Terry Klingel, Yorkville Police Guests: Matt Cudney, Pulte Homes Ken Huhn, Smith Engineering The meeting was called to order at 9:35 by Joe Wywrot. The May 26th meetings were approved as written. The June 23 minutes should indicate that Westbury open spaces would be plotted as part of the individual units. Autumn Creek Unit 1 —Final Plat Anna Kurtzman's comments 1) Lot size should be indicated on plats for the lots. 2) The 10 foot setback on the preliminary plat is okay as written in the annexation agreement. Setbacks should be shown for all multi-familys on the plat. 3) Building envelope should be reflected on each individual lot. Mike Schoppe comments 1) There is an additional lot on the final, which was not shown on the preliminary. He recommends a chart on the final to include the number of units on each individual lot. The unit sum should not exceed the total number of town home unites approved in the annexation agreement. 2) CDF will be commenting on the open space, natural, storm water basin treatment options and maintenance plans are due to Mike by July 15. 3) Landscape plan comments will be forwarded to the developer by July 15. 4) The storm sewer outlet stops short of Blackberry Creek. From an engineering prospective, this is a Phase I temporary outlet,with a minimal restricted flow. As other units are developed there will be additional work done. Mr. Huhn will report on the revising the pipe fitting, so it will not need to be as subsequent phases are completed. John Whitehouse comments 1) Street name need to be added to sheet one. 2) Easement provisions have been added for the bike/pedestrian trails, allowing all storm water management facilities and public utility and drainage easement to be used for bike paths. (#9) There needs to be 15 foot level area immediately north of Rt. 34 ROW for the construction of a bike trail. 1 3) Comments 13-22 deal with additional easements for side yard utilities, totally 20 feet. 4) The developer has no issues with comments 27-29 regarding vehicular access. The annexation agreement allows the commercial owner to request access to Rt. 34,but this would be at the discretion of IDOT. There is a 25 foot commercial radius in the commercial area that needs to be on the legal and front sheet. 5) Will need easement grants beyond this unit for the 16 inch water main provided on the west line,between 44 and 45, in Grande Reserve to Prairie Meadows. (#z15) 6) Easements should be granted on off site storm sewer and water mains for this unit. (#36) 7) It is suggested the light pole be in the island, with a double street light standard. The island proposed will need to be shortened so access is not prohibitive for turning to Lots 2 and 131. Lot 2 should be garage right and lot 131 garage left, so island would not have to be shortened the maximum amount. Restriction for these two lots should be put on the plat, with a note or triangle. (#42) 8) Lot 131poses a problem, with frontage a wide road or minor collector, provide a hammer head or three point turnaround. If the turn around will be used as the second parking space, (two spaces are allowed by code and normally are in the garage) exceptions may need to be looked at in future PUD agreements. 9) Regarding the 50 foot permanent easement for IDOT ROW. Initially was to be IDOT owned. Now water main is not taking this route, it goes between lots 44- 45, following streets to Hamann property and then to Rt. 34. 10) The requests a 15 foot level area north of Rt. 34 ROW for construction of a future bike trail, which goes across the commercial property. It will put the trail 30 feet off the pavement. This will be part of the engineering review, so grading facilitates it. 11) Pulte is building the HOA and regional trails, which be noted both storm water and pedestrian trail areas. 12) Kennedy Rd. sidewalk is on both sides. 13) Joe stated that agreements for improvements along state highways are handled by 1) credit by developer, 2) allow the sidewalk to be delayed, or that it 3)must by done. Rt. 34 will have a trail along side it. Pulte will put in the trail in lieu of a public sidewalk. The trail should be shown on the engineering plans. Additional comments 1) Tim Fairfield stated lots 228 and 332 have no access to Kennedy Rd. If maintenance equipment can be accessed, then restrictions will be placed on traffic to this area. This is scheduled for Plan Commission on August 10th The meeting was adjourned at 10:40. Step 2: Plan Council: The Planning Council meets the 2nd and 4th Thursday of the month at 9:30 a.m. in the City Administration Office. Upon recommendation by the Plan Council,you will move forward to the Plan Commission Meeting. Attendees to this meeting include: City Administrator, City Land Planner, Sanitary District Director, City Engineer, Building Department Official, Emergency Medical Rep, Public Works Director, Executive Director of Parks and Recreation,Fire Department Rep, and Police Chief Step 3: For Preliminary Plans only; Park Board Planning Meeting: The Park Board makes recommendations on any Park Sites included in the development. The Park Board Planning Meeting is the fourth Monday of each month at 7:00 p.m. at the Riverfront Building, 301 E. Hydraulic Street. Step 4: Plan Commission: The Plan Commission meets the second Wednesday of each month at 7:00 p.m. in the Council Chambers at City Hall, The Plan Commission will make a recommendation for the City Council's consideration. The Plan Commission consists of 10 members appointed by the Mayor, the City Attorney and City Land Planner. Page 3 of 7 United City of Yorkville Preliminary-/Final Plat Application Revised: 5/4/04 Step 5: Economic Development Committee: The Economic Development Committee meets the third Thursday of each month at 7:00 p.m. in the City Hall Conference Room. All projects (regardless of a positive or negative EDC recommendation) proceed to the Committee of the Whole for discussion. The Economic Development Committee consists of three (plus one alternate) City Council members. Step 6: Committee of the Whole: The Committee of the Whole meets the first and third Tuesdays of the month at 7:00 p.m. in the Conference Room at City Hall. The project will be discussed in an informal atmosphere at the Committee of the Whole where no formal voting takes place. This session is to discuss and consider recommendations of prior committee meetings. Step 7: City Council: The City Council meets the second and fourth Tuesdays of the month at 7:00 p.m. in the Council Chambers at City Hall. This is where all City Council voting takes place. If this project has included an annexation and/or zoning petition, a Public Hearing will be held at this time with notice given by publication. Any annexation agreement, PUD agreement or development agreement must be signed by the Petitioner prior to being voted on by the City Council. Prior to the recording of the final plat, the petitioner must pay the Administration Fee. This is equal to 1.75% of the approved engineer's estimate of construction costs of land improvements, including but not limited to all public improvements to be dedicated to the City, mass earth grading, and quasi-public improvements to be maintained by the homeowner's associations such as private storm sewer,parking areas, and trails. Step 8: Final Plat recording instructions: Once the final plat is approved by the City Council and all required documents, bonds, and letters of credit are submitted to the City, the final plat may be recorded with Kendall County. Submit the final plat mylar to the Deputy Clerk for signatures. When all City signatures are in place,the developer or his surveyor may take the mylar to the Kendall County Clerk for his signature. The next step is to have six paper prints made and return to the Kendall County Recorder's office for recording. Kendall County requires the mylar and four paper copies. The City of Yorkville requires that you submit two recorded paper copies to the Deputy Clerk. Any copies you may require would be in addition to these. We offer the following comments: Comments common to all Units 1. Gaps in the lot numbering sequences within a particular unit should be noted. 2. Kurtzman, Zoning Coordinator�� SUBJECT: Bristol Bay Final Subdivision Plat for Units 1 —7 Dated: July 7, 2005 Staff has reviewed the documents identified above for compliance with the zoning code and the approved annexation agreement. Based upon this review we offer the following comments: General 1. Note# 7 in the note box incorrectly identifies the zoning of the property and should be corrected. This property has been annexed. The zoning of these units ranges from R-2, R-3 and R-4, not the A-1 reflected in the note. 2. Sheet 14 of the preliminary plat (dated March 15, 2005)provides zoning setbacks, building separations, and, in the case of parcels zoned R-3 and R-2, permitted obstructions. As these permitted obstructions differ from those listed in the zoning code the pennitted obstructions should be listed on each plat. This note should also clarify— are these the only obstructions that are permitted or are these in addition to those outlined in the zoning code? 3. At the bottom of the last sheet (for each unit) there is a note referring to paying Kendall County Land Cash fees. Should this note be on this plat? 4. Also on the bottom of the last sheet (for each unit) there are notes implying that this document is a plat of survey. Staff defers to engineering regarding this,however, be believe this text should be removed. 5. For Units 4 thru 7: The preliminary plat notes that side yard setbacks in the R-2 district is either 10 feet or 7.5 feet if there is a three car garage. The typical detail shown on each of these plats expands this exception to include ranch homes. As a ranch home exception was not called out in the annexation agreement staff is recommending that this provision T. Graff Bristol Bay Units 1-7 July 27, 2005 Page 2 of 3 be removed from each plat(thus leaving the typical detail note to reflect a 10 foot side yard setback or a 7.5 foot side yard back for homes with a three car garage). 6. The preliminary plat states that the minimum lot area per dwelling is 9,000 sq ft for up to 50% of the lots. The applicant should demonstrate how this is being met—how many lots of the total are below 12,000 sq ft (the benchmark for determining the 50%). Unit 1 1. What is the zoning for Lot 1685 (fire station)? Staff believes that it should be R-2 but the applicant should review the legal description assigning zoning and confirm this. Once the zoning has been confirmed, the plat should be modified to identify the appropriate setbacks. 2. The minimum zoning setbacks and building separations should be noted on the plat. 3. The dimensions of lot separations should be noted, especially between lots: a. 1630 and 1631 b. 1632 and 1633 c. 1651 and 1652 d. 1659 and 1660 4. The northeast corner of lot 1630 appears close to the ROW. Please have the developer confirm the distance between these two points. 5. The Fire District should provide comments regarding the 10-foot wide ROW dedication occurring to the west of Lot 1628. Will rescue equipment be able to provide adequate protection with this amount of ROW? Unit 2 1. The lot sizes of several lots do not match the lot sizes reflected on the adopted preliminary plat (dated March 15, 2005). Most of these lots deviate by approximately 200 square feet, however, lot 34 is 1,014 sq ft less than what is listed on the preliminary plat. 2. The individual townhome lots apparently do not have a spatial relationship with the rest of the subdivision. Staff recommends that the dimensions between these lots and the property lines of the underlying lots be provided. 3. There are a number of lots where the building setback line cuts through the townhome lot that may significantly impact the location of the home. (Lots 319 and 324 in particular may be problematic.) Staff does not have engineering plans to compare the location of • T. Graff Bristol Bay Units 1-7 July 27, 2005 Page 3 of 3 the proposed homes in relationship to the building setback and lot lines. The applicant should be reminded to closely review their product to the lots and building setback lines to ensure that their product will be able to fit all requirements. Unit 3 1. A dimension between the eastern building setback line and the eastern property line was not provided on Lot 3. Unit 5 1. The developer should be aware that, by definition, Rosenwinkel Street will be considered the front (for zoning purposes) of Lot 1679. As such the 30 foot front yard setback will be off of Rosenwinkel, the 20 foot corner side yard will be off of Bristol Bay Drive. 2. The City should be aware that lot 1706 (a 3,839 sq ft lot at the southeast corner of Bristol Bay Dr and Bertram Dr) is being conveyed to the HOA. On the preliminary plat this lot did not exist as a separate lot but was part of a larger lot (lot 1695 of the preliminary plat) that is to be conveyed to the City. Unit 6 1. There are a number of changes between what is shown on the preliminary plat and the final plat for this Unit, including adding two lots (lots 1013 and 1707). Lot 1707 is to be conveyed to the HOA while 1013 is to be conveyed to a homeowner for a single-family home. 2. The lot widths between lots 986 —991 and 998 — 1010 do not match those listed on the preliminary plat. For lots 986- 991, these deviations can be explained due to making the lot lines more perpendicular with the street and by the addition of lot 1707. However, the applicant should provide an explanation as to why the lot widths have changed along Timbalier St. Unit 7 1. Our consultants at Teska Associates have collected background data and information and have developed an initial draft plan. We are writing to invite you to participate in the initial workshop meetings scheduled to be held in each of the affected townships during early August. During these meetings the background analysis will be reviewed, along with preliminary land use concepts and alternatives. The purpose of these meetings is to solicit input from the affected townships, municipalities and their respective residents. Based on community input, the plan will be revised and supporting text and tables developed. The refined version of the draft plan will then be reviewed and further refined following a series of additional meetings prior to scheduling a formal public hearing on a final version of the draft plan which is tentatively scheduled to take place in December of 2005. The County's Ad-Hoc Zoning Committee has scheduled the first workshop for the evening of August 3, 2005 in Lisbon Township. The meeting will be held at 6:30 PM in Lisbon/Seward Fire Station No. 2 located at 6410 Chicago Road, Plattville, IL. The second workshop will take place on August 4, 2005 at 6:30 PM in the Seward Township Hall. The Township Hall is located at 2870 Route 52 which is on the south side of Route 52 immediately adjacent to the Aux Sable Creek. As the plan is reviewed and refined over the next several months, we will provide you with further updates and an opportunity to comment and provide additional input. Attached for your review in advance of the upcoming meetings is a series of maps identifying the planning issues and the preliminary draft of the proposed future land use plan for the two affected townships.
