Additional Business Page 1 of 3 DRAFT PUBLIC SAFETY COMMITTEE YORKVILLE CITY HALL CONFERENCE ROOM Thursday, September 8,2005 Committee Chairman Wanda Ohare called the meeting to order at 6:30 p.m. Present Alderwoman Wanda Ohare, Alderman Dean Wolfer and Police Chief Harold Martin. 1.Minutes for ApprovaUCorrection--Minutes from the July 14 and August 11, 2005 meetings were approved. 2. Police Reports for August 2005—Ohare said she was pleased to see the number of thanks you notes the department received. Wolfer thanked Police Chief Harold Martin for all of the help the department gave to the River's Edge block party. The committee agreed to forward the report to the Oct. 4 Committee of the Whole meeting. 3. Trick-or-Treat Hours—Trick or treat hours are set for 4 to 7 p.m. on Halloween. 4. Engineering's Used Plotter—Chief Martin said the police department would like the city engineer's used plotter to help with accident reconstructions. Also, the plotter could be used in crime scene investigations, he said. He's not sure what the cost would be. Martin said he's hoping the engineering department could donate it to the police department. Ohare suggested the chief follow through on trying to obtain the used plotter and said she encourages the donation of the plotter since the city already paid for it. 5. Grand Reserve Weather Warning Siren—Chief Martin said the developers agreed to put in the warning siren and now that residents have moved into the development,he said it should be installed. He said he would inform the committee when the siren is operating. 6. Budget Request to Assist with Funding for Probation Officer's Salary—Chief Martin said he had budgeted $5,000 in the 2004/2005 budget for Functional Family Therapy, which was a federally funded program. The grant helped kids once they got to the probationary system, he said. However, the grant dissolved. Chief Martin said he intends to put $1,824 in the 2006/2007 budget. The money would go to the county's juvenile probation department to help hire an additional officer so a similar program could be offered. Since the city's juvenile referrals continue to increase, Martin said it would be money well spent. 7. NIMS Compliance—Chief Martin said he'd like everyone on the list provided in the committee's packets to take the online test to be NIMS compliant. There's no cost to the city and the test takes about 1 to 1.5 hours. Ohare said the request could go forward to the COW. 2qf " ::. 8. Business Registration—Chief Martin said the police department would like to implement a business registration program. The program would include a one-time registration fee of$25; businesses would need to keep their information updated; and businesses would have 15 days to inform police of an address change or a fine would be imposed. Ohare said she likes the idea of such a program. She wondered if a provision could be added to fine businesses that don't register. She also asked how the city could encourage people to register. Reviewing the proposed registration form, Ohare said it should ask for more identification regarding the type of business and there should be a way for businesses to update the form annually. She suggested those and a few other changes be made and brought back to the committee for review at the Oct. 13 meeting. 9. Liquor License Application—Ohare suggested the city require applicants to provide a driver's license or state identification card at the time they apply. Chief Martin said the city already requires a photo ID of applicants, which is usually either a driver's license or ID card. Ohare said she'd like the driver's license added as a requirement. Looking over the application, Ohare said that with the city growing so fast, she just wants to make sure that the application is right so that the city is doing the best it can. She asked the chief to make any necessary changes and to have city attorney John Wyeth review it before bringing it back to the committee in October. 10. False Alarm Ordinance Update—Chief Martin said he hasn't heard any negative feedback about the ordinance. He said the department is keeping track of all of the false alarms. When officers respond to the alarms, they give the person a copy of the city's ordinance and a warning. When a fine does have to be issued, Chief Martin said the city attorney would write a letter informing the person that a fine would be issued. Ohare suggested the city attorney create a form letter to have in place so that fines could be imposed immediately when necessary. Chief Martin said once the letter is drafted, he would bring it to the committee for review. 11. Parking Ordinance Update—Chief Martin said some of the initial issues have been addressed. He and the city's code official Bill Dettuier have since started talks about commercial vehicle parking on residential streets. The main issue is determining how to classify commercial vehicles. He proposes that any vehicle with a B license plate should be classified as a commercial vehicle. Dettmer said any vehicle with lettering should be classified as commercial Ohare said the city isn't trying to inconvenience anyone by restricting parking. The city is trying to make streets safer. Page 3 of 3 Chief Martin said he'd get a definite definition on a commercial vehicle and have a draft ordinance for the committee at the October meeting. 12. Additional Business—Ohare said the city is working on covering the air conditioning units and generator units at city hall and would like a follow up when the work is completed. She also asked if the railroad crossing signs that were in disrepair were replaced. Chief Martin said the person at the railroad company is working on it. She was able to find the suspect vehicle even the vehicle left the scene and then worked with me on making sure the appropriate citation was issued that would be upheld in court. The offender almost hit our foster child on August 26 at the Raintree Village Clubhouse. The offender decided to come back to Raintree Village and drive eratically up and down the streets of subdivision. This took place last night around 6: 15 if you need to look her badge number up. We and our neighbor are hoping this individual will not be returning to our subdivision with the same driving habits . Also, can we intersections warranted for stop signs now, or do we have to wait for the development to be completed. Specifically we want a three-way placed at Raintree and Parkside. I believe we would pass the warrant study since there is a lot of traffic at this intersection and it is right at the clubhouse and walking path where you have residents crossing the intersection on a regular basis. Plus it should slow down the construction vehicles that tend to drive to fast for conditions, also. Officer Calvert arrested an individual that my office and the Department of State-Diplomatic Security Service had been attempting to arrest for several years. Mr. Pasiecznik had served several years in federal prison on a cocaine conspiracy conviction and bonded out of our custody. Mr. Pasiecznik failed to appear for deportation and a warrant was issued for his arrest. During my part of the fugitive investigation, I discovered that he was using the name Arthur Hallen (among others) and had fraudulently obtained a U.S. passport. Mr. Hallen is currently awaiting trial in the Northern District of Illinois for crimes relating to his fraudulently obtaining a U.S. passport. Upon release from federal prison he will be deported to Poland. Swanson Chief of Police City of Countryside Introduction and Background After the tragic incident of 9-11-01, it became clear that our nation was facing changing times. It was also clear that our Illinois communities lacked some of the resources other states and nations have to respond to terrorism events. One of these resources was a law enforcement helicopter. More recently, on Aug 28 2005, officers from LaGrange and Countryside took gunfire from a bank robbery suspect, luckily only damaging vehicles while attempting to stop the suspect. This high-speed chase along with the suspect firing at the pursing squads, and officers blocking the intersections, could have resulted in death or injury to officers and the public. An air unit could have helped by allowing officers to back off, and trail at a safe distance. This most recent example is one of many incidents that occur daily. Hurricane Katrina is another example of why helicopters are an asset. Helicopters are one of the only ways to make rescues and insert personnel and supplies. Our geographic areas are not prone to hurricanes, but could be victims of tornados, floods or terrorism in need of these supplies and services. Law Enforcement has no resources for a law enforcement helicopter for use statewide in Illinois. The Illinois State Police had dropped the rotor wing program in the year of 2000. No other cities or communities in Illinois owed or operated a police/ rescue helicopter. In December 2004, Chief Swanson conducted a survey of chiefs of police utilizing the Illinois Chiefs of Police email service. This was a general survey asking if they had used helicopter services in the past (State Police) and over the last year could they have used a helicopter for law enforcement issues. 99.9 percent of the responding agencies responded that they did need this type of service. Most agencies agreed that the costs to operate a unit on their own were prohibitive. The responding agencies also agreed that they would be interested in using a service that would be modeled after a volunteer unit. A decision was made to move forward and look for support from the Illinois Chiefs of Police. The IACP supported the concept and idea, as well as various other local associations. Chief Swanson attended a meeting of the ILEAS group upon Chief Chudwin's request. At this meeting, Chief Swanson was going to ask for support from ILEAS in establishing nit a mutual aid response ufor air operations. In attendance and speaking was Ben Barrick from Helistar IL. Inc. He made a presentation on a similar program they had established in southern Illinois. During this meeting Swanson agreed to meet with Ben Barrick on expanding this concept on a statewide service. A few weeks later, Chief Swanson advised Ben Barrick that it was not in the best interest for Law Enforcement executives from this state to utilize his corporation for this statewide purpose. Chief Swanson reported to ILEAS President Gary Stryker and the board of officers on the status of Ben Barrick, and some history. Chief Swanson asked for support on the same concept utilizing a non-profit. ILEAS supported the concept of a mutual aid helicopter unit, and advised they would assist in any way to help promote this idea. Chief Swanson started IRASS, a new Not for Profit corporation called the Illinois Regional Air Support Service. The Purpose as outlined in the corporation by-laws states "The Corporation is incorporated under the laws of the State of Illinois specifically to provide aviation air support to law enforcement and rescue services". This corporation also allows for soliciting funding from the private sector to operate a law enforcement helicopter. Most law enforcement agencies in Illinois cannot afford to operate a helicopter unit. Chief Swanson made application to obtain a helicopter from the Department of Defense LESO 1033 program, this program is for counter-drug and anti-terrorism missions. The City of Countryside obtained an OH-58 helicopter on June 1 2005. 91"- � . r The City of Countryside has agreed to help in establishing a mutual aid helicopter program for this use. This program will be operated utilizing the not for profit corporation for funding, staffing. Countryside has invested about $30,000.00 dollars in establishing, repairing and promoting this program. Program Benefits The IRASS program is designed to benefit the entire State of Illinois. With the present lack of available funding in police budgets, it is the only solution that makes economic sense. As a vital tool in helping make our communities safer, it will not only provide much needed support to the police, but it can also be a very valuable resource for the fire department, as well. The use of emergency service helicopters in Illinois is long overdue. Much like a police cruiser, bicycle or police boat, they are valuable resources that emergency services can call upon to help save lives. Helicopters provide advanced capabilities and technology that greatly enhance our emergency services. Specifically, helicopters can provide: • quick response to community emergencies • terrorism prevention programs • search and rescue capabilities in locating lost or missing persons, such as children, or wandering patients, as well as helping locate missing boats and aircraft • faster and more effective police response in apprehending criminals by providing the latest onboard computer technology and equipment, while ensuring public and officer safety is a priority • support for crime prevention initiatives by providing a proven and effective means of deterrent against criminal activity and enhancing overall community safety • an effective observation, communication and command platform for incident management and control, as well as unit deployment • enhanced officer safety and increased support for emergency service personnel while on patrol, conducting routine traffic stops or involved in high-risk investigations, such as illegal drug operations • traffic surveillance and patrol, reduce or eliminating high speed chases and providing the ability to monitor and re-direct traffic in the event of a large scale evacuation or disaster, such as a fire or train derailment • major incident support, including scene security and control, assistance with locating evidence and providing video taped evidence for court The initial startup of this program will be in the Metropolitan Chicago area that include ILEAS region 3 and 4. The population base alone drives the program to start in this region. We will be looking to partner with Fire Departments and other public safety agencies in this public safety venture. Aircraft acquisition A request was sent out advising other Law Enforcement agencies that addition Department of Defense (DOD) helicopters may be available shortly. The Illinois Regional Air Support Service will help fund and operate additional units in Central and Southern Illinois. Any agency that has the resources and wishes to partner in this project may apply for aircraft from the 1033 program. Who can participate the 1033 program? Any Federal or State law enforcement agency whose officers have arrest and apprehension authority can qualify to receive surplus DOD personal property under section 1033 of the National Defense Authorization Act of fiscal year 1996/1997. Aircraft Request Procedures Under Section 1033 of the National Defense Authorization Act for fiscal year 1997 (10 U.S.C.2576a) the Secretary of Defense may transfer to Federal and State agencies personal property of the Department of Defense, including aircraft, that the Secretary determines is suitable for use by the agencies in law enforcement activities. Agencies in law enforcement activities are defined as government agencies whose primary function is the enforcement of applicable Federal, State and Local laws and whose law enforcement officers have powers of arrest and apprehension. All requests for aircraft from State and local law enforcement agencies must be submitted through the appropriate governor appointed State coordinator for approval. A listing of State coordinators is available upon request from the Defense Logistics Agency's (DLA) Law Enforcement Support Office (LESO). The following procedures must be followed when submitting requests. On agency letterhead answer the following questions in narrative form. Please address each question in a separate paragraph. 1. Administrative Data: Name, Address, Phone and FAX numbers of the requesting agency. Full name of the chief executive official of the requesting agency. Any additional points of contact. 2. The type and quantities of aircraft requested. Must include the aircraft's intended use and the impact the resource will have within the requesting agency's jurisdiction as well as surrounding jurisdictions. 3. The size of the requesting agency's jurisdiction by population and area. 4. Written understanding of the terms and conditions applicable to aircraft transfers as detailed in the MOA between DLA and the governor appointed state coordinator. (Response must detail the specific terms of transfer.) 5. Written description of agency's plan to maintain, operate and finance the requested aircraft. 6. Written understanding of the FAA regulations governing the operation of the requested aircraft. (Response must detail the specific regulations.) The letter must be signed by the chief executive official of the requesting agency and then forwarded to the state coordinator for state review. If approved at the state level the request will be forwarded to the servicing LESO for action. A request approved at the state level is no guarantee that the requesting agency will receive an aircraft. Agencies approved to receive aircraft will be contacted by their respective state coordinators. Questions regarding this application should be directed to your State Coordinator, Curtis A. These units are similar to the Bell 206 civilian model. These units are not equipped for law enforcement use. Costs could be around 50,000.00 dollars. Funding The primary funding for the Illinois Regional Air Support service will come from donations from the communities we serve. This fall IRASS will be working with the Illinois Chiefs and ILEAS for legislative funding initiatives. This will be critical in establishing a well round statewide program. ISP Air Operations is based at Springfield Capital Airport. Aircraft available is as follows • 5 Cessna 182 fixed wing aircraft some equipped with FLIR, Night Sun, Radios • 1 Cessna 412 Twin engine fixed wing aircraft State police aircraft are available by notifying the State Police District in your area. They have a wide range of service from, surveillance, searches, video, and observation platform. Illinois Department Vr Illinois Department of Transportation IDOT of Transportation IDOT has a wide variety of aircraft; most are set up for transportation of State staff members, photography ship, ect. IDOT recently placed in service a Bell 206, with Microwave downlink, FLIR and Night Sun. This unit is based at Capital Airport and is available for Homeland Security missions. Winthrop Harbor— LEAC The Winthrop Harbor Police Department (WHPD) coordinates a Law Enforcement Aviation Coalition (LEAC), which provides a unique service to law enforcement agencies from throughout northern Illinois and southern Wisconsin. The twin-engine jet helicopter is a privately owned Eurocopter EC135, which is made available at no cost for law enforcement emergencies on a limited basis. Unit missions include airborne assistance with Class X felonies in progress, searches for fleeing or lost persons, searches for downed or missing aircraft, threats to Homeland Security, and other types of support to law enforcement agencies within the capabilities of the aircraft, equipment and crew. The WHPD dispatch center (847-872-2131) is the designated communications point for the Law Enforcement Aviation Coalition. The unit Commander has final authority to approve mission call-outs, and once approved the missions operate under the law enforcement authority of the agency requesting such aid. There is no cost to the requesting agency or to the Village of Winthrop Harbor for these missions. For further information, contact Chief Joel Brumlik at 847-746-3868, extension 700. Closing It is my suggestion that Law Enforcement and other public safety units purse consolidating forces to organize a public safety aircraft consortium. This would be a statewide project that would utilize both public and private funding. By utilizing a non- profit approach, funding ideas are unlimited. The goal should be to establish at a minimum three units based in North, Central and Southern Illinois. The aircraft should be capable to fly VFR day/night missions, performing basic homeland security missions of CBRNE, rescues using short haul line operations and be capable of firefighting support with bambi bucket operations. Operations of these units would fall under a Board of Operations for the established regions. These regions could be formed using the existing (LEAS region board members or designees. Illinois Regional Air Support Service is well underway; we are anticipating being airborne Nov 1 2005. By utilizing a non—profit volunteer approach funding can be directed at the equipment needed to protect our Homelands. Ron Diederich Reference: Emergency Weather Warning Siren Chief Last week I met with Frank Kehoe from Fulton Contracting regarding the weather warning siren to be placed at the Bruell Street lift station. This project was held up due to the fact that there wasn't electric to the site. The electric is now in place and Mr. Kehoe said the price has not changed since his original quote of March 2, 2004. That quote was/is $9,500.00 to install a P-51 Siren that is large enough to cover the area in question. There will be an additional cost in labor and material to wire the siren and that cost is $950.00. The total on the Bruell St. lift station siren is $10,450.00 and I have attached the quotes to this memo. Director Eric Dhuse was also invited to the meeting and we toured the site for location of the pole and power. All were in agreement as to the location of the siren on the lift station property. I also asked Mr. Kehoe about the status of the new weather siren in the Grand Reserve. Mr. Kehoe said that he has been in touch with MPI, the site is ready and Mr. Kehoe is awaiting a purchase order from MPI and expects it to arrive shortly. The drawings for the proposed additional siren coverage in the southeast corner of Yorkville, north of the railroad tracks, have been sent to you. This coverage is for a 125dB, rotating, American Signal P-15 siren with a 4500'/70dB-coverage perimeter. This is a motor driven, 3-phase siren to be installed at the lift station, as discussed and agreed upon by the committee in your office on February 24, 2004. It will be installed on a Class 11, 60' wooden pole along with a Fulton RTU Telemetry unit, which will communicate with the existing control system. The total cost for this siren, which includes all material and labor, will be Nine Thousand and Five Hundred Dollars and no cents ($9,500.00). There is a one-year warranty on all parts and installation for this refurbished siren. There is no provision in this quotation to supply power to the siren site. We would, however, like to review the accessibility of power for the site. We can then provide a cost to do this work. Authorizes the retail sale of wine and/or beer only, on the premises specified, for consumption on or adjacent to said premises at a picnic, carnival, or similar function. Such temporary licenses are to be granted to local organizations or groups promoting a common object rather than the sale of wine and/or beer. 5.2. Such license shall be authorized on a day to day basis, but for not more than seven (7) consecutive days. 5.3. The fee for such license shall be fifty dollars ($50.00) per day. 6.Class F - Beer And Wine Retail Sale: 6.1. The annual fee for a class G license shall be one thousand seven hundred dollars ($1,700.00). 8.Class H - Clubs: 8.1. Authorizes the retail sale of alcoholic liquor only on the premises where sold to be issued to a regularly organized "club", as heretofore defined, such sales to be made only to members of the club or their guests. 8.2. The club shall file with the local liquor and tobacco control commissioner at the time of its application for a license two (2) copies of a list of names and residences of its members, and similarly shall file within ten (10) days of the election of any additional member his name and address; and, provided further that the club affairs and management shall be conducted by a board of directors, executive committee, or similar body chosen by the members at their annual meeting and that no member or any officer, agent, or employee of the club shall be paid, or directly or indirectly receive, in the form of salary or other compensation, any profit from the distribution or sale of alcoholic liquor to the club or the members of the club or its guests introduced by members beyond the amount of such salary as may be fixed and voted at any annual meeting by the members or by its board of directors or other governing body out of the general revenue of the club. 8.3. The annual fee for a club license is three hundred dollars ($300.00). 9.Class I - Hotel Or Motel: 9.1. Service of alcoholic liquor shall be only during the time that full meals are being served and a full menu is in effect. 9.3. The license shall only be available for premises defined as a "hotel or motel" herein. 9.4. All such liquor service shall be from a service bar only, said bar not to be available for customer use. 9.5. The annual fee for a class I license shall be two thousand four hundred dollars ($2,400.00). 10.Class J - Hotel And Tavern Or Motel And Tavern: 10.1. A hotel and tavern or motel and tavern license authorizes the retail sale on the premises specified, of alcoholic liquor by the drink for consumption on the premises, and beer and vinous beverages by the bottle, carafe, or beer by the pitcher of a capacity not to exceed sixty (60) ounces. 10.2. The license shall only be available for premises defined as a "hotel and tavern or motel and tavern" herein. 10.3. All such liquor service, excepting beer and vinous beverages by the bottle, carafe, or beer by the pitcher of a capacity not to exceed sixty (60) ounces shall be by the drink only, and may be served from a customer bar or as provided in subsection 3-3-11.1.1 of this section. 10.4. The annual fee for a class J license shall be three thousand one hundred dollars ($3,100.00). 11.Class K - Catering License: 11.1. A catering license authorizes the sale of alcoholic liquor in connection with the operation of a catering business within the city, which sale shall be made at the registered office of the licensee, which shall be the licensed premises, and nowhere else. 11.2. Alcoholic liquor shall only be sold and served by the licensee in connection with the catering of foods. 11.3. In addition to the other requirements of this chapter, a class K license shall only be issued to persons who can demonstrate that they are operating a bona fide catering business with headquarters within the city. 11.4. The annual fee for a class K license shall be one thousand dollars ($1,000.00). 12.Class L - Special Event License: 12.1. Authorizes the retail sale of wine and/or beer only, on the specified premises. Such special event licenses are to be granted to local not for profit community organizations chartered as such, or governmental entities, which are dedicated to the realization of local goals which are a direct benefit to all the citizens of the city. Such license authorizes the retail sale and/or consumption of wine and/or beer only, on municipally owned property, such as streets, roads or parks. The boundaries of the licensed premises and the duration of the license shall be established by the local liquor and tobacco control commissioner. The licensee shall maintain the premises in a neat, orderly and safe condition, shall provide such traffic control and sanitation facilities as may be required by the local liquor and tobacco control commissioner to protect the public health, safety, welfare and morals of the residents of the city, and shall restore the premises after expiration of the license to its prior condition, including the removal of trash, rubbish and garbage in accordance with this code. No alcoholic liquor shall be brought onto the premises or consumed on the premises other than that provided by the licensee under the terms and conditions of this chapter and its license. 12.3. The retail sale and consumption of wine and beer authorized by a license issued pursuant to this subsection 3-3-11.12 shall be limited to the premises specified in the license, which premises shall be entirely enclosed in a tent, in a fenced area, or entirely enclosed by a double fence with at least four feet (4') separating each fence row, demarcating the licensed premises. 12.4. Such licenses hereunder shall be limited to one such license for any one applicant in any one calendar year. 12.5. There shall be no additional charge for an entertainment license used in conjunction with the license issued hereunder. 12.6. All persons who will sell, serve, or dispense any alcoholic beverages shall annually attend a course of instruction given by the Naperville police department and the Naperville liquor and tobacco control commissioner prior to the event for which such license is issued. 12.7. The fee for such license shall be fifty dollars ($50.00) per day, plus payment to the city for the actual cost incurred by the city in providing additional police personnel necessitated by improper conduct or control by the licensee on the specified premises. Each licensee who is to be held responsible for additional charges shall receive an itemized invoice therefor, shall be given an opportunity to review the charges with the liquor and tobacco control commissioner, and shall thereafter promptly pay any such additional charge determined by the commissioner to be due the city. 13.Class M - Recreational Facility: 13.1. A recreational facility license authorizes the retail sale, on the premises specified, of alcoholic liquor by the drink or vinous beverages by the bottle or carafe, or beer by the pitcher of a capacity not to exceed sixty (60) ounces. 13.2. Service of alcoholic liquor shall be only during the time that the athletic or sports portions of the facility are open and available for use. 13.3. Food may be served for the convenience of the patrons, so long as such food service complies with all applicable health regulations and licensing requirements. 13.4. The annual fee for a class M License shall be two thousand dollars ($2,000.00). 14.Special Promotional Permits: 14.1. Promotional activities by local merchants or under sponsorship of a local not for profit organization httn://www.sterlinacodifiers.com/IL/Naperville/05003000000011000.htm 10/5/2005 -3-11: LIQUOR LICENSES, CLASSIFICATION AND FEES: Page 6 of 9 for the sale of merchandise other than undergarments, sleepwear, lingerie and swimming attire, displayed by live models, shall be permittedwithin class A, B, I, J, K, L or M licensed premises. 14.2. The fee for such permit shall be twenty five dollars ($25.00) per event. 15.Bottle Permit: 15.1. Sale at retail of distilled spirits, vinous beverages and beer by the bottle to registered guests within their rooms for consumption therein shall be permitted under a class I and class J license only. 16.Class N -Wine/Champagne Basket Sales License: 16.1. Authorizes the retail sale of bottled wine or champagne to be sold exclusively as part of an arrangement in a gift basket by an establishment in which the retail sale of bottled wine and champagne is the primary and principal business thereof. 16.2. In addition to other requirements of this chapter, a class N license shall only be issued to persons who can demonstrate that they are operating a bona fide wine/champagne gift basket business. 16.3. Wine and champagne shall be sold in sealed packages only and consumption on the premises where sold is not permitted. 16.4. The annual fee for the class N license shall be one thousand dollars ($1,000.00). 16.5. For purposes of this license classification, a "basket" shall be defined as a decorative gift container which may be constructed of wood, metal, plastic, woven rope, decorative paper or plastic bag or such similar material the purpose of which is to hold the gift bottle arrangement. 16.6. Wine and champagne tasting may be permitted by a class N licensee as a monthly promotion, for a period not to exceed three (3) consecutive days each month. This privilege is subject to an annual fee of one hundred dollars ($100.00) in addition to the prescribed fee, except that no licensee shall give or offer to give away alcoholic liquors as a gift, gratuity, or tie in with the sale of nonalcoholic products or to induce the purchase of or promote the sale of nonalcoholic products. (Wine and champagne tasting under this paragraph shall be limited to wines and champagne only.) 16.7. Wine and champagne tasting may be permitted by a class N licensee as a promotion each week for a period not to exceed two (2) consecutive days. This privilege is subject to an annual fee of two hundred dollars ($200.00) in addition to the prescribed fee, except that no licensee shall give or offer to give away alcoholic liquors as a gift, gratuity or tie in with the sale of nonalcoholic products or to induce the purchase or promote the sale of nonalcoholic products. All such liquor service, excepting beer and vinous beverages by the bottle, carafe or beer or margaritas by the pitcher of a capacity not to exceed sixty (60) ounces shall be by the drink only, and shall be served from a service bar by waitresses and waiters. 17.5. The annual fee for a class 0 license shall be two thousand one hundred dollars ($2,100.00), which shall be in addition to the license fees required for an entertainment license under section 3-3-15 of this chapter. 18.Class P - Brewery Pub: 18.1. Permits the manufacture of"beer" as defined herein, only at a designated premises, for the sole purpose of the retail sale, consumption and storage of such beer only at and within such premises. 18.2. The license shall only be available as a supplemental license for premises holding a class A or class B license. 18.3. All such supplemental licenses shall be granted only upon a showing by the applicant that all applicable federal and state tax stamps have been procured. 18.4. The annual fee for a class P license shall be five hundred dollars ($500.00). 19.CIass Q - Complimentary Beer And Wine: 19.1. Permits an all suite type hotel to serve complimentary beer and wine to registered guests between the hours of four o'clock (4:00) P.M. and seven o'clock (7:00) P.M. Hors d'oeuvres or other food must be served continually during the complimentary hours. Service of such complimentary beverages shall be provided only in an area separate and apart from the lobby and other common use areas of the hotel. 19.2. If an all suite type hotel currently has a class I liquor license then they need not also obtain a class Q liquor license. 19.3. The annual fee for a class Q liquor license shall be two hundred fifty dollars ($250.00). 20.CIass R - Legitimate Theater House: 20.1. Permits the sale at retail to patrons of the premises of beer and vinous beverages not more than one hour before the start of the theatrical performance and during intermission for a period of not more than one-half (1/2) hour. 20.2. Such sale and delivery shall be confined to the lobby or foyer of the licensed premises. 20.3. Such area shall be without seating and shall be fully illuminated. 20.4. No beer or vinous beverage shall be removed from such segregated area by any patron. 20.5. Such beer and vinous beverages shall be served from a customer bar only. Beer shall be served by the glass or bottle only, having a capacity of not more than twelve (12) ounces. Vinous beverages shall be served by the glass only, and such vessel shall have a capacity of not more than five (5) ounces. 20.7. The display of the uncovered female breast or the genitalia of either sex or the display or deportment of the human body in a manner that is lewd, lascivious, or appeals to prurient interests is strictly prohibited as are any productions exploiting minors in a sexual manner. 20.8. The annual fee for a class R license shall be five hundred dollars ($500.00). (Ord. 03-181, 8-19- 2003) 21.Class S - Specialty Wine Shop: 21.1. Authorizes the retail sale of wine only for consumption off premises. 21.2. A premises granted or issued a class S license, or any renewal thereof, shall be subject to the following conditions: 21.2.1. The licensed premises shall not exceed a gross area of one thousand five hundred (1,500) square feet total. 21.2.2. Not less than twenty percent (20%) of the total gross area of the licensed premises shall be designated for the sale of specialty foods. 21.2.3. Winetasting of only the wines permitted to be sold under this classification for consumption off premises, shall be permitted during authorized hours of business under the following conditions: 21.2.3.1. Not more than seven (7) ounces of wine may be offered for sale, sold or served to any one person during any one daily license period and such seven (7) ounces shall be comprised of not less than seven (7) different wines, and no glass shall contain more than one ounce of wine. 21.2.3.2. A price may be set for such tasting. 21.2.3.3. Sales tax shall be collected and paid on all revenue realized from winetasting. 21.2.3.4. The terms and conditions set forth in the definition of this class. 21.2.4. Customer seating shall not be provided or permitted. 21.3. A corkage license authorizes a restaurant to permit its patrons to bring, possess and consume wine or vinous beverages on the premises in accordance with the conditions set forth herein. Restaurants eligible for a corkage license must meet the restaurant definition in section 3-3-1 of this chapter, and in addition shall provide full meals at tables served by licensee's waitstaff. 22.3. Consumption of such wine or vinous beverages shall only be permitted by patrons who will order and be served a meal by the licensee. Every such bottle shall be opened by the licensee's agent or employee. Such consumption of wine or vinous beverages shall only be permitted from five o'clock (5:00) P.M. until eleven o'clock (11:00) P.M. 22.4. No restaurant that has a service bar is eligible for a corkage license. In addition, no restaurant that has any other classification of a liquor license under this code is eligible for a corkage license. 22.5. It shall be unlawful for the licensee and any agent or employee of the licensee, to permit any person under the age of twenty one (21) to possess or consume any alcoholic beverages on the premises. In addition to all other fines and penalties, the local liquor control commissioner may fine, suspend or revoke the license for any violation of this subsection. 22.6. It shall be unlawful for the licensee and any agent or employee of the licensee to permit any patron to leave the licensed premises with open liquor. 22.7. The annual fee for a class T license shall be seven hundred dollars ($700.00). Prohibition on Overnight Parking: No person shall park a vehicle, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic-control device at any time between the hours of 1:00 a.m. and 6:00 a.m. on a street of the City of Yorkville, except that this prohibition shall not apply to any street that has no curb. The Chief of Police, or the Chief's designee, shall have the authority to temporarily (not more then one day at a time) allow parking to a resident if the resident can prove a specific hardship caused by this restriction. B. Opt Out of Prohibition: The City Council may consider allowing owners of property on both sides of any city block, or the entire cul de sac to opt out of the prohibition contained in Paragraph A, above upon the following events:\ 1. They were concerned that Spring Street would carry the majority of that traffic, and requested that the traffic access the development some other way. Richard Marker Associates agreed to allow that traffic through their Heartland in Yorkville subdivision, which had a limited number of residents at the time. A detour route was posted, and was fairly successful in diverting construction traffic away from Spring Street. Since that time the majority of the public infrastructure in Heartland Circle has been completed. Heartland in Yorkville has almost completely built out, and the asphalt surface course in that development was paved earlier this year. Construction of individual homesites,however, still requires large trucks to deliver and haul away equipment and material. We have received several requests from residents of Heartland in Yorkville to stop the detour of construction traffic through their streets. They are concerned about the large trucks navigating the sharp curves and tight corners in their subdivision. They don't understand why their neighborhoods and families are less important than those on Spring Street. Please place this item on the Public Works Committee agenda of November 7, 2005 for discussion.
