I spoke with Bill Dettmer about this, and he said there was a state statute that allowed a municipality to issue itself a building permit rather than applying for a county permit. I also called Jerry Dudgeon who agreed that the statute existed, but also expressed concern due to a court case between Naperville and Will County years ago that found that the statute was not applicable. Jerry also said that there could be problems regarding the proposed land use and the current county zoning. He recommended that we annex the property to avoid any problems that might arise regarding county involvement. This is exactly the same situation as the proposed Countryside pump station, therefore I recommend that we annex the property to avoid any problems that might arise regarding county involvement.
