A quorum was established. VISITORS Mayor Art Prochaska; City Attorney John Wyeth; City Planner Mike Schoppe; and John Whitehouse, from EEI. Also Greg Ingmunson, David Meek, R. MINUTES Crouch made a motion to approve minutes from the Jan. 12, Feb. 9, March 23 and April 13, 2005 meetings. Kraupner seconded the motion. Corrections were made to the Jan. 12 court reporter documents to include Crouch and Lucietto in the roll. All of the minutes were approved by a voice vote. PUBLIC HEARINGS Crouch made a motion to open the first public hearing. Holdiman seconded the motion. The motion was unanimously approved by a voice vote. 1. PC 2004-18Wyndham Deerpoint Homes and Judith I. Bell, Jennie M. Mulvey and Richard Huston petition to rezone. See attached. Jones made a motion to close the hearing. Davis seconded the motion. The motion was unanimously approved by a voice vote. Kraupner made a motion to open the second public hearing. Crouch seconded the motion. The motion was unanimously approved by a voice vote. 2. PC 2005-08 McCue Builders, Inc. and Youth Camp Association of District 12 and 13 Polish National Affiance of the United States of America petition to annex and rezone. Page 2 of 6 See attached. Crouch made a motion to close the public hearing. Jones seconded the motion. The motion was unanimously approved by a voice vote. Crouch made a motion to open the third public hearing. Jones seconded the motion. The motion was unanimously approved by a voice vote. 3. PC 2005-14 and PC 2005-15 Robert and Debra Dearborn,petition to rezone See attached. Crouch made a motion to close the public hearing. Schillinger seconded the motion. The motion was unanimously approved by voice vote. NEW BUSINESS 1. PC 2004-18 Wyndham Deerpoint Homes Crouch said the situation hasn't changed since the last time the petition was presented. The plan still largely impacts the people who live on Walnut Drive and as they stated in the public hearing, they aren't happy about it, Crouch said. Overall, he said he sees the same plan as presented earlier with the same problems. Rich Guerard from Wyndham Deerpoint Homes said at the city's request,they put in an access to the south to eventually connect to another roadway. The only reason the plan has come back through the system is because of a setback change. The property was already annexed a zoned R-3. As for Walnut Drive,he said it is a designated public street and there's literally nothing else that can be done. The dispute is that the residents who testified at the public hearing fear using Walnut Drive as an entrance will impact their property. Guerard said it would impact their property. However,he said there's nothing else the developers and residents can do,but try to manage the best they can. City Planner Mike Schoppe the city's in the process of researching easements that may or may not have been made. The latest plat in 2002 shows there's an ingress and egress easement placed on St. Joseph's Way. It doesn't identify whom the easement is granted to and what rights might apply. The city attorney is looking into that issue, Schoppe said. He said the issue has been looked at several times and St. Joseph Way has been planned to extend through the property and eventually to Route 47. Schoppe added the Planning Council hasn't looked at the proposal yet as a preliminary PUD plan. Lucietto then questioned if the Plan Commission is premature in voting on this issue without input from the city staff. Without a staff recommendation or review Lucietto said she didn't feel ready to vote. Page 3 of 6 Crouch made a motion to table the request for PC 2004-18. Holdiman seconded the motion. The motion was unanimously approved in a roll call vote. Kraupner, Holdiman, Davis, Schillinger, Jones, Crouch and Lucietto voted yes. 2. PC 2005-08 McCue Builders petition to annex and rezone Crouch said the commission had a lot of issues on this request when it was brought to the commission earlier as a concept plan. At the top of the list was the fact there's only one entry/exit planned. There are questions about the road to the east that might come through the property. Also, there are a number of lots that are smaller than 12,000 square feet that don't back up to open space. Attorney Greg Ingmunson said the road to the east won't cross Blackberry Creek so it's unlikely it would go through this property. John Whitehouse from Engineering Enterprises, Inc. said the city plan shows an east-west road on the north side of the school property, which is where the north driveway is. However, he said it's unlikely that's where the road would go. In fact,he doubts there ever will be a roadway bridge to cross Blackberry Creek. Even if the east-west road doesn't go through the property, there are still a number of transportation issues plaguing the plan. For one, Cannonball Trail might be extended through to River Road, Whitehouse said. The John Street intersection, which was addressed in the public hearing, will eventually warrant a four-way stop. Moving past the access issue, Schillinger said he opposes R-4 zoning on the property. If that zoning is approved at all, it would have to be located near the jail. He doesn't want to see it further south on the property. Bill McCue said that even with an R-4 zoning, they would stay within the density of 2.25 units per acre. The intent is to provide age-targeted housing where people want smaller lots. Ingmunson added that the villa lots would be really nice. Ingmunson said the request has not yet gone to the Planning Council. Crouch said without information from the Planning Council and without engineering notes, he doesn't feel ready to vote. Ingmunson, however, said he'd like for the commission to vote rather than table the request. Crouch made a motion to recommend approval for annexation of PC 2005-08 as requested. Schillinger seconded the motion. The motion was unanimously approved in a roll call vote. Holdiman, Davis, Schillinger, Jones, Crouch, Kraupner and Lucietto voted yes. Crouch then made a motion to recommend approval of the rezoning request for PC 2005- 08 from agricultural to R-2 and R-4 PUD. Jones seconded the motion. The motion was defeated in a 5-2 vote. Davis, Schillinger, Crouch, Kraupner and Lucietto voted no. Jones and Holdiman voted yes. Page 4 of 6 3. PC 2005-08 Blackberry Woods—Planned Unit Development Lucietto said this request was merged into the previous request. 4. PC 2005-14 Robert and Debra Dearborn, petition to rezone Schoppe said the city's comprehensive plan shows the property in the traditional neighborhood area. Mayor Prochaska said that the downtown revitalization plan shows for this area to be a combination of commercial and residential. On this particular parcel, Robert Dearborn said the plan is to erect a building to house a commercial use on the first floor and three to four apartments on the second floor. A rendering of the proposed building shows an all brick building that could house up to three commercial uses or one user could use all three designated spaces, Dearborn said. Lucietto asked if the developer could make all sides of the building look nice. Crouch said someone at the public hearing asked if the zoning request is approved, could it start a domino effect. Mayor Prochaska said it could. As properties sell over time, they could be rezoned commercial. Davis said he'd like to make sure the building shown is close to what is actually built. Mayor Prochaska said the commission could ensure that happens by calling for an agreement s part of the zoning change. Davis made a motion to recommend approval for rezoning as requested in PC 2005-14 subject to the negotiation of a development agreement. Schillinger seconded the motion. The motion was unanimously approved in a roll call vote. Schillinger, Jones, Crouch, Kraupner, Holdiman, Davis and Lucietto voted yes. 5. PC 2005-15 Robert and Debra Dearborn petition to rezone Dearborn said this request is to rezone the existing house for eventual commercial use. For now,he intends for the residence to remain a residential use. Crouch made a motion to recommend approval for rezoning as requested in PC 2005-15 subject to design standards and a development agreement. Jones seconded the motion. Jones, Crouch, Kraupner, Holdiman, Davis, Schillinger and Lucietto voted yes. 6. PC 2005-03 Aspen Ridge—Preliminary Plan David Meek, attorney representing the petitioner, said the plan has been modified based on comments from the Plan Commission at the concept phase. The roadway system remained the same,but the detention ponds were moved and the park in the center will be dedicated to the city. Schoppe said there are a few issues the Plan Commissioners should ponder before voting. One important item to consider is that this is the first project south of the river based on the new comprehensive plan. Page 5 of 6 The proposed development is located in the estate area, which as a base density of 1.5 units per acre. The density could increase to 1.75 units if the project goes above and beyond normal requirements. In this project, a density of 1.72 units per acre has been proposed. Meek said the density credit explanation found on the preliminary plat addresses the principles outlined in the comprehensive plan. Also, the preliminary plat lists a summary of other specific improvement the developer is providing. For instance, Principle 5 states that the developer must provide a sense of architectural interest and unique identity. In response to that principle, the developer has promised to comply and exceed any requirements set forth by the city's architectural appearance code. Crouch wondered how the developer could guarantee it will exceed the standards. Meek said that the builders would have to evidence that they will indeed exceed the standards. Crouch said the word"exceed"is the problem. He questioned how the developer could say it will exceed and comply. Lucietto said the Plan Commission rejected the proposal in February and asked what has changed since then. Mayor Prochaska said the City Council voted in favor of it. However,before any permits are allowed, the Fox Road study has to be completed. Whitehouse said the last time the issue was before the Plan Commission, Plan Commissioners wanted it to be a PUD. The City Council, however, decided it could proceed as an annexation provided it is accompanied by an annexation agreement. All of the issues and concerns from city staff and the Plan Commission could be addressed in an annexation agreement, he said. The council wanted to do it as an annexation agreement because the project will set a precedent in the area, Whitehouse said. Schoppe said the developers have done a good job addressing Plan Council issues. The issue now is whether the developers exceed the minimum requirements enough to justify the higher density. Crouch said he has a difficult time seeing how the 10 principles are quantitative. They're hard to interpret as to whether the additional 30 lots are justified. Schoppe suggested focusing on two components—does the plan adhere to the design guidelines and does it exceed city standards. The exceeding part is more black and white because anything above the minimum requirement exceeds it. Determining if the design guidelines are exceeded is more nebulous, he said. Meeks pointed out that while he intends to leave most of the technical details to the engineers, there are numerous points that meet or exceed the city's standards. He said, for instance, the developers intend to put in a bike trail; they increased some of the lot widths so that they're more compatible to adjacent property owners and they are keeping the treeline along Pavilion Road. Also, the developers are putting up fencerows,putting in Page 6 of 6 elaborate landscaping and are helping to pay for the water main extension and sanitary improvements. Jones said he'd like for the developers to draft a list detailing where they believe they have surpassed standards. Davis agreed saying that the summary list provided on the plat is too vague. Crouch made a motion to recommend the preliminary plan for PC 2005-03 subject to staff comments and careful adherence to the test for higher density outlined in the comprehensive plan and to try to get more funding for the school district. Jones seconded the motion. The motion was approved 6-1 in a roll call vote. Kraupner, Davis, Schillinger, Jones, Crouch and Lucietto voted yes. Holdiman voted no. 7. PC 2005-18 Del Webb/Pulte Homes—Garritano/Brummel Concept Plan Matt Cudny introduced the plan for the subdivision. Cudny said Del Webb stands for lifestyle and value and the subdivision planned is for an age-restricted community. The proposal calls for a density of 3.3 units per acre in that subdivision. On the other side, where typical single-family housing is proposed, the density would be 1.75 units per acre, which falls within the comprehensive plan,he said. On the Del Webb site, the lot sizes would be 5,500 to 7,500 square feet. While Lucietto commented that the community is short on housing for adults, Jones said he would like to see how the developer makes the smaller lot sizes work. Cudny said the homes on the lots are typically 1,200 to 1,600 square foot homes and the average population per home is 1.7 to 1.8 people. He added that the planned community would be similar to the Del Webb communities in Shorewood and Huntley. When Crouch commented that the city has never approved lots as small as 5,500 square feet, Cudny said this concept is completely different than anything the city has seen before. Upon completion of the presentation, Jones made a motion to adjourn. Kraupner seconded the motion. The motion was unanimously approved by voice vote. I ' d just like to give 5 a brief overview of the preliminary plan for the 6 Wynstone townhome development located adjacent to 7 the Fox Highland subdivision and just east of 8 Route 47 . 9 This plan has been in front of 10 the Plan Commission previously a few months ago . 11 This plan does reflect a few modifications based 12 on some Staff requirement or Staff 13 recommendations . I ' d like to give you just a 14 brief run-through on some of those changes and 15 some of the overall data information . 16 The site is roughly 9 . 6 acres 17 in size . It consists of 56 townhome units , a 18 mixture of five-unit buildings and four-unit 19 buildings . 20 We have three access points 21 into the development; one is -- or three points 22 of access , ingress and egress . First one is 23 St . Joseph ' s Way, second one to the north , which 24 would be Walnut Drive , we are looking at stubbing Depo Court Reporting Service ( 630 ) 983-0030 6 1 into Walnut Drive . 2 It is our understanding that 3 the -- or the continuation of the full 4 cross-section or city cross-section would 5 continue to the road stub so that there would be 6 a full connection to Walnut Drive, a third -- 7 AUDIENCE : Wait a minute . 8 MR . WADEN : -- access easement , 9 30-foot access easement located there , and the 10 fourth point for future development is at the 11 southern portion of the project . 12 We have identified this road 13 network system as being a private road network 14 system. 15 There is 32-foot back-to-back 16 pavements within this cross-section . We have 17 utilized the amount of asphalt for some on-street 18 parking spaces . 19 We have shown on-street -- we 20 have shown a total of 50 off-street parking 21 spaces , I ' m sorry, about 15 of them are located 22 adjacent to the park site . 23 We also have off-street parking 24 located on the entrance road from St . Joseph ' s Depo Court Reporting Service ( 630 ) 983-0030 7 1 Way and also closer to the Walnut Drive location . 2 Within the motor courts 3 themselves we have also shown roughly four 4 parking spaces , so once again there is 5 off-street . 6 Then within the development 7 themselves there are two parking spaces within 8 the garage and then two behind the garage , so a 9 total of 224 spaces utilized there as well . 10 In the previous preliminary 11 plan we showed a wet detention basin in the 12 southeast corner of the project . We have now 13 converted that to a dry detention basin . It ' s 14 become a half acre high with a dry park site 15 adjacent to the detention basins . 16 The neat thing about this , it 17 could be utilized right now when there is some 18 inundation of water . We still have the half-acre 19 high and dry park facility . Maybe a gazebo could 20 be placed that ' s permanently dry for the whole 21 season . 22 When there is no rain , that 23 half acre could be almost converted into a one 24 and three quarter acre facility for the use of Depo Court Reporting Service ( 630 ) 983-0030 8 1 throwing a baseball , maybe a small pick-up soccer 2 game , so on and so on . 3 So we have made some 4 modifications to the plan with the park system 5 themselves . 6 So the changes themselves , 7 those are really the major changes we have dealt 8 with with the previous preliminary plan . 9 The data, again, it ' s 9 . 6 acres 10 in size for the site , 56 units . We have 50 11 off-street parking spaces and 224 additional 12 parking spaces within the garage and behind the 13 garages themselves . 14 We have landscape plans that 15 were done by Gary Weber, we can talk about those 16 if there are any questions , and we also have 17 Jason Wiesbrock from Jacob & Hefner to answer any 18 questions that you may have . So that ' s a brief 19 overview . 20 CHAIRMAN LUCIETTO : Okay . I ' m not sure if they ' re -- This 18 will help explain it a little bit . Is anyone 19 else on Walnut here? 20 The first one I will address , 21 Walnut Drive, we just discussed . We had a full 22 survey done of this property, which I have with 23 me up here , but what I am showing you is the 24 exhibit -- what I have passed out is an exhibit, Depo Court Reporting Service ( 630 ) 983-0030 14 1 just that house showing the road there, and that 2 is a township road . It ' s a 60- foot public 3 right-of-way . It ' s a street , dedicated street , 4 that dead ends into our property . 5 It ' s the only dedicated street 6 that has access to this piece of property right 7 now . It ' s the only public street . And obviously 8 it dead ends at the property for a reason . 9 What that shows you is the 10 distance of the house from the street where it I1 is , so that ' s actually from the right-of-way, so 12 her house itself, one corner , is 43 feet from the 13 right-of-way, and the other portion of it is 59 14 feet . The actual pavement is about 30 feet . 15 It ' s another 15 feet in . 16 So as far as parking and that 17 type of thing, there is plenty of room. From the 18 right-of-way, it ' s a 40-some foot setback . 19 Certainly what she is saying is 20 correct , the fact that there would have to be a 21 physical street put here , and we are going to be 22 required to be upgrading this road that goes on 23 out as part of our project, so -- and, you know, 24 that is a township road, so there is not much Depo Court Reporting Service ( 630 ) 983-0030 15 1 else I can say about that other than it ' s a 2 dedicated township road, it always has been, and 3 it ' s the only right-of-way to this property that 4 is dedicated . 5 Then to answer the one as to 6 the private drive, there is the townhome project 7 next to us , and I think there is a letter in the 8 packet from Lennar representing the group, and I 9 had talked to her this afternoon . 10 What she has said is this is a 11 private road, just as the gentleman said, that 12 she believes this is a private road, and that 13 there is no current agreements for a cross 14 easement or a cautionary arrangement , and I think 15 that still has to be researched as to what that 16 issue is or isn ' t . 17 One of the things -- It clearly 18 was intended to stub and to go in here , and at 19 one time -- in fact , that road was actually built 20 that goes into the property . 21 Nevertheless , if it is a 22 private existing road, then that ' s an issue that 23 would have to be dealt with, and maybe it could 24 only become an emergency access if some other Depo Court Reporting Service ( 630 ) 983-0030 16 1 issue can ' t be worked out . 2 What ' s unusual about that is we 3 developed the project on the other side of it , 4 which is Raintree, and this project stubs into 5 our project and goes through it , so all this 6 traffic goes through our project, you know, but 7 that is a public street and that was planned for , 8 so I don ' t think we have the answer to that , 9 except that we have contacted, and the person 10 that we contacted believes that ' s a private road . I1 And so -- And when we were in 12 the Planning Commission before , one of the 13 changes that has been made here is the additional 14 stubbing . 15 They requested a stub go to the 16 south so there could be an eventual connection 17 when the property to the south develops , and 18 you ' ll also see to the west there is an access 19 easement and right-of-way . 20 The purpose of that is so that 21 access can be built out to 47 when this parcel 22 develops , so there is going to be multiple 23 different accesses out of the property . 24 And I think what the lady had Depo Court Reporting Service ( 630 ) 983-0030 17 1 said is that Tony Graff had talked to her about 2 the fact that this could become an emergency 3 access when one of these is put in place as these 4 properties develop . 5 I wasn ' t involved in that 6 conversation, but I believe -- 7 MS . ALLEN : My name is Richard 2 Allen, I live at 2095 Muirfield Drive , which is 3 on the other side of the street closest to the 4 subdivision . 5 I am probably the most impacted 6 in terms of my -- the visibility of the 7 subdivision . I am immediately to the northeast 8 of the top right building there , and I am also 9 adjacent to St . Joseph ' s Drive , although I ' m set 10 back about 40 feet I think probably from 11 St . Joseph ' s Way . 12 My concern is that there is 13 going to be a lot of traffic on St . Joseph ' s Way, 14 and I don ' t see the way out of this dilemma 15 except probably corporate lawyers are going to 16 get together and work out an agreement whereby 17 St . Joseph ' s Way is no longer a private drive I 18 am supposing . 19 I am hoping that ' s not the 20 case , and the reason that ' s so is because I have 21 children that play in that area , and when we 22 bought the property, we knew that these two 23 drives , St . Joseph ' s Way, which is the connection 24 going into the Wynstone development , and Depo Court Reporting Service ( 630 ) 983-0030 22 1 Muirfield Drive , which is perpendicular to that 2 and goes off to the north , these two roads are 3 the obvious way that somebody coming out of the 4 subdivision that ' s planned would use to get to 5 work probably via Route 71 . 6 So they ' re either going to 7 continue on St . Joseph ' s Way and then turn left 8 on Village View, or they ' re going to go out 9 St . Joseph ' s Way, make a left turn onto Muirfield 10 Drive . 11 Now, both of those roads are 12 private roads , which to me mean that they -- 13 first of all, they have -- we have the 14 expectation of privacy by them being a private 15 road . 16 When we bought , it was with the 17 expectation that that would be a place where 18 there would be a road with a small volume of 19 traffic and our children could play there 20 safely . 21 I don ' t see -- My last 22 understanding is talking to the Lennar people , 23 and also I also talked to some of the Wynstone 24 people , was that I thought they implied that Depo Court Reporting Service ( 630 ) 983-0030 23 1 Walnut Street would be the logical principal 2 entrance because it connects only after about 50 3 feet , or maybe a hundred feet I think, to 4 Route 71 . 5 MS . FISHER : Oh, no , and then say 6 five acres . 7 MR . ALLEN : I understand their 8 objection , I wouldn ' t want it either, but what I 9 mean is their main street through that 10 subdivision aligns with Walnut Street after -- I 11 mean, that ' s probably where people are going to 12 want to go in and out of the subdivision I think . 13 But I can also see that that 14 could wind up being blocked by an objection or by 15 it only being an emergency entrance ; however , 16 that would leave only at the present time 17 St . Joseph ' s Drive as the way of getting in and 18 out of the subdivision, and I ' m hoping this is 19 not going to be resolved by some corporate 20 lawyers getting together and deciding to , let ' s 21 say, share the costs . 22 All that would be totally 23 objectionable . I would think that would be a 24 minimum requirement because right now we are Depo Court Reporting Service ( 630 ) 983-0030 24 1 paying for the maintenance of those roads . 2 We have to pay to have them 3 plowed in the winter, we have to pay to maintain 4 them, to service them, we will yet have to put 5 the final surfacing on I believe, and, you know, 6 if we have to pay for it , it doesn ' t seem 7 reasonable that another subdivision should have 8 the benefit of going over those roads for the 9 access into the subdivision . 10 I ' m a little bit surprised that 11 they haven ' t made a greater effort to make a 12 major connection out to Route 47 ; however, I have 13 talked to some people who have told me that that 14 might be impractical because there is a big pool 15 of water for one thing right now and they ' d have 16 to level that out . 17 Also, I understand that that ' s 18 commercially zoned, the woods area right there 19 between the subdivision and Route 47 , so they 20 would have to have -- come to some agreement 21 with the corporate interests that own the 22 property . 23 But still to me it seems to be 24 a lot more logical than coming out of there and Depo Court Reporting Service ( 630 ) 983-0030 25 1 then having to go through a network of roads to 2 get up to the major road they are probably 3 wanting to get to most of the time , Route 71 . 4 Again, my major interest in 5 this is because I ' m adjacent to the property, our 6 children play there , you will get a lot more 7 traffic through there , and also , again, that 8 something needs to be done about the cost 9 sharing . 10 I think if I had my druthers , 11 I ' d druther that it is public roads , at least we 12 wouldn ' t be paying for it .
