Citizen Comments: None Minutes for Correction/Approval: July 5, 2017 The minutes were approved on a unanimous voice vote. New Business 1. EDC 2017-53 Building Permit Report for June and July 2017 Ms. Noble reported the same number of permits were issued this June and last June, but the calendar increase was 9 more permits in 2017. July 2016 had more permits than 2017, but overall there were 7 more permits issued this year. 2. EDC 2017-54 Building Inspection Report for June and July 2017 In June there were 338 inspections and most were final inspections for homes. In July there were 274, averaging 6-7 per day, per inspector. Most of the inspectors' time is spent in the field, said Ms. Noble. Page 2 of 3 3. EDC 2017-55 Property Maintenance Report for June and July 2017 In June, there were 106 property maintenance inspections and 44 in July. Alderman Colosimo questioned property violations on Morgan St. which staff is still researching. 4. EDC 2017-56 Economic Development Update Ms. Dubajic reported the following: 1. Working with entrepeneur (owner of Fisherman's Inn & Encap) on proposed restaurant along Fox River 2. Yorkville Dairy Queen is the only official training facility in Illinois and employees will come to Yorkville for training. They have partnered with Hampton Inn to create 750 stays there. 3. A builder is purchasing 28 lots in Kendall Marketplace and will close the end of month. 4. Go For It Sports will have trusses raised this week. Mr. Olson added that an agreement has been reached with the developer for an easement off Galena Rd. to access the park site. A left turn lane will be constructed and the City will pay for half the cost. 5. Many other sites on Rt. 47 & 34 are being considered 5. EDC 2017-57 Overlap District RFP Ms. Noble said staff has been working on some of the goals established in the Comprehensive Plan, one of which is to create a streetscape for the downtown. The RFP will allow the City to bring in professionals to help with the design process. She hopes to have the RFP on the September 12 Council agenda and after interviews in early October, will bring this back to EDC on October 7 to award a contract. There is $25,000 budgeted this FY for the project. 7. EDC 2017-59 Sidewalk/Parklet Café Ordinance (out of sequence) Ms. Noble said a business has inquired about outside seating, however, the area would be in the public way. The City does have an ordinance allowing outside uses, however, they were on private property. An ordinance was drafted to allow this as a temporary use during business hours. There would be separate components relating to liquor licenses in this setting. Staff felt this was a good opportunity for a downtown outside cafe and parklet (built out into parking spaces). Not more than half of available parking spots can be used. Ms. Noble said this would be similar to Plainfield and would not be allowed on Rt. 34 or 47. Such requests will be reviewed on a case-by-case basis. Restrictions on smoking, loudspeakers and the hours of use were also discussed. Temporary items (tables/chairs) would need to be taken in after hours. This moves to the Public Safety Committee, Planning and Zoning Commission and City Council. 6. EDC 2017-58 Downtown TIF Districts Mr. Olson said notifications to the taxing entities and other interested parties will be one of the first steps in the creation of a new district. He shared information about the boundaries and Attorney Orr's opinions about the process of forming a new TIF. Mr. Engberg showed a map of the TIF boundaries and said 60 parcels from TIF #1 would be moved to TIF #2. He gave an overview of the following components: Page 3 of 3 Eligibility Report He said there are several criterion for the eligibility report including age of the building, utilities, non-conforming structures and decline in EAV. He said a survey of the buildings had been done this summer and the eligibility report supported the creation of a new TIF. Housing Study This study was required and staff compiled a list of all units in the designated area The demographics and housing availability of the area were also considered. Redevelopment Plan A plan was developed by Attorney Orr and shows why the TIF is being placed there, eligible activities, costs, what is trying to be accomplished, fiscal impacts, taxing bodies, effect if children are added and budgets for various projects. TIF District Extension Not discussed The criterion for a historic structure and the TIF budget were also discussed. Alderman Funkhouser requested a breakdown of the $14 million for the TIF project. Mr. Olson presented a timeline of the key upcoming dates and said a vote would be taken at the October 10th Council meeting. The next steps will be to publish a notice for interested persons/landowners and a notice will be sent to the taxing entitites. A Joint Review Board will be held in November and a required Public Hearing will be held in December. Mr. Olson outlined the formal process that will occur. This experienced restaurant operator desires to have the building become a very special “place” and would like to incorporate the na tural beauty of the Fox River into their plan. They have the property under contact, and will begin the rezoning process tonight. This entrepreneur also has a vast knowledge of nature and the environment. This project will be a wonderful complement to the City’s river front park area, and Town Square Park area. - Working with business locking at leasing space one of the existing buildings. Development south of Fox River: - Working with owner of out lot and building that is half completed at Stagecoach Crossing to spur continued development on the site. At this time we are working on financing and application for Enterprise Zone status. Development north of the Fox River : - Kendall Crossing…Sonny Shah has applied for permits for the Holiday Inn Express site. Construction fencing is up, and development will begin immediately. Sonny Shah has also met with an architect for the banquet facility. Plans will be finalized shortly. It is a possibility that the banquet facility will be completed and own prior to the hotel opening. - There are two Yorkville businesses that are discussing expansion on their current sites. These are both business that have been successful, and active business members of Yorkville. - Kendall Marketplace…Working with Alex Berman (owner) to identify potential addition al development on the project. Alex is working on developing a multi-tenant out lot building to attract small restaurants to the site. Alex has also entered into a contract for the purchase of the 28 single family lots with a local builder. These lots will close by the end of the third quarter of the year. The junior box approval is getting closer, as more of the existing retailers have “signed off” on the new addition. - Working with a developer interested in assembling parcels on Route 47 north of the river to create a small retail development site that would allow for a combination of single use buildings and multi-tenant buildings. I am also working with that developer as he has relationships with retailers looking at the site. - Working with developer interested in a significant parcel along Route 34 for development. This project would allow for free standing outlot development, and a multi-tenant building to be built. Industrial Development: - Working with Joyce Sloan, the industrial broker, who is the listing agent on Lincoln Prairie on Eldamain Road. - Working with Wrigley to meet their needs to increase their production of Skittles in the Yorkville plant. Recreational Development: - Continue to work with Justine Brummel on “Go For It Sports” facility. Barksdale-Noble, AICP Community Development Name Department Summary: Staff is seeking to extend the B.U.I.L.D. Program for a maximum of one-hundred (100) permits or until December 31, 2018, whichever comes first. Background & Request: As the Economic Development Committee knows, the last extension of the B.U.I.L.D. program was approved September 13, 2016 via Ordinance 2016-52 which allowed the incentive to run until December 31, 2017. To date, the City has processed 401 B.U.I.L.D. permit applications since the programs launch in 2012 compared to only 178 traditional single-family residential building permits during the same time. Due to the widely successful impact the B.U.I.L.D. program has had in the recovery of new home construction in Yorkville and the positive feedback from builders and homebuyers alike, staff is seeking the Economic Development Committee’s interest in extending the B.U.I.L.D. program for a maximum of one-hundred (100) permits or until December 21, 2018, whichever comes first. This would allow for an orderly wind-down of the program, as permits for B.U.I.L.D. have lessened over the last year (see chart below): Below is a brief refresher of how the program actually works, its documented success, and the merits for continuing the incentive beyond its current expiration. Incentive Program 7th Extension Request Program Overview: How it Works The B.U.I.L.D. program offers two (2) key benefits, which are: • To assist the developer/builder under the B.U.I.L.D. program, payment of building permit and impact fees are delayed until the issuance of the certificate of occupancy on the condition that the certificate is issued within one (1) year from building permit approval. • To assist the homebuyer, the City rebates a portion of the building permit fee, up to $5,000.00 with a matching contribution up to $5,000.00 from the builder/developer, and presents the homebuyer with a check for up to $10,000.00 after closing and upon issuance of the final certificate of occupancy. Developments with Building Permit Fees less than $5,000.00 are only eligible for a City refund up to the amount paid for the permit (ex. Windett Ridge’s average building permit is $2,500, therefore the City’s refund would be $2,500 with the developer’s match of $2,500 for a total rebate to the homebuyer of $5,000.00). These incentives are in addition to the municipal building impact fee being reduced from $5,509.00 per residential unit to $1,759.00 per residential unit. To qualify for the B.U.I.L.D. program, the property must be a new construction single-family detached structure. The developer/builder must provide proof of sale or contract for sale of the lot prior to issuance of building permit, and changes in buyer or cancellation of sales contract must be reported to City immediately. Finally, the builder/developer must sign a “Developer Contribution Agreement” consenting to match, dollar for dollar, up to $5,000.00 the required contribution to be paid to the homebuyer at issuance of the certificate of occupancy. The builder’s matching contribution is collected at the same time the building permit fees are due. Merits of Program: Comparison to Area Communities In addition to analyzing permit trends within the City since implementing the B.U.I.L.D. program, staff has also prepared a comparison of building permits pre- and post-recession of neighboring communities to graphically understand the impact the B.U.I.L.D. initiative has had in making Yorkville a competitive community for new housing starts. 1 As of August 30, 2017 PRE-RECESSION RECESSION B.U.I.L.D. Yet during the years of the recession, 2009-2011, the steady decline in permit issuance landed Yorkville behind Oswego, Plainfield and Montgomery in new residential construction. During this time several developments within the Yorkville were in various stages of foreclosure and the beginning of the fee/ordinance locks of approved annexation agreements were beginning to expire. The latter part of this time period also saw some communities, such as Plainfield and Sugar Grove; begin to explore lowering or rebating building permit fees to incentivize development in stalled subdivisions. Specifically, Plainfield implemented a resolution in March 2010 which eliminated certain impact fees (annexation, municipal, traffic, and beautification fees) which reduced a typical new home building permit in Plainfield from $22,500 to $15,500, a reduction of $7,000. However, upon the adoption of the B.U.I.L.D. program in 2012, and with the pace of new construction picking up, Yorkville has begun to regain its position in the market surpassing Plainfield, Montgomery and Oswego for calendar year 2016 and as of August 2017. It should also be noted that the success of the B.U.I.L.D. program has even caught the attention of Montgomery, Oswego and Plainfield, all of which have contacted staff within the last few years seeking additional information on the incentive. Program Feedback Finally, as part of the B.U.I.L.D. check issuance process, we ask the homebuyers to complete a brief survey providing feedback on their experience with the program. To date, we have received 334 completed surveys from those buyers and have tabulated their responses in the attached summary. Overall, the program has been successful in its main objective, which was to stimulate development in the City and influence those who would otherwise not build new or not build in Yorkville to do so. As demonstrated in the survey results, 80% of the respondents said that the B.U.I.L.D. was extremely or very influential in their decision to purchase a new home in Yorkville and 66% strongly or somewhat agreed that they would not have moved to Yorkville this year if not for the B.U.I.L.D. program. In addition, 80% of the respondents had looked at other communities to either buy or build a new home, but ultimately decided to build new in Yorkville. Staff Recommendation: Staff recommends that the Buyers of Undeveloped Infill Lot Discount (B.U.I.L.D.) program be extended for a maximum of one-hundred (100) permits or until December 31, 2018, whichever comes first. It is our intention to gradually wind down the program in a manner that will allow the builders that currently utilize the program to close out their inventory and price/market new housing products accordingly. Krysti Barksdale-Noble, AICP Community Development Name Department BACKGROUND & REQUEST: The petitioner, Mark Southern (contract purchaser), on behalf of Michael and Molly Schomer, property owners, has filed an application with the United City of Yorkville, Kendall County, Illinois, requesting rezoning approval from R-1, Single-Family Suburban Residence District and R-2 Single Family Traditional Residence District to B-2 Retail Commerce Business District. A variance is also sought by the petitioner to reduce the minimum required rear yard setback in the B-2 zoning district from twenty feet (20’) to zero feet (0’). The real property, comprised of two parcels, is approximately 1.05-acres and is located at 104 North Bridge Street, just east of Illinois Route 47, south of E. Main Street, immediately north of the Fox River and west of Ron Clark Park in Yorkville, Illinois. Currently, a single- family home is situated on the property which straddles two (2) parcels. As proposed, the petitioner will demolish the existing home and construct a two- story building with surface parking which will contain an approximately 12,000 square foot restaurant and banquet hall. The main floor of the building (~8,000 square feet) will house the food service and restaurant operations while the lower level, about 4,000 square feet, will be used as the banquet facility. The building is planned to be constructed immediately adjacent to the eastern property line, thereby necessitating the zero foot setback due the unique constraints of the topography in the area. The site topography also dictates stairs be proposed along the western walkway around the building to access the delivery area and trash enclosure. The parking lot will be constructed to the north of the restaurant structure along the eastern and western property lines. The plan illustrates utilizing the existing right-in/right out access drive off of Illinois Route 47 for deliveries. However, the primary access point for this proposed project will be constructed north of the property off of East Main Street through Ron Clark Park via a public/private partnership between the petitioner and the City whereby additional parking for the recreational area will be provided. This public/private partnership will be memorialized under a separate development Memorandum To: Economic Development Committee From: Krysti J. The park will also serve as an intervening land use and densely screened landscape buffer between the proposed commercial use and the nearby existing residential homes. Finally, the minimum off-street parking requirement for the proposed restaurant has been met on site via 38 parking stalls and bicycle racks. While no monument site signage has been illustrated on the plan, it is anticipated such signage will be incorporated into the final site design and signage details will be reviewed at time of building permit and will be required to adhere to the current sign ordinance regulations. EXISTING CONDITIONS: The existing zoning and land use for properties surrounding the subject property are as indicated below: Zoning Land Use North OS-1, Open Space (Passive) Ron Clark Park (City) East OS-1, Open Space (Passive) Ron Clark Park (City) South Waterway Fox River West Transportation Corridor Illinois Route 47 (Bridge Street) COMPREHENSIVE PLAN COMPLIANCE: The City’s Comprehensive Plan Update 2016 designated this parcel as “Traditional Neighborhood Residential” and “Parks and Open Space”. In general, the Traditional Neighborhood Residential designation is intended primarily for single-family detached residences, “preserving and maintaining the…scale and design of the existing housing stock.” While the Parks and Open Space land use designation is intended to preserve existing active centers for recreational activity through a well connected system of open spaces, trails and “green” infrastructure. However, the Comprehensive Plan Update 2016 offered a more detailed analysis of areas within the City that abutted major thoroughfares as part of a corridor study, further defining the relationships and development pattern of future land uses and surrounding neighborhoods. In Section 8 – Corridors of the updated plan, the subject property is identified within Zone F (Walnut Street to Fox River), it is envisioned that the existing residential development pattern be preserved and branding elements, such as streetscape and gateway signage, be installed to promote this areas characteristic as one of the “Old Bristol” neighborhoods. 3 Although the proposed commercial land use is not consistent with the future land use designation as Traditional Neighborhood Residential”, the Zone F area identified in the Comprehensive Plan Update 2016 does recognize this location adjacent to a major arterial roadway as having small-scale office, retail and institutional uses scattered throughout. Since it is the intent of the petitioner to enhance the park and open space areas nearby and on their property to take full advantage of the mature landscaping and river front views, it is staff’s recommendation that the petitioner maintain the neighborhood scale, and incorporates high quality development design with a “nod” to the surrounding “Old Bristol” residential character. AMENDMENT CRITERIA: Section 10-4-10-B-3 of the City’s Zoning Ordinance establishes standards for proposed amendment requests. Where the purpose and effect of the proposed amendment are to change the zoning classification of a particular property, the Planning and Zoning Commission shall make findings based upon the evidence presented to it in each specific case with respect to the following matters: 1. The existing uses and zoning of nearby property. 2. The extent to which the property values are diminished by the particular zoning restrictions. 3. The extent to which the destruction of property values of plaintiff promotes the health, safety, morals or general welfare of the public. 4. The relative gain to the public as compared to the hardship imposed upon the individual property owner. 5. The suitability of the subject property for the zoned purposes. 6. The length of time the property has been vacant as zoned considered in the context of land development in the area in the vicinity of the subject property. 7. The community need for the purposed use. 8. The care to which the community has undertaken to plan its land use development. The Petitioner has provided written responses to these amendment standards as part of their application and requests inclusion of those responses into the public record at the October 11, 2017 Planning and Zoning Commission meeting. STANDARDS FOR GRANTING A VARIANCE: The Planning and Zoning Commission must base its decision to vary, or recommend varying, the Petitioner’s request for minimum required rear yard setback relief of the Zoning Ordinance regulation upon the following standards (Section 10-4-7-C): 1. Because the particular physical surroundings, shape or topographical conditions of the specific property involved, a particular hardship to the owner would result, as distinguished from a mere inconvenience, if the strict letter of the regulations was carried out. 4 2. The conditions upon which the petition for a variation is based are unique to the property for which the variation is sought and are not applicable, generally, to other property within the same zoning classification. 3. The alleged difficulty or hardship is caused by this Title and has not been created by any person presently having an interest in the property. 4. The granting of the variation will not be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located. 5. The proposed variation will not impair an adequate supply of light and air to adjacent property, or substantially increase the congestion in the public streets, or increase the danger to the public safety, or substantially diminish or impair property values within the neighborhood. The Petitioner has provided written responses to these variance standards as part of their application and requests inclusion of those responses into the public record at the October 11, 2017 Planning and Zoning Commission meeting. STAFF COMMENTS: The City Administrator will be providing additional information regarding the public/private partnership for the additional parking on the Ron Clark Park site as part of this development. A public hearing is scheduled on October 11, 2017 before the Planning and Zoning Commission for the requested rezoning and variance. A recommendation will be forwarded to the City Council for consideration at the October 24, 2017 regularly scheduled meeting. Staff will be available to answer any question the Economic Development Committee may have at Tuesday night’s meeting. Attachments: 1. Summary Review of a discussion between the City and the 104 N Bridge St developer for a public private partnership on a parking lot to be constructed in and/or adjacent to Clark Park. Background During the discussion of the rezoning and variance application from Mark Southern for the 104 N Bridge St property, it became apparent that the size, location, and use of the property would provide some access and parking challenges. First, the right-in-right-out driveway and the location of the property adjacent to the raised median on Route 47 prevents the property from ever having full access. While the developer would have been ok with right-in-right-out access onto Route 47, the topography of the property would have required a second right-in-right-out access on the north side of the property (one entrance for deliveries, one for the parking lot). IDOT’s initial review of this plan was not favorable, which meant that we needed to look at full access to the property somewhere through Clark Park. Second, the size and use of the property posed some challenges to the amount of parking desired for the property. From a land-use perspective, we think the developer would be able to easily meet, but not exceed, the minimum parking requirements for the use of the property within the property boundaries. However, the nature of a restaurant/banquet facility means peak usage above the minimum requirements within our zoning code – so the developer has targeted additional parking spaces as necessary for successful operation of the restaurant. Very early concept plans for the property show that 40 spaces can comfortably fit on north end of the property. The building would likely sit in the middle of the property, and green space on the south end of the property. The building can not be shifted south on the property much further than the initial drawings because of the topography of the south end of the property, which means the developer has limited opportunity to add parking. Ideally, the developer would like access to an additional 40 parking spaces in the immediate area. While there are eight public parking spaces in the park off of E Main St, and there are a couple dozen spaces around Town Square, we felt that the use of the Clark Park and the problems crossing Route 47, respectively, would pose issues for regular use of the parking spaces by business patrons. All of the above led to a discussion that the City could build a parking lot and access drive across the Clark Park property which would both allow business patrons to access the 104 N Bridge St property and would increase parking for the general public for Clark Park and Town Square uses. Early proposal The 104 N Bridge St property is not in a TIF district, and while the staff expressed some willingness to explore whether the property could be added to the second Downtown TIF district (currently under review by the City Council), the property owner plans on developing the property much Memorandum To: Economic Development Committee From: Bart Olson, City Administrator CC: Date: September 27, 2017 Subject: Clark Park parking lot sooner than the TIF can be created. This meant that the City needs to look at more traditional incentive arrangements, including sales tax sharing or other methods. The discussions on property development and incentives led us to a public private partnership. Since Mark Southern is the owner at Encap and an owner of Fishermen’s Inn, he brings great expertise and a unique set of skills to environmental development, ecological restoration, and restaurant and banquet facility operations. Encap has been the low bidder on many City naturalization projects in the past. We envision utilizing Encap’s expertise and resources to both offset the City’s cost of the public private partnership and to improve the facilities within the park. Exact details of the arrangement are still being discussed between both parties, including commitment amounts and types, but the general concept is as follows: 1) Access drive and signage a. The City allows an access drive and directional/business signage to be constructed across a portion of the Clark Park so that business patrons can access the 104 N Bridge St parking lot from E Main St. 2) City parking lot a. 40 or so parking spaces get added within or adjacent to Clark Park, with a significant contribution coming from the developer for planning and construction of the spaces. b. Some form of use agreement with the developer so that business patrons have access to the 40 additional parking spaces in or adjacent to Clark Park during peak business periods. 3) Park use and improvements a. The City utilizes Encap’s expertise and resources at a discounted rate to improve areas within the park for general public use, including removing invasive species, installing high value plants and trees, and ecologically clearing areas viewpoint vistas within the park. b. The City partners with the property developer to improve the area around the existing shelter for better use as a wedding ceremony site. c. The property developer would receive be able to utilize the park for wedding ceremonies in consideration for all of the above. 4) Water and sewer service a. As a general incentive in the absence of a TIF agreement, the City has offered to replace the existing, residentially-sized water and sewer lines across the Clark Park property, with a larger water and sewer service. This offer would involve the City either contracting or performing in-house the excavation of the existing service lines and reinstallation of large service lines between the sewer and water mains near E Main St to the edge of the 104 N Bridge St property. We would expect this cost to be around $35,000 total, and could likely be funded out of the water and sewer fund. Out of the items listed above, the most important component is the access drive and additional parking. The developer has not closed on the property, but would expect to soon after a vote on the variance and rezoning application. While neither the variance nor the rezoning application require the parking and access issues to be addressed, the developer has let us know that he needs some guidance as to whether the public private partnership above has a reasonable chance of succeeding. In general, staff is supportive of the outline above. There are many hurdles yet to jump regarding: the contribution amounts for all components; cost, use, and layout of the parking spaces in and near the park; improvements to the park. However, we’ve found a willing negotiating partner and successful developer in Mark Southern and we are optimistic all of these issues can be ironed out as long as everyone is ok with the concept. Recommendation Staff requests feedback on the above proposal. CONSENT BY PROPERTY OWNERS Property:104 N.
