The July 14 minutes were approved as written. Bristol Bay Units 1-7 Final Plat Anna Kurtzmnan's comments Mr. Graff stated the reviews were done with the March 15 PUD plan. The new PUD ordinance gives staff discretion in final decision making, if there are deviations in the annexation agreement. General#5 )Ranch homes' with two car garage sideyard setback variance need to be determined. On the final PUD plat, a note will be added regarding the 7.5' setback, per Mr. Stough. Mr. Graff stated that he believes, according to the PUD ordinance, (pg. 8), if density, open space and engineering are not being modified, to affect the overall plan. General #1) The existing zoning on the old farmstead is A-1. It is shown as note 7 on all plats needs to be removed. Unit 1 #5) Zoning for the fire station is R-2 and needs to be noted so setbacks can be shown. There is an existing 60' access easement coming off Rt. 47 and the developer is dedicating another 10'. This will be a full width road within a 70' ROW. The final plat will note that the fire station lot"to be conveyed to the BKFD". Both parties must agree that the deed be transferred. Unit 2 #1) Lot 34's decrease does not change density. All setback requirements and sq. footage of 9000 per unit building envelope are being met. Architectural requirements will be reviewed before the final plat is recorded, and exhibits will be provided with the annexation agreements. A memo will be provided to council that the setbacks and architectural standards are met. Unit 5 #2) The 3,839 sq. feet lot will be conveyed to the HOA. Unit 6 # 1) Two build able lots are being added. Discussion on page 10 and 11 of the annexation agreement deals with the percentage of increase. If build-able lots increase is 1 less than 2%, then#1 on page 10 applies. Cumulatively, if overall density increases the City will need to keep record so the overall open space has not been reduced by more than 5 %. Anna will be responsible for tracking this development for changes in open space, and Mike Schoppe, if provided with approved plats, will be tracking the number of units approved. Unit 6 #2) Lot widths have been increased and the city, for land cash reasons, needs to know when acreage has been reduced so the school district receives more cash. Ms. Kurtzman will call this out in a memo. This is a stand alone school site. Unit 7) The developer made the lots wider and added extra width to the corner lot, squaring off the back lot lines. Mike Schoppe comments Unit 1) Lot 1704 will belong to the HOA. The lots cannot be reviewed as consolidated because the current lot line will be recorded. The developer will identify all setbacks along main streets, lot lines and side yards. Side yard setbacks will be 15' if the building is 25' high, according to the R-4 zoning ordinance guidelines. Unit 2 # 4) Bristol Bay is front yard on lots 31, 46. Setback should be 30'. Unit 2 # 5) Utility easement blanket language should be universal on the plats. All of lot 1699 should be noted as public access easement. Roadway easement provisions comments should be added to the motor courts. Final easement comments will be subject to final engineering reviews. Unit 6 #3)A note of conveyance should be on the Lot 1675. The City should make certain that the conveyance paperwork begins at the recording of the first plat. John Whitehouse comments He suggested the engineering department change the scales on the plats if the notations are not readable, after recording. This will move to Plan Commission on Aug 10. Yorkville, IL 60560 Re: Comprehensive Plan Amendment—Northwest Area Dear Tom, Attached is a copy of a proposed amendment to the City's Comprehensive Plan for the northwest portion of the City's planning area. We have also included an exhibit that shows the existing Comprehensive Plan for the same area so that you can more readily identify the proposed changes. General The study area for this amendment is outlined as the territory lying east of Eldamain Rd., south of Galena Rd., west of Route 47, and north of Corneils Rd. including a small portion of land lying south of Corneils Rd. and east of Beecher Rd. The purpose for considering these changes to the Comprehensive Plan stem from the Comprehensive Plan amendment for the southern portions of the City, which the City adapted in February of 2005. In that amendment, an additional 913 acres of Office/Research and Industrial were added to the Comprehensive Plan. This additional acreage of Office/Research and Industrial are located along the planned major highways of Route 47 and the Prairie Parkway. Proposed Changes The study area is approximately 1,756.0 acres in size. The current land uses within the study area include: 1. The 300 acre Westbury Village Property which has been annexed to the City 2. Feltes Sand and Gravel pit 3. Aurora Blacktop Asphalt Plant 4. A composting facility east of Aurora Blacktop Page I of 3 5. Kendall County Concrete 6. The closed Nelson landfill property 7. Undeveloped agricultural uses which encompass the majority of the study area Rob Roy Creek and a northerly tributary to the creek run through the area. The study area is split by two school districts with approximately 501 acres in the Plano School District and 1,255 acres in the Yorkville School District. The existing Comprehensive Plan outlines the following land uses: 1. Commercial Space (75.0 acres) 2. Industrial (871.0 acres) 3. Office/Research/Industrial (281.0 acres) 4. Transitional Neighborhood (255.0 acres) 5. Open Space (274.0 acres) The primary change identified in the proposed amendment to the Comprehensive Plan is changing approximately 1,152 acres of Industrial and Office/Research/Industrial in the western half of the study area to Suburban Residential. With the amendments, the proposed land uses would be as follows: 1. Commercial Space (99.0 acres) 2. Suburban Neighborhood (111.03 acres) 3. Transitional Neighborhood (252.0 acres) 4. Open Space (295.0 acres) An important element of the plan to bring to your attention is that the existing industrial uses of Feltes Gravel, Kendall County Concrete, Aurora Blacktop, and the composite facility are identified to ultimately someday be Suburban Residential. This change should be viewed as a long term change in land use and not something that would necessarily happen in the near future. However, if the proposed residential property surrounding these existing industrial uses were to develop while the current industrial uses are in operation, then it would be necessary for the residential uses to incorporate appropriate buffering of those uses. The potential need for this buffering will need to be described in the text of the Comprehensive Plan. Conclusion Considering the above, the City Council is requesting that the Plan Commission conduct a public hearing on the proposed amendments to gather input from the public as well as the Plan Commission. Following the public hearing, the Plan Commission should forward a recommendation on to the City Council reflecting the Commissions thoughts. It appears that Lots 159, 197,and 235 need to have a shade tree in the parkway. 2. Where the multi-family lots are contiguous to the single family lots (Lots 93-108) the City's Landscape Ordinance requires a perimeter landscaping requirement of three shade trees, three evergreen trees and two ornamentals for every 100 lineal feet of bufferyard.In accordance with the City's Landscape Ordinance there are 32 shade trees, 32 evergreens and 21 shrubs required in the perimeter landscaping for compliance. Basically all this plat does is shift the lot line between Lots 1 and 2 and between Lots 2 and 3. The total area of the 3 lots remains the same. The only concern I have regarding the plat itself is whether the public utility and drainage easements that were created when the previous plat was recorded still exist after the lot lines are shifted. I spoke with the surveyor who prepared this plat and he suggested that a note on the plat vacating those easements might be sufficient. John Wyeth should comment on this issue. The other issue is the process that this plat must follow to be approved. The plat has a signature blocks for the Plan Commission and the Mayor, so I assume that it must go through the foinial approval process. This plat creates two new lots on Countryside Parkway about 200 feet east of Marketview Drive. I have the following comments: • This property is zoned B-3, which nomially has a 50-foot front yard setback requirement. The development agreement with Menards changed that distance to 30 feet within the development. Therefore the setback shown from the Countryside Parkway ROW is correct. • The common driveway along the east side of the property lines up well with the existing median cut on Countryside Parkway. • We have not seen a site plan for either of the two new lots,but watermain, sanitary sewer, electric, gas, etc. will need to be run in from Countryside Parkway. The onsite easement widths may need to be increased. An alternative might be to dedicate offsite easements to the east of Lots 1 and 2. • If the common driveway to serve these lots is proposed to have curb & gutter, then it will need to be at least 28 feet wide. If curbs are not proposed, it could probably be 20 feet wide. Regardless, the ingress/egress easement width should be widened to cover the entire pavement width. • Since fire hydrants may be required along the common driveway, the public utility easement along the east site of both lots should be 5 feet wider than the ingress/egress easement. • Since Lot 2 does not have frontage on Countryside Parkway, it's building setback lines should be shown on the plat. I spoke with Anna KurtLluan, who suggested treating the north property line as the ROW line, the east and west property lines as side lot lines, and the southernmost property line as the rear lot line. The setback lines would also be used when determining the location of parking. We i should consider moving the setback line along the east side of these lots back 5 to 10 feet so that utilities like hydrants are not so close to the building. This review and our comments do not relieve the surveyor from his duties to conform to all required statutes, codes, regulations, and acceptable standards of professional land surveying practice. Engineering Enterprises, Inc.'s review is not intended as an in-depth quality assurance review.We cannot and do not assume responsibility for errors or omissions on the plats. We offer the following comments: Comments common to all Units 1. Gaps in the lot numbering sequences within a particular unit should be noted. 2. Except for Unit 1, a minimum scale of 1"=60' should be utilized for clarity due to the size of the lots. 1"=100' is not appropriate and some of the text size is well below the minimum recommended size of 0.08 inch. Also, no lines, text or dimensions within the unit being platted should be lightened in intensity. Contrasts should be achieved by line types and thicknesses. 3. It is not necessary to show the acreage of the single family and other small lots. 4. The standard note box on all sheets where it appears for all Units should be revised as follows: a. Kurtzman, Zoning Coordinator SUBJECT: Bristol Bay Final Subdivision Plat for Units 1 —7 Dated: July 7, 2005 Staff has reviewed the documents identified above for compliance with the zoning code and the approved annexation agreement. Based upon this review we offer the following comments: General 1. Note# 7 in the note box incorrectly identifies the zoning of the property and should be corrected. This property has been annexed. The zoning of these units ranges from R-2, R-3 and R-4, not the A-1 reflected in the note. 2. Sheet 14 of the preliminary plat (dated March 15, 2005) provides zoning setbacks, building separations, and, in the case of parcels zoned R-3 and R-2,permitted obstructions. As these permitted obstructions differ from those listed in the zoning code the permitted obstructions should be listed on each plat. This note should also clarify— are these the only obstructions that are permitted or are these in addition to those outlined in the zoning code? 3. At the bottom of the last sheet(for each unit) there is a note referring to paying Kendall County Land Cash fees. Should this note be on this plat? 4. Also on the bottom of the last sheet(for each unit) there are notes implying that this document is a plat of survey. Staff defers to engineering regarding this, however,be believe this text should be removed. 5. For Units 4 thru 7: The preliminary plat notes that side yard setbacks in the R-2 district is either 10 feet or 7.5 feet if there is a three car garage. The typical detail shown on each of these plats expands this exception to include ranch homes. As a ranch home exception was not called out in the annexation agreement staff is recommending that this provision T. Graff 1 Bristol Bay Units 1-7 July 27, 2005 Page 2 of 3 be removed from each plat (thus leaving the typical detail note to reflect a 10 foot side yard setback or a 7.5 foot side yard back for homes with a three car garage). 6. The preliminary plat states that the minimum lot area per dwelling is 9,00p sq ft for up to 50% of the lots. The applicant should demonstrate how this is being met—how many lots of the total are below 12,000 sq ft(the benchmark for determining the 50%). Unit 1 1. What is the zoning for Lot 1685 (fire station)? Staff believes that it should be R-2 but the applicant should review the legal description assigning zoning and confirm this. Once the zoning has been confirmed, the plat should be modified to identify the appropriate setbacks. 2. The minimum zoning setbacks and building separations should be noted on the plat. 3. The dimensions of lot separations should be noted, especially between lots: a. 1630 and 1631 b. 1632 and 1633 c. 1651 and 1652 d. 1659 and 1660 4. The northeast corner of lot 1630 appears close to the ROW. Please have the developer confirm the distance between these two points. 5. The Fire District should provide comments regarding the 10-foot wide ROW dedication occurring to the west of Lot 1628. Will rescue equipment be able to provide adequate protection with this amount of ROW? Unit 2 1. The lot sizes of several lots do not match the lot sizes reflected on the adopted preliminary plat(dated March 15, 2005). Most of these lots deviate by approximately 200 square feet, however, lot 34 is 1,014 sq ft less than what is listed on the preliminary plat. 2. The individual townhome lots apparently do not have a spatial relationship with the rest of the subdivision. Staff recommends that the dimensions between these lots and the property lines of the underlying lots be provided. 3. There are a number of lots where the building setback line cuts through the townhome lot that may significantly impact the location of the home. (Lots 319 and 324 in particular may be problematic.) Staff does not have engineering plans to compare the location of T. Graff Bristol Bay Units 1-7 July 27, 2005 Page 3 of 3 the proposed homes in relationship to the building setback and lot lines. The applicant should be reminded to closely review their product to the lots and building setback lines to ensure that their product will be able to fit all requirements. Unit 3 1. A dimension between the eastern building setback line and the eastern property line was not provided on Lot 3. Unit 5 1. The developer should be aware that, by definition, Rosenwinkel Street will be considered the front(for zoning purposes) of Lot 1679. As such the 30 foot front yard setback will be off of Rosenwinkel, the 20 foot corner side yard will be off of Bristol Bay Drive. 2. The City should be aware that lot 1706 (a 3,839 sq ft lot at the southeast corner of Bristol Bay Dr and Bertram Dr) is being conveyed to the HOA. On the preliminary plat this lot did not exist as a separate lot but was part of a larger lot(lot 1695 of the preliminary plat) that is to be conveyed to the City. Unit 6 1. There are a number of changes between what is shown on the preliminary plat and the final plat for this Unit, including adding two lots (lots 1013 and 1707). Lot 1707 is to be conveyed to the HOA while 1013 is to be conveyed to a homeowner for a single-family home. 2. The lot widths between lots 986—991 and 998 — 1010 do not match those listed on the preliminary plat. For lots 986- 991, these deviations can be explained due to making the lot lines more perpendicular with the street and by the addition of lot 1707. However, the applicant should provide an explanation as to why the lot widths have changed along Timbalier St. Unit 7 1.
