KRAMER fin002/004 1', STATE OF ILLINOIS ) ss January 13, 2003 COUNTY OF KENDALL ) Revised January 14, 2003 ORDINANCE NO. 2003- ORDINANCE AMENDING UNITED CITY OF YORKVILLE LAND CASH ORDINANCE NO. 96-3 WHEREAS, THE UNITED CITY OF YORKVILLE, after careful consideration by the Mayor and City Council, has determined it necessary to amend the Land Cash Ordinance#1996-3 Section 1.C.5 Fair Market Value to reflect a substantial increase in the fair market value of improved residential real estate based upon a study prepared by a certified appraiser and; WHEREAS, THE UNITED CITY OF YORKVILLE, after careful consideration by the Mayor and City Council, has determined that the "fair market value" for all residential improved real property shall be determined by a study performed by the United City of Yorkville's direction not less than every three years commencing in the 2002-2003 fiscal year; WHEREAS,THE UNITED CITY YORKVILLE,after careful consideration by the Mayor and City Council, has determined that it is in the best interests of the community to amend the Section 1.C.5 Fair Market Value of the Land Cash Ordinance#1996-3. NOW THEREFORE BE IT ORDAINED BY THE UNITED CITY OF YORKVILLE; 1. That Section 1.C.5 Fair Market Value of the Land Cash Ordinance#1996-3 is hereby revoked; and a new Section 1.C.5. is created to read as follows: a. The "Fair market value" for any parcel of residential real property shall be deemed to be fifty-eight thousand dollars and 00/100($58,000.00)based upon the study of Thompson Appraisals. The"Fair market value"of an area of residential real property shall be reviewed by study no less than every three(3) fiscal years commencing May 1, 2003. In the event of any objection by the subdivider, developer, or public body, the objector shall submit an appraisal showing the "Fair market value" of such improved land in the area of development of other evidence. Final determination of said"Fair market value"per acre of such improved land shall be made by the City Council based on such information submitted by the subdivider or developer and from other sources as may be submitted to the City Council by affected parties." 2. The Impact Fee/Land Cash Value Analysis&Report prepared by Thompson Appraisals dated December 1, 2002 is incorporated herein reference. 3. Any Ordinance or parts thereof in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict, 4. The various parts, sections, and clauses of this Ordinance are hereby declared to be severable. If any part, sentence, paragraph, section, or clause is adjudged unconstitutional or invalid by a Court of competent jurisdiction, the remainder of the Ordinance shall not be affected thereby. Deuchler Associates, Inc. regarding the proposed Countryside Interceptor Sewer. This sewer replaces the Blackberry Interceptor Sewer project that has been abandoned. The general alignment of the Countryside Interceptor follows the existing 12" sewer from Blackberry Creek to W. Kendall Drive, then east along Countryside Parkway to Route 47, then north along Route 47 as a forcemain to a new lift station at Route 47/Carpenter intersection. The current construction cost estimate of the project is $2,700,000. The proposal covers both design and construction engineering services, and would be paid for on an hourly basis with a not-to- exceed amount of$405,000. This language of this agreement is very similar to the Blackberry Creek Interceptor engineering agreement. That project had estimated engineering expenses of$190,000 and construction expenses of$1,460,000. With engineering costs roughly proportionate to construction cost, and adding in the 10% increase in hourly rates from 2000 (the year of the Blackberry Creek agreement) to 2003, the new proposed engineering agreement is in the $400,000 range. We should confirm that these engineering expenses are reimbursable from YB SD. Please place this item on the December 23, 2002 Public Works Committee agenda for' consideration. - Cc: Dan Kramer, City Attorney ENGINEERING AGREEMENT FOR DESIGN SERVICES AND CONSTRUCTION GUIDANCE OF THE COUNTRYSIDE INTERCEPTOR UNITED CITY OF YORKVILLE This Agreement is made and entered into this day of , 2002, by and between Walter E. Deuchler Associates,Inc.whose address is 230 S. Woodlawn Avenue,Aurora, IL 60506, hereinafter called the "Engineer", and the United City of Yorkville, Kendall County, Illinois, hereinafter called the "Owner", and covers certain professional engineering services in connection with the improvement. Witnesseth that, in consideration of these premises and of the mutual covenants herein set forth, Now,therefore,the Owner and Engineer, in consideration of their mutual covenants,herein agree in respect to the performance of professional engineering services by the Engineer, and the payment for those services by the Owner, as set forth below. SECTION 1 - PROJECT DESCRIPTION 1.1 The extension of the existing Blackberry Creek Interceptor, to be named the Countryside Interceptor,herein referred to as the"PROJECT", and previously labeled as ALTERNATE NO. 6 in the November 6, 2002 letter to the Yorkville-Bristol Sanitary District, consists of installing approximately 3500 L.F. of 24 inch pipe, and 1450 L.F. of 12 inch forcemain along the west side of Route 47 and the south side of Countryside Parkway,the construction of a 2.9 mgd pump station at the southeast corner of the Holdiman property and the elimination of a small lift station in the Countryside Subdivision. SECTION 2 - THE ENGINEER AGREES 2.1 To perform professional engineering services in connection with the Project, as hereinafter stated. 2.2 To serve as the Owner's professional engineering representative in those phases of the Project to which this Agreement applies, and to give consultation and advice to the Owner during the performance of services. 2.3 To sublet geotechnical, wetland delineation and archaeological survey work. 2.4 To provide Design Services for the Project described in Section 1.0, as delineated on the attached Exhibit A and as summarized in the following: -2- 2.4.1 Perform topographic surveys. 2.4.2 Delineate jurisdictional wetlands of the Blackberry Creek at the location of crossing. 2.4.3 Order title commitments of parcels considered as "Green Space"in the Countryside Subdivision. 2.4.4 Prepare Plans and Specifications of the proposed 24 inch gravity sewer and 12 inch forcemain, based on the alignment shown on Exhibit A. 2.4.5 Prepare Plans and Specifications of the proposed 2.9 mgd pump station. 2.4.6 Locate markers and monumentation of parcels and ROWs and prepare plats of easement and plat of survey, as needed upon easement negotiations and property acquisition by the Owner. 2.4.7 Assist the Owner in obtaining appropriate permits from the Corps of Engineers, IDNR, and the State of Illinois EPA. 2.4.8 Upon authorization of advertisement for bids by the Owner,the Engineer will furnish Owner necessary copies of the Plans and Contract Documents and will endeavor to interest competent contractors in submitting bids on the work as advertised, and will advise with the Owner in the matter of letting contracts for work on the basis of bids received. 2.5 To furnish construction guidance for the Project. 2.5.1 Video taping the site prior to any construction activity. 2.5.2 Consultation on interpretation of plans and specifications and changes under consideration as construction proceeds. 2.5.3 Establishment of lines and grades for the work as construction progresses. 2.5.4 Checking all shop and working drawings. 2.5.5 Furnishing a Resident Project Representative (RPR) at the job site to provide continuous observation of the work. The duties, responsibilities and limitations of authority of the RPR are set forth in Exhibit B to this agreement. 2.5.6 Reviewing and checking all reports by testing laboratories on equipment and material tested, if provided by the Owner. • -3- 2.5.7 Reviewing and checking all payment estimates, change orders, records and reports required. 2.5.8 Preparing final pay estimates. 2.5.9 Preparing record drawings and supplying the City mylar record drawings after completion of construction. SECTION 3 - THE OWNER AGREES 3.1 To furnish available data such as utility maps, special design criteria, available plans of existing subdivisions,title searches for determination of existing right-of-way and property encumbrances. The Owner will negotiate easements and property acquisition with the property owners affected by the Project. 3.2 To designate in writing a person to act as Owner's representative with respect to the services to be performed or furnished by Engineer under this Agreement. Such person will have complete authority to transmit instructions, receive information, interpret Owner's policies and decisions with respect to Engineer's services for the Project. 3.3 To pay the Engineer, for those services described in Section 2 a not-to-exceed amount of $405,000.00 based on the Engineer's Fee Schedule attached, for the 2003 calendar year or the current schedule in effect after calendar year 2003. 3.4 That those services beyond the scope of Section 1 and not included in Section 2, such as,but not limited to, assisting the Owner in negotiating easements and acquiring property, changing alignment of the interceptor due to failure in acquiring easements and others, will be considered additional work. Compensation for additional work will be paid in accordance with the attached 2003 Fee Schedule for the 2003 calendar year or the current schedule in effect after calendar year 2003. 3.5 That payments due the Engineer for services rendered will be made in monthly payments based upon actual work completed. 3.6 To pay Engineer within thirty (30) days after the invoice date, after which, payment will increase at an interest rate of 1.5%per month. 3.7 That Engineer has the right to suspend or terminate service if undisputed charges are not paid within forty-five(45)days of receipt of Engineer's invoice, and Owner agrees to waive any claim against Engineer arising, and to indemnify, defend, and hold Engineer harmless from and against any claims arising, other than from Engineer's negligence or wrongful conduct,from Engineer's suspension or termination due to Owner's failure to provide timely payment. Owner recognizes that any charges not paid within thirty (30) days are subject to a late payment charge equivalent to 1.5% of the balance due for each additional month or -4- fraction thereof that undisputed charges remain unpaid. 3.8 In the event of termination by Owner under Section 4.2 for convenience or by Engineer for cause, Engineer, in addition to invoicing for those items identified in Sections 3.3 and 3.4 shall be entitled to invoice Owner and shall be paid a reasonable amount for services and expenses(not to exceed a total of$1000.00),directly attributable to termination,both before and after the effective date of termination, such as reassignment of personnel, costs of terminating contracts with Engineer's Consultants, and other related close-out costs, using methods and rates for Additional Services as set forth in Section 3.4, but in addition to amounts paid thereunder. In addition a 10% charge of the unbilled amount as set forth in Section 3.3 shall be paid by the Owner to the Engineer. 3.9 To pay the Engineer an additional 8% for sublet services and outside vendor expenses. 3.10 In the event that Owner shall bring any suit, cause of action or counterclaim against Engineer, to the extent that Engineer shall prevail, Owner or the party otherwise initiating such action shall pay to Engineer the cost and expenses incurred to answer and/or defend such action, including reasonable attorneys fees and court costs. In no event shall Engineer indemnify any other party for the consequences of that party's negligence, including negligent failure to follow Engineer's recommendations. 3.11 Engineer's employees shall not be retained as expert witnesses except by separate written agreement. Owner agrees to pay Engineer pursuant to Engineer's current fee schedule for any Engineer employee(s) subpoenaed by any party as an occurrence witness as a result of Engineer's services. 3.12 The Engineer will not be responsible for job or site safety of the Project other than arising from validly implemented affirmative recommendations therefor. Job and site safety will be the sole responsibility of the contractor/contractors of the Project unless contracted to others. 3.13 The Owner shall require in any agreement it makes with a Contractor for the Project that the Contractor shall obtain Commercial General Liability Insurance with contractual liability and shall name the Engineer, its employees and consultants, as additional insured,with said coverage to be primary and non-contributory. In addition, the Owner agrees to name the Engineer, its employees and consultants, as an additional insured on any policy of Owner covering the Project,with said coverage to be primary and non-contributory. When Owner requests services of the Engineer in any capacity other than as a design professional, then, to the fullest extent permitted by law,the Owner shall defend, indemnify, and hold harmless the Engineer,its employees and consultants,from and against claims,damages,losses,costs, including but not limited to reasonable attorneys fees and costs, ("Losses") arising out of or resulting from the Engineers performance of services other than as a design professional (including any services that could be construed as those of a construction manager)provided that such Losses are attributable to bodily injury, sickness, disease or death, or to injury to -5- or destruction of tangible property to the extent caused, in whole or in part, by the contractor, subcontractor, or anyone directly or indirectly employed by them or anyone for whose acts they may be liable. This provision shall survive the termination or completion of this Agreement. 3.14 Neither the professional activities of the Engineer, nor the presence of the Engineer or his or her employees and subconsultants at a construction site, shall relieve the General Contractor and any other entity oftheir obligations,duties and responsibilities including,but not limited to, construction means, methods, sequence,techniques or procedures necessary for performing, superintending or coordinating all portions of the work of construction in accordance with the contract documents and any health or safety precautions required by any regulatory agencies. The Engineer and his or her personnel have no authority to exercise any control over any construction contractor or other entity or their employees in connection with their work or any health or safety precautions. The Owner agrees that the General Contractor is solely responsible for job site safety, and warrants that this intent shall be made evident in the Owner's agreement with the General Contractor. The Owner also agrees that the Owner, the Engineer and the Engineer's consultants shall be indemnified and shall be made additional insureds under the General Contractor's general liability insurance policy. In addition, and notwithstanding any other provisions of this Agreement,the Owner agrees, to the fullest extent permitted by law, to indemnify and hold harmless the Engineer, his or her officers, directors, employees, agents and subconsultants from and against all damage, liability or cost, including reasonable attorneys' fees and defense costs, arising out of or in any way connected with the Project or the performance by any of the parties above named of the services under this Agreement, excepting only those damages, liabilities or costs attributable to the sole negligence or willful misconduct of the Engineer. 3.15 The Owner agrees to limit Engineer's liability specifically and exclusively to the Owner on the Project arising from Engineer's professional acts, errors, or omissions or breach of contract or other cause of action, such that the total aggregate liability of Engineer to all those named shall not exceed $100,000.00 or the total cumulative fees for the services rendered for this Project, whichever is greater; and Owner hereby releases Engineer from any liability above such amount. 3.16 If any of the provisions contained in this Agreement are held illegal, invalid, or unenforceable, the enforceability of the remaining provisions will not be impaired. 3.17 That any difference between the Engineer and Owner concerning the interpretation of the provisions of this Agreement shall be referred to a committee of disinterested parties consisting of one member appointed by the Engineer, one member appointed by the Owner and a third member appointed by the two other members for disposition and that the committee shall attempt to resolve the difference by formal non-binding mediation conducted in accordance with rules and procedure to be agreed upon by the parties. -6- SECTION 4 - IT IS MUTUALLY AGREED 4.1 During the progress of work under this Agreement,the Engineer shall continuously monitor its costs and anticipated future costs, and if such monitoring indicates possible costs in excess of the amounts stated in Section 3 above, the Engineer shall immediately notify the Owner of such anticipated increase and the compensation for engineering services shall be adjusted, if any, by amendment to this Agreement. 4.2 This Agreement may be terminated by the Owner upon giving notice in writing to the Engineer at his last known post office address. Upon such termination, the Engineer shall cause to be delivered to the Owner all drawings, specifications, partial and completed estimates and data,with the understanding that all such material becomes the property of the Owner. The Engineer shall be paid for any services completed and any services partially completed in accordance with Section 3. 4.3 That the Engineer warrants that he has not employed or retained any company or person, other than a bona fide employee working solely for the Engineer, to solicit or secure this Agreement, and that he has not paid or agreed to pay any company or person, other than a bona fide employee working solely for the Engineer, any fee, commission, percentage, brokerage fee,gifts,or any other consideration, contingent upon or resulting from the award or making of this Agreement. For breach or violation of this warranty the Owner shall have the right to void this Agreement without liability whatsoever. 4.4 That the Owner acknowledges that the Engineer is a corporation and agrees that any claim made by the owner arising out of any act or omission of any director, officer or employee of the Engineer, in the execution or performance of this Agreement shall be made against the Engineer and not against such director, officer or employee. 4.5 That the Owner and the Engineer each binds himself and his partners,successors, executors, administrators and assigns to the other party of this Agreement and to the partners, successors, executors, administrators and assigns of such other party in respect to all covenants of this Agreement; except as above, neither the Owner nor the Engineer shall assign, sublet or transfer his interest in this Agreement without the written consent of the other. Nothing herein shall be construed as creating any personal liability on the part of any office or agent of any public body which may be a party hereto, nor shall it be construed as giving any right or benefits hereunder to anyone other than the Client and the Engineer. 4.6 All Reports, Drawings, Specifications, other documents, and magnetic media prepared or furnished by the Engineer pursuant to this Agreement are instruments of service in respect to the Project, and the Engineer shall retain ownership of said documents and magnetic media including the right of reuse by and at the discretion of the Engineer whether or not the Project is completed. The Owner may retain copies, including reproducible copies, of the Engineer's documents and magnetic media for information and reference in connection with the use and occupancy ofthe Project by the Owner and others;however,the Engineer's -7- documents and magnetic media are not intended or represented to be suitable for reuse by the Owner or others on additions or extensions of the project, or on any other Project. Any such reuse without written permission and verification or adaption by the Engineer for the specific purpose intended will be at the Owner's sole risk and without liability or legal exposure to the Engineer. The Owner shall indemnify and hold harmless the Engineer from all claims, damages,losses and expenses including attorneys' fees arising out of or resulting therefrom. Any furnishing of additional copies and verification or adaptation of the Engineer's comments and magnetic media will entitle the Engineer to claim and receive additional compensation from the Owner. 4.7 The Engineer's agent shall perform the function of Agent or Representative of the Owner, duringthe performance p ere of the PROJECT. The Engineer may be required to enter private properties and private premises to perform the work identified in the PROJECT. DEFINITIONS Buffers Areas designed to reduced the sound or visual impact on the neighboring community or houses. Buffers can be made by planting of bushes or a mixture of vegetation. Conservation Natural area identified as having rare plant or animal species, or areas identified within the Parks Open Space Master Plan . This area may include or be identified as a fen, watershed or have historic value needing preservation. Detention (Dry Ponds) These areas are designed with a 2 year low flow underdrain system so that ponding beyond the storage does not occur and that a good stand of grass can be maintained. The slopes shall be a minimum of 2% except that a slope will be allowed directly over the underdrain pipes. All incoming and outgoing conduits shall have concrete flared end section or poured in place headwall with grates. 2 foot inlets can be placed over the low flow pipe. The maximum water depth below the HWL shall be 4 feet. Subdivision control ordinance 3-9-00/2000-2 Flood Plain That land adjacent to a body of water with ground surface elevations at or below the base flood or the 100 year frequency flood elevation. The floodplain is also known as the Special Flood Hazard Area (SFHA). Subdivision control ordinance 3-9-00/ 2000-2 Private facilities and parks Parks or facilities that are secluded from the general population; or owned and controlled by a person or group rather than the public or municipality. Public Open Space Any publicly owned open area, including but not limited to the following: parks, playgrounds, conservation, trails, greenways, etc. Retention (Wet Ponds) These areas are designed to a minimum depth below normal water levels of 6 feet. If fish life is to be maintained, 25% shall be to a minimum depth of 12 feet. These areas must have a safety shelf 3 feet in width at a depth of 2 feet below the normal water elevation. The slope to the bottom of the lake is 2:1 and the slope up from the lake is a maximum of 3:1. All storm water inlet points must have calculated desilting basins below the required 6 feet depth. Subdivision control ordinance 3-9-00/2000-2 Public Sidewalk That portion of street or crosswalk way, paved or otherwise surfaced, intended for pedestrian use only, 5' wide, 5" thick on 2" compact stone. Trail way Is a paved path or connecting paths or walkways with the intent to allow pedestrians or bikes to traverse across the City. Wetlands As defined by the Illinois Department of Natural Resources and/or US Army Core of Engineers. II. LAND / CASH STANDARDS Contribution of land cash according to land/cash ordinance #1996-3 "The ultimate population density to be generated by a subdivision or planned unit development shall bear directly on the amount of land required to be dedicated for park and recreation sites. The acreage of land dedication requirement shall be determined by obtaining the total population of the development times 10 acres per 1,000 population. Total population is determined by applying the estimated ultimate population per dwelling unit table to the number of respective units in the development. Each single family home will be calculated to have four bedrooms; Duplex unit will be calculated as 50% two bedroom units and 50% three bedroom units; Town home and apartments will be calculated with two bedrooms". When available land is inappropriate for park, or recreational use, the City shall require a cash contribution in lieu of the land dedication. This is based on the land cash calculation and the value per acre of the land based on the "Fair market value". In cases approved by the Park and Recreation Board the contribution of Land Cash can be a mixture of 50% land 50% cash, or other agreed upon contribution mixes. A developer may donate the land and cash for park development upfront to have the construction of the park expedited. Otherwise a 50% build-out standard for the subdivision will be set in place for park development. Areas of NO Credit No credit for exclusively private facilities & parks. No credit for retention or detention areas, measured from the top of the bank area. Full or Partial Credit Credit may be received for active wet areas (lakes, rivers, creeks) historical areas, preservation area or other areas, that are identified to have recreational or conservation value. This will be considered on a case-by-case base. Ecological study may be required to verify historical and/or preservation areas. Credit for trail ways that are identified as infrastructure or connecting trails to a regional trail way system. Partial credit may be given for undeveloped trail ways. Full credit may be given to land donations that are usable and or classified as developable for use for the general public. III. MINIMUM DEVELOPMENT STANDARDS OF LAND DONATION UPON RECEIPT The slope, topography and geology of the dedicated site as well as its surroundings must be suitable for its intended purpose. All sites shall be dedicated in a condition ready for full service of electrical, water, storm sewer, sanitary sewer, sidewalks, landscaping, streetlights, and streets. • OPEN / PARKLAND To be graded, topsoil and seeded according to the Park and Recreation Staff direction. • TRAILWAYS Surface Level and graded width for two-directional shared use path is 10 feet. A minimum of 2 feet wide level graded shoulder with is grass is required on each side for clearance. Grades should be kept to a minimum. A grade of 5% should not be longer than 800 feet. A grade of 8% 12:1 will be the maximum to allow for ADA compliance. Horizontal grades —the trail surface will be sloped in one direction at the maximum rate of 2% (1/4" per foot). Other requirements and improvements may be required based on the location and needs of the site. Paving 2" asphalt, 8" compacted stone and aggregate bases extend a minimum of 6" beyond pavement on each shoulder. • CONSERVATION AND PROTECTED AREAS An environmental study including a Topographic map is completed by the developer prior to the land dedication identifying the endangered and protected areas, summary of floristic quality, wetland and floodplain maps and inventory of wildlife, vegetation and habitats. Watershed areas are identified with recommendations for management. Park Development Upon acceptance or through the PUD agreement of the park land from the developer the Park and Recreation Board and staff would plan the development of the park and/open land site with the following guidelines whenever possible. Procedures 1. Based on the established land cash ordinance a developer will make a donation of park land to the United City of Yorkville Park and Recreation Department for future use and development. 2. The Park and Recreation Board and staff will project park utilization and design in conjunction with the Parks Open Space Master plans established needs and determine priority and fiscal needs. 3. Annually the staff will recommend budget projections for park development based on available fiscal resources 4. A concept plan will be developed by the park planner or United City of Yorkville Staff indicating park design and preliminary cost projections. 5. Whenever possible, a public meeting inviting residents for the surrounding subdivision and area to the location site for input. 6. A finalize concept plan and cost projections will be developed and submitted to the Park Board for approval and recommendations to the City Council for development. 7. Timeline is established for project management. 8. Project/ Park plan completed. • There may be occasions when a developer provides development support in advance to a subdivision being built which may require these procedures to be adjusted or altered. The book suggests using this on matters that require no debate or where enough debate has already taken place and no further discussion is necessary. UNITED CITY OF YORKVILLE UTILITY BILLING CLERK JOB DESCRIPTION Department: Administration Reports To: Finance Director Status: Full-time Position Description Overview This individual will be responsible for handling billing of all municipal utility accounts, as well as doing adjustments, running reports, and problem solving questioned accounts. This position involves heavy customer contact and the ability to respond to questions and complaints. A need for mathematical ability is necessary. Essential Job Functions 1. Maintain and update account information, data sheets and delinquent accounts. Prepare, review, adjust, sort, and mail bi-monthly bills for municipal utility accounts, also issue closed accounts final bills. Enter bank payments and meter installations into system and copy to accounting as required. 2. Process and transfer information recorded within the water meter radio units into the computer billing system. 3. Print and review water meter reads after transfer has been completed by the water meter radio unit. Identify any problem reads and request a re-check of the water meter read to the Public Works Director. 4. Periodically review the past due account list, follow up on delinquent and collection accounts, sending letters prior to referral. A copy of the renter's delinquent letter is also sent to the property owner. 5. Prepare penalty report, review to identify any exceptions, and complete the penalty process. Print and mail the penalty bills. 6. Prepare aging reports for credit balances and past due accounts, indicate collection and shut-off processes as required. 7. Set up monthly payment plans when applicable. Monitor monthly. 8. Prepare the shut off list. Check payments received daily to update the shut off list. Adjust shut off fees to accounts. Distribute the shut off list to the Public Works Director and receptionist. 9. When necessary, prepare documentation on uncollected past due accounts to begin filing a lien on the property as directed by procedures. 10. Prepare refuse report to inform the refuse company of the house count and Senior Citizen count on a monthly basis. 11. Calculate the YBSD payment, which is obtained from the cash receipts reports (mid and end of month) and provide this information to the Finance Director for approval. 12. Prepare reports monthly for meter installation, and new water and sewer installations accounts for assignment to Public Works. 13. Check status on Meter Reader's referrals, final and other meter readings for assignment to Public Works. Follow-up weekly. 14. Answer phones, take messages as needed, and provide customer service at counter 15. Investigate and respond to any customer billing questions and make adjustments when appropriate, notify the supervisor with any issues. 16. Take all utility complaint calls and refer to the proper department, if an emergency is reported contact the Public Works Director immediately. 17. Maintain and file all water utility reports and records. 18. Provide a monthly listing of all new water accounts and change of ownership information to the Deputy Clerk and Administrator's Assistant. 19. Provide information for annual audits re: Water fund, and YBSD collections and billing of fees. Provide census information update as required. 20. Other duties as assigned by the Finance Director. Memo To: Tony Graff, City Administrator, Joe Wywrot, City Engineer From: Jim Hoving Date: January 21, 2003 Re: Kennedy Road Alternative Realignment Analysis - Yorkville Per your request at our meeting last Thursday, we have conducted an analysis for improving the Kennedy Road curve, located approximately 0.5 miles east of Route 47. The analysis included two (2) realignment scenarios. The first would be to introduce a reverse curve on Kennedy Road and the second would be to introduce a "Tee" intersection at McHugh Road (extended) using a simple curve that would take the east leg of Kennedy Road south into McHugh (see attached exhibits). The west leg of Kennedy would be stop controlled at the "Tee" intersection. Both analyses used design speeds that were 5 mph greater than the posted speed (or expected posted speed). The design criteria were derived from IDOT's Bureau of Design and Environment Manual. The ROW width was assumed to be 80 feet for a major collector roadway per City ordinance. Alternative 1: Realign Kennedy Rd. using reverse curves. Design Parameters: Method A: Maintain existing posted speed limits of 55 mph with a normal crown roadway and with a 4% super elevated roadway. • Normal crown roadway with 55 mph speed limit resulted in 1600 ft. radii which were too large to fit within the Menard's property. • 4% super elevated roadway with 55 mph speed limit resulted in 1300 ft. radii, which fit within the Menard's property. • The tangent runoff using these parameters would be a minimum of 200 ft. • See Exhibit 1A • Page 1 Method B: Decrease the posted speed limit to 45 mph and use normal crown. • Using a normal crown and a 45 mph posted speed limit resulted in a minimum radius of 900 ft. • The tangent runoff using these parameters would be a minimum of 70 ft. • See Exhibit 1 B. Method C: Decrease the posted speed limit to 45 mph and use a 4% crown. • The 4% super elevation at a 45 mph posted speed limit resulted in a minimum radius of 625 ft. • The tangent runoff using these parameters would be a minimum of 70 ft. • See Exhibit 1 C Alternative 2: Realign Kennedy Rd into McHugh forming a "T" intersection. Design Parameters • 45 MPH posted speed limit on Kennedy Rd. • Equates to a minimum radius of 900 ft. with a normal crown roadway on the east leg of Kennedy Rd. • The west leg of Kennedy Rd. would be a stop controlled. This will allow for the reduction of the posted speed limit, on the west leg. Super elevation approaching a stop condition is not recommended and is not included. The west leg of Kennedy Rd. will have a minimum radius of 600 ft. with a normal crown roadway assuming a 35 MPH speed limit. • See Exhibit 2. • Page 2 Recommendations: Although the reverse curve alternatives are designed to standard IDOT policy, the introduction of a second curve appears to be counterproductive to solving the accident history at the subject curve on Kennedy Road. Part of the existing safety issue is due in part to limited sight distance on the existing curve and the ability of the driver to anticipate the curve when approaching it. By introducing a second curve, the sight distance is somewhat improved but the existing obstacles (mainly trees) will still obstruct a driver's far view of the roadway. The introduction of a second curve combined with the fact that the curves will need to be constructed back to back, will further complicate a driver's decision making ability thus creating the potential for driver error. Back to back reverse curves, in general, are not a good design practice. By turning Kennedy Road into McHugh Road (see Exhibit 2), the desired sight distance can be achieved for west bound vehicles and the use of stop control on the west leg would eliminate the hazardous curve for east bound vehicles. Maintaining one curve designed to applicable standards decreases the potential for driver error.
