In Attendance: Alderman Joe Besco Alderman Rich Sticka Public Works Director Eric Dhuse City Engineer Joe Wywrot Alderman Marty Munns (in at 6:45) APPROVAL/CORRECTION OF MINUTES With the number of corrections needed to be made the committee agreed to bring the December minutes back to the next scheduled Public Works meeting on March 24, 2003. NEW BUSINESS: 2003 Joint & Crack Filling City Engineer Joe Wywrot stated that IDOT requires the plans to be signed by Mayor Prochaska before they will give their approval. The City Council will also need to give their authorization for Mayor Prochaska to do that. Mr. Wywrot added that there is also a MFT appropriation resolution for the estimated amount of$26,682.60 which will also need approval. These items will go to COW on March 4, 2003. Fox Industrial Park—Final Balancing Change Mr. Wywrot said he received word from Aurora Blacktop and they have agreed to accept the numbers that were posted last fall. The final project cost is a net reduction in the amount of $42,6.59.98. He was pleased with the reduction and mentioned that they had saved a lot of money on Deer Street where the under cuts were not as bad as they had originally thought. He said that because they were under quantity that they did some additional under cutting on Wolf St. They also did some extra curb work on Badger Street. Even with that extra work they still ended up with a cost reduction. This item will go to COW on March 4, 2003. Supplemental Truck Purchase Public Works Director Eric Dhuse said that instead of selling the Dodge Dakota as they had originally planned, they have decided to keep it for the new Engineering Technician. He said that the Engineer Technician should begin working in March. He said that they will get the truck tuned and cleaned up. The truck currently has 64,000 miles on it. He mentioned that since they will not have to purchase the truck out of next year's Capital Fund which will push back up the Reserve. This item will go to COW on March 4, 2003. PW Time Studies Mr. Dhuse stated that the primary goal for this was to try and set goals and guidelines for the Public Works Depai tnient. He said that they have tried to break down each department; water, sewer and streets. Mr. Dhuse said that it should show where they hope to be and where they Page 2 of 6 should be doing for time. He said that the astrics next to items show where they are below on standards. Right now they are very below standards as the growth keeps coming. What that essentially means is that they do not have enough man power,especially in cases of installing water meters. He said the problem will only escalate when the bigger subdivisions come in. He said that the smaller print items are what were done last year.He said that with each apartment, there is a small synopsis at the end next to the astrics,which is what they are falling short on or need to do more of Alderman Besco asked if the meter installation could be contracted out. Mr. Dhuse said not really because it would be too difficult to try and schedule it. Alderman Sticka asked if this was information that has been brought to Staff meetings. Mr. Dhuse said that he has been gathering the information all year and that he had just had a meeting with City Administrator Tony Graff and Finance Director Traci Pleckham. He mentioned that Public Works hasn't hired anyone but 1 person since 1995. He mentioned that with all the new growth and new customers there is increasing streets to plow, catch basins to clean and a lot of customer questions. Alderman Besco asked how many employees they are falling short on. Mr. Dhuse said that they are 1 employee below in each department. He said that if the City would like to keep up the work they are currently doing then he would need to hire 3 people for each the Sewer, Water and Streets departments. He said that he is currently working with Mr.Graff and Mrs. Pleckham to see if there is enough dollars for this. Alderman Kot asked if Public Works ever has problems hiring people. Mr.Dhuse said he currently has 30 applicants for the opening. He said that he would like to see some new employees come in before Joe Moore makes changes with the cation exchange plan. Alderman Sticka asked where Mr.Dhuse was getting all his information on cation. Mr. Dhuse said from reading up on it and talking with EEI. Alderman Sticka asked if there were any place Mr. Dhuse could go to see any of these installations. Mr. Dhuse said that there is in Maple Park, Illinois and that he has plans to go up now that they are getting close to plant design. This item will go to COW on March 4, 2003. Menard Commercial Commons Bond Reduction Mr. Wywrot said that a lot of work has been done at Menard's. He recommended a reduction of 5.8 million dollars. He said there is still 2.9 million left in the bond. By approving the reduction it will allow Menard's to make payments to contractors. Alderman Sticka asked how the road ways were coming along. He said that the Rt. 34 improvements haven't been done yet and the traffic signals at Kennedy and Rt. 47,one at Countryside and Rt. 34.There are also future plans for a traffic signal on Carpenter Rd. next to Wendy's. The Kennedy traffic signals could be up and running in about a month. Alderman Sticka asked if the concrete roadway was in. Mr. Wywrot said all but on the entry into Rt.34 and a small piece at McHugh Rd. This item will go to COW on March 4, 2003. OLD BUSINESS Page 3 of 6 Wetland Protection Ordinance Mr. Wywrot reported that they had initially requested comments from the development community about the ordinance because they hadn't received any response. He said that they received one from Inland and Encap. Encap is a wetlands firm. The tone of Encap's letter was more in support of the ordinance than not. They did however suggest some changes to make the review process quicker and improve it. Mr. Wywrot said that he thought they felt it would be a worth while ordinance to have. The Inland letter did not have the same tone. He hopes that by next month there will be more responses. Mr. Wywrot recommends this item to come back to Public Works on March 24, 2003. Fox Hill— 1728 John Street This item was in regards to a fire hydrant that is illogically located on the property of 1728 John Street. The resident complained that she or other visitor's have hit the hydrant while backing out of her driveway. Mr. Wywrot reported that in February after getting some information from Attorney Dan Kramer that he said that the City has no liability on this issue. The home was built with the full knowledge that the hydrant was there and that the residents should have addressed the issue at that time. Mr. Dhuse suggested that the resident should try planting something there to use as a buffer. Alderman Besco suggested that the committee should write the resident to let them be aware of the situation Sanitary System Overview Mr. Wywrot used maps from their 1996 Sewer Study to give the committee a broader view of the City's sewer system. He said the sewer system flows in a dendritic pattern, which means like a tree. It follows the path of least resistance. He said that some lines would be replaced with larger lines. He said most of the lines have 8 inch pipes but some have a bigger trunk line. They were concerned that there would be an over load next to the line at Jewel down to the plant. They managed to find a weak link in the chain that leads into Jewel. He said that they did find some weak links they would need to work on. He pointed out on the maps and explained the situation. He said that the situation can be helped by making some construction changes. The pipes along Hydraulic Street will be replaced with 42 in pipe. Alderman Kot asked if the over all pipe condition was in good shape and if there were any real problems there. Mr. Wywrot said that the problem is that we have a tendency to rely on lift stations. When developer's can't get a gravity sewer in at a reasonable cost and their thought is to throw in a lift station. Mr. Wywrot said that a lift station is not the way to go. They would like to find a reasonable way to get these large gravity sewers put in. The problem is that they are very expensive. The costs range over 11 million dollars for the Rob Roy Creek Interceptor. The plan would be from Baseline Road all the way to the Plant. Alderman Kot asked Mr.Dhuse about the situation at Naden Ct. It is mostly a localized problem in the main in Countryside Pkwy. The problem situated from silver maple tree roots. The roots grow right down through the pipes. Alderman Kot asked about the conditions in the old part of town. Mr.Dhuse pointed out on the map that the squiggly lines indicate where the repairs were made. Alderman Kot asked if it was now in good shape. Mr. Wywrot said that structurally the pipe is in better shape. He said the purpose for this particular project was to reduce infiltration and inflow (I & I). He said that they got very good results from it. They were able to get 70%of I &I out of the sewer on the north side of town. On the south side of town it was 19%. The Page 4 of 6 problem is that there is higher ground water there and older pipes. If they were to replace it, it would have to be replaced all the way to the houses in that area. If the sewer main is fixed then the water table will rise to the point that it will find another point to leak into the sewer system. So it would end up going into the main regardless of the new pipe that would be put in. He said then what we'd have to do is build the treatment plan larger to treat rain water when there is a storm. He said that this project here was to improve how the system responds to handle a 5-year storm with out any surcharge. He felt they did achieve that on the north side, but is unsure on the south side. As far as the pipes are concerned, it is as good as they will get. He said that they should continue maintenance of the manholes. Yorkville Road Program Update—Smith Engineering Mr. Wywrot stated that they have come up with 3 basic repair methods that they would recommend: 1) Resurfacing—Basically reconstructing as done on portions of Morgan St. and State St. 2) Recycling—A large tiller is brought out to the road to be repaired which then pulverizes and grinds up what is there. It is then rolled down and compacted, and then a new road is paved over the top of it. Almost all of the streets can be recycled except for Mill Street which would require reconstruction. 3) Patching—This method does reduce the ride ability of the road and breaks up quicker than the existing road if there was no patch there. A trench will be cut and jagged edges will be sawed away. Then they will patch the trench. Alderman Kot asked if they would be wasting money to patch on Mill Street since there are plans to tear up the street for the new storm sewer. Mr.Wywrot said that timing is an issue and without patching the road would mean the road would be torn up for an extensive amount of time. Road Program Storm Water System Allderman Kot asked about the where the storm water systems would be installed. Mr.Wywrot said that the storm sewers for this program are mainly intended for the streets that are on the hills because other wise the water rushes down the hills. Alderman Kot asked concerning the possibility of flooding if it would be wise to consider a storm system on Main Street, since there isn't one now and if it would help alleviate flooding problems. Mr. Wywrot said that it might help to a certain degree but it would be very hard to estimate it as far as what they would do there. There will always be a storm that beyond which there will be a flood. Mr. Dhuse added that another problem in that area is the clay soil is such that it holds water. Alderman Kot mentioned that he would like the committee to keep in mind of trying to find a solution to the flooding problems that could arise in that area in the future. Mr.Wywrot said that the most cost effective thing to do would be to continue to expand manhole maintenance. He said that the City Ordinance now require that new subdivisions to have storm services to the homes. The purpose of that is for the sump pumps to get into the storm sewer right away. Closing Off of Adams Street to Van Emmon Street Mr. Wywrot said that by closing off the road from Adams Street to Van Emmon Street would turn Adams into a cul-de-sac. He said that Frank Wilman has plans to come in with plans for the vacant area west of Adams Street. He said he spoke with him about the possibility of not only making a cross connection from Morgan over to Adams, but also to put in a larger water main. Smith Engineering said that there is no real way to make it a standard roadway.Also from Smith's point of view it would be non-conforming and possibly a liability issue and to eliminate it. There needs to be some consideration as to what the residents would have to say as well. • Page 5 of 6 Alderman Kot suggested having a meeting with the residents there to discuss the situation. On the spread sheet from Smith Engineering were all the streets that they had identified as being problems. Alderman Kot asked from an engineering stand point if the recycling is the best method for the road repairs. Mr.Wywrot said that it improves the road and will give a minimal width. I will bring the roads listed up to a minimum standard. Alderman Kot asked what the life expectancy would be after the roads would be recycled. Mr. Wywrot said that the minimum would be 10 years. Alderman Besco asked if the Reclamite projects would be able to be applied to these roads. Mr. Wywrot said that it would and that reclamite on these streets would be an excellent idea. Alderman Sticka added that as soon as the recycling were done on these roads that it would be a good idea to get the roads on the reclamite list. Mr.Wywrot said that would be a good idea. Mr.Wywrot pointed out that for comparison that with the method Smith Engineering is recommending that the total cost is 2.7 million. If they were to reconstruct everything it would be 4.4 million. It is 1.7 million dollars more if they did not reconstruct the roads. He said that something to consider in order keeping the roads at the 10yr time line is that they will have to borrow money to do it. It would be best to try and pay that money back with in 10 years. Alderman Kot asked if Traci Pleckham had any input on the plan. Mr. Wywrot said that she agrees with the 10 year pay back period, but that it would be tough to fund the project with that short of a pay back. Alderman Kot asked what if anything from this plan could the Public Works Department could do. Mr. Dhuse said that they could probably do part of the storm sewer and probably some of the other work but nothing of the road work rehabilitation. They do not have the equipment for it. Alderman Kot said that he would like to see this item go to COW and in the mean time have Mrs. Pleckham give her input on this with some numbers. Alderman Besco said that if they are unable to get financing for 10 years with this project then he would like to have Traci see if we could possibly fund a portion of this project. This item will go to COW on March 4, 2003 upon Mrs. Pleckham's review. ADDITIONA BUSINESS Street Light in Front of City Hall Alderman Kot mentioned that he noticed that the street light in front of the City Hall continues to go on and off. Mr. Dhuse said that he will take a look at it. Alderman Kot said that though the road reflectors enter into the drive way are better than what was there before, he would like to see better lighting put in there. Mr. Dhuse said that they would take a look into what might help that area. Page 6 of 6 Alderman Joe Besco stated that Sugar Grove has an ordinance that with new developments the dumpsters can be on the roads until the first occupancy permit is issued then they all have to be off the roads. He thought it should be something that the City of Yorkville should consider to adopt, particularly with all the subdivisions coming in. He said he didn't care to see the dumpsters lined updown the roads in these places. Mr. Dhuse said he would get a copy of the ordinance to look over. There was no additional business. Yorkville is now officially within the Chicago metropolitan area, therefore we can request FAU route designations for certain roads. The FAU (Federal Aid Urban) designation makes a road eligible for federal funds if we have a construction project. State and County roads have FAP (Federal Aid Primary) or FAS (Federal Aid Secondary) designations, and already are eligible for federal funding. I recommend that we request FAU designation as collector roads for the roads listed below: Mill Road (Galena to Orchard) Kennedy Road (Galena to Route 47) Bristol Ridge Road (Route 34 to Cannonball) Countryside Parkway (Center Parkway to Route 34) Center Parkway (Route 34 to Countryside Parkway) McHugh Road (Spring Street to Kennedy Road) Spring Street (McHugh Road to Route 47) River Road (Route 47 to Eldamain) Somonauk Street (Route 47 to Game Farm) Game Farm Road (Somonauk to Route 34) Cannonball Trail (Route 34 to Route 47) Van Emmon Road (Route 47 to Route 71) Mill Street (Van Emmon to Route 126) Fox Road (Route 47 to High Point) Refer to the attached map to see how these roads relate to each state and county roads as well as each other. Some of these roads already have FAS designation (Bristol Ridge, Fox, Van Emmon, etc.) for some or all of their lengths, but Lou recommended that we request FAU designation. Designation as a minor arterial would be a possibility for Cannonball Trail (Route 34 to Route 47). Doing so, however, could require construction of wider lanes and longer radii at curves, which encourage higher speeds. Designating it as a collector gives us more flexibility on the type of road we want to have there. Once we settle on which streets that we would like to designate, IDOT will review the request make sure it is reasonable. They will then send the request on to IDOT's District 1 office, which will process it through the Kane County Council of Mayors. for the different construction projects we are planning for this year. We are a little behind in plan preparation so we aren't ready to go to bid immediately, but I want to set the dates so I know what deadlines I have to meet. I recommend the following: Apple Tree Court Roadway& Watermain Improvements This project is estimated to cost $70,000, of which $37,000 is watermain work and $33,000 is street work. The plans are essentially complete and the IEPA permit for the watermain has been issued. I need to make some minor changes to the plans regarding curb replacement and landscape restoration. I recommend that we open bids on June 18, 2003. The bid results would then go to PW Committee on June 231-d, with City Council approval on July 8th . Dickson Court Roadway& Watermain Improvements This project is currently estimated to cost $70,000. The plans are 50% complete. We are negotiating for an easement for a watermain that would connect to York Meadows Apartments to provide looped supply to Dickson Court. If we get that easement we will need to apply for the TEPA permit. Regardless of whether we build the watermain or not, the recommended bid opening date would be July 23, 2003. The bid results would then go to PW Committee on July 28th, with City Council approval on August 12th. 2003 Asphalt Surface Treatment This project is currently estimated to cost about $40,000. We are considering two potential areas for surface treatment this year, those being Fox Hill or the Prairie Park/Spring Street/Teri Lane area. Prairie Park would likely need to have CRF treatment, which makes the road look like a seal-coat road right after the work is done. The stone chips blend into the asphalt after several weeks. Once we establish the streets to be treated, we can put the contract documents together rather quickly. The scheduled bid opening date would be June 19,2003. The bid results would then go to PW Committee on June 23`1, with City Council approval on July 8th. 2003 Public Sidewalk Repairs There is $35,000 budgeted for this project. We put a press release in the Kendall County Record a few weeks ago and are getting a fairly good response from residents. We typically also have some city-funded repairs and also a city-funded section of new sidewalk. Last year the new sidewalk was on Fox Street. We can continue a portion of that walk this year, but some catch basins would need to be relocated by Public Works. Timing could be a problem. Another possible section of walk would be on Mill Street and/or Route 126 for the new middle school. The school district currently has no plans to construct this sidewalk. We M W couldn't afford to build this entire sidewalk in one year, but it could be done over a 2-year timeframe. I spoke with Brian DeBolt, who suggested that the School Board and City Council explore an agreement where the city constructs the Mill Street sidewalk this year, and the school district constructs the Route 126 sidewalk next year. We always try to get the sidewalk finished before school opens, therefore I recommend that we open bids on June 20, 2003. The purpose of the easement is to allow the construction of a watermain from Apple Tree Court to an existing watermain in Beecher Park. Currently Apple Tree Court has two sources of water supply, one being from Route 47 and the other coming from the west through Beecher Park and the end of the cul- de-sac. The Route 47 watermain will have to be abandoned when IDOT widens Route 47 in a few years. Since we are planning to re-pave Apple Tree Court this year, we want to construct a watermain now to replace the Route 47 watermain. Doing so will eliminate the need to cut into the new road in the future. Dan Kramer has reviewed the easement .recommends approval (see attachment). No. 02 - AN ORDINANCE ADOPTING WATER CONSERVATION REGULATIONS FOR THE VILLAGE WHEREAS, the Village of Hampshire is not a home rule municipality within Article VII, Section 6A of the Illinois Constitution and, pursuant to the powers granted to it under 65 ILCS 5/1-1 et seq.; and, WHEREAS, the population of the Village of Hampshire has grown substantially in recent years and is projected to continue to grow at a rapid pace; and WHEREAS, prolonged dry periods, increased Water demand, and equipment failures from time to time may threaten the Water resources and jeopardize the health, safety, and welfare of the residents of the Village of Hampshire; and WHEREAS, Water is a limited natural resource that must be protected and the conservation of Village water supplies is good and proper stewardship of those resources; and WHEREAS, it is the finding of the President and Board of Trustees of the Village of Hampshire that certain mandatory Water conservation measures be imposed on the Water users of the Village water supply system. NOW, THEREFORE, BE IT ORDAINED, BY THE PRESIDENT AND THE BOARD OF TRUSTEES OF THE VILLAGE OF HAMPSHIRE, KANE COUNTY, ILLINOIS, AS FOLLOWS: Section 1 . The Hampshire Municipal Code of 1985, as amended, shall be and is hereby further amended to adopt and incorporate therein certain water conservation measures in the Village, limiting watering of lawns and other uses of water during certain hours and establishing other regulations, as follows: CHAPTER 8 Water and Sewer ARTICLE III Water Conservation Regulations SECTION 8-3-1 et seq. -- See Attached Text of Regulations -- Section 2. The Hampshire Municipal Code of 1985, as amended, shall be and is hereby further amended to provide for the collection of unpaid fines assessed for violation of the Water Conservation Regulations herein adopted, by adding the amount of any unpaid fine to the water bill due for the property at which the offense occurred, as follows: CHAPTER 8 Water and Sewer ARTICLE I Water and Sewer Systems SECTION 8-1-9 (D) Bills, Time of Payment 4. The amount of any fine due pursuant to Section 8- 3-10(A) of this Chapter, for a violation of the provisions of Article III of this Chapter occurring at a property in the Village, if it has not otherwise been paid as provided therein, shall be added to the amount of any bill for water consumption rendered in respect to said property pursuant to this Section. Section 3. Any and all ordinances, resolutions, and orders, or parts thereof, which are in conflict with the provisions of this Ordinance, to the extent of any such conflict, are hereby superseded and waived. Section 4. If any section, subdivision, sentence or phrase of this Ordinance is for any reason held to be void, invalid, or unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance. Village Clerk Village of Hampshire Ordinance No. 02 - Water Conservation Regulations Text CHAPTER 8 WATER AND SEWER ARTICLE III WATER CONSERVATION REGULATIONS SECTION 8-3-1 et seq. 8-3-1 .Definitions. The following words and phrases when used in this Article shall, for the purpose of this Article, have the following meanings: Drip-Irrigation System: A soaking-type hose that when in use does not result in an actual dissipation of Water. Drip-Line: Pertaining to a tree or shrub, the ground area immediately beneath the branches of the tree or shrub. Landscape / Landscaping: Sod and seeded turf lawns, gardens, trees, shrubs, and other living plants. Permitted Hours of Water Use: A time period between 5:00 a.m. and 9:00 a.m., and between 9:00 p.m. and 12:00 midnight, each day. Person: Any individual, firm, partnership, association, corporation, company, organization, or entity of any kind. Village: The Village of Hampshire. Water: The water provided by and obtained by any person from the Village water supply and distribution system. 8-3-2.Application. A. The provisions of this Article shall apply to all Persons using Water, 1 and to all properties within the Village or in unincorporated areas which are connected to the Village's Water supply and distribution system, regardless of whether any Person using the Water has a contract for service with the Village. B. The provisions of this Article shall apply annually from May 1 through September 30, subject to any modifications thereof, including application of these or other regulations during this or any other time, by an Emergency Proclamation issued pursuant to Section (I) below. 8-3-3. Restricted Hours and Days for Specified Uses A. Water may be used for landscape watering or the filling of swimming pools only as follows: 1 . All properties with even-numbered street numbers (i.e., numbers ending in 0, 2, 4, 6, or 8) may use Water for landscape watering, or for pool filling, only on even-numbered calendar dates during Permitted Hours of Water Use. 2. All properties with odd-numbered street numbers (i.e., numbers ending in 1 , 3, 5, 7, or 9) may use Water for landscape watering, or for pool filling, only on odd-numbered calendar dates during Permitted Hours of Water Use. 3. There shall be no restrictions as to hours or days when Water may be used for any of the following: a) Landscape watering or sprinkling where such watering or sprinkling is done by a Person using a hand-held watering device; b) Filling swimming pools with a volume of fifty (50) gallons or less; c) The automatic watering of trees and shrubs by means of automatic root-feed or Drip-Irrigation Systems within the Drip Line of the tree or shrub; or d) Vehicle and equipment washing; or e) Any other lawful use of Water such as bathing, clothes 2 washing, and other normal household uses not otherwise specifically restricted by the provisions of this Article. 8-3-4. Restrictions for Sod Laying and Lawn Seeding for New Lawns. Notwithstanding the provisions of Section 8-3-3 above, the following special regulations shall apply: A. Sod laying, lawn seeding, and the planting of other landscaping for the establishment of a new lawn or new landscaping is prohibited from July 1 through August 31 each year. B. From May 1 through June 30, and from September 1 through September 30, Water may be used on new lawns (sod or seed), only as follows: 1 . On the day new sod or seed has been placed on a property, a Person may use an automatic sprinkling device to apply Water to the sod or seed for a total period of time not to exceed eight (8) hours. 2. For the next nine (9) days thereafter, a Person may apply water to said sod or seed each day during Permitted Hours of Water Use. .. 3. Following the first ten (10) days after the sod or seed is placed, the provisions of Section 8-3-3 above shall apply. C. Prior to the execution of any real estate contract for the sale of newly constructed property, the builder or owner of such new construction shall: 1 . Inform prospective purchasers of the restrictions upon the installation of new lawns set forth in this Article; 2. Attach a copy of these regulations to the contract; and 3. Obtain the signature of the purchaser(s) on a statement that he, she or they has (have) been informed of the new lawn installation restrictions set forth in this Article. D. The applicant for a certificate of occupancy for any newly constructed property shall submit as a part of his application, and as a condition of issuance of such certificate, a copy of said signed statement. When an application for 3 certificate of occupancy is submitted prior to sale of the property, and the future occupant is unknown, the applicant shall submit his signed statement that he shall comply with the requirements of this Section at the time the real estate contract is executed. 8-3-5.Waste of Water Prohibited. No Person shall allow a continuous stream of Water to run off into any gutter, ditch, drain, or street inlet while using Water for restricted purposes during the Permitted Hours of Water Use. 8-3-6. Exceptions. The provisions of this Article shall not apply any commercial or industrial entity for which use of Water is necessary to continue normal business operations, or to maintain stock or inventory. Provided, however, this exception shall not apply to any and all uses of Water not essential to normal business operations or maintenance of inventory or stock, and specifically shall not apply to landscape watering or pool filling. 8-3-7. Bulk Water Rates. Bulk Water rates shall be increased to three (3) times the non-resident Water rate during the time described in Section 8-3-2(B) above. 8-3-8. Hydrant Use Prohibited. Hydrants connected to the Village water supply and distribution system for the purpose of providing Water for fire fighting purposes shall not be opened by any Person, other than authorized Village or Fire District personnel, except for the purpose of fighting a fire. 8-3-9. Emergency proclamation. A. Whenever the Water supply of the Village is diminished from any cause, including but not limited to prolonged dry period, increased Water demand, equipment failure, or Water quality concerns, to an amount which in the opinion of the Village Engineer or Director of Public Works is or is likely to become dangerous to the health and safety of the public, the Village President is hereby authorized and empowered to issue an Emergency Proclamation specifying different or additional regulations on the use of Water. B. Such regulations may provide for limitations on the usage of Water, limitations on days and hours of use of Water for some or all purposes, and the prohibition of specified uses of Water. C. Upon issuing such Proclamation, the Village President shall make the 4 contents thereof known to the public by posting a copy at the Village Hall, and by news release to local newspapers and radio media, and may also endeavor to notify the Village residents and other Persons in any other practical manner that he or she shall devise. Further, the Village President shall immediately deliver notice of such Proclamation, and the regulations that have been imposed by such Proclamation, to all members of the Village Board of Trustees. D. The Emergency Proclamation of the Village President, and the regulations imposed thereby, shall remain in full force and effect until any one of the following shall first occur: 1 . The Village President determines that the emergency no longer exists and that the Emergency Proclamation, and the regulations imposed thereby, shall no longer continue in effect. 2. The Village Board of Trustees modifies or repeals the Emergency Proclamation, and the regulations imposed thereby, by means of an ordinance enacted at any regular or special meeting of the Village Board of Trustees. 3. The first regular meeting. of the Village Board of Trustees occurring more than 30 days after the date of the Emergency Proclamation of the Village President. E. Any Village employee or officer may, at the direction of the Village President, notify and warn any Person of the effect of said Emergency Proclamation and direct said Person to comply with said watering or sprinkling restrictions. If any said Person, after having first been warned about said restrictions and said proclamation, shall continue to violate said restrictions of the Emergency Proclamation, they shall be deemed to be in violation of this Article. 8-3-10. Penalty. A. Any Person who or which violates, disobeys, neglects, fails to comply with or resists enforcement of the provisions of this Article other than Section 8-3- 4(A) above, shall, within ten (10) days of receiving notice of such violation, pay at the Office of the Village Clerk, a fine, as follows: 1 . $ 50.00 for a first offense; 5 2. $125.00 for a second offense; and 3. $500.00 for each subsequent offense. B. Any Person who violates Section 8-3-4(A) of the Article shall, within thirty (30) days of receiving a notice of such violation, shall be subject to imposition of a fine up to $750.00 for each offense. C. Each day a violation occurs or continues shall be considered a separate violation for purposes of this Article. D.
