Calabrese,Jr., Successor Executor for the estate of Lucille Calabrese, petition to annex and rezone. See attached. Holdiman moved to close the public hearing. Crouch seconded the motion. The motion was unanimously approved by a voice vote. NEW BUSINESS 1. PC 2005-57—Belinda Lies, Hendra Conrad and Faith Unlimited,Inc., petition to rezone with special use. Lucietto moved to recommend acceptance of the special use PUD zoning request to the City Council. Crouch seconded the motion. All moved to pass with a roll call vote. The motion passed with a 6-0 vote. Crouch, Davis, Holdiman, Lindblom, Lucietto and Schillinger all voted yes. 2. PC 2005-53—Kendall Creek Development LLC, petition to annex and rezone. The R2 zoning is consistent with the comprehensive plan on the South side of the River. Crouch moved to recommend annexation to the City Council. Lucietto seconded the motion. All moved to pass with a roll call vote. The motion passed with a 6-0 vote. Crouch, Davis, Holdiman, Lindblom, Lucietto, and Schillinger all voted yes. Lucietto made a motion to recommend rezoning to R2 subject to the guidelines of the comprehensive plan. Schillinger seconded the motion. All moved to pass with a roll call vote. The motion passed with a 6-0 vote. Crouch, Davis, Holdiman, Lindblom, Lucietto, and Schillinger all voted yes. 3. PC 2005-59—Tanglewood Real Estate Development Corp., petition to annex and rezone. The residential portion will be a PUD request and will be resubmitted. Travis Miller said the PUD was presented to Plan Council after it was advertised and the Plan Council recommended the petitioner resubmit the PUD portion. Lindblom was concerned with the two cuts onto Galena road. He asked if they were within acceptable space limitations. One of the entrances may be right in and right out only. Lucietto made a motion to continue this. Crouch seconded the motion. The motion was unanimously approved by a voice vote. Page 3 of 5 4. PC 2005-62—47 Corneils LLC and 1"United Bank as Trustee Under Trust Agreement petition to annex and rezone. Crouch asked if there was a potential use. Janine Boggs said that there was not at this time. They will rezone to meet the comprehensive plan and see how things develop in the area. John Whitehouse said with the Rt. 47 improvements there may be additional Right of Way requirements that they must be aware of. Lucietto moved to recommend annexation to the City Council. Crouch seconded the motion. All moved to pass with a roll call vote. The motion passed with a 6-0 vote. Crouch, Davis,Holdiman, Lindblom, Lucietto, and Schillinger all voted yes. Lucietto moved to recommend rezoning to B3. Crouch seconded the motion. All moved to pass with a roll call vote. The motion passed with a 6-0 vote. Crouch, Davis, Holdiman, Lindblom, Lucietto, and Schillinger all voted yes. 5. PC 2006-03—CCTF 500, LLC and Frank J. Calabrese,Jr., Successor Executor for the estate of Lucille Calabrese, petition to annex and rezone. This is a 12 acre parcel zoning B2 to the City of Yorkville. The comprehensive plan shows residential in this area. There is a residential plan to the North. Dan Kramer said there will be no industrial uses. This will be geared for offices. There will be heavy landscaping along 126. The buildings are along the rear of the property, and the asphalt will be broken up. Crouch asked if they were opposed to office zoning. Dan Kramer said they would like to add some B1/B2 uses that would allow for things such as a Montessori school or a small sit-down restaurant. An annexation agreement could be worked out with the city with a permitted and prohibited list. There would be another Public Hearing for the annexation agreement. Crouch said the other issues that were raised were the traffic. Crouch asked if there was sufficient buffering, how would that affect the plan for the property? Dan Kramer said it would not affect the plan at all. There will be an extra wide buffer to include a Right of Way that would accommodate the eventual widening of Rt. 126. Crouch said another issue was the height of the buildings. Dan Kramer said they would be looking at a 1 or 2 story limit that would be no taller than a 2 story house. Dan Kramer said they will try to preserve the tree line to the North that would create a large buffer for the development to the North. There would be destination users on this property that would not generate a lot of trip traffic. Lindblom asked the public if they had any comments after what they had just heard. There was a concern about parking lot lights. That is addressed by City Ordinance that limits the amount of light that goes beyond the lot line. The citizen asked if the lighting could be aimed at the parking lot so the glare would not go to the South. There was a question about sidewalks and bike paths. There will be sidewalks or a Bike path along the North side of Rt. 126. Joanne Buchner says she feels the traffic issues are not being addressed. She says there is a lot of traffic backed up at the beginning and the end of school and she is concerned that the start times and end times of businesses on this property would be at the same times as the school starts and ends. She was also concerned that there is no crossing guard at the nearby intersection. Page 4 of 5 Dan Kramer said before building can begin they have to submit a traffic study to the City and submit an application to the State to get a cut onto Rt. 126 for the main access and for the right in and right out. Then they will be told what improvements will need to be made. IDOT will be looking at 126 as a whole and what improvements will need to be made and the developer will have to pay their fair share of the improvements. Dan Kramer said professional offices generally open a little bit later than school hours and also close a little bit later. This will be a phased in development over a number of years. John Whitehouse said that the Kendallwood development had a panhandle access to 126 and had an alternate that would connect to the road opposite Wooden Bridge Dr. This is a through road to Van Emmon that was a requirement the Plan Commission and the City had for the Kendallwood development. This is the best location for this access point because it is opposite Wooden Bridge and the 3rd lane for a turn lane would be continuous from the school to this development. If the traffic study warrants signalization in the future, that will be discussed with the developers for this parcel as well as with the Kendallwood development. Crouch moved to recommend annexation to the City council. Lucietto seconded the motion. All moved to pass with a roll call vote. The motion passed with Davis abstaining. Crouch, Holdiman, Lindblom,Lucietto, and Schillinger all voted yes. Lucietto moved to recommend zoning subject to specific design standard and uses as part of the annexation agreement. Crouch seconded the motion. This will come back to a Public Hearing at some time in the future. All moved to pass with a roll call vote. The motion passed with Davis abstaining. Crouch, Holdiman, Lindblom, Lucietto, and Schillinger all voted yes. 6. PC 2006-05 Bristol Ridge—Concept Plan—Kevin Carrera and Rich Olson were here on behalf of the petitioner for this concept plan. This is a 190 acre proposed development that would be zoned in a combination of R2 and R3. It is located South of Galena road and is divided almost in half by Cannonball Trail. There will be 245 single family lots with a minimum lot size of 12,000 square feet, a maximum lot size of 28,863 square feet, and an average lot size of 14,168 square feet. There will be 102 units of 2—3 unit townhomes and 73 units of 4—6 unit townhomes. There is an 11.8 acre school site located off the comprehensive plan and a 5.5 acre park site. The gross density is 2.2 units per acre. There is a portion of this property that is currently under an annexation agreement, but it was pulled off of the agenda for the Committee of the Whole to allow the development to go through as a whole. There is a through East— West road and there is a stub that lines up with the road the existing school is on. There will be trails throughout the development and 3 detention areas. There will be no zoning variations requested. Lindblom is not comfortable with traffic going onto Charity Lane. Lindblom suggested this could be more of a walkway to the school instead of a road. If lot 123 was eliminated an access can be made to Corneils Rd. John Whitehouse said it could be a temporary access until the East-West road connects to other subdivisions. It may also be a right in right out. Page 5 of 5 The school site is located next to Railroad tracks and power lines. The developer has not yet discussed this location with the school. Crouch was concerned that the school board would not like this location for a school site. There was a suggestion that the 4— 6 unit townhomes could be removed and the school site would be located in this area. Lucietto was concerned with the road stub into an existing home. The developer is planning for future development and that this property could connect to this stubbed road in the future. The Commission was asked if they were comfortable with the land uses. Davis said he feels the City is overdeveloping on Townhomes. The annexation agreement allows 40 duplexes on the West side of the development. The developer was trying to balance the development to match the Bristol Bay development. The townhomes to the south are backing up to B3. Lindblom suggested they get a different name because of Bristol Ridge Road, and this development does not touch Bristol Ridge Road. 7. PC 2006-07 Caledonia Unit 1 —Final Plat—The Final Plat for all of Caledonia was previously approved,but the property has been sold and the new developer wishes to develop it in phases. Crouch moved to recommend approval to City Council on the Final Plat. Lucietto seconded the motion. All moved to pass with a roll call vote. The motion passed with a 6-0 vote. Crouch, Davis, Holdiman, Lindblom, Lucietto, and Schillinger all voted yes. ADDITIONAL BUSINESS Crouch wanted to commend the chairman for moving the meeting along. There will be 2 meetings each month for the next 2 months. Lucietto moved to adjourn the meeting. Crouch seconded the motion. The motion was unanimously approved by voice vote. Frank Sakelaris is here behind 16 me tonight representing both the property owners 17 and is principal of the actual developer of the 18 project . 19 I told Mr . Crouch before the 20 meeting, given the current school situation, it ' s 21 nice being here with a commercial development 22 hopefully to help the city ' s tax base and the 23 school ' s tax base . 24 As Mr . Lindblom has indicated, Depo Court Reporting Service ( 630 ) 983-0030 12 1 it ' s a little bit over a 12-acre parcel that ' s 2 located on the north side of 126, and 3 Mr . Sakelaris has designed it with this platting 4 so the major entrance of the property would be 5 directly across from Crooked Tree Subdivision -- 6 or Crooked Creek Subdivision, which is , in fact , 7 a Kendall County subdivision that ' s not annexed 8 completely into the city . Some homes at the very 9 back with Wildwood when you drive through that 10 are part of the city . 11 They are looking to do a very 12 high-end office-type project with buildings that 13 would be masonry in character . Although he will continue to work with the city as needed, he will no longer be attending the Plan Commission meetings. Lindblom said it's been a pleasure working with Schoppe and he wishes him well. PUBLIC HEARINGS Crouch made a motion to open the public hearings. Jones seconded the motion. The motion was unanimously approved by voice vote. 1. PC 2005-59 Tanglewood Real Estate Development Corp. Petitioners petition to annex and rezone. Lucietto made a motion to continue the public hearing until the second Wednesday in June. Holdiman seconded the motion. Page 2 of 4 PRESENTATION 1. Kendall Marketplace Concept Plan Rick Filler and Jim McPhail, from Harlem Irving Co., and MidAmerica, respectfully, presented a concept plan for Kendall Marketplace. Kendall Marketplace is a proposed commercial and residential development on 193 acres at Route 34 from Cannonball Trail to Beecher Road. Filler said the developers are taking the opportunity to create a different shopping experience in Yorkville. Rather than a big power strip or mall, the planned area would feature several larger anchors such as a Target and a Home Depot. However, the area also would have a downtown type of area for local retail businesses or restaurants. The plan also features a residential component with single-family homes and townhomes and a police station. Phil Stuepfert, from SEC Planning, said the land is very important and the developers want this marketplace to be a step above the average retail center. In designing the concept, Stuepfert said he tried to pull together features from the city. There are three components in the plan: a downtown center area, peripheral landscapes and the main entries. In the downtown center of the plan, Stuepfert said they want people to be able to walk around the meandering creek. The intent is for the area to have a strong pedestrian/urban streetscape. On the peripheral streetscape, the planners are looking at 30-foot buffers along Cannonball and Route 34. The streetscape would include a board fence along with naturalized grasses. Schillinger said he thought the buffer on Cannonball is supposed to be 50 feet. Stuepfert said they'd look into that as well as the right of way. Schillinger also asked if the developers had considered environmentally friendly parking areas or other conservation practices. It was said they are looking at native grasses and other plantings. Lucietto said she sees great potential in the plan. The plan is for more than 800,000 square feet of retail. Filler said this is a big project and said the developers are trying to thread everything together. Currently, a development like this doesn't exist so there's no place for city officials to visit to see how the concept might work, Filler said. Crouch said obviously the city is anxiously awaiting the preliminary plan. He said as long as the developers are sensitive to its neighbors, he excited about it. He said it's the biggest thing to hit Yorkville in a long time. Page 3 of 4 Filler said the developers also would see the project through and stay with it. He said his company builds a home and manages the property. NEW BUSINESS 1. PC 2006-06 Grand Reserve Unit 16—Preliminary/Final Plat Patti Bernhard, representing the petitioners, said the parcel covers 106 acres and would house 159 units. There also is a 5.2-acre park in the project. City Planner Mike Schoppe said the plans were reviewed and city staff recommends approval subject to staff comments. Lucietto made a motion to recommend approval of PC 2006-06 Grande Reserve Unit 16 Preliminary/Final Plat subject to staff comments. Jones seconded the motion. The motion was unanimously approved by roll call vote. Kraupner, Holdiman, Lucietto,Davis, Schillinger, Jones, Crouch and Lindblom voted yes. 2. PC 2006-02 Yorkshire Estates—Final Plat Andy Fitz from Montalbano Home said the plan features homes on 10,000 square foot lots, which is consistent with what was approved in the preliminary plan. This plan, he said, is almost identical to that plan. Schillinger said he has problems with the number of those 10,000 square foot lots and said they should abut larger open spaces. Meanwhile, Lindblom said he'd like to see an emergency entrance either at lot 31, 32 or 33 until another entrance is created. He also didn't like the use of the name boulevard in the subdivision when the road isn't actually a boulevard. Lucietto made a motion to recommend approval of the final plat for PC 2006-02 subject to staff concerns, the renaming of the boulevard and an additional temporary entrance. The motion was unanimously approved in a roll call vote. Holdiman, Lucietto, Davis, Schillinger, Jones, Crouch, Kraupner and Lindblom voted yes. 3. PC 2006-21 Villas at the Preserve—Final Plat City staff has reviewed the final plat and said there are a few engineering issues to resolve, Schoppe said. The Planning Council recommended approval of the final plat subject to staff comments. Lucietto made a motion to recommend approval of the final plat for PC 2006-21 subject to staff concerns. Jones seconded the motion. The motion was unanimously approved by roll call vote. Lucietto, Davis, Schillinger, Jones, Crouch, Kraupner, Holdiman and Lindblom voted yes. ADDITIONAL BUSINESS Lindblom suggested beginning the meetings at 7 p.m., but not holding the public hearings until 7:30 p.m. especially on nights where many people are in attendance and the public Page 4 of 4 hearings are expected to last a while. By holding the regular portion of the meeting first, some of the developers then wouldn't have to sit though a lengthy public hearing. Also, he said that the Plan Commission would continue to have two monthly meetings if there are more than three public hearings slated. He said the intent is to hold the public hearings at the first meeting of the month. However, if there are more than three public hearings scheduled,he'd prefer that a second meeting be added. Crouch and Jones agreed with Lindblom's suggestions and suggested that the Plan Commission try restructuring the meetings. Joe Wywrot suggested final acceptance of public infrastructure along Westhaven and Del Webb Blvd. not be accepted until 70 % of the units are built out(per city ordinance). Proposed revisions to annexations include re-platting of individual roadway lots, consecutively. Unit Two will have a permanent connection of the SE street to the commercial area and the language regarding gating of the right of way (which would be determined by the residences). The frontage road going to the commercial area is private. There will be sidewalk along Westbury Blvd. on the opposite side. The construction traffic will have access into the cul-de-sac (the residents,police and fire will determined the gate coding for accessibility). The second entrance will be Del Webb Boulevard. The majority of the engineering comments pertain to bringing specifications to city standards. The water main goes up Westbury Blvd. and a second feed under Galena (at west end of Westbury) or through the commercial. The stub to Bailey Meadows will be east of the Schultz property. The Bailey Meadows annexation agreement will be checked for assignment of responsibility for sewer costs across the Com Ed. Water hydrants should be marked with bags until they are in service. The plats will be prepared consecutively, by PUD Units with those with residential lots. Engineering plans should correspond to the specific unit of plats. Anna Kurtzman cautioned the developer regarding the placement of entryway monuments, showing proposed easements. This will be presented at the June 28t`Plan Commission. 1 Grande Reserve Unit 24—Final Plat Anna Kurtzman requested lot width at building setback lines. Lots 1055 and 1081 need rear and side yard identification. Lot 3063 could be conveyed to the park department or HOA. The city was deeded all area behind neighborhood 19, and this area could be used as parking. Dave Mogle will check with the park board on this issue. Lot 3062 has more street frontage and there is a bike trail easement through this area to get to the conservation area. The developer will label the parks (3062) and trails (going north from lot line between 1063 and 1064). The area east of this trail will be conveyed to the home owners' association. All streets should have 25' right of ways at intersections. Bill Dunn requested an additional 5% contingency line item to cover increases in paving costs. Midwest Technical's comment letter will be copied to EEI. The Autumn Creek Phase II will be building within the year. Secondary access point in Autumn Creek is through the field entrance crossing the AT& T easement(non vacated)to the un-named street. There is 75' of build-able area(no fill area) in the lots abutting this easement. Grande Reserve could use lot 1099 or 1100 to Kennedy Road to provide a second access. Jason Nijim stated Units 19 probably would be in late 07 or early 08. John Whitehouse stated the developer should provide 100' right of way between units 17 and 24 for Kennedy Rd. improvements. The city is asking for plans and specifications on the engineering plans for the retaining wall between 1088 and 1074. e. Building permits allow a 3 foot wall. Heartland Crossing Preliminary PUD Plan The correct density is 1.84, excluding the commercial component. There are block lengths exceeding 1520 feet. EEI's storm water group will meet with the developer. Variances noted were minimum 30 foot buffers between property lines, maximum two foot bounce for 10 yr. storms, access points for Rt. 47 should be addressed after zoning approval and responses from IDOT. In addition, a variance is being suggested for side slopes for 4:1 vs. 5:1. Joe Wywrot pointed out that because there are residential areas close to the commercial areas, he felt the ratio should be 5:1. The developer will negotiate further with the city regarding these variances, which should be noted on the plans. The developer will shift lot 100 to align the pathway in a straighter path coming from between lots 80 and 99. The Army Corps has accepted the delineation report. On lot 821 a full access is being proposed to the south. The commercial developers in contact with Marker are interested in having a full access on the parcel and segregating the residential and commercial traffic. The spacing of full access between Ament Rd. and Wheeler is locked in according to Pete Huinker. The city proposed a 2 northern extension of the road between lots 343 and 310, intersecting it with a western extension of the southern-most proposed full access in Lot 821. The layout will be contingent on the commercial concept design layout and determined before platting. Travis Miller stated 805 and 807,private HOA parcels, might have cross connections (at 700 and 585). Discussed was whether the cross streets proposed would actually aid the residents in getting traffic to intended destination and if this would be for traffic movement and flow. The police department does not have objections leaving the street plans as they are presented. An initial signage plan should be presented to the City in conjunction with the ADT analysis. Dave Mogle would like a dividing line between the HOA and the city on lot 795. and on lot 810/lot 433 on the final plat. The storm water management easement along Aux Sable creek allows for trail placement. Language regarding water hydrant bagging before full use will be in the annexation agreement. This will be presented at Plan Commission on June 14. Wal-Mart Zoning, Preliminary Plan and Variance Anna Kurtzman stated lot configuration poses problems for building permit issuance. All lot must have direct access to a public street. An option would be a PUD, then designation can be made for the front of each lot. A zoning front does not mean the building needs to be oriented toward the front. The code states the front of the lot abuts the right of way. There is also split zoning and to establish setbacks the plat needs to be changed or rezoned. The petitioner stated the plan and plat are two separate issues, because Mr. Hamman wants subdivision of his property in the plat. Regarding the plat, Wal-Mart is asking for site plan approval of their lot. Lot 9 is partially zoned R-2 and the petitioner has applied for re-zoning. Travis Miller recommends moving forward with Lot 9 now as Unit 1,then submitting separate applications for subdividing the rest of the property, beginning with Unit#2. Cross access easements and shared parking easements should be provided. In reference to covenants on the plats, language should state "there shall be access between parking facilities". The design of Crimson Lane will be shown conceptually on the Wal-Mart plans, but will be submitted separately. This project is Don Hamman's,not Wal-Mart's specifically. Improvements will be shown conceptually on the Wal-Mart plans. The street to the north, Prairie Clover Drive, is anticipated to intersect with Clover Lane somehow. Travis Miller strikes the comment#2 regarding sidewalks (shown on this plan for outlots 2-5). There will be a sidewalk along the Rt. 34 frontage. Parkway trees along Rt. 34 should be shown along the frontage of the property. Twelve additional trees should be added to the interior parking lots, and trees can be added to the vacant islands. The Plan Council reviewed the preliminary plan submittal May 25,2006 and advised the petitioner to reduce the subdivision request from 29 lots to the western most 6 lots resulting in the submittal of`Yorkville Crossings Unit F preliminary plat. The purpose of this recommendation was based on the current zoning of the western most lots will need to be revised similar to the 6.22 acre rezone request in the northwest corner of proposed lot 1 prior to consideration of subdividing this acreage. Due to public notice timing and the desire for Wal-Mart to proceed as rapidly as possible,the Plan Council and petitioner agreed the most effective method would be to revise the preliminary subdivision request to only the property Wal-Mart is purchasing and we will review the zoning and subdivision of the western lots at a later date. 2. Recommend providing a sidewalk along the north edge of the frontage lots; Preliminary Landscape Plan 1. Recommend providing the required parkway trees along Route 34 as part of this subdivision plat(1 per 50 lineal feet); 2. The quantities of plant material meet or exceed the Landscape Ordinance requirements for buffers, perimeter and lot landscaping; 3. The interior parking lot tree plantings are deficient by 12 shade trees. Recommend planting trees within all of the seven(7)vacant islands to address this deficiency; 4. Review the engineering and place said easements where needed and dimension. 12.Certificates will need to be placed on the final Plat in the language and format developed by the United City of Yorkville and can be obtained by request (this information mentioned here to help expedite future Final Plat approval). 13.The Parking Setback lines should be shown and labeled along the northerly property lines of Lots 1 and 2. 14.The name and addresses of the Owner, Subdivider/Developer should be provided on the plat. 15.The gross area of the proposed subdivision should be placed on the plat.
