(*) At our last meeting on March 3, 2004, you mentioned Mayor Prochaska
was interested in expanding the Municipal Facilities Master Plan to
include the redevelopment of the downtown. The BCA team would
recommend running this service in parallel with the Phase II of the Master
Plan. This service would include the need for a Market Study outlined in
Phase II prior to the establishment of the Redevelopment District outlined
in Phase III. The Market Study would also enhance and complement the
other tasks of Phase II.
On the matter of fees and budget. If the BCA team is selected, we will work with the
City to coordinate the scope and phases to correspond to the United City of Yorkville
timeframes and budgets.
This letter is in a condensed format to allow you and the Council to have an insight into
our interview presentation and the flexibility of the BCA team to work closely with
Yorkville. The BCA team members have a national and a regional reputation for
excellence that we will bring to the United City of Yorkville.

We are pleased to submit our qualifications for the United City of Yorkville Municipal Facilities Master
Plan and Downtown Redevelopment PIan. The attached binder, in preparation for our interview on 4
May 2004 at 7:00pm, is a summarized version of our previous response to your Request for
Qualifications. In addition to the previous response and based upon the pre-interview architect's
conference with staff on 3 March 2004, we have added an additional scope of work and portfolio of
selected works for downtown redevelopment planning.
Our current experience in Yorkville, in our role as Sexton Company's architect and planner, has been
very enjoyable. The public meetings and listening sessions that we have held, as well as the individual
interactions with staff members, have been rewarding. We submit our qualifications for this municipal
facilities master plan so that we may continue to work with the City, and in this case, on a more intimate
level to fulfill your goals and objectives.
We understand that your greatest need is to partner with a team that will work with you, your City
Council and Staff, to conduct public meetings, recommend options and provide a final report that is
realistic, buildable and holds a strong vision for your future needs. These are precisely Yas/Fischel
Partnership's greatest strengths; the partners/owners of the firm will work with you to produce the most
appropriate solutions to improve municipal services and economic vitality for your downtown and for
your community.
From the information in your Request for Qualifications, it is our understanding that the municipal
facilities may need to grow and expand,with the community. With a growing population and a need for
additional space, the current facilities need to be examined, and short-term and long-term solutions for
bringing a renaissance back to your historic downtown need to be explored. The Yas/Fischel Partnership

community and the programmatic requirements which lie therein. This ensures that the master plan for
your buildings uniquely represent the people of Yorkville while fulfilling their functional missions.

The Municipal Facilities Master Plan design process will begin with an affirmation of your needs
by reviewing existing information, asking probing questions, listeninn and understanding how

phase we use creative thinking and problem solving to address those needs. Good design and
listening talents add value to the process, enhance the United City's image, are meaningful to the
users, and are sensitive to the context.
The design alternatives are done "to scale" to communicate and assist the United City of
Yorkville in perceiving the ramifications of decisions prior to finalizing a direction for the plan.
The conceptual design phase should be viewed as a master plan approach.
A statement of probable construction and furniture cost will be prepared for one final concept for
each building type. It allows for actual cost testing of goals, desires, and size. The statement of
probable construction cost at this phase assists in defining realistic expectations prior to major
expenditures of architectural/engineering fees and incurring construction costs in the future.
The project schedule (noted below, following each phase) is flexible and adaptable, and is meant

Project Team: MunicipaI Facilities Master Plan
The Yas/Fischel Partnership project team has the blend of expertise to successfully provide services to
the United City of Yorkville. Each consultant has been selected for their specific relevant expertise,
and for technical and aesthetic quality. We have all worked together as a team previously.
Directing the project team, the Yas/Fischel Partnership will coordinate and manage the team's effort,
and all communication between you, the owner, and the project team. Specifically, Stephen Yas, as
Partner-in-Charge of Design, will guide the daily design effort. Jonathan Fischel, as Partner-in-Charge
of Management, will function as the "traffic cop" for all project communications between the United
City of Yorkville and our consultants, ensuring the expeditious management of the team in response to
agreed-upon design criteria.
Yas/Fischel Partnership is firmly committed to a collaborative team approach to master plan projects.
Our firm is strongly in favor of client involvement throughout the project. We suggest team-building
sessions which promote personal interactions and a "togetherness" attitude about the project.

meet the growing needs of this community comprised of a residen-
tial population of 21,000 and daytime work population of 40,000.

After interviewing all Village staffmembers through the use of space program criteria evaluation forms,three schemes
were prepared for the Village Board. Common areas are sub-divided to create better circulation,and rest rooms are made
accessible off of a main corridor,for public use. The formerly non-inviting,sterile main artery of the building is made
user-friendly and legible through the use of materials and improved signage. A new public safety reception area was

The Heritage Marina Village is a low-rise,high-density mixed-use urban center surrounded by a forest preserve in the
suburban landscape.The masterplan for a 2500-person waterfront community along the Minois/Michigan Canal Heri-
tage Corridor consists of the following;

the Willow Springs area an attractive suburban alternative for living and working.

Prior to the founding of Yas/Fischel Partnership, Stephen Yas was responsible for the Master Plan development
of Cityfront Center,which consists of public spaces,riverfront promenades, 12,000,000 sf of office development
and 6,000 residential units.
The scope of his work included definitive architectural design of the public spaces and streetscapes, river prom-
enade
romenade and lighting, as well as the schematic designs for the residential buildings, a 2,000 room hotel located at
Chicago River and Columbus Drive, and the office towers.

Result
Prior to the founding of Yas/Fischel Partnership,Stephen Yas was Project Designer working on the Museum Campus
Master Plan in conjunction with the design of the proposed 1993 Chicago World's Fair. To create a pleasant pedes-
trian pathway both under and over Lakeshore Drive, Northbound Lakeshore Drive lanes on the East side of the Field
Museum were relocated to the West side. The Campus design included a promontory point for people to enjoy the
expansive view of the city and serve as a central focal space at the cross access of all three museums.
The secret of success of this Master Plan was in the ability to work with several municipal departments including the
City of Chicago, Illinois Department of Transportation, Chicago Park District, World's Fair Committee and the
executive committees of the Adler, Shedd and Field Museums to create a plan that worked both functionally and
aesthetically for all involved. Even though the Chicago World's Fair was never realized, the Museum Campus and
relocation of Lake Shore Drive were complete in 1996.

Prior to the founding of Yas/Fischel Partnership, Stephen Yas
—— was a Project Designer on the 175,000 sf Oceanarium, which
wraps the lakeside elevation of the aquarium's existing building.
The same white Georgia marble, window fenestration and de-
tailing of the original aquarium building is used to create a frame
for the Mammal Exhibit and Performance Building.
Incorporating a Pacific Northwest coastline design, the addition includes whale and dolphin tanks; an underwater
viewing area; amphitheater seating; a library; members' lounge; food service facility; classrooms; and 250 seat
auditorium. The exterior backside wall consists of expansive glass that looks as if it edges up against Lake Michigan
when viewed from inside near the amphitheater,creating a feeling of the mammals existing in an open body of water.
Both interior and exterior traffic and pedestrian circulation patterns were carefully designed to accommodate large
crowd movement.

RE: Library Referenda
Dear Mayor and City Council:
Please be advised that in response to the inquiry presented to the City Council at the April
20,2004 Committee of the Whole Meeting the following constitutes an outline of the
legal process for calling a referenda to levy a tax or increase a current tax levy for
libraries.
In any municipality of 500,000 or fewer inhabitants, the corporate authorities may levy a
tax for library purposes of an amount not to exceed .15% of the value of all taxable
property within the municipality or assessed by the Illinois Department of Revenue.
If the corporate authorities desire to increase the tax rate in an amount not to exceed .60%
of the value of all taxable property within the municipality or assessed by the Illinois
Department of Revenue, the municipality may do so through the enactment of an
ordinance stating the tax rate and directing that the proposition be submitted to the voters
of the city at any regular election. Upon the adopting of an ordinance providing for the
submission of increasing the library tax for maintenance and operation, the municipal
clerk shall certify the proposition to the proper election officials. If the majority of voters
vote in favor of the proposition, the corporate authorities may levy annually a tax for
library purposes at the authorized increase rate.
Additionally, corporate authorities may levy an additional tax of-02% of the value of all
the taxable property in the city, as equalized or assessed by the Department of Revenue,
for the purchase of sites and buildings, for the construction and equipment of building,
for the rental of buildings required for library purposes, and for maintenance, repairs and
alterations of library buildings and equipment.

In any year which the corporate authorities propose to levy such additional .02% tax the
corporate authorities shall accomplish the following:
1. Adopt a resolution determining levy such tax.
2. Publish the resolution at least once in one or more newspapers published in
the city within 15 days of adopting the resolution. The resolution shall contain
the following:
a. The specific number of voters required to sign a petition requesting that
the question of the adoption of the resolution be submitted to the electors
of the city.
b. The time in which the petition must be filed.
c. The date of the prospective referendum.
If within 30 days after publication of the resolution, a petition is filed with the corporate
authorities, signed by electors of the city equal in number to 10%or more of the total
number of registered voters in the city, asking that the question of levying such a .02%
tax be submitted to the electors of the city, the question shall be submitted at an election.
The City Clerk shall provide a petition form to any individual requesting one.
Alternatively, if no petition is filed with the corporate authorities within 30 days after
publication of the resolution, or if all petitions so filed are determined to be invalid or
insufficient the city shall then be authorized to levy the tax. If a majority of votes cast
upon the proposition are in favor of the proposition, the corporate authorities may levy
the additional tax.
As a result of the enactment of the new ethics legislation I would recommend that the
United City of Yorkville Employees and City Council refrain from participating in an
Ad-Hoc Committee to investigate pursuing the Library Referendum. In accordance with
the legislation a"Prohibited Political Activity" includes:
1. Planning, conducting, or participating in a public opinion poll in connection
with a campaign for elective office or on behalf of a political organization for
political purposes or for or against any referendum question.
2. Surveying or gathering information from potential or actual voters in an
election to determine probable vote outcome in connection with a campaign
for elective office or on behalf of a political organization for political purpose
or for or against any referendum question.
3. Soliciting votes for or against any referendum question or helping in an effort
to get voters to the polls.
4. Initiating for circulation, preparing, circulating, reviewing, or filing any
petition for or against any referendum question,
5. Distributing, preparing for distribution, or mailing campaign literature,
campaign signs, or other campaign materials for or against any referendum
questions.
6. Campaigning, managing or working on a campaign for or against any
referendum questions.

At this time I would recommend that after a formal presentation of the referenda
question to the City, that the City vote upon the issue to proceed with the referendum.

RESOLUTION AMENDING THE UNITED CITY OF YORKVILLE
RESOLUTION NO. 99-25
THE UNITED CITY OF YORKVILLE FACADE IMPROVEMENTS AND HISTORIC
PRESERVATION PROGRAM
WHEREAS, the City is desirous of continuing to stimulate commercial growth in
order to increase employment opportunities in the City, to prevent decline in economic
conditions in the City and to enhance the tax base and sales tax revenues of the City; and
WHEREAS, the City has identified that all commercial, business and or
residential buildings built before 1940, within city limits, shall be eligible for a grant in
order to encourage property owners to restore the building to its original architectural
integrity; and
WHEREAS, the aforementioned grant shall be awarded on a priority basis, with
the highest priority being the downtown business district; second priority being property
that face arterial roadways as identified in the United City of Yorkville Comprehensive
Plan; and thirdly, the remainder of city properties.
WHEREAS, business owners, merchants and owners of buildings within the
boundaries of the City have exhibited their desire to improve the appearance of their
buildings by repairing,painting, cleaning and doing other sundry renovations as part of
an overall historical renovation, and not simply routine maintenance or remodeling,
including restoring windows to their original size, removing false fronts and adding
awnings when appropriate; and
WHEREAS, the City has established a Review Committee,to provide guidance
for such improvements and to ascertain which improvements best implement the City's
efforts to improve economic condition within the defined area; and
WHEREAS, the City agrees to set aside a certain amount of money annually to be
used as a grant or grants, to be administered and awarded by the Review Committee, to
business owners, merchants and owners of other buildings within the City who are
engaged in improving their building's exterior appearance and facades, which are defined
as the exterior of the building including both front and back, and have spent, or guarantee
that they will spend, at least 51,000 on said improvements within one fiscal year; and
NOW THEREFORE, be it and it is hereby resolved as follows:

1. That the above recitals shall be incorporated in to the currant Facade Improvement and
Historic Preservation Program and in all other respects said Resolution number 99-25

UNITED CITY OF YORKVILLE
AND TANGLEWOOD
DEVELOPMENTCORPORATION For Recorders Use Only
NOW COMES Tanglewood Development Corporation, an Illinois corporation, (hereinafter
referred to as("Owner-Developer")as owner and developer of certain real property described in the
attached Exhibit"A" (hereinafter referred to as the "Property"),and the United City of Yorkville, an
Illinois municipal corporation (hereinafter referred to as the "City"),who do hereby enter into this
Annexation Agreement,including the various exhibits attached hereto and approved herewith by the
City Council of the City,
RECITALS
1. The parties agree that it is in their mutual best Interest that the Properly be annexed
to the City;
2. The Parties further agree that it is in their mutual best interest that specific
performance standards applicable to the Property's development be established;
3. The Owner-Developer acknowledges that the Property, when developed, will
substantially Impact the City's various services, such as provision of public sewer and water
facilities; and

4, The Owner-Developer has agreed to perform certain conditions substantially above
those requirements otherwise required by the City in its various ordinances.
NOW THEREFORE, in consideration of the foregoing Recitals,the separate provisions of
this Agreement hereinafter set forth and other good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged,the parties hereto agree as follows:
A. The City shall take all actions necessary to and shall enact an ordinance annexing
the Property contingent upon the Property being concurrently zoned as Estate Class One Family
Residential District, By its terms, that Ordinance shall be effective upon the Property becoming
contiguous with no further action required. A true and accurate copy of the proposed Annexation
Plat is attached hereto as Exhibit"B."
B. The proposed plat of subdivision pursuant to which the Owner-Developer intends to
develop the Property is attached hereto as Exhibit"C"(the Subdivision Plan). Except as otherwise
configured on the Subdivision Plat,the minimum lot size and dimensions shall conform to the City's
Subdivision Control and Zoning Ordinances in effect as of the date hereof. Conditioned only upon
the final plat of subdivision being in substantial compliance with the Subdivision Plat,any departures
from lot size and dimension from those currently permitted shall be hereby deemed as approved and
varied and the resulting lot or lots regarded as conforming.
C. Development of the Property shall be conducted in accordance with the Subdivision
Plat, Landscape Plan(Exhibit"D"attached),Preliminary Engineering(Exhibit"E"attached)and Final
Plat to be approved by the County of Kendall and in conformance to those requirements set out in
the Kendall County Zoning Ordinance, Subdivision Control Ordinance, Storm Water Run-Off
Ordinance, City Reimbursement of Review Ordinance City and Infrastructure Ordinances,in effect
at the time of the execution of this agreement, unless specifically varied by this agreement.
0. Owner-Developer agrees to dedicate those public easements set forth on the
Subdivision Plat.
E. Owner-Developer agrees to substantially replicate the easements depicted on the
Final Plat of Subdivision to be recorded with the Kendall County Recorder of Deeds and agrees to
execute any and all easement agreements for the aforementioned utility easements.

F. The City will not require Owner-Developer to annex to Yorkville Bristol Sanitary
District or other applicable sanitary district, unless and until platting or application for a building
permit seeking connection to the City sewer system is sought by Owner.
G. Owner-Developer may, but shall not be required to, connect to the City's sanitary
sewer or water systems, unless and until the same are within 250 feet of the Property.
H. in the event the City's water and sewer service lines are not within 250 feet of the
Property at the time Owner-Developer desires to develop the same,the City hereby grants Owner-
Developer a variance from its Subdivision Control Ordinance for use of private wells and septic
systems. In the event City water and/or sewer services become available within 250 feet of any or
all of the lots to be created through the subdivision approval process, Owner-Developer agrees to
connect to the said available City utility. The cost of Infrastructure to provide any such services
within the Property shall be funded through enactment of a Special Assessment for that purpose,
with the then owners of lots within the Property each paying their proportionate share of said
installation's cost; the terms of that Assessment and allowable costs to be assessed thereby shall
include,without limitation, all consultants'fees and other expenses reasonably Incurred to extend
that service. [Kelly: This language might require technical expansion]
I. In order to facilitate maintenance of all common areas, detention facilities and
common subdivision monument signage Owner-Developer shall form an Illinois Not-For-Profit
Corporation and provide an initial estimated budget, by-laws and assessment terms creating a
mechanism for said open space improvements'maintenance prior to or simultaneous with the first
Final Plat of Subdivision being approved by the County Board.
J. In order to provide for the maintenance of open space and trail areas Owner-
Developer agrees to execute a consent to the creation of a Special Tax Service Area and have
approved Ordinances encumbering all residential units of said subdivision, in the event the
Homeowners Association for Tanglewood Trails Subdivision fails to carry out its maintenance
responsibilities.
K. Owner-Developer shall cause a declaration of covenants,conditions and restrictions
("Declaration")to be recorded against the Subject Property,either in its entirety or incrementally with

each Phase of Development,which shall provide,among other things,for the establishment of an
association of all lot owners within the Subject Property ("Association") and the mandatory
membership of all lot owners in the Association. The cost of carrying and administering the
Common Facilities Maintenance during the Initial Build-Out Period shall be paid through
assessments levied by the Owner-Developer through the Association against the members of the
Association,with any annual shortfall in the monies thereby generated funded by Owner-Developer
or as otherwise set forth in the Declaration. At the end of the Initial Build-Out Period, which shall
automatically occur upon the issuance of not more than eighty-five percent(85%)of the occupancy
permits for all of the dwelling units approved hereunder for development within the Subject Property,
the Common Facilities shall be conveyed to the Association and the Association shall accept title to
the Common Facilities, provided Owner-Developer has properly carried out the Common Facilities
Maintenance prior thereto. The Association shall thereafter carry out the Common Facilities
Maintenance. Owner-Developer shall have no further liability or responsibility for the Common
Facilities Maintenance following the end of the Initial Build-Out Period.

Owner-Developer and Its respective successors,assignees and grantees,shall not

object to and agree to cooperate with the City In establishing a back-up special service area("SSA")
for the Subject Property to be utilized as a secondary funding mechanism for the care and
maintenance of the Common Facilities. Subject to the provisions of Paragraph K of this Agreement,
a Homeowners Association established by the Owner-Developer shall provide for the regular cam,
maintenance, renewal and replacement of the Common Facilities ("Common Facilities
Maintenance"), including, without limitation, the mowing and fertilizing of grass, pruning and
trimming of trees and bushes,removal and replacement of diseased or dead landscape materials,
the repair and replacement of fences and monument signs,the repair and maintenance of private
roadways within the Subject Property so as to keep the same In a clean, sightly and first class
condition. The Homeowners Association shall have the primary responsibility and duty to carry out
the Common Facilities Maintenance ("Primary Responsibility'). In the event the Homeowners
Association fails to carry out its maintenance duties,City,through and under the Back-up SSA shall
assume full responsibility for carrying out and paying for,through assessments levied against all
dwelling units in the Subject Property, the Common Facilities Maintenance ("Secondary
Responsibility')_ The SSA shall provide for the authority of the City to levy up to fifty cents($.50)per
One Hundred Dollars ($100.00) of assessed valuation ('Rate Cap") to fund the payment of the
aforesaid costs and expenses, The City shall utilize the SSA to provide sufficient funds to defray the
costs,including administrative costs not to exceed one hundred and fifteen percent(115%)of such

maintenance costs,thereby reasonably incurred by the City and to establish reserve funds forfuture
repairs and replacements as reasonably determined by the City to be appropriate. Subject to the
provisions of Paragraph K of this Agreement, the Common Facilities shall be conveyed to and
owned by the City so long as the SSA remains in force and effect. In any event, a maintenance
easement ("Common Facilities Maintenance Easement") shall be established over all of those
Common Facilities located on the Final Plat of Subdivision in favor of the City and any future
Homeowners Association which undertakes responsibility for the Common Facilities Maintenance.
The substance of the Common Facilities Maintenance Easement shall be as approved by legal
counsel for the City and Owner-Developer,which approvals shall not be unreasonably withheld.
M. This Agreement and Annexation shall be effective upon Owner-Developer becoming
contiguous to the United City of Yorkville.
N_ Upon annexation,the Owner-Developer will receive police protection, 911 service
and library service as provided by City.
O. The City shall pay the costs of any oversizing of utilities done at Its request.
P. This Agreement shall be binding upon the successors, heirs, and assigns of each
party hereto.
0. If any portion of this agreementwere determined to be invalid the remaining portions
thereof shall be in full force and effect between Developer-Owner and City.
R. The parties mutually acknowledge that the primary purpose of this Agreement Is to
insure the City's ability to annex the Property at such time as it becomes contiguous and the orderly
adoption of City utility usage by the occupants of residences to be constructed upon the Property. In
that regard, it is agreed that, except for reimbursement of the City's consultant and in-house
expenses related to the approval of this Agreement and all expenses incurred as a condition of final
plat approval by the Kendall County Board and the City. the Owner-Developer shall have no
continuing financial obligations to the City as a result of the Property's annexation or provision of

RE: Fox Hill Subdivision, PODs 9 and 10, Yorkville, Illinois
Gentlemen:
Please be advised that Paul Dresden has decided to modify his request with respect to
sales tax rebates for PODs 9 and 10 of the Fox Hill Subdivision, Mr. Dresden prefers to
withdraw at this time his request for specific sales tax rebates and only have an option in the
Amendment to the Planned Unit Development Agreement to pursue such a rebate agreement
with the City of Yorkville in the future when more details are available and users for the
commercial site are known. Mr. Dresden may also forego such a request if other opportunities
are successful_ Consequently, at this time Mr. Dresden is only seeking a rezoning of the subject
property.
Mr. Dresden wishes to continue to cooperate with the City of Yorkville in order to
complete the successful development of Fox Hill and looks forward to continued cooperation
from the City of Yorkville as he investigates and pursues additional opportunities for
development in the City.

Bids were opened at 12:00 pm on Thursday April, 29 2004 for the
concession stand driveway. Bid packets were sent out to Aurora Black Top,
Kendall County Black Top, Novak Paving, Valley Paving, Liberty Paving,
Miller Black Top, and Geneva Construction. We only received one bid for the
project from Aurora Black Top. There bid proposal was as follows;
Aggregate base$1800.00
Preparation of base $ 810.00
Bituminous Surface course at 3" $6650.00
Total Estimated Cost$ 9260.00
My recommendation is to accept Aurora Black Top's bid and take it to the
May, 10th Park Board meeting. We have budgeted $15000.00 under the
Parks expense capital outlay line item Beecher Pathway. I would like to add
an additional $ 2000.00 for possible extras. That would bring the total project
cost to$ 11260.00.

AN ORDINANCE PROHIBITING THE USE OF GROUNDWATER AS POTABLE
WATER SUPPLY BY THE INSTALLATION OR USE OF POTABLE WATER SUPPLY
WELLS OR BY ANY OTHER METHOD
WHEREAS, certain properties in The United City of Yorkville, have been used over a
period of time for commercial/industrial purposes; and
WHEREAS, because of said use, concentrations of certain chemical constituents in the
groundwater beneath the United City of Yorkville may exceed Class I groundwater quality
standards for potable resource groundwater as set forth in 35 Illinois Administrative Code 620 or
Tier I residential remediation objectives as set forth in 35 Illinois Administrative Code 742; and
WHEREAS, the United City of Yorkville desires to limit potential threats to human
health from groundwater contamination while facilitating the redevelopment and productive use
of properties that are the source of said chemical constituents.
NOW THEREFORE BE IT ORDAINED BY THE UNITED CITY OF YORKVILLE;
1. The use or attempt to use as a potable water supply groundwater from with the
corporate limits of the United City of Yorkville by the installation or drilling of wells
or by any other method within a two thousand six hundred foot radius of the property
commonly know as 106 Beaver Street and legally described as Lots 2, 3, and 4 in
Block 2 of Fox Industrial Park Unit 1 in the United City of Yorkville, Kendall
County, Illinois is hereby prohibited.

2. Any person violating the provisions of this ordinance shall be subject to penalties as
provided in section 1-4-1 of this code.
3. Definitions:
a. "Person" is any individual,partnership, co-partnership, firm, company, limited
liability company, corporation, association,joint stock company, trust, estate,
political subdivision, or any other legal entity, or their legal representative,
agents, or assigns."
b. "Potable Water"is arty water used for human or domestic consumption,
including, but not limited to, water used for drinking, bathing, swimming,
washing dishes,or preparing foods.
4. The Mayor of the United City of Yorkville is hereby authorized and directed to enter
into a Memorandum of Understanding with the Illinois Environmental Protection
Agency"Illinois EPA" in which the United City of Yorkville assumes responsibility
for tracking the aforementioned remediation site, notifying the Illinois EPA of
changes to this Ordinance, and taking certain precautions when siting public potable
water supply wells.
5 Any Ordinance or parts thereof in conflict with the provisions of this Ordinance are
hereby repealed to the extent of such conflict.
6. The various parts, sections, and clauses of this Ordinance are hereby declared to be
severable. If any part, sentence,paragraph, section, or clause is adjudged
unconstitutional or invalid by a Court of competent jurisdiction, the remainder of the
Ordinance shall not be affected thereby.

Re: Additional Debt Service Schedules
Dear Traci:
In response to the request of members of the administrative committee we are enclosing
debt service schedules related to the City's $4,000,000 of water projects as follows:
• Level debt service for 20 years. (In response to an inquiry at the meeting, if
interest rates were to increase by 1%, the additional interest costs on this schedule
would be some $510,000 or some $25,000 per year.);
• Back-weighted schedule with interest only for the first three (3) years;
• Back-weighted schedule with interest only for the first four (4) years;
• Back-weighted schedule with interest only for the first five (5) years; and
• Back-weighted schedule with interest only for the first six (6) years.
In order to issue these bonds as alternate bonds the City would need to demonstrate
coverage of 125%. At the present time certain years do not meet this test and therefore,
the City may have to designate an additional revenue source to be pledged to pay debt
service on the bonds.
