In Attendance: Alderman Mike Anderson— Chairman Alderman Paul James Alderwoman Rose Spears Alderman Larry Kot Chief Harold Martin Mayor Art Prochaska APPROVAL/CORRECTION OF MINUTES None Monthly Police Reports for January 2003 The Committee reviewed the reports and Aldermen Kot and James commented that they liked the summary report. Alderman Kot asked Chief Martin if he could compare the current month's number to those from last year. Chief Martin stated that he would check into this. Other items discussed were the use of the Expedition and twelve-hour shifts. The reports were sent.to the March 4, 2003 Committee of the Whole (COW) meeting. Semi-Track Trailer Parking within Corporate City Limits The Committee discussed semi-trucks and/or trailers parked on Hillcrest, John Street and in the Countryside Center. Alderwoman Spears stated that she spoke with the owner of Countryside Center, Harold Oliver, who said he would check into the situation and have the vehicles towed. Chief Martin discussed that the parking of vehicles in some areas such as the Shell gas station on Routes 71 and 47 violates city zoning. Vehicles can only park in these areas temporarily. They discussed that there are no areas in the city for people to park their vehicles long term. Chairman Anderson suggested looking at other community's policies. Mayor Prochaska and Alderman James suggested that if a policy is created, alternative parking should be identified. The Committee discussed a few specific examples of trucks parked in residential areas and Chairman Anderson wondered if the City wanted to enact legislation for three or four vehicles. The Committee also discussed vehicles hauling hazardous materials and the state laws that apply to this. It was decided that no policy would be addressed at this time however if truck parking becomes a bigger problem, the Police Department(PD) could bring it back to the Committee. Request to Replace Part-Time Officer Chief Martin reported that part-time officer Tina Baird has been gone since August 2002 and he would like to replace her. No additional hours will be added as Officer Baird's hours were divided between other part-time officers. Alderman Kot asked if the part- time salaries were holding up and Chief Martin stated that the pay range is from $12.50 to $15.00/hour. He explained that whenever the PD receives an increase the part-timers also receive a percentage. Even though no action is needed by the Council, Chief Martin wanted to inform the Committee of the hiring. Page2of3 Request Last Sergeant's Position (Operations Sergeant) Chief Martin distributed a memo requesting another sergeant's position which would place a sergeant on almost every road shift. His memo outlined who the sergeant would be supervising: • Detective • Middle and High School Resource Officers • CPAT Officer • 4 Part-time Officers The sergeant would also be in charges of: • Maintenance and care of all PD vehicles, speed trailer, equipment, squad computers, radars, portable breath testers, noise meter, RoadSpikes, cell phones, pagers, etc. • PD building maintenance issues • Upcoming PD and City Hall build-out Also, with this new position all the supervisors should be able to oversee three to four more officers per shift. This position allows for an increase in the force of sixteen more officers without creating another sergeant's position and would cost the City approximately $10,000.00/year. Chief Martin stated that he was not looking to hire a new person but rather promote a current officer. This would not leave an opening because the PD is currently testing for new officers as one new officer was already approved. He proposed creating the position in the next fiscal year. The Committee further discussed Chief Martin's proposal. Mayor Prochaska noted that there could be an increase in the salary budget next fiscal year depending on contract negotiations. He suggested that the creation of the position be delayed until the 2004/2005 fiscal year. They discussed that the sergeant's list was good for a few more years. Alderman Kot complimented the plan however he agreed with Mayor Prochaska that due to the contract negotiations looming and the recent promotion of Sergeant Hilt this should be postponed. The consensus of the Committee was that the plan for the extra sergeant was a good plan for future growth however the present personnel did not warrant an additional supervisor. It was decided to revisit the plan at a later date and Chief Martin thanked the Committee for their forward thinking and open minds. Readdress Motorcycle Unit Possibility The Committee discussed the possibility of a motorcycle unit. The unit would be good for traffic control, parades, escorts, etc. The PD suggested this be tried on a trial basis. The Committee discussed the cost of leasing the motorcycles, outfitting them with lights, full-time versus part-time officers manning the cycles, certification, etc. The Committee felt the department was not ready for this at this time however the need for the unit should be revisited next year. Chief Martin stated that he would relay this information back to the officers. Also discussed was reinstating the bicycle officers now that there is more manpower available. Page 3 of 3 McGruff Suit Replacement Chief Martin stated that it had been previously discussed that the McGruff suit needed to be replaced. He reported that he included funding in the budget for this and also the Citizens Police Academy Alumni (CPAA) offered to divide the cost of the outfit in half. The McGruff Dog Animated Costume costs $3,000.00. The costume's eyes and mouth move and it has an audio tape with songs and dialog. The Committee approved the purchase of the costume and Chief Martin stated that the CPAA will be able to present the Council with their contribution at the March 11, 2003 City Council meeting if the costume would be available by then. It was not necessary for the purchase to be discussed at the Committee of the Whole meeting. Additional Business Sidewalks Mayor Prochaska stated that with the new budget year beginning soon, he asked that more funding be placed in the sidewalk program. He asked for suggestions for safety routes and places where additional sidewalks were needed for pedestrian traffic. Alderman Anderson asked if Freemont was going to go through and suggested there be sidewalks along it if it does. Alderman James also noted there were no sidewalks on the east side of Mill Street by Circle Center School near Illini Street. Alderman Kot suggested that this be further discussed by the Public Works Committee. Liquor Sampling Ordinance Alderman Anderson stated that the new sampling ordinance only covered beer and wine however he saw in the Record Newspaper that Vat& Vine Liquors was hosting a single- malt scotch sampling. He asked Chief Martin to look into this with Vat & Vine. Polar Bear Plunge Alderman Kot asked who the check needed to be made out to for a donation to the Polar Bear Plunge and Chief Martin stated that it should be made out to Special Olympics Illinois. There was no further additional business. The meeting was adjourned at 7:30 P.M. Plock Denise Kachlic Mike Kachlic The meeting was called to order at 6:30 by Chairman Anderson. APPROVAL/CORRECTION OF MINUTES January 23,2003 minutes were approved with correction of"resident" to "Attorney" classification for Kelly Kramer, as seen under guests. VAT & VINE This coincides with the item 6 on the agenda. Proposed is the amendment from Class B to Class A, instituting sampling at both establishments. Attorney Melissa Maye, representing the owner of Vat and Vine, states she and her clients do not oppose the ordinance. She made mention of# 1D, E, G, which are incorrectly numbered. Four year Vat&Vine manager, Jill Pluck, stated she has been in the business 17 yrs, has been involved in many tastings, always assuring legal ages and consumption on the premises, provides a friendly atmosphere, and assures no legal ramifications for the owners. She believes the tasting of a product is intricately intertwined with sales of the product. Limiting of samples will limit revenue, which will, in turn affect revenue streams and taxes for Yorkville. She asks the members of the committee to reconsider the ordinance amendment; suggesting that 1) a section of the store could be set aside for tasting and that 2) it be mandated that a member of management (with a minimum number of staff) be in attendance. Owner Mike Kachlic suggests "tasting", usually targeting wine and beer consumers, does not promote casual drinking, as typically only one ounce is served. Dump buckets and spittoons are available. Invitations are sent out for wine tastings, oftentimes with a salesmen present at the open house, and Vat & Vine has incorporated a wine club in Yorkville, generally supported by an older, professional membership. He stated the ordinance makes mention that only three samples be available, and he suggested that, as many as 15-25 bottles of wine, could (or may) be open at a successful tasting event. He suggests that Yorkville residents are attending wine samplings in other communities and he would like to keep them spending monies in Yorkville. Food is usually served at the events, and their business has never had a violation in Yorkville. A tasting is a managed situation and carding is done by management. Mrs. Kachlic stresses the experience of management staff, and assures they are providing community members with their desires. Mr. & Mrs. Kachlic value being a part of the community, and want to meet their customers wishes, which they feel is evidenced with 65 new members in their wine membership club. Mrs. Kachlic mentioned the surrounding communities who are offering tasting events, and stated the issue they contest is small scale tasting with a limited number of products (which in her opinion, does not address wine club membership open houses, and special events, which are hosted typically before holidays). In response to a question by Ms. Spears, Ms. Kachlic suggested that they will work with the city on the designated number of events allowed per year. Chairman Anderson suggested that the ordinance came into being with keeping control at Jewel Osco, suggesting prior to the amendment, the city had no way of control. Attorney Maye made issue with the following: 1) single designated premises would like to clarify saying a "single designated premise"; 2) paragraph E - limiting wine and beer - she would like to add a special use permit, given by city, which would allow spirits, stating her clients would be willing to charge serious consumers for admission ; 3) would like a special permit to put the city on notice that the tasting events were happening, stating that her clients designed their buildout for consumer events for a wine club; 4) limiting two ounces is not a problem, 5) limiting three or less sample - would like city to allow special use permit. Ms. Maye stated evidence of ordinances: 1) Plainfield permits tasting with permission and no limits on the number of open bottles, 2)Naperville permits tasting once a month for three days/or once a week for no more than two days (for certain types of business ), 3) Sugar Grove allows tasting with a city permit, and 4) St. Charles permits consumption at winery (with no less than 13 ozs). She suggests the proposed amendment states her clients would be limited, based on the selling tool they have designed. She believes this is a"uniform statue" and that they would like to tailor it more specifically, to the needs of her clients. Alderman Anderson stated Class "A"has been passed by the council, suggesting that the Vat &Vine now bring their concerns to the council. He is not opposed to a tailor made ordinance for"B", and Attorney Kramer believes we should tailor language in reference to location on the premises,possibly limiting it to a contiguous location. Ms. Kramer will prepare new language for next meeting, and will be in contact with Ms. Maye, putting together new language. The beer and wine language is in reference to the state statue. The city council agreed on"no liquor", and argument may be presented to council. The city ordinance can be stricter that the state law. The committee believes the special permit would be a useful tool. Proposed changes will be presented by Attorney Kramer to this committee at the April meeting. MONTHLY POLICE REPORTS FOR FEBRUARY 2003 Committee members looked over the reports, with notice that overtime has been at a minimum. These will be passed on to the consent agenda. 2002 YEARLY POLICE REPORT Chief Martin gave special thanks to the historian/public information/secretary, Charese Spears, for her work on the report. This will go to COW on April 15th TRAFFIC SIGNAL -ROUTE 34 & GAME FARM ROAD Chief Martin said this has been discussed at COW, DOT has been contacted, and made reference to letter dated March 7, 2003. Mayor Prochaska suggested getting it funded, putting up the light for eastbound travelers, and then check with IDOT for payment assistance. Chief Martin will provide more detailed information concerning the cost at the next public safety meeting, and whether IDOT can assist. Alderman Kot reiterated that this was a time sensitive issue, and the committee is recommending this item go to COW on April 2nd REQUEST TO REPLACE OFFICER TERMINATED ON 3/12/03 The committee approves going forward with a replacement. Chief Martin has a new list with the orals taken on April 5th. He anticipates at May 1St deadline, with a 6-month"on the street" availability for the new hire. This item will go to the police commission, and the COW will be made aware, given the rotation of a detective into this shift, and the potential for additional overtime. ADDITIONAL BUSINESS Alderman Kot will check into the entrance light at Vat&Vine property on West Veterans. Meeting adjourned at 7:30 P.M. Cc: Mayor Arthur Prochaska Public Safety Committee City Administrator Anton Graff Finance Director Traci Pleckham United City of Yorkville Intergovernmental Agreement To Provide A School Resource Officer To Yorkville Community Unit District Number 115 THIS AGREEMENT is made on , between t h e United City of Yorkville (the "City") and the Board of Education of Yorkville Community Unit District Number 115, Kendall County, Illinois, (the "District") located in the State of Illinois. WHEREAS, the Illinois Constitution provides that units of local government and school districts may contract to share services through intergovernmental agreements, Ill. Const., Art. VII sec. 10 (1970); and WHEREAS, Illinois statutes provide that public agencies may share powers through intergovernmental agreements, (5 ILCS 220/1 et. seq.); and WHEREAS, the City is a unit of local government, Ill. Const., Art. VII, sec. 1, and a public agency, (5 ILCS 220/1) and the District is a school district, Ill. Const., Art. VII, sec. 1, and a public agency, (5 ILCS 220/1); and WHEREAS, the District desires to have services of a police officer available throughout the Yorkville Community Unit District #115, Yorkville, Kendall County, Illinois (hereinafter the "Schools"); and WHEREAS, the City has determined it to be in the best interests of the City to provide the services of a police officer at the Schools. NOW, THEREFORE, in consideration of the mutual covenants contained herein the City and the District agree as follows: Page 1 of 5 I. SERVICES PROVIDED A. The City shall provide a police officer (hereinafter the "School Resource Officer") to the District to perform services as identified in Exhibit A, titled Yorkville Police Department Policy Number 2.008 and other services as may be agreed to in writing by the parties. B. The School Resource Officer will prepare a monthly calendar and provide a copy for the principals and Director of Instruction. C. The City shall provide assistance with overall security evaluation of school grounds and activities. The Police Department will provide traffic control at the beginning and end of each school day within our jurisdiction. The specific details to develop a traffic plan shall be agreed to jointly by the District and the Police Department. II. EMPLOYEE OF THE CITY The School Resource Officer is the employee of the City and is supervised through the Police Department chain of command. All activities of the School Resource Officer shall be taken as an employee of the City, pursuant to all applicable laws and Police Department rules and regulations. III. COORDINATION OF SERVICES The Chief of Police and the District's Superintendent shall coordinate the provision of services required by the District pursuant to this agreement. Page 2 of 5 IV. PAYMENT A. The School District shall pay the sum of $21,664.00 (twenty- one thousand six hundred and sixty four dollars) as payment to the City for services required pursuant to this agreement. The payment shall be made in two (2) equal installments, on January 15, 2004 and March 15, 2004. V. SERVICES TO BE SUPPLEMENTAL The parties agree that the services provided by this agreement are in addition to general police services provided by the City in the regular course of operating its Police Department. VI. AMENDMENT This Agreement may be amended only in writing with approval of both the City and the District. VII. GOVERNING LAW AND SEVERABILITY This agreement shall be construed in accordance with the law and Constitution of the State of Illinois and if any provision is invalid for any reason such invalidation shall not render invalid other provisions which can be given effect without the invalid provision. VIII. EFFECTIVE DATE, TERM OF AGREEMENT AND TERMINATION This Agreement shall take effect on June 1, 2003, and shall remain in effect until June 30, 2004 or until canceled by mutual agreement of the parties, or until canceled by either party by written notice of one party given to the other sixty (60) days in advance of the date of cancellation. NOTICE Notice of termination or request for amendment of any term of this Agreement or for any other reason must be in writing and delivered by one party to the other at its administrative office either personally or through the U.S. mail, postage prepaid. Any notice sent to the City shall be directed to the attention of the Mayor with a copy to the Chief of Police. Any notice sent to the District shall be directed to the attention of the Board of Education, President with a copy to the Superintendent. X. EXECUTION This Agreement shall be executed in a sufficient number of counterparts so that the City and the District shall each have a copy of this Agreement containing original signatures. Each of the counterparts shall be executed by the City and District and all the counterparts shall be regarded for all purposes as one original and shall constitute and be but one and the same.
