The meeting was called to order at 7:02 pm. by Chairman Joe Besco.

Presentations:
1. Blackberry Creek
a. USGS Floodplain and Flood way Mapping for Blackberry Creek

Floodplain and Flood way Mapping for Blackberry Creek
c. Sidwell Contract for Blackberry Creek
EEI coordinated with USGS on questions the committee had and with Sidwell on
the review of their contract. There was also a meeting with all the funding
agencies. The City of Yorkville's current and future commitment will remain the
same at $59,530 over 3 years. There is an amendment being made that the $96,000
from the grant will pay for the extra costs. Gary Lobdell from Sidwell spoke about
the proposal for the Topographic Mapping. The services that Sidwell will perform
are an extension of work that has already been done in Kendall County, and they
will be paid out of the grant money. The city will have to pay the costs up front
and then get reimbursed from Kane County. The grant will not be finalized with
Kane County until all the agreements are in place. The extra cost is to pay for
additional, more detailed elevation data. This will be done using existing
photography,but additional ground control will be needed to proceed. There will
be additional surveying in Yorkville and Montgomery. The accuracy of the flood
study improves with improved data. What is being asked right now is for the
council to approve the contract with Sidwell and EEI's proposal to provide
oversight. The approval will be contingent on the intergovernmental joint funding
agreement. This will move on to COW with a request for Jeff Freeman to come to
COW to explain answer any questions the other Aldermen would have.

Some of the items were moved ahead to accommodate people that were present for
certain issues.
New Business
6. Resident Request for a Buffer for PNA Property—Mr. Levy and his wife have been
trying to purchase some property owned by the PNA camp to create a buffer zone
between his property and the PNA camp. He has not yet been able to acquire this
property, and because of the sewer line replacement, all the trees that were in between
his property and the property used for the camp,he now has a very difficult time
keeping people and animals that are visiting the camp out of his yard. Mr. And Mrs.
Levy are requesting an 8 foot high fence be put up to solve this problem. The fence
would be installed on Mr. Levy's property and he would maintain and repair it after it
is in place. Alderman James had a concern that if the city were to grant Mr. Levy's
request, that everyone who is along the water and sewer lines would want something
like a fence for their property. Alderman James is not sure the city should have to pay
for this. The cost of the project would go through the Sanitary Department and
eventually the future developers would pay for it. This will be discussed with the
Yorkville/Bristol Sanitary Department. This will move on to the July 5th COW.
Old Business
1. Citywide Transportation Analysis—Mayor Prochaska requested there be a full 2030
build out in the proposal. This will be a Prairie Parkway developed model using the
Chicago Area Transportation Study(CATS). Eric Dhuse asked if this would be similar
to the last Transportation Study done by Smith Engineering. Jason Poppen said it
would be more precise. The information would be put into the model and run. The
findings would include possible future river crossings. It will be a better planning tool
because it is consistent, and it will help with the needs assessment. This is a base
estimate proposal which includes four alternate roadway networks in the test roadway
scenarios and will illustrate alternative roadway improvement scenarios. This is not a
budgeted expense. The fees for this will not be recapturable. This will move on to
COW.

New Business
1. Illinois State Geological Survey Research Agreement for Groundwater Resource
Investigations for Kendall County- The USGS performed a Hydrogeologic Resource
Assessment for Kendall County with the ISGS and ISWS. The cost was $86,000 with
local funding at $43,000. Yorkville's share of the cost was $10,000. Then there was a
Contract Amendment of$11,000 with the cost being split between the funding
agencies. The new proposal is for a groundwater research study including information
of the residential wells. 3D Geology will be used to create the model with the filed
work being done by the University of Illinois. The municipalities agreeing to share
the costs are Kendall County, Joliet, Millbrook, Shorewood, Yorkville, Montgomery,
Oswego, Plano, and Minooka. The project cost would be $292,000, and Yorkville
will fund 3 payments of$11,515 over 3 years. The first payment would be due after
the agreement's execution. This will be a helpful study in the longterm. The
committee is being asked to agree with the county to contract with the University of
Illinois. This will move on to the July 5th COW.
2. Plat of Easement—Betwizer Development—This is for an easement in the Fox
Industrial Park. It will become a 4 building development. Joe Wywrot recommends it
be approved. This will move on to COW.
3. Block 4 Black's Addition—Letter of Credit Reduction#1 —This is related to New
Business #15. It is an authorization for the City Clerk to call the letter of Credit prior
to it's expiration, should the need arise. New Business #3 is also for a reduction in the
letter of credit. Joe Wywrot recommends approval of New Business items #3 and#15.
They will move on to the July 5th COW Consent Agenda.
4. 2005 Asphalt Surface Treatment Program—Results of Bid Opening—This will be
applied in the newer subdivisions, Cannonball Estates, Kylyn's Ridge Unit 1, River's
Edge (South of the RR tracks), Sunflower Estates Units 1 and 2, and Country Hills
Unit 1. Joe Wywrot recommends awarding the contract to CAM, LLC in the amount
of$34,695.44. This will move on to COW Consent Agenda.
5. 2005 Crack Filling Project—Results of Bid Opening—This will be applied to the
same streets as the Asphalt Surface Treatment Program, and is there is enough money
leftover, Joe Wywrot recommends adding Colonial Parkway. The recommendation is
to award SKC Construction, Inc. the contract, in the amount of$27,600.03. This will
move on to COW Consent Agenda.
7. Contract A.2—Cannonball Trail Booster/PRV Station—Change Order#2—This is
additional work involving valving and an auto-dialer to monitor the water levels in the
water tower. The work is already complete. This will move on to COW Consent
Agenda.
8. Greenbriar Unit 4 Letter of Credits—There has been difficulty getting the as-built
reports. Handwritten as-built diagrams are going to be the best information that will
be able to be obtained at this time. This is a request to call the letter of credit if
necessary. The punch list has not been completed yet. This will move on to COW
Consent Agenda.

9. Cornerstone Subdivision Bond Reductions No. 1 —This subdivision is at Greenbriar
and Rt 47. This is for a reduction in the letter of credit for 2 Bonds. The Lexon Bond
would be reduced to $139,678.41 and the Safeguard Bond would be reduced to
$363,667.24 This will move on Consent Agenda.
10. Bruell Street Force main and Gravity Sewers—Change Order#2—This is due to
some field tiles needing replacing, and some changes at the connection. The
connection will be made at the wet well, and the well head will become a permanent
manhole. This will move on Consent Agenda.
11. Sale of Used Equipment—This is for the sale of 3 trucks. The 1987 Chevy and
the 1989 GMC have been passed from Sewer to different Engineering Departments,
and the 1998 dump truck has been on the rotation program. This will be handled as
sealed bids. Attorney Wyeth will have to make a resolution to sell the trucks. This
will move on to COW Consent Agenda.
12. Water Tower Repairs—This is informational for now. It will come back to a
future Public Works Meeting. Sprint has placed their antenna on top of the flange,
making it impossible to open. Sprint will be contacted to move it, and if they do not
move the antenna, it will be moved for them.
13. Sanitary Sewer Manhole Lining Project—Eric Dhuse believes that Performance
Pipeline of Ottawa is the only company in the area that does this kind of work. This is
a budgeted expense. Right now there is no written agreement, only a verbal
agreement that it will cost $9 per linear foot high. The company will do the work and
then the final bill will be presented for payment.
14. Hiring for Locator Position—Ami has been hired. She used to work for NICOR
and she has her CDL. She already knows how to do the locates and has worked with
the staff in the past. She will have a truck to drive. This will go on to COW as
informational.
15. Block 4 Black's Addition—Letter of Credit—This was discussed at the same time
as New Business #3. It is going on Consent Agenda.
16. 500MG Water Tower Painting—Change Order#1 —This water tower is currently
empty. This change order is to install a roof vent, an overflow flap gate, to repair the
vapor jacket inside the riser pipe, and the cathodic protection system will be removed
and the seams sealed. This will move on Consent Agenda.
Old Business
2. Route 126 and Route 71 Intersection Realignment—IDOT wanted a joint agreement to
transfer jurisdiction of a 1,000 foot portion of 126 to the City of Yorkville. The City
wants to vacate the portion of the roadway, and IDOT wants reimbursement of the
Right Of Way that was purchased years ago. Whoever the road is vacated to would
have to reimburse the city for this cost. The BKFD will be contacted to see if they are
willing to help pay for the Opticom system. The water main casings could be put into
a recapture agreement. This will come back to a future Public Works Meeting.

Additional Business
Alderman Munns wanted everyone to be aware of the road in Fox Hill with the spot in
the road that has been dug out and filled with gravel, the gravel is not filled as high as the
cement, which is causing a bump.
Alderman Besco pointed out that the citizens of Yorkville are not following the watering
restriction and are watering in the middle of the day or are watering excessively. Eric
Dhuse already knows about this and stated the first time the person or company is caught,
they will receive a warning, and anytime after that they can be issued a ticket by the
Police. The watering hours are from 5 am—9 am and from 9 pm— 12 am. If the water
usage does not go down, then the watering ban will have to be further restricted.
At Coffee with the Mayor, a resident pointed out there is no Stop sign for the people on
Illinois that are going onto Mill St. Every other road that crosses Mill Street has a Stop
Sign. Also there are some big holes at Mill and Orange that need some patching. Art
Prochaska also received a letter from a resident on Conover Ct. that began inquiring
about the parking ban, and then went on to point out some rather large cracks and holes in
the streets near the driveways. Alderman Besco pointed out that he has seen several steel
plates being installed across the curbs. At one point the city entertained an idea of having
a curb program similar to the sidewalk program the city uses. A notice will be sent to the
homeowners with the steel plates across their curbs asking the plates to be removed.

ApprovaUCorrection of Minutes: May 23, 2005 —The minutes were approved.

New Business
18. Heartland Circle—Water main, Sanitary Sewer, and Storm Sewer Final
Acceptance and Bond Reduction No. 3—This is for early acceptance of the
improvements. The punch list is complete. The obligation will expire when the last
warranty in the development expires. This will move on to COW with a letter of
credit reduction in the amount of$128,693.86. The remaining letter of credit would
be for $1,354,929.56. This will go on to COW Consent Agenda.
1. Water Department Reports for May and June 2005—The wells are still low by
about 30 feet. This will move on to COW Consent Agenda.
2. Castle Bank—Sidewalk Agreement—This property is on Rt. 34, but it is in the range
of the Rt. 47 improvements. This will move on to COW Consent Agenda.

17. Fox Hill Unit 3—Additional Parking—This is being brought up because there
was not enough off street parking required by the city when this was being built, and
when the Overnight Parking Ban is finalized, the people who live here will not have
enough places to park. The plowing and maintenance for these parking spots will be
provided by the Homeowners Association. Alderman Besco was concerned about
using public funds for private parking. He is proposing the city should share the cost
for these parking spots with the Homeowners Association. Wanda Ohare will talk to
Joyce Barrett, the president of the Homeowners Association. John Wyeth will be
contacted to find out if these spaces can be created because some of the space is on the
public right of way,but the rest is on private property. The price estimate includes
tree removal,but not tree replacement. This will come back to the August Public
Works.
19. Well No. 6 Treatment Facility—Jeff Freeman passed out graphs about when the
current wells would possibly not be large enough to meet the needs of the city. Also a
graph that shows the timetable expected to get the work completed. Jeff Freeman
reminded the committee that well 6 was talked about in 1999, and was possibly going
to go through the loan program,but because of complications it was tabled. It was
also in the contract in 2003. Jeff Freeman proposes that there be an amendment to the
contract to include the proposed work schedules and the updated fees. The total cost
including engineering would be $3,729,500. The treatment facility would be similar
to well 7's. There will be additional shallow wells that would go through well 6 for
treatment after going through the shallow well Iron treatments. The flow rate of well 6
could be modified to accommodate 1,500 gallons per minute to treat the deep well and
the future shallow wells. The estimated cost of the project would cover transportation
to the site. The Kendall County Loan program has around $2 million dollars available
for this project or for a water main project. There was Bond money set up that can be
used. Connection fees would repay the funds spent on this project. Tony Graff will
have staff talk to developers to see if they would be willing to fund some of this.
Bristol Bay and Bailey Meadows already have annexation agreements, but the Pulte
development, Ocean Atlantic, and some others do not. Would they be willing to pay
half of the connection fees up front? This will move on to COW subject to funding.

10. Route 47 Widening—Jefferson Street Update—Rt. 47 is going to be 5 lanes
with a 6 ft carriage walk on the side. The county is concerned with adequate parking
for the county buildings so they are not willing to vacate Jefferson Street. There will
be low retaining walls going up the side of the hill, and instead of a green slope,
landscaping could be placed in between the walls. The county established an Ad-Hoc
committee and liked the idea of the slope being landscaped. Mayor Prochaska would
like to see that the county has a plan to use their parcels of land in this area. If they are
not willing to vacate Jefferson street so they are able to have additional parking, what
are they going to do with the other parcels of land they have in the area? Also the jail
is becoming a safety hazard. There are bricks falling off the building. Maybe this
could be a 2 phase project. Tony Graff will talk to the county to see what their plans
are. This will come back to committee in August.

Alderman Besco talked to Senator Petka and said the highway appropriation was
approved and Rt. 47 was included on it.
Mayor Prochaska had a letter for Eric Dhuse and his Department from Chief Martin
commending the department for their excellent work.
3. Greenbriar Subdivision Unit 4—Final Acceptance—This is the development where
the contractor has only as built notes, and no record data from the engineer. The punch
list is complete. This will move on to COW Consent Agenda.
4. 500 MG Water Tower Painting—Change Order#2 - The first item in the change
order is for the installation of a flap gate at the tower on Tower Lane. The second item
is for partial removal of the cathodic protection system,which is no longer needed on
the tower that is being painted. The third item is for sealing the seams of the roof
rafters. This will move on to COW Consent Agenda.
5. 2005 Concrete Roadway Pavement Striping—Bid Results—Maintenance Coatings
has placed a bid of$11,042.71 which is lower than the engineer's estimate of$23,597.
$10,000 has been budgeted for this. This will move on to COW Consent Agenda for
awarding the contract.
6. Bruell Street Pump Station—Change Order#2—The amount of$38,562 reflects a
4% escalation cost increase due to the removal of buried construction debris and a cost
difference in a tank. The company from the original estimate is out of business, so
another vendor was contacted. This will move on to COW Consent Agenda.
7. Raintree Village Unit 5 —Letter of Credit Expiration—When this is renewed it will
have a letter of credit reduction. This will move on to COW Consent Agenda.
8. Supplemental MFT Resolution for General Maintenance—There has been an
increase in the cost of salt. Last year it was $35.30 per ton, this year it is $41.40 per
ton. This will move on to COW Consent Agenda.
9. Grande Reserve—Neighborhoods 6— 16 Earthwork—Letter of Credit Expiration
—This will move on to COW Consent Agenda.
11. Rob Roy Creek Interceptor Contract No. 1 —Change Order#4—This is a
$2,500 increase for connecting to the bunkhouse. This will move on to COW Consent
Agenda.
12. Updated Capital Improvement Program—This will come back to the August
Public Works Meeting.
13. Kylyn's Ridge Unit 1 —Letter of Credit Reduction#3—They have completed
work on the water main, storm sewer, paving, sidewalks, and have planted trees. The
reduction is in the amount of$164,508.27. The remaining letter of credit would be
$454,768.95. This will move on to COW Consent Agenda.

14. F.E. Wheaton—Letter of Credit Reduction #1—The letter of credit should have
been $671,000 not the $230,337 in the letter The reduction would only be a little less
than half. This will move on to COW Consent Agenda. Joe Wywrot is also proposing
a policy be made that would allow staff, the Chairman of the Public Works
Committee, or the City Administrator to be able to accept public improvements for
ownership and maintenance by the city and also to reduce the corresponding letters of
credit on behalf of the city council for smaller developments with the amount of
reduction not to exceed $500,000. John Wyeth will prepare a policy to come back to
the August Public Works meeting.
14. 2005 In Town Drainage Improvements—Change Order#6—This is a$0 time
extension due to delays caused by the city.. This will move on to COW.
15. 2005 In Town Drainage Improvements—Change Order#7—The alignment of
the storm sewer along Center Street on the West side of Rt. 47 had to be changed to
avoid conflict with various existing utilities. This will move on to COW Consent
Agenda.
20. F.E. Wheaton Expansion—Plat of Easement—The easement would be for a
water main loop. This will move on to COW Consent Agenda.
21. Game Farm/Somonauk Road Improvements—Plat of ROW Dedication—The
Federal Government is funding the improvements to Game Farm Road, and the city
has to dedicate a Right of Way to itself. There is also a plat for the school district to
dedicate a right of way. This will move on to COW Consent Agenda.
Old Business
1. Tree Canopy Protection Ordinance— Alderman Besco is bringing this forward to
try to save the existing trees in proposed developments. This will come back to the
August Public Works Committee.
Additional Business
Alderman Munns asked Eric Dhuse if there is an equipment and tool inventory. There is
for larger items, but not for the small hand tools. Alderman Besco and Alderman Munns
want to be sure the guys in the shop have the tools they need for their job. Eric Dhuse
assured Alderman Munns that no one is walking away with any of the city's tools.

Subject: Jefferson Street Project
Attached find one copy of a proposal from Schoppe Design Associates, Inc. to perform
planning and preliminary design services related to the Jefferson Street area. The
proposal is for a fixed fee amount of$18,500.
This downtown area will undergo dramatic changes during IDOT's Route 47 widening
project. The retaining wall along Route 47 between Van Emmon Street and Fox Road
will be removed, and several buildings will be removed. IDOT has requested that the city
vacate Jefferson Street, which is located immediately east of the historic Kendall County
courthouse, to meet slope and drainage requirements. Upon considering their request, it
became apparent that vacating Jefferson Street would have a negative impact on the
downtown county campus. There were also safety considerations regarding traffic on
Jefferson, and the realization that we should try to create an aesthetically pleasing view of
the historic courthouse from Route 47. We met with IDOT about this, and they indicated
a willingness to incorporate an alternate design for this area into their plans, but they did
not want to pay for the cost of design and construction beyond their original plans.
We met with Kendall County, IDOT, and Mike Schoppe on August 11th to discuss this
area, and the result is the attached proposal. We anticipate that the cost of this work will
be evenly split between the county and the city.
Please place this item on the Public Works Committee agenda of August 22, 2005 for
consideration.

Dear Tony and Jeff,
Thank you for the opportunity to submit this proposal for planning and design services for the Jefferson
Street project. We look forward to working with the City and the County to create an appropriate
image for this downtown project.
We understand that as part of the Rt.47 improvements, currently being designed by IDOT,the existing
retaining wall on the west side of Rt. 47 will be removed. With the wall removed the City and the
County would like to explore design options for the area between Route 47 and Jefferson Street
between Van Emmon Street and Yorkville Bristol Fire Protection District building.
To that end, I have attached a copy of our proposal for planning and design services for your review.
Our methodology will include gathering of the necessary base information from the City and DOT,
becoming familiar with the physical characteristics of the site and planned downtown improvements,
and then preparing 2 or 3 alternative designs for the site. These preliminary designs, along with their
corresponding estimates of probable construction cost, will be reviewed with both the City and the
County and then submitted for approval.
Following the approval of the preliminary design we will prepare construction documents and
specifications for the proposed improvements and coordinate these with IDOT for the bidding and
construction of the improvements

PART TWO—BASIC SERVICES
Program Phase:
SDA will conduct a kick-off meeting with UCOY and KC staff to identify:
a. Goals and objectives
b. Schedule and milestones
c. Participants
d. Design Program
e. Budge parameters
f. Other administrative matters
g. Role of consultant and UCOY AND KC staff
Research and Analysis:
Using information gathered during the Program Phase, SDA will:
1. Review boundary survey or plats as provided by IDOT and prepare necessary base sheets. •
2. Visit and photograph the site and surrounding areas to become acquainted with:
a. Existing views
b. Apparent physical conditions
c. Downtown redevelopment plans
d. Kendall County's master facility plan
Preliminary Design Phase:
Using the information gathered during the Program and Research and Analysis Phase, SDA will:
1. Prepare a minimum of three(3)preliminary designs illustrating the scale,type and organization of the
proposed site and landscape improvements. Items to be addressed in the schematic plans include:
a. Different alternatives for treatment of slopes
b. Pedestrian access from Jefferson St.to Route 47
c. Retaining walls (if necessary)
d. Proposed grading and drainage
e. Proposed plantings
2. Prepare a preliminary construction cost opinion of our schematic designs using our generic systems
costs and an appropriate design and construction contingency.
3. Review designs and cost information with City and County staff and then one (1)meeting with the
UCOY City Council and Kendall County Board.
4. Prepare necessary revisions to preliminary plans and review with UCOY and KC.
5. Document our design proposals and prepare plan view renderings for public presentation.
Additional Services:
We may provide additional services that are not included in the Basic Services, such as, but not limited to:
1. Revisions to previously completed and approved phases of our services.

2. Meetings with you or presentation to other parties not specified in the Basic Services.
3. Detailed quantity estimates and/or construction cost opinions using data or format other than our own.
4. Detailed written summaries of our work or our recommendation.
5. Services required due to the discovery of concealed conditions, actions, of theirs, or other
circumstances beyond our control.
6. Modifications or revisions beyond those specified in the Basic Services.
If circumstances arise during our performance of the Basic Services,which we believe requires additional services,
we will promptly notify you about the nature,extent and probable additional cost of the additional services and
perform only such additional services following your written authorizations.
PART THREE—COMPENSATION AND PAYMENT
Basic Services:
UCOY and KC agree to compensate SDA for the services described in Part two of this Agreement based on a fixed
fee as described below
Program Phase thru Preliminary Design Phase Fixed Fee - $18,500
Additional Services:
UCOY and KC agree to compensate SDA for additional services as described in this agreement at our standard
rates.
Expenses:
In addition to fees for Basic Services, SDA will be compensated for the following customary out of pocket
expenses:
Outside Printing and Courier Services Cost plus 15%
In House Plotting Services . $1.00/s.f.
Standard Rates:
Project Principal $ 135.00 per hour
Project Management . $ 110.00 per hour
Construction Phase Services . $ 90.00 per hour
Project Design $ 95.00 per hour
Drafting .$ 65.00 per hour
Administrative Support $ 60.00 per hour
These rates are effective thru April 30,2006, after which SDA will provide an updated rate schedule.
Payment:
Invoices:
Each month, or as otherwise appropriate, we will provide invoices that describe the invoice period,the services
rendered, fees and expenses due. Invoices for fees based on a percentage of the construction budget will describe
the percentage of services completed. Invoices for hourly fees will describe the tasks, hours, and hourly rates for the
services completed. Payments will be due 30 days from date of invoice. We reserve the right to suspend our
services if you have unpaid invoices over 60 days old.

PART FOUR—ADDITIONAL CONDITIONS
Credit
UCOY and KC agree to give SDA proper credit for our professional services in your official communications,
published articles, and temporary project identification signage.
Client Responsibilities:
UCOY and KC agree to be responsible for the following:
Providing base information to SDA in AutoCAD format for:
a. Property lines and limits of I.D.O.T. ownership
b. Utility easements
c. Location of existing utilities
Cost and Quantity Opinion
SDA has no control over the cost of labor, materials and equipment or the services of others. We provide quantity
summaries and construction cost opinion based on our professional judgment, familiarity with the construction
industry, and recent, comparable bidding results.
We estimate certain quantities and/or costs for your convenience. The Contractor is responsible for determining
actual quantities and providing sufficient labor, services, equipment and materials to complete the work as drawn
and specified.
PART FIVE—ACCEPTANCE
Please indicate your acceptance of this Agreement by signing and returning both originals to us. A countersigned
agreement will be returned to you.
This proposal may be modified or withdrawn unless executed within 30 days.

Subject: Curb Cost for In-Town Road Program
There have been some questions asked by residents as to why curb and gutter was not included
as part of the In Town Road Program. My recollection is that the general consensus of the City
Council was to replace as much road and infrastructure as money would allow. It was decided to
omit curb from the project not only because of the linear foot cost, but the engineering and
construction costs associated with the extra vertical curves and storm sewer placement. I have
put together an estimate of cost ONLY for the linear foot cost of curb for this project.
Approximate lineal footage of road (phase one only) 7,900
Curb on both sides of the street= 15,800
Cost per linear foot $ 20.00
Estimated cost for placement of curb only $316,000
Note: This cost is only for the curb itself This does not include any estimate of cost for the extra
engineering, roadway construction, parkway restoration or additional storm sewer.

Subject: Southwest Stamiwater Study-EEI Proposal
Attached find one copy of a proposal from EEI to conduct a stormwater study for the area
tributary to Fox Road and downstream to the Fox River, roughly from Eldamain Road to
Route 47, excluding the old area of town. The proposal is for an estimated amount of
$33,800.
This general area (most notably the unincorporated Fox Lawn subdivision) has had
flooding problems in the past. Due to the extent of development now proposed, I believe
that we should perform this study to better understand the existing conditions, the impact
of development on neighboring properties, and also to make recommendations that would
be incorporated into the design of the new developments.
Please place this item on the Public Works Committee agenda of August 22, 2005 for
discussion.

Dear Tony-
In accordance with your request, please find attached an agreement for consulting engineering
services to conduct a regional drainage study for the Fox Road Area. The study will examine the
existing drainage conditions and analyze proposed condition alternatives. Development of the area
and overall stormwater management options for the new developments will be evaluated to ensure that
the area will maintain existing drainage conveyance in its current state at a minimum and improve
drainage conveyance and storage where possible. We look forward to working with the City to conduct
this study and recommend stormwater management guidelines for development in the Fox Road Area.
We propose to provide our services to the City on an hourly basis. We estimate our total fees for the
proposed study period to be approximately $33,800.

AGREEMENT FOR CONSULTING ENGINEERING SERVICES FOR
THE FOX ROAD AREA DRAINAGE STUDY
UNITED CITY OF YORKVILLE, KENDALL COUNTY, ILLINOIS
This Agreement, made this day of , 20_ by and between the United City of
Yorkville, Kendall County, Illinois, a municipal corporation of the State of Illinois (hereinafter referred to
as the "CITY") and Engineering Enterprises, Inc. of 52 Wheeler Road, Sugar Grove, Illinois, 60554
(hereinafter referred to as the "ENGINEER").
In consideration of the mutual covenants and agreements contained in this Agreement, the CITY and
the ENGINEER agree, covenant and bind themselves as follows:
1. Services: The ENGINEER agrees to perform for the CITY the necessary engineering services
to complete the Fox Road Area Drainage Study (see Exhibit A for Study Area) in accordance
with the Work Items outlined in the attached Exhibit B.
2. Direction: The Mayor, or his written designee, shall act as the CITY'S representative with
respect to the Services to be provided by the ENGINEER under this Agreement and shall
transmit instructions and receive information with respect to the Consulting Engineering
Services.
3. Compensation: The CITY agrees to pay the ENGINEER for providing the Services set forth
herein as specified on the ENGINEER'S approved Standard Schedule of Charges and the
Personnel, Positions and Classifications for the various classifications of employees performing
the work on the project. Total compensation for this Agreement shall be at an Hourly Rate.
Based on the information currently known about the project, the ENGINEER estimates his fees
to be approximately $33,800. The ENGINEER'S attached 2005 Standard Schedule of Charges
shall be used as the basis of this contract. If, in the future, the CITY approves a revised
Standard Schedule of Charges, then work conducted on or beyond the effective date of the new
Standard Schedule of Charges shall be billed on the basis of the then effective Standard
Schedule of Charges.
4. Term: The ENGINEER will deliver a Draft Report within 90 days of the execution of this
Agreement. Following completion of review by the City and other interested parties the
ENGINEER will deliver a Final Report within 30 days. The term of this Agreement shall be
active through March 31, 2006, unless otherwise extended through written confirmation by both
parties.
5. Payment: Engineer shall invoice the CITY on a monthly basis for Services performed and any
costs and expenses incurred during the previous thirty (30) day period. The CITY shall pay the
ENGINEER within thirty (30) days of receipt of said invoice.
6. Termination: This Agreement may be terminated upon fourteen (14) days written notice of
either party. In the event of termination, the ENGINEER shall prepare a final invoice and be due
compensation calculated as described in paragraph 3 for all costs incurred through the date of
termination.

7. Documents: All related writings, notes, documents, information, files, etc., created, compiled,
prepared and/or obtained by the ENGINEER on behalf of the CITY for the Services provided
herein shall be used solely for the intended project.
8. Notices: All notices given pursuant to this Agreement shall be sent Certified Mail, postage
prepaid, to the parties at the following addresses:

9. Waiver: The failure of either party hereto, at any time, to insist upon performance or
observation of any term, covenant, agreement or condition contained herein shall not in any
manner be constructed as a waiver of any right to enforce any term, covenant, agreement or
condition hereto contained.
10. Amendment: No purported oral amendment, change or alteration hereto shall be allowed. Any
amendment hereto shall be in writing by the governing body of the CITY and signed by the
ENGINEER.
11. Succession: This Agreement shall ensure to the benefit of the parties hereto, their heirs,
successors and assigns.

Subject: Public Works Committee—Change of Meeting Date
With the recent change in COW agenda policy, items moving forward from the Public
Works Committee don't get to the Committee of the Whole until the third Tuesday of the
following month. The August PW committee meets on 8/22, but items moved forward
won't get to COW until 9/20, which is over 4 weeks. This can be quite a problem for
time-sensitive items such as change orders, contract awards, etc.
I recommend that the Public Works Committee meeting date be shifted to either the first
of second Monday of the month. Other meetings on the first Monday are the Senior
Facility ad-hoc committee at 4pm and the Fire &Police Commission at 6pm. Other
meetings on the second Monday are the Park Board and the Library Board, both at 7pm.
The current meeting on the fourth Monday conflict with the Park Board at 7pm.
Please place this item on the Public Works Committee,agenda of August 22, 2005 for

Agreement dated January 22, 2001 and known as Castle Bank Trust Number 2029
(hereinafter referred to as "Owner/Developer"), is the owner of the real property upon
which is now situated an improved structure (hereinafter referred to as "Property")
described in the Exhibit "A", attached hereto and incorporated herein by reference; and
WHEREAS, said Property, located at 604 W. Veterans Parkway, Yorkville, in the
United City of Yorkville, Kendall County, Illinois, and is currently zoned B-2 General
Business District; and
WHEREAS, the United City of Yorkville has heretofore issued a building permit
and site development approval for the construction of a commercial building and
restaurant on said Property and, incidental thereto, requiring the installation of sidewalks
along the northern frontage of the Property adjacent to U.S. Route 34; and
WHEREAS the United City of Yorkville expressed a desire for the installation of
a sidewalk around the detention pond directly east of said Property, and the undersigned,
as the owner, have requested of the United City of Yorkville that they be pemaitted to
delay or defer the installation of the sidewalks adjacent to U.S. Route 34 until such time
as the City or other entity installs along said detention pond; and

with the provisions of this Covenant.

Subject: State Street Finished Watermain—IDOT Highway Permit& Resolution
Attached find one copy of the IDOT highway permit application for the referenced
project. The project includes watermain construction across the IDOT Route 47 right-of-
way between Elizabeth Street and Colonial Parkway. The crossing allows us to abandon
several watermains in the IDOT right-of-way that date from the 1930's to the 1970's.
Abandoning these watermains also helps prepare us for IDOT's Route 47 widening
project. Related to the permit is the standard resolution form that IDOT routinely asks us
to pass. The resolution guarantees that the work will be completed satisfactorily.
I recommend that the City Council authorize the Mayor and City Clerk to sign the permit
application, and also pass the accompanying resolution. Please place this item on the
Public Works Committee agenda of August 22, 2005 for consideration.
RESOLUTION
WHEREAS, the City of Yorkville located in the county of Kendall, state of Illinois, wishes to watermain
improvements which by law comes under the jurisdiction and control of the Department of Transportation of the
state of Illinois, and
WHEREAS, a permit from said Department is required before said work can be legally undertaken by said City of
Yorkville; now
THEREFORE, be it resolved by the City of Yorkville, county of Kendall, state of Illinois.
FIRST: That we do hereby request from the Department of Transportation, state of Illinois, a permit authorizing
the City of Yorkville to proceed with the work herein described and as shown on enclosed detailed plans.
SECOND: Upon completion of the proposed watermain improvements by the contractor and acceptance by the
city, the city guarantees that all work has been performed in accordance with the conditions of the permit to be
granted by the Department of Transportation of the state of Illinois.
Further, the city will hold the state of Illinois harmless for any damages that may occur to persons or property
during such work.
The city will require the contractor to obtain a bond and a comprehensive general liability insurance policy in
acceptable amounts and will require the developer to add the State of Illinois as an additional insured on both
policies.

First: The Applicant represents all parties in interest and shall furnish material, do all work, pay all costs, and
shall in a reasonable length of time restore the damaged portions of the highway to a condition similar or equal to
that existing before the commencement of the described work, including any seeding or sodding necessary.
Second: The proposed work shall be located and constructed to the satisfaction of the District Engineer or his
duly authorized representative. No revisions or additions shall be made to the proposed work on the right-of-way
without the written permission of the District Engineer.
Third: The Applicant shall at all times conduct the work in such a manner as to minimize hazards to vehicular
and pedestrian traffic. Traffic controls and work site protection shall be in accordance with the applicable
requirements of Chapter 6 (Traffic Controls for Highway Construction and Maintenance Operations) of the Illinois
Manual on Uniform Traffic Control Devices for Streets and Highways and with the traffic control plan if one is
required elsewhere in the permit. All signs, barricades, flaggers, etc., required for traffic control shall be
furnished by the Applicant. The work may be done on any day except Sunday, New Year's Day, Memorial Day,
Independence Day, Labor Day, Thanksgiving Day and Christmas Day. Work shall be done only during daylight
hours.
Fourth: The work performed by the Applicant is for the bona fide purpose expressed and not for the purpose of,
nor will it result in, the parking or servicing of vehicles on the highway right-of-way. Signs located on or over
hanging the right-of-way shall be prohibited.
Fifth: The Applicant, his successors or assigns, agrees to hold harmless the State of Illinois and its duly
appointed agents and employees against any action for personal injury or property damage sustained by reason
of the exercise of this permit.
Sixth: The Applicant shall not trim, cut or in any way disturb any trees or shrubbery along the highway without
. the approval of the District Engineer or his duly authorized representative.
Seventh: The State reserves the right to make such changes, additions, repairs and relocation's within its
statutory limits to the facilities constructed under this permit or their appurtenances on the right-of-way as may at
any time be considered necessary to permit the relocation, reconstruction, widening or maintaining of the
highway and/or provide proper protection to life and property on or adjacent to the State right-of-way. However,
in the event this permit is granted to construct, locate, operate and maintain utility facilities on the State right-of-
way, the Applicant, upon written request by the District Engineer, shall perform such alterations or change of
location of the facilities, without expense to the State, and should the Applicant fail to make satisfactory
arrangements to comply with this request within a reasonable time, the State reserves the right to make such
alterations or change of location or remove the work, and the Applicant agrees to pay for the cost incurred.
Eighth: This permit is effective only insofar as the Department has jurisdiction and does not presume to release
the Applicant from compliance with the provisions of any existing statutes or local regulations relating to the
construction of such work.
Ninth: The Construction of access driveways is subject to the regulations listed in the "Policy on Permits for
Access Driveways to State Highways." If, in the future, the land use of property served by an access driveway
described and constructed in accordance with this permit changes so as to require a higher driveway type as
defined in that policy, the owner shall apply for a new permit and bear the costs for such revisions as may be
required to conform to the regulations listed in the policy. Utility installations shall be subject to the "Policy on the
Accommodation of Utilities on Right-of-Way of the Illinois State Highway System."
Tenth: The Applicant affirms that the property lines shown on the attached sheet(s) are true and correct and
binds and obligates himself to perform the operation in accordance with the description and attached sketch and
to abide by the policy regulations.

SPECIAL PROVISIONS
All turf areas which are disturbed during the course of this work shall be restored to the original line and grade
and be promptly seeded in accordance with Standard State Specifications.
Whenever any of the work under this permit involves any obstruction or hazard to the free flow of traffic in the
normal traffic lanes, plans for the proposed method of traffic control must be submitted to and approved by the
District Engineer at least 72 hours, and preferably longer, before the start of work.
All traffic control shall be in accordance with the State of Illinois Manual of Uniform Traffic Control Devices and
amendments thereof. It should be noted that standards and typical placement of devices shown in the Uniform
Manual are minimums. Many locations may require additional or supplemental devices.
The petitioner agrees to furnish the necessary barricades, lights, and flagmen for the protection of traffic.
Traffic shall be maintained at all times.
The applicant agrees to notify the Department of Transportation upon completion of work covered under the
terms and conditions of this permit so that a final inspection and acceptance can be made.
To avoid any revisions to the work completed under the highway permit, the applicant should insure the
conditions and restrictions of this permit, the applicable supplemental permit specifications and permit drawing
are fully understood.
If this permit work is contracted out, it will be the responsibility of the applicant to furnish the contractor with a
copy of this highway permit, as the applicant will be responsible for the contractor's work.
A copy of approved permit shall be present on job site at all times the work is in progress.
The Department reserves the right to reject or accept any contractor hired by the applicant.
No person, firm, corporation or institution, public or private, shall discharge or empty any type of sewage,
including the effluent from septic tanks or other sewage treatment devices, or any other domestic, commercial or
industrial waste, or any putrescible liquids, or cause the same to be discharged or emptied in any manner into
open ditches along any public street or highway, or into any drain or drainage structure installed solely for street
or highway drainage purposes.
The excavation under the pavement shall be replaced with controlled low strength material, and the pavement
replaced in accordance with pavement replacement details. All excess material shall be removed from the
highway right-of-way.
All excavations shall be promptly backfilled, thoroughly tamped and any excess material removed from the State
right-of-way (including rock exposed during backfilling operations). Mounding or crowning of backfill will not be
permitted.
The diameter of any bored hole shall not be more than one (1) inch larger than the outside diameter of the pipe.
Boring of pipe over six (6) inches in diameter shall be accomplished with an auger and following pipe. Borings
six (6) inches and under may be accomplished by either jacking or auger and following pipe method.
Excavation adjacent to the edge of pavement shall be shored to prevent caving if the distance is less than ten
(10) feet plus the depth of excavation from the edge of pavement.
No open ditch or trench severing the roots of trees or shrubs shall be dug any closer than three (3) feet, or two-
thirds (2/3) the distance from the central stem to the dropline of the tree, whichever distance is the greater. All
installations within this root zone area shall be made by augering at a depth of not less than thirty (30) inches.
It is the applicant's responsibility for insuring that all requirements of the Illinois Environmental Protection Agency,
Division of Water Pollution Control and Public Water Supplies have been satisfied.

Subject: Emergency Vehicle Pre-Emption Equipment
We have begun requiring Opticom emergency vehicle pre-emption equipment at new
traffic signals. This equipment allows an emergency vehicle approaching a signalized
intersection to stop traffic on all approaches to the intersection except the approach where
the emergency vehicle is located. The average cost of installing pre-emption equipment is
about $10,000 per intersection, and does not include the cost of the emitters that are
mounted on the vehicles.
We have also infoimed IDOT of our desire to have the new and/or replacement traffic
signals they build to incorporate Opticom into the design. IDOT has informed us that
they are willing to do this, but they will not fund the construction or design of the
equipment. The Route 47 project includes replacement or modifications to 14 traffic
signals, extending along Route 47 from Route 71 to Cannonball Trail, and extending
along Route 34 from Cannonball Trail to McHugh Road.
At this time we are proposing that the city (or the developer in the case of a new signal)
fund the installation of this equipment. The city would assume maintenance responsibility
thereafter. Any fire department or police department vehicle that has an emitter would be
able to activate the pre-emption equipment. Opticom would be added over a period of
several years as new signals are constructed or existing signals replaced.

Subject: Menards Commercial Commons—Final Acceptance of Landscaping
Attached find a letter from Menards requesting final acceptance of the landscape
improvements for the referenced project. All punchlist items have been completed with
the exception of the items listed below. Completion of this work will be completed this
fall. Our Parks Department has already taken over maintenance of the landscape medians
along Countryside Parkway.
I recommend that the landscaping of public areas for the referenced project be accepted
by the City Council for ownership and maintenance. The few remaining items would be
completed during the one-year warranty period. As a result of acceptance, the letter of
credit would be released upon receipt of a warranty letter of credit in the amount of

CREATING A POLICY
PROCEEDURE AND AUTHORITY TO REDUCE LETTERS OF CREDIT AND
BONDS FOR CONSTRUCITON OF PUBLIC IMPROVEMENTS
WHEREAS, the United City of Yorkville requires that developers and/or contractors
provide security for the successful completion of the installation of certain public
improvements including but not limited to streets, curbs, sidewalks, water pipes, sewer
pipes (storm and sanitary), streetlights, etc., and
WHEREAS, said security is established either by means of a Letter of Credit, or a Bond,
and
WHEREAS, from time to time, the developer and/or contractor will seek reduction of the
Letter of Credit or Bond after the successful completion of a portion, but not all, of the
public improvements under heretofore established practices and/or contracts, and
WHEREAS, current practice involves an approval of the City Engineer's
recommendation by the City Council which while thorough, requires long time lines for
approvals that are in most instances a routine, and
WHEREAS, the Mayor and City Council wish to provide an expedited review and
approval process for certain smaller Letter of Credit and/or Bond reduction requests.
BE IT HEREBY RESOLVED BY THE MAYOR AND ALDERMAN OF THE
UNITED CITY OF YORKVILLE:
1. Letters of Credit and/or Bonds in an initial amount of$500,000 or less shall be
eligible for approval under this policy, however, if deemed appropriate by any of the
persons involved in this process (i.e. the City Engineer, City Administrator, Mayor or
Public Works Committee), any request for reduction may be sent to City Council for
review and approval consistent with the procedures established for Letter of Credit and/or
Bond reduction requests for amounts in excess of$500,000.
2. The approval process for eligible Letter of Credit and or Bond reductions shall be as
follows:
a. The City Engineer shall issue a written recommendation including his basis
for approving or denying a request for reduction. Said written recommendation shall
include the amount of the requested reduction and the amount remaining in the Letter of
Credit and/or bond if the request is approved.
b. The City Engineer's written recommendation shall be delivered to the City
Administrator with copy to the Mayor and Public Works Committee to be placed on the
next available Public Works Committee agenda.
c. Either the City Administrator or the Mayor may concur, and advise the
Public Works Committee of their concurrence, or either may direct that the request must
go forward to the City Council.
d. If either the City Administrator or the Mayor concurs with the City
Engineer's recommendation, and if neither the City Administrator, the Mayor or the City
Engineer has directed that the request should go forward to the City Council, then, at the
next available Public Works Committee meeting, if those members of the Committee in
Attendance (a quorum not being required), have no objection to the recommendation of
the City Engineer and concurrence by either the City Administrator or the Mayor, then
the reduction shall be deemed approved and the City Engineer shall be authorized to issue
a letter to implement the reduction.
f. The Mayor and the City Council hereby expressly delegate authority for
approval to the parties listed herein sufficient to implement the approvals authorized by
this Policy.
NOW THEREFORE, upon Motion duly made, seconded and approved by the
majority of those members of the City Council voting, BE IT RESOLVED that the
Policy set forth above is the Policy of the United City of Yorkville.
