Allen stated that no other cars were present and he did not understand why a
ticket was issued. He said the officer had told his son,that the son should have slowed
down at that intersection and that a ticket could also have been issued for leaving the
roadway. Mr. Allen stated that there were no tire tracks on the grass.
Chief Martin said that the Police Department often publicizes problem areas, however,
the schools do not feel they can announce this type of information. Mayor Prochaska
added that the City is not targeting kids because the offenders are not always kids. Chief
Martin said he would determine if the police camera was taping at the time of the
incident. The Chief and Mr. Allen will also meet on February 10th.
3. PS 2006-04 Police Reports for January 2006
The D.A.R.E. car mileage was briefly discussed. It is being replaced
The following points on the police reports were noted:
• Ms. Spears said she had received very positive feedback on the cadet patrol in the
neighborhood.
• Additional cadet positions will be added to the 2006-2007 budget.
• Community relations were down due to the weather.
• Drug-related offenses were increased due to the "on the move" safety check in
January.

• The overtime has decreased due to the use of part-time help.
• No grant was received for 2006.
• Two thank-you notes were received.
• Beacon News reporter wrote article on classes being taught for alcohol training
for bar-owners and bartenders. Yorkville Police Department is the only
department in Kendall County who has trainers for this.
• Chief and Lt. Schwartzkopf are attending an institute which certifies police
officers and provides executive training.
• Speaker of the House Hastert will provide a"bomb"dog and free training.
This report will move to the C.O.W. on March 7th.
4. PS 2006-05 Maintenance Proposal for Fire Alarm System at City HalUPolice
Station
Chief Martin said that currently no one maintains the fire alarm system and a firm called
Thomas Alarm was suggested. For a annual fee of$600,they will inspect the system
twice a year. He said that this maintenance item and contract should be transferred to
Administration who oversees the building. Alderman Wolfer said the company needs to
ensure the strobes are synchronized since that can affect an epileptic person.
5. PS 2006-06 Request to Hire Two Additional Patrol Officers
Chief Martin said two officers were to have been hired in October, but won't be hired
until the end of February. Two others are to be hired April 1St. PTI classes are available
March 27th and he would like to take advantage of that. Because of the timing, this
matter will be pushed forward to the February 21St C.O.W. It was noted that there are
similar classes at C.O.D., however, more lead time is needed for availability. The State
reimburses the cost of classes.
6. PS 2005-13 Countryside Parkway Addresses
Alderwoman Spears said the information regarding an update of deeds and costs had not
been received regarding changing addresses. (According to Dean Wolfer, KenCom is
working on a satellite program that will file all addresses and any pertinent medical
information.) Approximate costs will be obtained and this matter will be brought back to
committee in March.
7. PW-2005-16 Heartland Circle Construction Traffic
This matter came from Public Works. The original agreement is still needed and Chief
Martin will speak with Joe Wywrot about obtaining same. Speeding construction trucks
in this area were also discussed. A speed study was done and some tickets were issued.
This will come back to the Public Safety committee with the contract.

ADDITIONAL BUSINESS:
Alderwoman Spears asked if anything would be done with business registration. No
action will be taken at this time according to Chief Martin,but this will be brought back
next month.
There is no information yet on skateboards and related ordinances so this will come back
to committee at another time.
There was discussion of illegal use of handicap parking spaces. The cadet is currently
monitoring these spaces and Chief Martin added that the illegal use of these spaces was
more prevalent during bad weather. The committee will ask Glory Spies to issue a press
release regarding use and enforcment. Alderman Wolfer said that the Citizen's Patrol can
help monitor these spots as well. Chief Martin said he believes in"zero tolerance"for
illegal use.
Alderwoman Spears said she had received a letter from a resident of Country Hills
Subdivision complaining about speeders. She turned this letter over to the Chief for
follow-up.
There was no further business and the meeting was adjourned at 8:25pm.

Subject: School Referendum Rally/March
This is an update on the status of the up coming School Referendum march.They are planning the Rally/March
on 03/18/06. They will be starling at the Middle School at 1:00 pm. From there they will be going east on
Somonauk to Church,south on Church to the City Park,through the City Park to Rt.47,south on Rt. 47 to
Hydraulic. They will cross Rt.47 at Hydraulic and head east to the River Front Park. The March will end at that
point.They are planning on setting up some type of tent either in the park or on Hydraulic just east of Heustis.
The event will be over by 4 pm.They will need some traffic control during the event especially at Rt. 47 and
Hydraulic.They do not know how many will attend but they are encouraging both adults and the school children to
attend. Below is a list of name who are part of the planning committee.

ORDINANCE ANNEXING PROPERTIES TO
THE UNITED CITY OF YORKVILLE,
KENDALL COUNTY, ILLINOIS
WHEREAS,RICHARD MARKER ASSOCIATES,INC.,an Illinois Corporation,as record
owner in fee simple of a tract of land contiguous to THE UNITED CITY OF YORKVILLE,have
heretofore submitted a Petition for Annexation of said property; and
WHEREAS, the development and annexation of said land have been considered by THE
UNITED CITY OF YORKVILLE: and
WHEREAS, THE UNITED CITY OF YORKVILLE deems it to be in its best interests to
annex the said land described in said Petition for Annexation to THE UNITED CITY OF
YORKVILLE; and
WHEREAS, the Petitioner is the Owner of Record of said property and no other electors
reside thereon; and
WHEREAS, said Petition is under oath requesting the annexation of said property to THE
UNITED CITY OF YORKVILLE, Kendall County, Illinois and in all respects is presented in

years of the execution of this Agreement, the Developer agrees to pay its proportionate s
of the estimated total population equivalents (p.e.) projected for the entire service area
tributary to the proposed Regional Sanitary Sewer and Pump Station.
If any of the Developer's Yorkville-Bristol Sanitary District Infrastructure Participation Fees
("IPF" fees)are utilized to construct said Regional system, Developer shall be reimbursed
by the CITY up to the percentage paid by the Developer.
If plans for a"Regional Sanitary Sewer"have not been initiated prior to final plat approval,
Heartland Circle will proceed with sanitary sewer improvements per the preliminary
engineering plans including the right to construct the force main with plastic pipe and not
ductile iron pipe.
K. The Annexation and Planned Unit Development being approved, as part of this Agreement
shall be constructed in substantial conformance with the Preliminary Plan attached hereto
and incorporated herein as Exhibit "C". Deviations from this Agreement shall be allowed
only if approved by the City Council, or upon City Engineer's approval as to technical
aspects of engineering plans.
DEVELOPER shall use its best efforts to keep all contractors on designated
construction traffic routes as such routes are established in cooperation with the Yorkville
Police Department.
L. This Agreement shall inure to the benefit of and be binding upon the successors, heirs, and
assigns of each party hereto.
M. If any portion of this Agreement were determined to be invalid by a court of competent
jurisdiction the remaining portions thereof shall be in full force and effect between
DEVELOPER/OWNERS and the CITY.

AN AGREEMENT RELATING TO THE APPROVAL OF
THE FINAL PLAT OF SUBDIVISION FOR
HEARTLAND CIRCLE,YORKVILLE,ILLINOIS
WHEREAS, the United City of Yorkville, hereinafter "City", after proper petition
therefore, adopted an ordinance annexing the property legally described on Exhibit A, the plat of
annexation, attached to this agreement and made a part hereof; and
WHEREAS, the City granted a rezoning of the property to R-2 One-Family Residence
District with a Special Use for a Planned Unit Development; and
WHEREAS,FRANK VICTOR TAUS AND ELIZABETH TAUS, AS CO-TRUSTEES
UNDER THE PROVISIONS OF A TRUST AGREEMENT DATED APRIL 22, 1991 AND
KNOWN AS TAUS TRUST, and RICHARD MARKER ASSOCIATES, INC. an Illinois
Corporation, agreed to provide certain improvements and various amenities for the City in the
Annexation and Planned Unit Development Agreement; and
WHEREAS, Richard Marker Associates,* Inc., has now acquired title to the Subject
Property and shall continue to be the Developer herein; and

WHEREAS, the Developer/Owner freely, knowingly and voluntarily agree to waive any
and all rights to attack and/or challenge this Development Agreement.
NOW, THEREFORE, in consideration of the premises and of the mutual covenants and
agreements herein contained, together with the annexation of the property to the United City of
Yorkville, the parties agree as follows:
1. Preambles. That the preambles of this Agreement are a material part hereof
and,by this reference, are incorporated as part of this Agreement.
2. Park Land. The Developer shall convey lot 318 consisting of approximately five
(5) acres to the City for a public park in partial satisfaction of the City's School/Park land/cash
ordinance. Conveyance of lot 318 shall take place by a Special Warranty Deed. Lot 318 shall be
graded to a minimum slope of 2% and a maximum of 4%. Maintenance of the park site shall be
the responsibility of the Developer until the establishment of a uniform stand of grass, which has
no bare spots that are greater than 0.25 square feet. A ten (10) foot wide asphalt path shall be
constructed around the perimeter of the park by the Developer as shown on the,approved final
engineering plans prepared by Roake and Associates dated 3/21/03. Any manholes within the
park shall be buried a minimum of 8" to 16" below finished grade. Construction of the park
site, including all underground improvements, grading, asphalt path, and turf establishment shall
be completed within eighteen(18) months of the approval of the Final Plat for Unit Three.
3. Traffte Main-gement Plan. Developer agrees to prepare,a construction traffic
management plan for approval by the City. Developer agrees to pay the City for the cost the
City incurs in preparing, installing and maintaining appropriate signage. The City agrees to erect

and maintain construction traffic routing signs according to the management plan -during the
development of the Subject Property.
4. Johnson Street Watermain. Developer agrees to install at the City's expense,
including costs for design and engineering, a watermain connection from the watermain system
in Heartland Circle to the existing dead-end watermain in Johnson Street. Invoices shall be paid
by the City within thirty (30) days of receipt of the invoice and adequate waivers of lien. City
agrees to notify adjacent landowners of the work to be performed within existing City easements
and right-of-way and to obtain any additional easements and/or licenses necessary to allow for
said watermain installation. City shall also be responsible for all restoration work and costs upon
completion of the watermain installation within the parkway and residential lots while the
Developer shall restore the street and curb for the City.
5. Storm sewer. City agrees to allow the Developer, at no cost, to 'install a storm
sewer outlet pipe within the 30 foot permanent utility easement that the City will obtain from the
property owner to the south of the Subject Property (PIN 02-33-227-001). Developer agrees to
participate in the cost for any re-grading of the .outlot ditch and installation of any
erosion/sediment control measures as part of the City's sanitary sewer installation as outlined in
Joe Wyrot's letter to Roake and Associates dated July 16, 2003.
6. Regional Sanitary Sewer and Pump Station. City agrees to sign any "Construct,
Own and Operate" IEPA permits requested by the Developer for the proposed temporary
sanitary sewer pump station and force main proposed to serve the Heartland Circle Subdivision
that have been approved by the City Engineer or consulting engineers. Developer agrees not to
construct any temporary facilities unless mutually agreed to by the City. In the event that the

City does not have its proposed regional sanitary sewer and pump station operational by the time
that sanitary sewer service is needed for the Subject Property, the City agrees to allow the
Developer'to pump sewerage on an as needed basis from the deepest manhole and transport any
sewerage to the Yorkville-Bristol Sanitary District Plant for processing. Developer agrees to
pay any extra costs incurred for treating said sewerage. Building permits for up to fifty (50)
homes shall be available for the subdivision prior to the operation of the Regional Pump Station
or a temporary pumping station. However, only thirty -four (34) homes will be issued
occupancy permits and be allowed to discharge sewage into the system for temporary disposal as
set forth above. No building permits shall be issued for Lots 71-72, 172-180, 193-195 and 220-
221 until the regional pump station or a temporary pumping station is operation. Developer
,agrees to hold the City harmless from any actions that may be brought against the City for not
having the regional pumping station operational at the time that Certificates of Occupancy are
requested.
Developer shall be responsible for dismantling and removing the existing pump station in
the Heartland Subdivision after the regional pump station is operational City shall be
responsible for all costs of connecting to and abandoning the Gowne Lane and Woodworth lift
stations. The Developer shall be responsible for the cost of connecting to and abandoning the
Heartland Lift Station.
Developer shall be responsible for paying up to 32.6% of the cost of the regional pump
station, forcemain and the sanitary sewer line connecting the Heartland Circle Subdivision and
the regional pump station. The City shall be responsible for all other costs including, but not
limited to, the cost of the sanitary sewer connecting the existing Heartland Subdivision with the

sanitary sewer system in the Heartland Circle Subdivision. Pursuant to the annexation
agreement, if the Yorkville-Bristol Sanitary District participates in the Regional Sanitary Sewer
and Pump Station Costs, the Developer shall be reimbursed by the City up to the percentage paid
to the Yorkville-Bristol Sanitary District by the Developer, but not to exceed the total amount of
the IPF fees paid by the Developer to the District.

Dear Chief Martin,
I am in receipt of your letter dated 16 May 2003 regarding the Heartland Circle
Construction Management Plan. I wish to offer the following:
• The sign at Spring St. and Teri Ln. is for westbound (exiting) traffic. (note that
the sign is shown on the north side of the street). This is the same condition as
the signs at McHugh and Heritage, and Wacker and Arrowhead.
• We considered the marked detour route idea but felt that it would be confusing to
the general motoring public — especially motorists travelling on Rte. 34 and Rte
47 that were unfamiliar with Yorkville. if this is becoming a City policy, marking
multiple construction detour routes for each construction project could become
very confusing for everyone, as well. Too many signs just discourage motorists
from reading any of them! We would prefer to keep the signage as shown to
minimize confusion.
• We have added a note that additional signage may be required during
construction as conditions warrant.
Hopefully, by distributing the Construction Management Plan to all contractors and local
material suppliers, the plan can be implemented without noticeable impact on the
general motoring public.

Subject: Heartland Circle—Construction Traffic
During negotiation of the development agreement for Heartland Circle, we had received
many comments from residents on Spring Street about the anticipated construction
traffic. They were concerned that Spring Street would carry the majority of that traffic,
and requested that the traffic access the development some other way. Richard Marker
Associates agreed to allow that traffic through their Heartland in Yorkville subdivision,
which had a limited number of residents at the time. A detour route was posted, and was
fairly successful in diverting construction traffic away from Spring Street.
Since that time the majority of the public infrastructure in Heartland Circle has been
completed. Heartland in Yorkville has almost completely built out, and the asphalt
surface course in that development was paved earlier this year. Construction of individual
homesites, however, still requires large trucks to deliver and haul away equipment and
material.
We have received several requests from residents of Heartland in Yorkville to stop the
detour of construction traffic through their streets. They are concerned about the large
trucks navigating the sharp curves and tight corners in their subdivision. They don't
understand why their neighborhoods and families are less important than those on Spring
Street.
Please place this item on the Public Works Committee agenda of November 7, 2005 for
discussion.

Subject: Swanson Lane Estates/Address changes to new road
Swanson Lane Estates has progressed to the stage of development in which addresses are assigned. There are two
existing houses in this one-road subdivision: Gordon&Marcia Swanson's,and the Skopec's. The Skopec's lot was
not annexed in with the surrounding area,but the Swanson's was.Please note the locations on the enclosed diagram.
The development will have a new road called Swanson Lane,which will be accessed via Boomer Lane. All houses,
including the Swanson's and the Skopec's will utilize Swanson Lane for ingress/egress.
I was told by the developer that the Swanson's are currently using the address 3300 Boomer Lane,and the Skopec's
are currently using the address 3150-D Cannonball Trail. After speaking with Joe regarding the confusion that may
ensue if there are three different address configurations on one common frontage road, we feel it would be in the
best interest to all if the Swanson's and Skopec's addresses are changed to a number and name consistent with those
surrounding them on either side&utilizing the same frontage road,namely Swanson Lane.
Please place this item on the next Public Safety Committee Agenda for discussion(March 9).Thank you.

I would like to request to attend the NASRO Conference this year. The conference goes from July 16-21
and is being held in Palm Springs, California this year. I attended this conference two years ago and it
was by far, the best conference I have ever attended. I probably learned more at this conference than
all the others combined. Everything I learned I used while working at the school and a lot of the
information helps while working patrol as well. If I attend no other conference this year, this is the one.
Unlike most conferences where you are not held accountable for the classes you attend, this organization
mandates you attend at least 32 hours for your certificate. If you do not attend, you don't get the
certificate. For your consideration, I have attached sheets to this memorandum of the most affordable
prices for airfare and ground transportation as well as a breakdown of the costs with a preliminary cost of
the conference. Also attached is a map of the area and a weather breakdown for the area (108 degree
average high temperature for the month of July). I want to go to the conference, not because of the cool

Without this protection,the police department could be liable for loss of evidence,being the

2 The Mobile Upload software provides for the automated upload of New World's Law Enforcement Field Reporting data
over Customer's mobile data network. Customer is responsible for obtaining from their mobile vendor, the written
definition and documentation of the optimal(mobile message)record size to upload laptop data over the mobile network
to be used. This definition must be received within thirty(30)days of this Agreement being executed.
3 Budgeting estimate for laptops:$8,000 for ruggedized includes laptop, external modem mounted in vehicle and mounts;
$3,000 for standard includes laptop, external modem mounted in vehicle and mounts.Pricing estimates do not include
installation of mounts.
4 Prices assume that all software proposed is licensed. Prices are quoted as preliminary estimates only and are subject to
further clarification and confirmation.

Cul-De-Sac Out-Out Petition Instructions
Please complete the petition located on the other side of this document per the ordinance regulation listed under Section D of
Ordinance #2005-59:
D. Opt out of Prohibition (cul-de-sac, only): The City Council may consider granting a petition to opt out of the prohibition cont ined in
Paragraph A, from the property owners of a cul-de-sac upon the following events:
1. Submittal of a petition identifying the street name of the cul-de-sac, and all street addresses fronting on the cul-de-sac, Parcal Index
Numbers (PIN's) for all street addresses, and the desire to opt out.
2. One Hundred Percent (100%) agreement among the property owners as evidenced by signatures from the owners of all of the
properties fronting on the cul-de-sac upon the petition.
3. If the City Council approves the petition, the Chief of Police shall add the cul-de-sac to the list of opted out cul-de-sacs. The opt-out
shall have a duration of 24 months and will expire automatically unless it is renewed by the petition process set forth herein. Within
the last six months prior to expiration of the 24 month opt out period, the Police Department shall notify all property owners on an
opted out cul-de-sac of the expiration date, and the right to apply for renewal.
After being turned in to the City Offices, this petition will be forwarded to the next Committee of the Whole (COW)— Public Safety
Meeting (which are held the first Tuesday of every month). If accepted at the COW meeting, the petition will be forwarded to the next
available City Council meeting (which are held the 2"d and 4t'Tuesday of each month).
It is the resident(s) duty to ensure the petition was passed and accepted by City Council prior to parking on the street overnight. This
can be done by contacting the Police Department office at 630-553-4340, Monday through Friday, 8am —5pm. The Police Department
maintains a list of cul-de-sac's exempt from the ordinance.
NOTE: Although this petition makes the residents exempt to all of the ordinance, it does not exclude them from Section E.
E. Limitation on Parking of Second Division Vehicles: No second division vehicle, including contractor's trailers and equipment, except
those with a license classification of "A" or "B" under the provisions of the Illinois Vehicle Code shall be parked for a period longer
than one (1) hour on any public street in a residential district, except where making a delivery or rendering a service at such
premises.
