Rolfe, Record Allecia Vermilion, Beacon PARK DISTRICT DISCUSSION: Alderman Munns had indicated that over the years residents have expressed the idea of becoming a park district, especially with the continued growth, so that the public would have a little more say in how money is spent. So Alderman Munns wanted to see what has been discussed in the past and what would be best for the future. The Parks and Recreation Board and the Public Works Committee each gave their comments: • A Park District may have more control over a Park Board in doing more of what the people want rather than having to recommend to the City Council to make the final decision. • It would cost the tax payers more money if we were to become a park district because we don't have the industrial and the commercial support with the tax base. 1 • With a park district,the taxpayers will be able to vote in the board members and will be held accountable for their own budget separate from the city. Expenditures will, therefore,be approved by taxpayers a little more directly. • Although in the past it did not seem beneficial to become a park district, now, however, that may have changed when you consider the extension of the boundaries—school district boundaries or even county boundaries. • If the City Council and the Park Board agree that it is time to examine becoming a park district more closely,research and preparation needs to be done in order to seriously consider doing this and to present it to the voters. • Yorkville may not be at the point right now for a park district,but it may take a couple years to get the infrastructure in order before this can even happen anyways. We would need to decide on things such as transferring capital/assets that are currently in place and having a cooperative agreement. • To form a park district it would involve either a referendum or a ratifying referendum. Anything that would go outside of the city limits would require a referendum. • If Parks had to create their own levy, the amount that they would levy could be a substantial increase to the residents. But having a larger geographical area to spread the tax burden would help. • It would take approximately 2-3 years before the taxpayers would see a tax benefit from commercial development. Find out if there is a dollar amount per person to have in revenue so that when we go forward we would have the tax base in place so that the hit on the residents is not so bad. • If assets are turned over to a park district,the city's bonding ability and the city's financing ability will be affected because those are no longer considered city assets. • Staffing would need to be considered because there will be a redundancy because there will now be two groups. It was suggested that a committee of residents,non-residents (since we may be going outside of the city limits), Park Board Members, and City Council Members should research this so everyone knows how this will affect them—the benefits and the impacts. Instead of looking at an ideal formula,we need to look at our own circumstances as a community. Laura Brown indicated that there are a lot of resources available—Illinois Associated Park Districts (IAPD)has Peter Murphy,their resident attorney, who can consult with them. Peter Murphy authored guides on how to form a park district. But it needs to be decided if this is the time that they want to pursue it. It will take a year or two to actually organize and be prepared. You can get all this information without committing. The information can be gathered just to make that decision. Laura Brown indicated that there are some very successful park districts as well as some very successful city recreation departments. One is not right or wrong. With the library addition the city is pretty close at their maximum amount. With a need for a police station, there was a question on how we will be able to extend that further for the park district. Mayor Prochaska answered that this is true but that number changes every year because our EAB grows every year with our growing community. 2 Joe Besco would like to see more facts and have the professionals come in to talk with everyone before forming a committee. Before spending a lot of time on studying the issue, Mayor Prochaska mentioned that we should get some input from our residents and non-residents to see what kind of interest is out there. Valerie Burd also wants to make sure City Council is in favor of this before we poll the residents. Alderman Dean Wolfer suggested that the Park Board provide City Council with information on organizing a park district, the projected boundaries,how the assets will be divided over a three year period, and project the impact on the cost of the school boundary versus the city boundary. He said it would help if there could be an estimated cost. Laura Brown indicated that there is a rate that is established as a park district code which is one percent on your EAV for a park district. To levy under the municipal for city recreation and parks it is 10-12%. It is drastically different. Currently, our levy for the city including the library was .008. If you levy the maximum, this could be a large increase. But Laura Brown indicated that you would have corporate and new growth dollars factored into that as well which would make it not quite as bad. Chris Rollins suggested contacting the non-residents who participate in our programs to survey or send a letter to them to see if they may be interested. A non-resident is paying higher fees for using the services so if they are comparing what they are paying as a non- resident verses what they may be taxed as a district, their picture may look different to them than a city resident. Passive recreation verses active recreation has an impact on cost also. Wanda Ohara would like for the Park Board to make a recommendation for or against this before the City Council would vote. Parks will come up with some information and will bring this information to COW. Wanda Ohara would also like to know how we are going to work together with all the development coming in. We are now able to do this fairly smoothly because we are part of the city—how will this continue to work when you are a district. Laura Brown will call Sugar Grove to see how they did their transition. Park Board will start gathering the information and will have the information by the beginning of October. We need to confer with the public about this before this gets put on a ballot, even if it is just a question whether they are interested in it or not. Valerie Burd did not recommend that they rush into even a question on the ballot. She'believes there needs to be some education of the public first. We need a citizens committee formed after this is approved and have them go out and promote it before a vote is made. PARKS MAINTENANCE FACILITY Laura Brown indicated that in the packet there was a memo to the Public Works Committee summarizing the space needs analysis and cost summary from Sentle Rubel for the construction of a parks maintenance facility for the proposed 7 acre park in the Prairie Meadows subdivision. Included were two funding options from Speer Financial and Traci Pleckham. In order to move forward, Parks and Recreations would need to know if the park maintenance facility should encompass a portion of Public Works or all of Public Works—should it be a joint facility or an independent facility. The Public Works Committee does feel there is a great need for a Public Works facility. Alderman Marty Munns feels the key question is how they are going to fund it. Right now, Parks is in the planning process and wanted to know if Public Works had any 3 facilities planning process in place for its needs. Currently,the company that does all the planning for the city's facilities has a bubble plan for a Parks and a Public Works Building. Joe Besco suggested that in order to incorporate a large Parks and Public Works Building and possibly a community center to use a post framed building. Instead of going with a predetermined motion about the type of structure that should be built, Parks and Recreation hired Sentle Rubel to look at their space needs and had them design around that—their needs,their growth,the anticipated uses, and then Sentle Rubel proposed the most cost effective structure for them. Part of it may, however,be a type of a post frame building. Parks was moving forward to try to alleviate and identified a parcel of land that would be a good site for a maintenance facility. They went to Council to get permission to go out and hire. They currently have two funding options on how they can actually fund the build of this type. Before they proceed forward with any recommendations and/or bring it to Council for approval,they wanted to interact with Public Works and make sure that they have ironed out any duplications or to make sure this is a good use of their space and dollars. It was suggested to use the multipurpose room for programs. This multipurpose room is a public meeting room,board room,training room,break room,lunch room, as well as a conference room. They have asked John Bosman of SRBL Architects to be frugal about what he's proposing but sense/space wise—something they can grow with. It was suggested that they make the facility to be an all in one building—public works,parks, and even some additional space for a community center where it can be utilized for programs. John Bosman explained,though,that there are complications that are associated with this idea that need to be looked at, such as how it affects staffing and the hours of operation especially in a situation where you have multiple type use. Although the city is planning a larger joint facility that will cap the total build out of the city,this will be a good interim for a number of years until the larger joint facility can be built. Alderman Dean Wolfer is up for pursuing the plans presented by Parks. Alderman Marty Munns would like to have future maintenance costs on an annual basis. There was a question by Mayor Prochaska about how the money for the payments of $200,000 is broken down. Laura Brown indicated that Kevin McCanna from Speer Financial said any of these would work or a combination of them. He can also extend it beyond 13 years to 20 years, or in 10 years you could pay it off or refinance or roll it over. The size of the facility is based around the Parks operations at the present time with a small amount for storage of Public Works vehicles. This was projected out for 10 years of the Park employees. If this were built today, the existing staff of both departments could fit. It does not allow for future growth because it is not how it was designed for 10 years of Public Works and 10 years Parks and Recreation. Joe would still like to go bigger for the growth,but it was explained to him that there is some size restraint on site. John Bosman can go back and figure the cost to redesign it to accommodate a little more 4 future growth and a community center. It was noted that this,however, can be one location of many. And it somewhat makes sense to have a north and south facility because of the river crossing. Alderman Dean Wolfer suggested that we bring it to COW for full Council's input to see if we should move forward. Alderman Marty Munns is okay with going forward with this but he would like to know the maintenance costs/operation costs. PRESENTATIONS: 1. PW 2006-04 SCADA System—Contractor Qualification Process by EEI Jeff Freeman gave an overview of the SCADA system and said that it is the "nerve center" for the City water system. He said that the installation of this system is highly specialized with a limited number of qualified contractors. Five firms were interviewed by a committee consisting of City personnel and EEI representatives. The committee then selected the three most qualified firms. Mr. Freeman said that the committee is now asking the Council to ratify this process/questionnaire and confirm that the City will seek bids from the following firms: Engineered Control Solutions, Kamp Synergy and US Filter Control. This will move forward to the January 17th C.O.W and Jeff Freeman will attend to answer questions. 2. PW 2006-16 Route 47 Improvements (Corneils-Baseline)—Engineering Agreement by EEI This item was tabled until the February Public Works meeting. Page 2 of 4 3. PW 2006-18 Water Connection Fee—Proposed Revision by EEI Mr. Freeman said that the current water connection fee for a single-family home is $2,660. He then referred to a handout that showed the cost for water supply,treatment and storage and suggested an increase to $3,700. For comparison purposes, he noted that Montgomery charges $3,591 and $4,637 for Sugar Grove per single family. Increases would also be implemented for commercial and other structures. The committee concurred regarding an increase per Mr. Freeman's suggestion and this item will be moved to January 17th C.O.W. for discussion. Mr. Freeman will attend also to make the presentation. (The committee moved forward on the agenda to Old Business, item #2 to accommodate guest Larry Franklin) OLD BUSINESS: #2 PW 2005-28 Private Improvements in City Right-Of Way, Tree Removal Policy Joe Wywrot referred to a memo and rough draft of a policy from John Wyeth. Mr. Wywrot said that the homeowner is responsible for submitting plans for right of way improvements. A bond amount of$500 41000 was suggested for such projects. Building permits were suggested as a means of regulating bricked-in mailboxes in the right-of-ways. However, Attorney Wyeth had previously stated that a policy should be written for that, rather than using a permit. Ultimately it was decided to require a permit but, fees will be waived. The Committee then discussed Mr. Franklin's request for curbing in front of his property. The neighbors' approval must also be obtained. Revision comments will be given to Mr. Wyeth for inclusion in a revised policy and Mr. Franklin's request will be moved to C.O.W. on January 17th. NEW BUSINESS: 1. PW 2006-05 Bristol Bay—Plat of Easement for Offsite Utilities This easement is needed for a water main between Grande Reserve and Bristol Bay. It was recommended for approval. It moves forward to the C.O.W. consent agenda on January 17th. 2. PW 2006-06 Betzwiser Development—Earthwork Letter of Credit Reduction The letter of credit is expiring and needs to be renewed. It moves to the January 174h C.O.W. consent agenda. 3. PW 2006-07 Rob Roy Creek Interceptor (Contract#2) —Change Order#2 This was for crop damage and it was recommended for approval. Mr. Wywrot recommended it move forward to the January 17th C.O.W. agenda. Page 3 of 4 4. 2006-08 Rob Roy Creek Interceptor(Contract#3)—Change Order#3 This also pertains to crop damage and also addresses a delay in sewer pipe delivery. It will move forward to the C.O.W. consent agenda on January 17th. S. PW 2006-09 In-Town Road Program Phase 2 Smith Engineering is proceeding with the design for phase 2. Mr. Wywrot issued a memo regarding: 1) the possible alignment of Adams Street and Van Emmon Street and 2) extending the Mill Street reconstruction. The committee discussed these two points. They felt the residents of Adams Street should be asked for their input about possibly making their street a cul de sac. It was also noted that a train could block access to that street. It was decided to address this matter when the downtown is redeveloped. On point#2, it was noted that there is very poor drainage on Mill Street between Fox and Washington. It would cost approximately $100,000 additional to repair this area. The committee will ask Ms. Pleckham to determine fund availability. If the money is available, Mr. Wywrot will have Smith Engineering proceed with the engineering and this item would be placed on a C.O.W. agenda. 6. PW 2006-10 Sunflower Estates Unit I—Bond Reduction #4 7. PW 2006-11 Sunflower Estates Unit 2—Bond Reduction #2 8. PW 2006-12 Sunflower Estates Unit 3—Bond Reduction #2 These three items are all standard bond reductions on work that has been completed. All three have been reduced to the minimum 15%prior to acceptance. These will move forward to the January 17th C.O.W. consent agenda. 9. PW 2006-13 Galena Road Watermain—Laycom Easements This is an additional easement on Galena Road that Laycom has approved. Only 2 easements are still needed. This item moves to the January 17th C.O.W. consent agenda. 10. PW 2006-14 Saravanos Properties—Earthwork Letter of Credit Expiration A renewal letter of credit will be obtained. This also moves to the January 17th C.O.W. agenda. 11. PW 200-61 S F.E. Wheaton Expansion—Final Acceptance & Letter of Credit Reduction #3 The punchlist is complete and Mr. Wywrot recommended that the City Council accept the watermain and sewer for ownership and maintenance. There will be a one-year warranty bond for$8,246. It was recommended to move this to the January 176 C.O.W. on consent. Page 4 of 4 12. PW 2006-17 2005 In-Town Road Program—Change Order No. 1 This was for the roadway project and represents a decrease of$37,000. Mr. Wywrot recommended this be approved and it will move to the January 17t' C.O.W. consent. 13. FY 2006/2007 Budget Request Improvement projects discussed were: • Somonauk Road and Game Farm Road • Orange Street improvements • Rte. 47 from Kennedy Road to south of Rte. 71 • Rte. 47 from Caton Farm Road south to I-80 • Widening on Rte. 47 from Corneils north to Baseline Rd. Mayor Prochaska suggested the City begin to set aside money for the various projects and work with developers to procure land for future Public Works buildings on both the south and north side of town. The Hamann property on Eldamain Road was suggested as one possible site. Another possible project was a new water tower south of town and west of Rte. 47. Sidewalk projects were also discussed. OLD BUSINESS 1. PW 2005-25 Tree Canopy Protection Ordinance—Part One Alderman Besco said that he had contacted Morton Arboretum for a possible presentation relating to this ordinance,however,he had not yet received a reply. ADDITIONAL BUSINESS: Alderman Besco said that some residents in Countryside had steel plates in the gutters. He said these pose an extreme hazard when snow is plowed. Property owners have been notified to remove these,however, they have not complied with the request. It was suggested to send another letter stating that the resident has 30 days in which to comply or the plates would be removed and the homeowner billed. Eric Dhuse will initiate these letters. Mayor Prochaska said that a resident had contacted him about a damaged mailbox during snowplowing and also requested that the snow be placed in the open space in his neighborhood. The Mayor will forward the information. The meeting was adjourned at 8:25pm. No revisions or additions shall be made to the proposed work on the right-of-way without the written permission of the Region Engineer. Fifth: The Applicant, his successors or assigns, agrees to hold harmless the State of Illinois and its duly appointed agents and employees against any action for personal injury or property damage sustained by reason of the exercise of this permit. Sixth: The Applicant shall not trim, cut or in any way disturb any trees or shrubbery along the highway without the approval of the Region Engineer or his duly authorized representative. Seventh: The State reserves the right to make such changes, additions, repairs and relocation's within its statutory limits to the facilities constructed under this permit or their appurtenances on the right-of-way as may at any time be considered necessary to permit the relocation, reconstruction, widening or maintaining of the highway and/or provide proper protection to life and property on or adjacent to the State right-of-way. However, in the event this permit is granted to construct, locate, operate and maintain utility facilities on the State right-of- way, the Applicant, upon written request by the Region Engineer, shall perform such alterations or change of location of the facilities, without expense to the State, and should the Applicant fail to make satisfactory arrangements to comply with this request within a reasonable time, the State reserves the right to make such alterations or change of location or remove the work, and the Applicant agrees to pay for the cost incurred. Eighth: This permit is effective only insofar as the Department has jurisdiction and does not presume to release the Applicant from compliance with the provisions of any existing statutes or local regulations relating to the construction of such work. Ninth: The Construction of access driveways is subject to the regulations listed in the "Policy on Permits for Access Driveways to State Highways." If, in the future, the land use of property served by an access driveway described and constructed in accordance with this permit changes so as to require a higher driveway type as defined in that policy, the owner shall apply for a new permit and bear the costs for such revisions as may be required to conform to the regulations listed in the policy. Utility installations shall be subject to the "Policy on the Accommodation of Utilities on Right-of-Way of the Illinois State Highway System." SPECIAL PROVISIONS This work shall be done according to the cross section shown on the attached sketch, and at no place between the edge of the pavement and the ditch line shall the drive be higher than the edge of pavement. The state right of way shall be left in good condition. (No advertising matter shall be placed on the state right of way). The petitioner, their successors, or assigns, shall maintain that portion of the driveway on state right of way in such a manner satisfactory to the department, otherwise the department will maintain the shoulders included in the entrance driveways to the same standard that exists on adjacent shoulders, and if necessary, such areas will be restored to the original cross section and earth shoulders. All turf areas which are disturbed during the course of this work shall be restored to the original line and grade and be promptly seeded in accordance with Standard State Specifications. Whenever any of the work under this permit involves any obstruction or hazard to the free flow of traffic in the normal traffic lanes, plans for the proposed method of traffic control must be submitted to and approved by the Regional Engineer at least 72 hours, and preferably longer, before the start of work. All traffic control shall be in accordance with the State of Illinois Manual of Uniform Traffic Control Devices and amendments thereof. It should be noted that standards and typical placement of devices shown in the Uniform Manual are minimums. Many locations may require additional or supplemental devices. The petitioner agrees to furnish the necessary barricades, lights, and flagmen for the protection of traffic. Traffic shall be maintained at all times. The applicant agrees to notify the Department of Transportation upon completion of work covered under the terms and conditions of this permit so that a final inspection and acceptance can be made. As of now, I inherited an unwritten policy that consists of replacing all mailboxes except those that are not installed correctly or that are rotten. Our biggest problem with the current policy is the lack of definition as far as responsibility of replacement and the cost of replacement. (Exhibit 1) The full version of the document is United States Postal Service Bulletin 21997 (5-6-99). Mailbox Replacement Criteria for mailbox replacement 1. Mailbox must meet City standards for installation and material. 2. Only mailboxes that are struck directly by a City vehicle or piece of equipment will be eligible for replacement. Damage caused by snow will not be eligible for replacement. Mailbox Replacement Procedure 1. Resident must notify the Public Works department within three (3) days of the occurrence. During this time, a temporary mailbox will be placed until a determination can be made as to weather or not the City is responsible. 2. A Public Works representative will inspect the mailbox and make a determination as to weather or not the mailbox was properly installed,the material was in good condition, and if it was struck by a city vehicle. 3. If the determination is made that the City is responsible for replacement of the mailbox, the homeowner is eligible for reimbursement of up to $75.00 for material to replace the mailbox. Reimbursement may be submitted to the City after the homeowner installs a new mailbox and it is inspected by a Public Works representative. 4. If it is determined that the City is not responsible for the damage, it will be the homeowner's responsibility to replace the mailbox following City Standards. The proposal also includes evaluation of a storm sewer outfall along McHugh Road. We have discussed the possibility of creating a infiltration basin for some time on the Hamman property. These types of basins are environmentally beneficial because they recharge groundwater and don't contribute to offsite flooding. Infiltration basins are prone to clogging,however, and for this reason standard practice is to provide an outlet storm sewer. The proposed study will assess the possibility and practicality of creating an infiltration basin, as well as recommending design parameters if such a basin is to be constructed. The proposal includes an item called"soil testing", which is actually for pumping tests to determine the ability of the soil at this site to conduct water. The proposal also includes evaluation of a storm sewer outfall along McHugh Road, which would ultimately reach the Fox River at Gawne Lane where we already have a storm sewer outfall. Previous research by IDOT indicates the presence of wetlands along the Fox River bluffs near the Hamman property, making an outfall at that location impossible. A McHugh outfall avoids the wetlands, and would also provide an outfall for IDOT's Route 34 stormwater, which hopefully would be routed through the Hamman pond before infiltration and/or discharge. The proposal is for an amount of$39,800. Paragraph 2.B.viii of the Hamman annexation agreement states that the city will reimburse Don Hamman for the construction of the storm sewer through sales tax revenues generated by his property. Paragraph G states that the city will cooperate with Don to acquire permits for construction. Since this study is a necessary step towards permitting and eventual construction of the storm sewer, I believe that Don Hamman is obligated to fund this study,with the city eventually reimbursing him. John Wyeth should review the agreement and offer his opinion on this matter. THE HAMMAN PROPERTY STORMWATER FEASIBILITY STUDY UNITED CITY OF YORKVILLE, KENDALL COUNTY, ILLINOIS This Agreement, made this day of , 2006 by and between the United City of Yorkville, Kendall County, Illinois, a municipal corporation of the State of Illinois (hereinafter referred to as the "CITY") and Engineering Enterprises, Inc. of 52 Wheeler Road, Sugar Grove, Illinois, 60554 (hereinafter referred to as the"ENGINEER"). In consideration of the mutual covenants and agreements contained in this Agreement, the CITY and the ENGINEER agree, covenant and bind themselves as follows: 1. Services: The ENGINEER agrees to perform for the CITY the necessary engineering services to complete the Harriman Property Stormwater Feasibility Study (see Exhibit A for Study Area) in accordance with the Work Items outlined in the attached Exhibit B. 2. Direction: The Mayor, or his written designee, shall act as the CITY'S representative with respect to the Services to be provided by the ENGINEER under this Agreement and shall transmit instructions and receive information with respect to the Consulting Engineering Services. 3. Compensation: The CITY agrees to pay the ENGINEER for providing the Services set forth herein as specified on the ENGINEER'S approved Standard Schedule of Charges and the Personnel, Positions and Classifications for the various classifications of employees performing the work on the project. Total compensation for this Agreement shall be at an Hourly Rate. Based on the information currently known about the project, the ENGINEER estimates his fees to be approximately $39,800. The ENGINEER'S attached 2005 Standard Schedule of Charges shall be used as the basis of this contract. If, in the future, the CITY approves a revised Standard Schedule of Charges, then work conducted on or beyond the effective date of the new Standard Schedule of Charges shall be billed on the basis of the then effective Standard Schedule of Charges. 4. Term: The ENGINEER will deliver a Draft Report within 90 days of the execution of this Agreement. Following completion of review by the City and other interested parties the ENGINEER will deliver a Final Report within 30 days. The term of this Agreement shall be active through December 31, 2006, unless otherwise extended through written confirmation by both parties. 5. Payment: Engineer shall invoice the CITY on a monthly basis for Services performed and any costs and expenses incurred during the previous thirty (30) day period. The CITY shall pay the ENGINEER within thirty (30) days of receipt of said invoice. 6. Termination: This Agreement may be terminated upon fourteen (14) days written notice of either party. In the event of termination, the ENGINEER shall prepare a final invoice and be due compensation calculated as described in paragraph 3 for all costs incurred through the date of termination. State legislation was recently passed that gives Kendall County the ability to establish countywide stormwater requirements. Over the past year or so the county has analyzed the stormwater requirements of the municipalities within Kendall County in an effort to create uniform standards that could be implemented countywide. The results of their recommendations are attached. These standards are proposed to be enforced by each individual municipality rather than by the county. I concur with Kendall County's proposed standards, and recommend that we modify our subdivision control ordinance and ordinance exhibits accordingly. The recommended changes reflect sound engineering practices. They also promote environmental aspects of stormwater management that are becoming more commonplace as the Illinois EPA's stormwater requirements are implemented. Attached find a spreadsheet listing the proposed standards and how they vary from our current standards. Our proposed wetland protection ordinance has all of the recommended requirements regarding wetlands, and actually goes quite a bit beyond these recommended requirements,but that ordinance has not been adopted yet. Whether direction is given to modify our stormwater standards or not, I also recommend that we make the following changes to the ordinance: • For naturalized stormwater basins or conveyance channels, require a 15-foot wide buffer between the top of the basin embankment or edge of channel and any lot line of a residential property. The buffer shall have a slope no greater than 10:1, and shall be landscaped in a manner mutually agreeable between the developer and the city. • Revise Paragraph 13 on page S-12 of the Standard Specifications for Improvements to state more clearly that the Park Development Standards shall be used for the design of all stormwater basins in town. • One deviation that we should consider from the Park Development Standards is the minimum water surface area of a wet pond. The Park Development Standards require a minimum area of 2 acres, which is not uncommon but may not be possible in smaller developments or practical depending on natural land topography. I recommend that a minimum area of 0.5 acres be established. For comparison purposes,this is the approximate size of the Fox Highlands pond immediately north of Village View Drive. • Incorporate our"night sky"parking light policy standards into the ordinance. The purpose of this standard is to avoid the glare of urbanized commercial districts, and to be able to look up into the sky at night and see the stars. It is a standard that retains quality of life while at the same time providing adequate lighting. We have been largely successful in implementing our policy,but have seen resistance from time to time. Our policy calls for an allowable average lighting intensity range of 2.0-2.5 footcandles,rather than the minimum average of 2.0 footcandles currently called for. The policy also sets maximum values for average-to-minimum and maximum-to-minimum lighting ratios of 6:1 and 20:1. Our current ordinance has no lighting ratio standards. Please place this item on the Public Works Committee agenda of February 6, 2006 for discussion. The many proposed and ongoing developments north of Comeils Road will have a significant affect on traffic flow along Route 47. Historically, IDOT has required improvements to their roadway system on an individual basis as development occurs. Due to the anticipated dramatic increase in traffic volumes on Route 47, we have initiated discussions with IDOT to propose that the city take the lead on a regional improvement to Route 47. By combining funds from the various developers, we believe that a cost- effective regional improvement can be constructed years before an IDOT-funded project could be built. IDOT is supporting this initiative. As currently envisioned, the project would turn the existing Route 47 roadway into two southbound lanes. Two new northbound lanes would be constructed along the east side of the existing roadway. A nominal 30-foot wide landscaped median would separate the northbound and southbound lanes. New intersections, traffic signals, and streetlights would be constructed at agreed-upon locations, with turn bays as required. The construction cost is currently estimated to be around $15,000,000. This proposal uses the standard MFT contract form due to IDOT's involvement,but we do not propose to use any of the city's MFT funds. We need to explore financing directly through the development community,perhaps with incentives offered by the city to allow them to recoup some of the cost. (5) Inspection of all materials when inspection is not provided at the sources by the Bureau of Materials and Physical Research, of the DEPARTMENT and submit inspection reports to the LA and the DEPARTMENT in accordance with the policies of the said DEPARTMENT. k. ® Furnish or cause to be furnished (1) A resident engineer, inspectors and other technical personnel to perform the following work: (The number of such inspectors and other technical personnel required shall be subject to the approval of the LA.) a. Continuous observation of the work and the contractor's operations for compliance with the plans and specifications as construction proceeds, but the ENGINEER does not guarantee the performance of the contract by the contractor. b. Establishment and setting of lines and grades. c. Maintain a daily record of the contractor's activities throughout construction including sufficient information to permit verification of the nature and cost of changes in plans and authorized extra work. d. Supervision of inspectors, proportioning engineers and other technical personnel and the taking and submitting of material samples. e. Revision of contract drawings to reflect as built conditions. f. Preparation and submission to the LA in the required form and number of copies, all partial and final payment estimates, change orders, records and reports required by the LA and the DEPARTMENT. 2. That all reports, plans, plats and special provisions to be furnished by the ENGINEER pursuant to this agreement will be in accordance with the current standard specifications and policies of the DEPARTMENT, it being understood that all such reports, plats, plans and drafts shall before being finally accepted, be subject to approval by the LA and the said DEPARTMENT. 3. To attend conferences at any reasonable time when requested to do so by the LA or representatives of the DEPARTMENT. 4. In the event plans, surveys or construction staking are found to be in error during the construction of the SECTION and revisions of the plans or survey or construction staking corrections are necessary, the ENGINEER agrees that he will perform such work without expense to the LA, even though final payment has been received by him. He shall give immediate attention to these changes so there will be a minimum delay to the contractor. 5. The basic survey notes and sketches, charts, computations and other data prepared or obtained by the ENGINEER pursuant to this agreement will be made available upon request to the LA or the DEPARTMENT without cost and without restriction or limitations as to their use. 6. To make such changes in working plans, including all necessary preliminary surveys and investigations, as may be required after the award of the construction contract and during the construction of the improvement. **-See Exhibit A for further clarification of scope of services. That all plans and other documents furnished by the ENGINEER pursuant to the AGREEMENT will be endorsed by him and will show his professional seal where such is required by law. 8. To submit, upon request by the LA or the DEPARTMENT a list of the personnel and the equipment he/she proposes to use in fulfilling the requirements of this AGREEMENT. The LA Agrees, 1. Upon award of the contract for the improvement by the LA and its approval by the DEPARTMENT, 100 percent of the total fee(excluding any fees paragraphs 1j and 1k of the ENGINEER AGREES), based on the above fee schedule less any previous payment. c. Upon completion of the construction of the improvement, 90 percent of the fee due for services stipulated in paragraphs 1j and 1 k. d. Upon completion of all final reports required by the LA and the DEPARTMENT and acceptance of the improvement by the DEPARTMENT, 100 percent of the total fees due under this AGREEMENT, less any amounts previously paid. By mutual agreement, partial payments, not to exceed 90 percent of the amount earned, may be made from time to time as the work progresses. 4. That should the improvements be abandoned at any time after the ENGINEER has performed any part of the services provided for in paragraphs 1a and 1g, and prior to the completion of such services the LA shall reimburse the ENGINEER for his actual costs plus 139.13 percent incurred up to the time he is notified in writing of such abandonment "actual cost" being defined as material costs plus actual payrolls, insurance, social security and retirement deductions. Traveling and other out-of-pocket expenses will be reimbursed to the ENGINEER at his actual cost. 5. That should the LA require changes in any of the detailed plans, specifications or estimates(except for those required pursuant to paragraph 4 of THE ENGINEER AGREES)after they have been approved by the DEPARTMENT, the LA will pay the ENGINEER for such changes on the basis of actual cost plus 139.13 percent to cover profit, overhead and readiness to serve—"actual cost" being defined as in paragraph 4 above. It is understood that"changes"as used in this paragraph shall in no way relieve the ENGINEER of his responsibility to prepare a complete and adequate set of plans. 6. That should the LA extend completion of the improvement beyond the time limit given in the contract, the LA will pay the ENGINEER, in addition to the fees provided herein, his actual cost incurred beyond such time limit—"actual cost"being defined as in paragraph 4 above. It is Mutually Agreed, 1. That any difference between the ENGINEER and the LA concerning the interpretation of the provisions of this AGREEMENT shall be referred to a committee of disinterested parties consisting of one member appointed by the ENGINEER one member appointed by the LA and a third member appointed by the two other members for disposition and that the committee's decision shall be final. 2. This AGREEMENT may be terminated by the LA upon giving notice in writing to the ENGINEER at his last known post office address. Upon such termination, the ENGINEER shall cause to be delivered to the LA all drawings, specifications, partial and completed estimates and data if any from traffic studies and soil survey and subsurface investigations with the understanding that all such material becomes the property of the LA. The ENGINEER shall be paid for any services completed and any services partially completed in accordance with Section 4 of THE LA AGREES. 3. That if the contract for construction has not been awarded one year after the acceptance of the plans by the LA and their approval by the DEPARTMENT, the LA will pay the ENGINEER the balance of the engineering fee due to make 100 percent of the total fees due under the AGREEMENT, based on the estimate of cost as prepared by the ENGINEER and approved by the LA and the DEPARTMENT. 4. That the ENGINEER warrants that he/she has not employed or retained any company or person, other than a bona fide employee working solely for the ENGINEER, to solicit or secure this contract and that he/she has not paid or agreed to pay any company or person, other than a bona fide employee working solely for the ENGINEER, any fee, commission, percentage, brokerage fee, gifts or any other consideration contingent upon or resulting from the award or making of this contract. For breach or violation of this warranty the LA shall have the right to annul this contract without liability. Phase I-Preliminary Engineerinq 1. Topographic Survey 2. Environmental Study a. Gather all necessary data as required by the State to satisfy Phase I Engineering Requirements in regards to the environmental, cultural/archaeological, biological, and special waste reports, from when available from previously completed studies by developer. b. When not provided by the adjacent developer, EEI will provide the necessary investigations to satisfy these requirements. c. Coordinate with the Illinois Historic Preservation Agency in regards to archaeological or historic resources. d. Coordinate with the Illinois Department of Natural Resources in regards to threatened and endangered species and natural areas. e. Coordinate to determine the status of special waste or sites otherwise potentially impacted by regulated substances. f. Coordinate with the State, Local and Development Officials. 3. Soil Borings and Investigations a. Provide a soil boring report in compliance with MOT standards (1 boring every 300 linear feet for new roadway construction). 4. Traffic Impact Study a. Provide traffic data collection services, consisting of historical data, manual traffic counts and twenty four hour machine counts as necessary. b. Develop traffic projections for years 2017 and 2030 at all existing intersections along corridor including Jericho Road. EEI will utilize previously conducted studies to determine future traffic, as well as conducting independent estimates for background growth and traffic in future development. c. Provide analyses and recommendations utilizing 2017 traffic volumes. d. Determine the required roadway improvements based on 2017 traffic volumes. 5. Traffic Signal Warrant Analysis a. Prepare signal warrant analyses for all future intersections 6. Intersection Design Studies a. Conduct an IDS for each of the ten intersections within the corridor for 2017 and 2030 traffic. b. Determine required geometric improvements. 7. Finalize R.O.W. Requirements a. Determine the required parcels of land required for easements and R.O.W. acquisition. b.
