This agreement is made and entered into this day of 2003, by and between THE UNITED CITY OF YORKVILLE an Illinois municipal corporation (the "city"), and the NEW LIFE CHURCH OF YORKVILLE, INC., an Illinois not-for-profit corporation (the "Church"). WITNESSETH WHEREAS, the City is the owner of the Skate Park (the "Park") which the Church wishes to obtain from the City and the City wishes to offer the Church the Skate Park equipment on the terms and conditions set forth herein. NOW, THEREFORE, in consideration of the covenants and agreements hereinafter contained, it is mutually agreed by and between the parties hereto as follows: FEES FOR USE. The City agrees to waive fees associated with the sale of the skatepark equipment in exchange for the Church's assistance with removal and restoration of the property known as parfection park, skate park. FURTHERMORE, The church agrees to complete the restoration of parfection park site to its original status through the disassemble and removal of the skate equipment, pavers, fencing; and canopy, and breaking up and removal of the concrete; and the removal of the gravel and providing of the black dirt fill. The City will coordinate the removal of the building, drinking fountain, landscaping and the disconnection of the utilities. Operation of Skate Park In recognition of the donation by the City of the Skate Park equipment, the Church agrees to operate the Skate Park for open to the general public during the posted times as established by the Church. In addition, the Church will operate the park without assessing a fee for use for one year. After said time the Church will fulfill their obligation and determine the best administrative practices for the future use. Maintenance Agreement. In agreeing to obtain the Skate Park equipment from the City, the Church agrees to assume all responsibility and liability associated with the maintenance of, and the operation of the equipment. Insurance The Church shall maintain appropriate liability coverage to cover all parties associated with the church during the removal of the skate park equipment and the work during the restoration of the parfection park property. Furthermore, the church shall provide their own coverage for the operation of the skate park at the 3205 Cannonball Trail site. Waiver of subrogation. The Church waives all rights against the City for recovery of damages to the extent these damages are covered by the liability insurance maintained pursuant to this Agreement. Indemnification. To the fullest extent permitted by law, the Church will defend, indemnify and hold the City harmless from all claims arising directly or indirectly from or in connection with (i) the conduct or management of the programs and activities of the Church; (ii) any act, omission or negligence of the Church or any of its directors, officers, agents, employees, invitees or contractors of the Church; (iii) any accidents, injury or damage whatsoever occurring on or at the Skate Park arising from, directly or indirectly, the use of the Park by the Church or any of its directors, officers, agents, employees, invitees or contractors, as well as participants in the Church's programs and activities except to the extent of any negligent or wrongful act or omission of the City. However, this limitation shall not in any way limit the Church's duty to defend the City. CITIZEN COMMENTS Helen Drew Mitchler of 7542 Route 34 West addressed the City Council with concerns about the Grande Reserve development. The following answers were provided for Mrs.Mitchler's questions(see attached): • Mayor Prochaska explained that he was not sure who the current owner of the property was because there are contracts for the property which may not have closed yet. He explained that this process is not uncommon. • The property is currently unincorporated. • Moser Enterprise petitioned the United City of Yorkville for annexation. The Minutes of the Regular Meeting of the City Council-May 27,2003-page 2 • If the United City of Yorkville denies the annexation the developer could petition Kendall County or another community. If the development stays in the County it would be unincorporated. • Construction is estimated to begin in spring of 2004. • Wells are contingent on permits from the Illinois Environmental Protection Agency (IEPA)and as long as they are approved,they can be dug. They will be dug at the developers risk if the annexation is not signed at the time they begin digging. The wells shouldn't affect the water table or springs but Administrator Graff suggested that Mrs. Mitchler discuss this with the developer's engineers. • Mayor Prochaska explained that the Illinois Department of Transportation(IDOT)is beginning their Phase I engineering of Route 34 from Route 47 to Orchard Road. When this is finished they will immediately go into Phase II engineering. Currently there isn't a date for construction. Administrator Graff explained that annexation agreement requires that Bristol-Ridge Road,Kennedy Road,etc.are widened however this will be determined by the phasing of the development. Also,there will be traffic signals placed at five intersections. • It was clarified that eight City Council members would be voting on the annexation. • The development does not have to be approved by the County but the County has been in discussion regarding the roads. Robert Mitchler of 7542 Route 34 West addressed the Council. He explained that he has been a precinct committee member since 1954 and he has been receiving calls regarding the development. He stated that the main concern people have is for the density of the development. He asked the Council to consider the lot sizes being requested by the developer and cited Blackberry Oaks and White Oaks subdivisions as positive examples of areas with large lots.He stated that another concern was the roads and traffic. Property owners are concerned that easements will be taken from them instead of the developer to widen the roads. Mayor Prochaska suggested that concerned residents contact the state and IDOT with their concerns since they are currently engineering the widening of Route 34. The widening will take place whether or not the development goes through. Mr.Mitchler also expressed concerns with open burning allowed in the County and its affects on the new homes. He stated that he was not addressing the Council to complain but to bring resident's concerns to the attention of the Council. Glenna Patterson of 2625 Kennedy Road addressed the Council. She stated that her concerns are similar to the Mitchler's but her main concern was if she would lose property if Kennedy Road is widened. Mayor Prochaska explained that if the City annexes the Moser property,the City annexes to the far side of the right-of-way so that the whole street becomes the City's responsibility. Administrator Graff noted that according to the engineering plans,no right-of-way will be taken from any of the existing homes on Kennedy road. The right-of-way will be taken from The Grande Reserve. George Patterson of 2625 Kennedy Road asked if the developer would follow the whole project through to the end. Mayor Prochaska explained that the developer places funds into Letters of Credit with the City which are held until certain things on a punch list are completed properly. This ensures that the developer doesn't walk away until the development is finished. PUBLIC HEARINGS PC 2002-16 Menard's Residential Mayor Prochaska entertained a motion to go into public hearing for PC 2002-16 Menard's Residential:Menard,Inc.,petitioner,requests to annex to the United City of Yorkville and rezone from Kendall County A-1 Agricultural to United City of Yorkville R-2 Planned Unit Development and for hearing as to the Annexation and Planned Unit Development Agreement of petitioner.The real property consists of approximately 142 acres and is located on the south side of Kennedy Road,approximately 1,300'east of Route 47,Bristol Township,Kendall County, Illinois. Alderwoman Spears noted a correction needed on page 8,second paragraph,fourth line should read"However,Montgomery officials have indicated...." The word "don't"should be removed. BILLS FOR APPROVAL Alderwoman Spears clarified that one portion of checks was coming out of the fiscal year 02/03 budget and the other out of the fiscal year 03/04 budget. A motion was made by Alderwoman Spears to approve the paying of the bills listed on the Detailed Board Reports dated May 22, 2003 and May 23, 2003 totaling the following amounts: checks in the amount of$597,243.72(vendor for fiscal year 02/03),$87,747.47(vender for fiscal year 03/03)for a total of$684,991.19;seconded by Alderman James. Mayor Prochaska noted that he has a team participating in the"Relay for Life". He stated that he had a few openings on the team if anyone was interested in joining him and also donations are welcome. The Minutes of the Regular Meeting of the City Council-May 27,2003-pare 4 Pork Chop Dinner Mayor Prochaska reported that the Citizens Police Academy Alumni are holding their annual Pork Chop Dinner on May 29,2003 from 4:30 to 7:30. Dinners are$8.00/person and this is the main fund raiser for the group. Grande Reserve Letters Mayor Prochaska reported that he received two letters regarding the Grande Reserve Subdivision. He read letters from Lois Seaton and Jessica Lee. Please see attached. Mayor Prochaska commented that the Council would take all comments into considerations. He noted that the issue of parks was addressed in Ms.Seaton's letter and he noted that the Youth Baseball had to turn children away due to the lack of baseball fields. He wondered if several residents would be willing to put their yards together to form a baseball diamond if we are not going to have any parks. Alderman Sticka commented that this is the first time he has heard someone object to the city having parks. ATTORNEY'S REPORT No report. CITY CLERK'S REPORT No report. DIRECTOR OF PUBLIC WORKS REPORT Public Works Director Eric Dhuse reported that the areas of street that were affected by water main breaks were saw cut and will be paved soon. Alderwoman Spears asked what could be done about those who put brush out after the pick up because the next one isn't until the end of June. Administrator Graff stated that he would check with the Building Department to verify if this was a violation of the property maintenance standards. CHIEF OF POLICE REPORT No report. COMMUNITY&LIAISON REPORT Alderman Ohare thanked Chief Martin,Administrator Graff and Bill Dettmer for working to get the grass cut at the abandon house on Freemont Street. ECONOMIC DEVELOPMENT COMMITTEE REPORT PC 2003-05 Heartland Circle—Final Plat A motion was made by Alderman Sticks to approve PC 2003-05 Heartland Circle Final Plat, Units 1,2 and 3,subject to final engineering approval by the City Engineer before the Mayor and City Clerk execute the Final Plat documents;seconded by Alderman James. Alderman Sticka commented that the final plat conforms to the preliminary plat. Administrator Graff stated that City Engineer Joe Wywrot did have a few issues with sewer, water and streets. • The Minutes of the Renular Meeting of the City Council-May 27,2003-pane 5 Alderwoman Spears asked if Chief Martin's concerns were going to be addressed and Administrator Graff stated that these would be addressed under the engineering review. ADMINISTRATION COMMITTEE REPORT No report. ADDITIONAL BUSINESS Transmitter Alderman Munns asked Chief Martin if he had any complaints regarding radio problems on Countryside Parkway near Pizza Hut. He stated that he lost his car radio signal in that area and he wondered if there was a transmitter in the area. Chief Martin stated he would check into it. City Administrator Alderman Sticka commented that recently the Council received a copy of a letter criticizing the City Administrator. He stated that his personal view was that Administrator Graff has been very effective in doing his job. He noted that the Administrator has a difficult job and there are a lot of different situations happening in the City which he has addressed well. Memorial Day Activities Alderwoman Burd thanked everyone who was involved in the Memorial Day event. She stated that the park looked beautiful,it was a nice event and it was well attended. Mayor Prochaska also thanked the American Legion for the new plaques on the memorial,one for each branch of the service. He also thanked all those who participated. To the Editors: When schools are built on donated land from MPI, the burden will still be on all taxpayers including senior citizens on fixed incomes and other residents who do not have school children. MPI is planning 10 parks for Grande Reserve (in Bristol Twp.) And also lots that are too small: parks attract many people from other areas and create over-crowding. Larger lots would allow children to play in their own yards and provide a safer atmosphere. Who pays the taxes for all these parks? Why is MPI allowed to inconvenience the people living in 9 homes on Sunset Ave. and Bristol Ridge Rd., in River Ridge Subdivision, by joining the road entrance to Grande Reserve with that of Sunset Ave.? This needs to be addressed. Kendall Co. and Bristol Twp. Need to very carefully control housing development! Please do not allow developers to control Kendall Co. This letter addresses some of our concerns about the Grande Reserve development. The original was presented to the Bristol Township Planning and Zoning Board on May 7,2003. At this time we ask that you share this'letter with the City Council, and please keep our concerns in mind as you make your development plans with Moser Enterprises. Our first concern is the proposed town homes and apartment complex as we feel it will create the following problems: • Decrease our property values • Close in our open area • Increase population density • Cause on street parking and abandoned cars • The apartments will bring in transients (persons who will not take pride in property appearance because they do not own the property) The residents of Lynwood that we spoke to would like to see only single family homes in Grande Reserve. We would like to point out that of the 4 developments on the Moser web site Grande Reserve is the only one that is not exclusively single family homes. Our second concern is the buffer zone between Grande Reserve and our existing homes, Moser Enterprises has had plenty of time to respond to this issue and still has not provided information as to: • Will the barrier be high enough and wide enough to separate us from Grande Reserve • What will the barrier be (trees, fencing, land berm, etc.)(Most residents feel a land berm with evergreens on top would be nice) • Does their 25' include the utilities easement or is it in addition to the utilities easement • Why is there no buffer zone between 18 Anna Maria and Grande Reserve? COUNTY OF KENDALL ) ORDINANCE 2003 - AN ORDINANCE AMENDING ORDINANCE NO. 1990-24 AN ORDINANCE SETTING FORTH THE STANDARDS AND REGULATION FOR PAYMENT FOR DEVELOPMENT AND EXTENSION OF UTILITY COSTS UPON ANNEXATION AND/OR PLANNED UNIT DEVELOPMENT WHEREAS,the UNITED CITY OF YORKVILLE is currently experiencing a substantial increase in population, together with the need to expand existing municipal services to provide for orderly growth and adequate municipal services; and WHEREAS, the UNITED CITY OF YORKVILLE has thoroughly reviewed the need for expanding municipal services and the need for capital purchases and conducted a study to support increases in the fees provided herein; and WHEREAS,the UNITED CITY OF YORKVILLE has thoroughly reviewed the cost to be incurred to provide for the expansion of said City services;and WHEREAS, the City has determined that the following fees bear a rational relationship to the costs anticipated to be incurred by the various governmental entities and departments of the City to be affected; and —1— 06/06/2003 16:23 FAX 630 553 5764 DANIEL J. That a new capital fee in the amount One Hundred and 00/00 Dollars($100.00) per residential dwelling for each unit annexed, zoned, and platted for residential development after the effective date of this Ordinance for the UNITED CITY OF YORKVILLE ENGINEERING DEPARTMENT shall be enacted for the acquisition and maintenance of engineering equipment and other capital purchases. 5. That a new capital fee in the amount Fifty and 00/00 Dollars ($50.00)per residential dwelling for each unit annexed,zoned, and platted for residential development after the effective date of this Ordinance for the UNITED CITY OF YORKVILLE Parks and Recreation Department shall be enacted for the acquisition and maintenance of equipment and other capital purchases to maintain and service park facilities. 6. The various parts, sections, and clauses of this Ordinance are hereby declared to be severable. If any part,sentence,paragraph, section, or clause is adjudged unconstitutional or invalid by a Court of competent jurisdiction,the remainder of the Ordinance shall not be affected thereby.
