In Attendance: Alderman Sticka Alderman Munns Alderman Kot (arrived 6:40) Mayor Prochaska City Engineer Wywrot Director of Public Works Dhuse APPROVAL/CORRECTIONS OF MINUTES The minutes from the February 24, 2003 meeting were approved. The committee did not receive copies of the March 24, 2003 meetings so they were not approved and will be brought back to the next meeting. NEW BUSINESS FAU Routes City Engineer Joe Wywrot reported that he was contacted by the Illinois Department of Transportation(IDOT) regarding the City's ability to designate Federal Aid Urban Routes now that its population is over 5000. There are three classifications of roads; FAP —Federal Aid Primary—interstate and state highways, FAS—Federal Aid Secondary— county roads and FAU—Federal Aid Urban—municipal roads. Roads designated as FAU routes have to meet certain criteria such as they have to begin and end at another FAU route or a road of a higher designation. The committee went over a map indicating which city roads meet the FAU criteria. Mr. Wywrot indicated that the map had been reviewed by both the county and township and they approved of the streets being designated. Mr. Wywrot explained that when approved these roads are eligible for federal highway funds for construction. This designation is the first step in a process; the routes still need to go through an approval process. The item was sent to the June 3, 2003 Committee of the Whole (COW) meeting. RIVER'S EDGE SUBDIVISION PHASE 2—LETTER OF CREDIT REDUCTION Mr. Wywrot reported that this is a standard reduction request from S&K Development. He concurred with the quantity of work that they have completed and stated that they have been very cooperative. He recommended the letter of credit be reduced in the amount of$340,757.24. The item was sent to the June 3, 2003 Committee of the Whole (COW) meeting. SETTING BID DATES Mr. Wywrot reported on the bid opening dates for the following projects: a) Appletree Court—June 18, 2003 b) Dickson Court—July Page 2 of 5 c) Asphalt Surface Treatment—June 19, 2003 -Mr. Wywrot stated that there are two general areas he felt should be done this year. First is Fox Hill where the streets are substandard by today's standards. This treatment will help extend the life of those streets. He noted however that the City has not accepted the streets yet but that the City has done this type of work in White Oak before it was accepted. The second potential area is the Prairie Park area such as Spring, Somonauk, Elm and Freemont Streets. These streets are older and would need a CFR treatment such as what was previously done on Mill, Bruell and Woodworth Streets. Mayor Prochaska suggested asking City Attorney Dan Kramer for a legal opinion on doing maintenance on streets not accepted by the City. The preference of the committee was to do Fox Hill pending Attorney Kramer's opinion. d) Public Sidewalk Repairs—June 20, 2003 - Mr.Wywrot stated that the School District does not have plans for any sidewalks for the new school on Route 126. They are exempt from local ordinances in respect to things like this. They voluntarily comply with the City's storm water retention requirement and have to comply with the water and sanitary sewer requirements because they have to connect to the City's facilities. Mr. Wywrot spoke with Brian DeBolt with the school district who confirmed that sidewalks are not in the budget. Mr. DeBolt suggested a joint project;the City would build the Mill Street sidewalk this year and they would build the Route 126 sidewalk before the new school opens. The Mill Street sidewalk(Walter Street to Route 126)will cost approximately $15,000.00. The committee further discussed the need for a sidewalk on Route 126 and the school district's role. It was decided to take the discussion of the Mill Street sidewalk to the June 3, 2003 COW. The setting of the bid dates does not need to move on to COW. When the bids come in, the bid information will move to on COW. APPLETREE COURT WATERMAIN EASEMENT Mr. Wywrot reported that Attorney Tom Grant drafted an easement for property owners on Appletree Court. The City will be working on the street this year and needs to loop a watermain to Beecher Park. Mr. Wywrot met with the homeowners and they are agreeable to the easement. The location of the watermain is under the driveway and the cost to replace the driveway(approximately$3,000.00) is the only consideration the homeowners are asking for. The signed document has been received from Attorney Grant. The item was sent to the June 3, 2003 Committee of the Whole(COW) meeting. PUBLIC SIDEWALK REPAIRS Mr. Wywrot stated that he received a request from a Mr. Richardson of 607 S. State Street to replace a sidewalk. The resident is trying to coordinate the paving of their driveway with replacing the sidewalk and can't wait until the summer for the sidewalk program. Mr. Wywrot went to the site and saw the sidewalk was in terrible shape and gave them approval to proceed. The reimbursement is either 60% of the resident's cost or the City's 60% share of the cost based on the annual project,whichever is less. The Page 3 of 5 resident will have to wait for their reimbursement until June or July. Mr. Wywrot also noted he received a call from another resident on State Street, Steve Bridge. He also wants to proceed with a new sidewalk on his own. Mr. Wywrot also recommended approval for the Bridge's to proceed. This was an informational item and does not need to go on to COW. WATER CONSERVATION ORDINANCE Director of Public Works Eric Dhuse discussed the first draft of a water conservation ordinance which allows residents to water on days depending on their address number; even numbers on even numbered days and odd numbers on odd numbered days. It also specifies the hours of the day to water. This is to be used until the City has its new wells and treatment facilities on line. The ordinance sets forth rules and fmes for watering including provisions for watering new sod. The committee discussed the times of day for watering, kids using sprinklers, etc. Mr. Dhuse stated he would clean up the draft and the committee felt it was best to keep this moving forward. The item was sent to the June 3, 2003 Committee of the Whole (COW) meeting. OLD BUSINESS FOX HILL SUBDIVISION ACCEPTANCE Mr. Wywrot reported he received a written request April 10, 2003 from Paul Dresden requesting that the City accept Units 2, 4,and 6 and the Route 34 units. He went out and checked the punch list and there are still items that need to be done on all the units of Fox Hill. He noted that some improvements have been done and the list is shrinking in size however he is not recommending accepting the improvements until the punch list is complete. The committee agreed with Mr. Wywrot's recommendation. Also discussed was the issue of a homeowners association. Only Unit 3 of Fox Hill has an active association. There is also no SSA in place and this cannot be done at this time. The lack of SSA and the affect on the maintenance of the trails and open space was also discussed. Mr. Wywrot stated that he would check with Attorney Kramer to see if a vote was needed for the written request. If it is, this item will be sent to the June 3, 2003 COW. DICKSON COURT WATERMAIN EASEMENT Mr. Wywrot stated that this is a similar to the Appletree Court project. Dickson Court has a dead-end watermain that could be looped while the street is being repaired. He met with the owners of Lot #23 and they are consulting an attorney. They are asking for $5,000.00, attorney fees and other expenses. The watermain was improved in the past to a 6"main and there is not a fire flow issue. Mr. Wywrot stated he is neutral on this and if it is not done it is not a big issue. The committee discussed this and agreed it was not a necessity. Mr. Wywrot stated he would contact the homeowners and advise them the easement was not needed. Page 4 of 5 PERSONNEL FOR STREETS AND WATER--UPDATE Mr. Dhuse reported that he was still working with Finance Director Traci Pleckham regarding this. This will be brought back to the June Public Works Committee meeting. ADDITIONAL BUSINESS WOODWORTH LIFT STATION Mr. Dhuse reported that earlier in the day he gave the Council a memo regarding the final cost of the Woodworth Lift Station. The cost of the project was authorized not to exceed $50,000.00 and the cost came in well under the estimate. EEI Mr. Dhuse reported that he and Mr. Wywrot met with Engineering Enterprises, Inc. (EEI) regarding a slight change to the water treatment facility design. When Jeff Freeman of EEI gave a presentation to the COW, it was decided to use split face block partially up the side of the building and then hardy plank siding. The architect feels that this would leave the door jam exposed which could cause leakage. The architect changed materials in an effort to give the building a better look and work around the door. The increase cost for this is $2225.00/building. The new design uses three materials; split face block, brick and siding. The committee agreed with the change and recommended it be sent to the June 3, 2003 COW meeting. COUNTRYSIDE INTERCEPTOR LIFT STATION Mr. Wywrot reported that he met with Deuchler and the lift station was discussed. He distributed pictures of a lift station facility and recommended that the City use the same design. Mayor Prochaska asked if the easements have been obtained and Mr. Wywrot stated that the property owners have a verbal understanding regarding the easement. Mayor Prochaska suggested that before moving any further,the easements should be obtained. Mr. Wywrot stated he would ask Administrator Graff how this is progressing. MILL/VAN EMMOM WATERMAIN Mr. Wywrot stated that the bids for the Mill/Van Emmon Watermain Project will be opened May 29, 2003. There are two easements that the City has requested. They are from Bob Dearborn(Bridgeberry Twigs) and Yorkville National Bank(YNB) and are for fire hydrants. Mr. Dearborn has signed his easement and is not asking for anything in exchange. Mr. Wywrot suggested that the City Council accept this formally. YNB didn't seem to have a problem with the easement however he has not received anything from them. He suggested that if YNB does not give the easement a stub be put in the main in order to add the hydrant when the easement is received. The Dearborn easement was sent on to the June 3, 2003 COW meeting. Page 5 of 5 SIGN CHECK Mayor Prochaska asked Mr. Dhuse to develop a plan to periodically check signs in Yorkville for damage. ROUTE 34 EXPANSION Mayor Prochaska reported that he,Administrator Graff and Mr. Wywrot met with IDOT regarding widening Route 34 from Route 47 to Orchard Route. They are beginning the phase 1 engineering and this along with phase 2 engineering is in IDOT's budget. IDOT asked if the City wanted sidewalks installed however Yorkville would have to pay for it. Mayor Prochaska suggested getting promissory notes from those developing along Route 34 or Route 47 saying that they will be responsible for sidewalks if and when the City wants them installed. RADIUM UPDATE Alderman Sticka asked if everything was on track with Illinois Environmental Protection Agency(TEPA) and the radium project. Mayor Prochaska stated that Attorney Roy Harsch is currently working on this because the City will not meet the compliance date. STREET SIGNS Alderman Munns asked the status of the Aspen Court and John Street signs in Fox Hill and Mr. Dhuse stated that they were on order. This change order, in the amount of a$16,500 decrease,is for changing the temporary water supply from a shallow well to the city's water system in Country Hills. Drilling a deep well requires a water source to aid in the drilling process. This water can be supplied by a shallow well, but a more reliable source is the city's water system. The base bid for Well No. 7 called for a shallow well because we weren't sure of the impact on our water system if we were to connect to a fire hydrant. We requested, however, that bidders state what credit they would offer if the city's water supply could be used. Since that time, EEI evaluated the water system using our WaterCAD computer model. We found that at times of peak demand the system pressure would drop about 3 psi, from 35 psi to 32 psi. While this pressure is the lowest in town(prompting us to create the new pressure zone)it is within acceptable limits. Therefore, I recommend that Change Order No. 1 be approved. Please place this on the Public Works agenda of October 27, 2003 for discussion. The exact fire hydrant and location of the conduit shall be determined by the Engineer at the time of construction. Justification: The City's water supply will provide a more reliable source of water supply for the well drilling operation at a price advantage to the City. This change order, in the amount of a $4,362.75 decrease, is the final balancing change order. Please refer to the change order for details on specific changes. The pay items that resulted in major decreases were water service connections, aggregate base repair, and supplemental watering. We opted to keep two existing water services connected to the old watermain rather than re-connecting them to the new watermain. We also found that the existing aggregate base for the roadway was in generally good condition, allowing us to avoid repairs. Rather than excavating out the base in the one area that was a little soft, we decided to thicken up the binder. Lastly, we were able to eliminate the supplemental watering for the sod. Approved: Date: City of Yorkville UNITED CITY OF YORKVILLE To: Tony Graff, City Administra r From: Joe Wywrot, City Engineer / Subject: Kane County Council of Mayo s Date: September 18, 2003 I attended today's Kane County Council of Mayors meeting and would like to report two items of interest to Yorkville. First is that the design engineering and ROW acquisition for the Game Farm/Somonauk project has been moved from the Council's multi-year list to the FY 05 program. These work items would be funded 50%through the Council of Mayors. Funding for construction is still in the multi-year program, but would probably be moved up for funding as plans are prepared. Preliminary engineering is to be funded 100%by the city. The preliminary engineering is in our recently approved Capital Improvement Program, and is currently scheduled for FY 04-05. This should work out fine with the Council of Mayors schedule, but we shouldn't wait longer than next year to begin preliminary engineering. I believe that the opportunity also exists to incorporate the realignment of Somonauk and Spring Streets into the project. The second item is that the project for emergency pre-emption at existing traffic signals is still on the Council's list of projects, although at the end of the list for funding. BKFD has not expressed any interest in this project, therefore I recommend that we request its removal from the Councils list of projects. We have not budgeted any funds for this project in our Capital Improvement Program. If you have questions about any of these items, please see me. UNITED CITY OF YORKVILLE To: Tony Graff, City Administra or From: Joe Wywrot, City Engineer Subject: Well No. 8 & 9 Treatment F lity Date: September 30, 2003 The building that houses the treatment facility in Grande Reserve was bid to have exterior brick all the way around for the first floor, with Hardy-Plank masonry siding for the second floor. There was also an alternate bid received for extending the brick all the way up on the front side only. That additional cost was $2400. After bids were received, there was discussion that the new architectural standards we are considering adopting would require brick all the way up on all sides. We got a price of$4900 back from Pasquinelli Development Group for that additional cost, resulting in a total extra cost of$7300. We need to decide if we want to go wi e base bid, the first alternate, or the second alternate. Please place this item on the 'c Works Committee agenda of October 27, 2003 for discussion. Since accuracy is of prime importance with any information system, EEI suggested that we use the roadway and property line base map created by Kendall County. Until now we have used a map that we obtained from Pavia-Marting when they were our city engineer. We have noticed that this old map was inaccurate in the outlying areas, which sometimes required us to revise it extensively to add newly annexed properties. To avoid confusion we should have only one base map, therefore I have begun creating a new zoning map using the Kendall County data. The average citizen will probably not notice any difference between the old and new map, but it will be more accurate. The Kendall County mapping data ends abruptly at the county line, but since our ultimate boundary may extend to Baseline Road, I would like to have our new map extend somewhat beyond the county line. That information is available from Kane County, but in order to get it we need to agree to the attached Memorandum of Understanding, which is very similar to the agreement we reached with Kendall County recently. The data is available at no cost so long as we abide by the terms of the agreement. Please place this item on the Public Works Committee agenda of October 27, 2003 for discussion. This change order, in the amount of a $1285.00 increase, is for replacing a light in the old city hall parking lot. A windstorm on July 27, 2003 blew down a large tree on Game Farm Road in front of City Hall. The tree fell on and destroyed an existing parking lot light pole. Since the same type of pole was specified for the new employee parking lot, we asked the parking lot contractor for a unit price to replace the pole. We have a unit price for a pole and foundation for the new parking lot ($1835.00), so the proposed unit price for just a pole seems reasonable. The proposal is for an estimated amount of$11,450. The proposal from Smith would identify the tributary area and prepare a preliminary design for an outfall for the pond. The Hamman pond currently drains portions of Countryside Parkway and McHugh Road, but has no outfall. Stormwater entering the pond either evaporates or seeps into the ground. We have an agreement with Don Hamman that requires him to keep the pond bottom clean until an outfall to the Fox River can be constructed. This arrangement is adequate for now, but an outfall will need to be constructed as part of the next large commercial development that drains to the pond. This outfall would probably extend to the Fox River somewhere upstream of Tuma Road. There are environmental issues, however, in this area that may need additional study and coordination with IDOT, IDNR, and the Corps of Engineers. The area served by this pond will be a major commercial center for the city. Establishing a regional stormwater pond is much preferred over individual basins on each lot. If individual basins were constructed, their total area would be more than a single regional pond, they would probably be less efficient, they would tend to trap blowing debris, and would require a considerable amount of maintenance. By having a regional stormwater plan, we can guide individual site designs in the right direction. This is similar to the sanitary interceptor plan that YBSD has prepared for their Facility Planning Area. While a regional pond is preferred, it may require the city to assume ownership and maintenance responsibilities. This certification shall: a)contain the name and license number of the certifier;b)specify each and every act or omission that the certifier contends is a violation of the standard of care expected of a Design Professional performing professional services under similar circumstances;and c)state in complete detail the basis for the certifier's opinion that each such act or omission constitutes such a violation. This certificate shall be provided to SEC not less than thirty(30)calendar days prior to the presentation of any claim or the institution of any arbitration or judicial proceeding. Standard of Care Services provided by SEC under this AGREEMENT will be performed in a manner consistent with that degree of care and skill ordinarily exercised by members of the same profession currently practicing under similar circumstances. Job Site Safety Neither the professional activities of SEC,nor the presence of SEC'S employees and subconsultants at a construction site,shall relieve the General Contractor and any other entity of their obligations,duties and responsibilities including,but not limited to, construction means, methods, sequence,techniques or procedures necessary for performing,superintending or coordinating all portions of the work of construction in accordance with the contract documents and any health or safety precautions required by any regulatory agencies. SEC and its personnel have no authority to exercise any control over any construction contractor or other entity or their employees in connection with their work or any health or safety precautions. The CLIENT also agrees that the CLIENT,SEC and SEC'S consultants shall be indemnified and shall be made additional insureds under the General Contractor's general liability insurance policy. Reuse of Documents All project documents including,but not limited to,plans and specifications furnished by SEC under this project are intended for use on this project only. Any reuse,without specific written verification or adoption by SEC, shall be at the CLIENT's sole risk, and CLIENT shall indemnify and hold harmless SEC from all claims,damages and expenses including attorney's fees arising out of or resulting therefrom. Ownership of Instruments of Service All reports,plans,specifications,field data,field notes,laboratory test data,calculations,estimates and other documents including all documents on electronic media prepared by SEC as instruments of service shall remain the property of SEC. SEC shall retain these records for a period of five(5)years following completion/submission of the records,during which period they will be made available to the CLIENT at all reasonable times. Drywells, Underdrains and Other Infiltration Devices Services provided by SEC under this AGREEMENT do NOT include the geotechnical design of drywells, underdrains, injection wells or any other item that may be devised for the purpose of removing water from tie CLIENT'S property by infiltration into the ground. Due to the high variability of soil types and conditions such devices will not be reliable in all cases. While for this reason SEC does not recommend the use of these devices, in some cases their use may be necessary to obtain an adequate amount of area for development on the CLIENT'S property. Since the use of these devices is intended to enhance the value of the CLIENT'S property and, in some cases,allow development that would otherwise not be possible,the CLIENT will assume all risks inherent in the design and construction of these devices,unless the contractor or a Geotechnical Engineer assumes these risks. Typical risks include but are not limited to: 1. Failure to obtain the required release rate; 2. Variability of the soils encountered during construction from those encountered in soil borings;(Soils can vary widely over a small change in location,horizontal or vertical,particularly with regards to permeability.) 3. Failure of the device due to siltation, poor construction or changes in the water table; 4. Need to obtain additional soils information(i.e.borings etc.)to evaluate the function of installed devices; 5. Reconstruction of failed or inadequate devices; 6. Enlargement of detention/retention facilities to make up for release rates that are lower than those used in the stormwater design, including engineering design and additional land required for such enlargement;and 7. Regular maintenance to remove accumulated silt over the device's life span. If the use of these devices is required SEC will advise the CLIENT that a Geotechnical Engineer must be retained to consult on the project. The CLIENT must enter into a separate agreement directly with this consultant. They will not is sub-contracted through SEC nor are their fees included as part of this AGREEMENT. SEC will work together with this consultant to obtain a final design. Our collaboration may include the use of a common standard detail or the creation of a new standard detail. SEC may make suggestions to the Geotechnical Engineer on ways to tailor these devices to meet the needs of the overall site design. SEC may use a release rate of these devices as provided by the Geotechnical Engineer for the design of the stormwater system. This rate may be faxed to us,as a draft copy of he Geotechnical Engineers report or as a final copy of that report. In no case will SEC accept responsibility for the determination of the expected release rate of these devices. If certification of the contractor's construction of these devices is required by the municipality or desired by the CLIENT a Geotechnical Engineer must also be obtained for these services. This is highly recommended in order to observe the actual soils where the devices are being constructed and to verify that the construction methods used do not violate any assumptions made by the Geotechnical Engineer during the design and evaluation of the standard detail. If a Geotechnical Engineer is not retained by the CLIENT to provide construction review,the CLIENT shall assume all risks that the devices may fail requiring additional geotechnical investigation or reconstruction. Any construction inspection services provided by SEC shall not include inspection of these devices. Failure to Abide by Design Documents or to Obtain Guidaree The CLIENT agrees that it would be unfair to hold SEC liable for problems that might occur should SEC'S plans, specifications or design intents not be followed,or for problems resulting from others'failure to obtain and/or follow SEC'S guidance with respect to any errors,omissions,inconsistencies,ambiguities or conflicts which are detected or alleged to exist in or as a consequence of implementing SEC'S plans,specifications or other instruments of service. Accordingly,the CLIENT waives any claim against SEC,and agrees to defend, indemnify and hold SEC harmless from any claim for injury or losses that results from failure to follow SEC'S plans,specifications or design intent,or for failure to obtain and/or follow SEC'S guidance with respect to any alleged errors,omissions,inconsistencies,ambiguities or conflicts contained within or arising as a result of implementing SEC'S plans,specifications or other instruments of services. The CLIENT also agrees to compensate SEC for any time spent and expenses incurred by SEC'S prevailing fee schedule and expense reimbursement policy. Opinion of Probable Construction Cost SEC shall submit to the CLIENT an opinion of probable cost required to construct work recommended, designed, or specified by SEC. SEC is not a construction cost estimator or construction contractor,nor should SEC'S rendering an opinion of probable construction costs be considered equivalent to the nature and extent of service a construction cost estimator or construction contractor would provide. SEC'S opinion will be based solely upon his or her own experience with construction. This requires SEC to make a number of assumptions as to actual conditions that will be encountered on site;the specific decisions of other design professionals engaged;the means and methods of construction the contractor will employ;the cost and extent of labor, equipment and materials the contractor will employ; contractor's techniques in determining prices and market conditions at the time, and other factors over which SEC has no control. Given the assumptions that must be made, SEC cannot guarantee the accuracy of his or her opinions of cost,and in recognition of that fact,the CLIENT waives any claim against SEC relative to the accuracy of SEC'S opinion of probable construction cost. Design Information in Electronic Form Because CADD information stored in electronic form can be modified by other parties, intentionally or otherwise, without notice or indication of said modifications, SEC reserves the right to remove all indicia of its ownership and/or involvement in the material from each electronic medium not held in its possession. The CLIENT shall retain copies of the work performed by SEC in CADD form only for information and use by the CLIENT for the specific purpose for which SEC was engaged. Said materials shall not be used by the CLIENT,or transferred to any other party,for use in other projects,additions to the current project,or any other purpose for which the material was not strictly intended by SEC without SEC'S express written permission. Any use or reuse of original or altered CADD design materials by the CLIENT,agents of the CLIENT,or other parties without the review and written approval of SEC shall be at the sole risk of the CLIENT. Furthermore,the CLIENT agrees to defend, indemnify,and hold SEC harmless from all claims, injuries,damages, losses, expenses, and attorney's fees arising out of the modification or reuse of these materials. Mr. Joe Wywrot United City of Yorkville Phase I Road Improvement Program YORK-030781-3, 4 August 21,2003 Revised September 30,2003 Page 8 The CLIENT recognizes that designs,plans, and data stored on electronic media including,but not limited to computer disk and magnetic tape,may be subject to undetectable alteration and/or uncontrollable deterioration. The CLIENT,therefore,agrees that SEC shall not be liable for the completeness or accuracy of any materials provided on electronic media after a 30 day inspection period, during which time SEC shall correct any errors detected by the CLIENT to complete the design in accordance with the intent of the contract and specifications. After 40 days,at the request of the CLIENT, SEC shall submit a final set of sealed drawings,and any additional services to be performed by SEC relative to the submitted electronic materials shall be subject to separate AGREEMENT. Dispute Resolution In an effort to resolve any conflicts that arise during the design or construction of the project or following the completion of the project, the Consultant and CLIENT agree that all disputes between them arising out of or relating to this AGREEMENT shall be submitted to nonbinding mediation unless the parties mutually agree otherwise. If the dispute cannot be settled amicably,it shall then be settled by arbitration in the State of Illinois in accordance with the American Arbitration Associates. The Award of the arbitrator shall be conclusive and binding upon the parties. The CLIENT agrees,to the fullest extent permitted by law,to limit the liability of SEC and its subconsultants to the CLIENT for any and all claims, losses, costs,damages of any nature whatsoever or claims expenses from any cause or causes,including attorneys'fees and costs and expert witness fees and costs,so that the total aggregate liability of SEC and its subconsultants to all those named shall not exceed SEC'S total fee for services rendered on this project, whichever is greater. It is intended that this limitation apply to any and all liability or cause of action however alleged or arising, unless otherwise prohibited by law. Hazardous Materials It is acknowledged by both parties that SEC'S scope of services does not include any services related to asbestos or hazardous or toxic materials. In the event SEC or any other party encounters asbestos or hazardous or toxic materials at the job site,or should it become known in any way that such materials may be present at the job site or any adjacent areas that may affect the performance of SEC'S services, SEC may,at its option and without liability for consequential or any other damages,suspend performance of services on the project until the CLIENT retains appropriate specialist consultant(s)or contractor(s)to identify, abate and/or remove the asbestos or hazardous or toxic materials,and warrant that the job site is in full compliance with applicable laws and regulations. Exclusion This fee does not include attendance at any meetings or public hearings other than those specifically listed in the Scope of Services.These work items are considered extra and are billed separately on an hourly basis. Payment 1. All work will be invoiced on a monthly basis. All invoices shall be paid within 45 days of the invoice date. 2. This AGREEMENT shall not be enforceable by either party until each has in its possession a copy of this AGREEMENT signed by the other. Time Limit This AGREEMENT must be executed within thirty(30)days of the composition date to be accepted under the terms set forth herein. Work cannot begin until we have your signed AGREEMENT. Subject: Greenbriar/Walsh Stop Signs `,j Date: October 21, 2003 We have conducted traffic counts at this intersection to determine if multi-way stop control is warranted. The MUTCD lists several factors that may warrant multi-way stop control. Those include vehicle and pedestrian volumes, accidents, speed of traffic, conflicting turn movements, and sight distances. For this intersection, the only apparent criteria that may apply is traffic volume. To warrant multi-way stop control, the total traffic entering the intersection from the major street (in this case Walsh Drive) exceeds 300 vehicles per hour for any 8 hours of the day while the total traffic from the minor street (Greenbriar Road) exceeds 200 vehicles per hour for those same 8 hours. The highest hourly count on Walsh Drive was only 133 vehicles, and that was for only one hour of the day. The highest hourly count on Greenbriar Road was about 90 vehicles, and that was only for one hour of the day. Based on the results of the traffic counts, multi-stop traffic signals are not warranted at this intersection.
