Minutes from the July 23, 2007 were approved with correction.
Autumn Creek
Anna Kurtzman reviewed her comments from her August , 2007 memo and asked the applicant
if they had a questions about them. They responded that they did not have any questions and
stated that they could address all of them. William done summarized his comments and the
applicant stated that they would not have any problems making the desired changes. Joe Wywrot
asked if the grading plan would need to be modified to address the stormwater management
concerns. The applicant stated that they did not believe so. Joe then asked if the school had
approved the grading plan and they replied affirmatively.
This project was approved to go to the Plan Commission on September 12, 2007.

Septram
Anna Kurtzman went over her comments and questions.No changes to the Plat of Survey were
needed. Anna did have a number of questions about the Plat of Annexation. She had questions
on Lot 6 and the building on it. Mr. O'Brian said the building encroached on the property when
they purchased the property. It was suggested that a legal description excluding the building and
the surrounding five feet be used to annex the portion of the property without the building. It was
determined that the applicant would need to do some more research on if the alley by Parcel 6
had been vacated and assigned PIN numbers. Parcel 6 acts as the entrance/egress to the bus
parking area. There was some discussion on how the property would be divided and conveyed if
the alley had to be vacated. The staff requested that the applicant do additional research to
determine the ownership status before proceeding. They were informed that the City would need
to have this matter to be resolved by September 14 in order for it to go to the September Plan
Commission meeting.
Fields of Westhaven
Travis went over the comments on their Landscape Plan and the applicant said they would be
able to address all of the staff concerns.Next, Anna went over her three comments and the
applicant stated that they would make all the requested changes.
Bill Dunn brought up a concern about the boundary between the park and school site. He said
that they had to bring utilities to the east and wanted a street extended to the eastern property
line. Dave Mogle stated that he needed street frontage for the proposed park property. The
applicant stated that the school system had told them they needed a minimum of 15 acres and
that determined the boundary between the school and park properties. It was determined the
applicant needed to go back to the school administration to see if the boundary between the park
and scholl could be moved to the north.
Joe Wywrot then suggested that relocating the school sites access points should be discussed. He
suggested that the second point of access to the subdivision be moved to the east to provide
better access to the school site. Joe also said that they should also have engineering plans for
Baseline Road to the subdivision entrance. The applicant was informed that revised plans would
need to be received by 8/31/2007 in order to have time to review them for the September Plan
Commission meeting.
Development Ordinance compilation
Charles Wunder summarized what development ordinances were contained on the distributed
CD. Anna Kurtzman mentioned that a date needed to be added to the disclaimer statement so that
the person looking at the Development Ordinance CD would know when the CD was made and
what ordinances were being used at that particular date.

The Department of Building Safety staff has reviewed the proposed modification to Ordinance 2006-
101 (O'Keefe Annexation Agreement). The proposed amendment would eliminate language
requiring the owner and developer to provide certain storm water conveyances. Department of
Building Safety staff has no objection to the elimination of this language.

Request for Amendment to Existing Annexation Agreement
United City of Yorkville, Kendall County, Illinois.
Dear Mr. Wywrot:
We have reviewed the following materials that were forwarded to us by the City:
D An Application & Petition to Amend Annexation or Planned Unit Development (PUD)
Agreement for O'Keefe Subdivision dated July 31, 2007
D Copy of the executed Annexation Agreement for the O'Keefe Property recorded by
Kendall County on November 7, 2006.
We offer the following comments:
REQUEST FOR AMENDMENT
1. The original Annexation Agreement for O'Keefe Subdivision contains language which
enables commercial developments north of Galena Road to acquire the necessary
easement through the O'Keefe property and Raging Waves property to convey
stormwater to the Raymond Regional Basin. The proposed amendment asks that the
language requiring this easement for the purpose of stormwater conveyance to be
stricken from the original agreement. The removal of said language would effectively
allow O'Keefe Subdivision to utilize all the benefits of the regional basin and at the same
time cut off developers north of Galena, namely the commercial areas that have been
commonly referred to as "Northgate" and "Bristol Bay Commercial", from being able to
gain the same advantage from the regional basin. We feel that allowing this
amendment would be a major departure from the City's regional stormwater plan and
would severely impact the marketability of those properties north of Galena. Without

the conveyance route through the O'Keefe Subdivision, the Northgate and Bristol Bay
commercial areas would need to provide on-site detention basins that would
significantly reduce their profitable land areas.
2. We recommend that the City Attorney review the Annexation Agreements for Northgate
and Bristol Bay (commercial) for commitments that the City may have made previously
regarding the conveyance of stormwater.
CONCLUSION
For the reasons stated above, we do not recommend the approval of the requested amendment.

Zangler Annexation and Rezoning
Staff has reviewed the applicant's request to annex and rezone property at 96 Quinsey Lane (PIN:
02-33-227-001). The property is presently unincorporated with a County zoning designation of A-1.
The petitioner,Anthony and Nicole Zangler, is seeking to rezone the property to the City's Estate
classification. This classification requires, for a detnched_residential house, one acre of land with a
width of 200 feet at the established building line. The subject property consists of 5.7 acres and is
approximately 266 feet wide at the front property line. As such,the property meets the minimum
requirements for the Estate zoning district.

Thomas Alarm System Rezoning Request
The Department of Building Safety staff has reviewed the Thomas Alarm System's request to rezone
property at 711 N. Bridge Street(PIN: 02-28-351-021) from the City's R-2 (One-family Residence
District)to B-3 (Service Business District). Within the B-3 district the following standards apply:
Lot size: Minimum 10,000_sq
The subject property consists of 13,095 sq ft.
Front yard setback: Minimum setback of 50 feet
The existing house is located 68 feet from the front property line.
Side yard setback: Minimum setback of 20 feet
The existing house is 17.6 feet from the northern property line and 28
feet from the southern property line
Rear yard setback: Minimum setback of 20 feet
The existing house is approximately 53 feet from the western (rear)
property line.
Transitional yard setback: Minimum setback of 30 feet
A transitional yard is required to be provided along the western
property line. The existing house is approximately 53 feet from this
property line.
The subject property meets,with one exception,the standards outlined above. As noted,the existing
house does not meet the side yard setback as measured from the northern property line.
Staff does not, at this time, have a geometric plan to determine whether the site meets the minimum
parking requirements.

Wells Annexation
The Department of Building Safety staff is in receipt of an application to annex and rezone property
commonly referred to as the"Wells Property." Along with this application is a Plat of Annexation
dated August 23, 2007 and a proposed annexation agreement (undated). Staff has reviewed these
documents for consistency with the zoning code and building code and offers the following
comments:
1. The petition and agreement indicate that the area being annexed is approximately 250
acres however the plat of annexation indicates that the area being annexed is 232.5 acres.
The discrepancy between these documents will need to be addressed.
2. The 1st Whereas Clause on the top of the 2nd page indicates that the owner is seeking to
rezone the property to R-1 and M-1 with some B-3 uses. The application only lists R-1
as the requested zoning. The discrepancy between these documents will need to be
addressed.
3. The property meets the minimum lot area requirement for R-1 zoned property.
4. There are a number of typographical errors throughout the document(i.e.,
"Ownerowner,""Yorkyille," "Wfiereof').

Re: Virginia Wells Property
Proposed Annexation Agreement

Dear Mr. Wywrot:
We have reviewed the Proposed Annexation Agreement to the United City of
Yorkville for the Virginia Wells Property and offer the following comments:
1. On the second page top paragraph the property is described as "...R-1
One-Family Residence District, M-1 General Manufacturing District with
underlying B-3 Service Business District..." This language does not agree
with the Application which appears to be requesting R-1 One-Family
Residence District.
2. On page 3, section 1-13. School Transition fees for Yorkville School District
are discussed. We do not believe this property lies within the Yorkville
School District. We believe it is in District 88.
3. On Page 4, the language regarding various fees is confusing and seems
to contradict itself in many places with respect to whether or not fees are
to be paid and with respect to the zoning classification. Beyond this
language it should be researched as to whether any of the provisions in
the southwest developer agreements have any impact on this annexation
agreement with respect to possible services and the timing of fee
payment.
4. On page 4, Section 1—B (repeated section number) specifies no
connection to City Sewer or water. If well and septic is contemplated,

minimum lot sizes will need to be 1 acre rather than 18,000 square feet as
required for R-1. Would this development ever be required to connect to
City utilities?
5. The language in Section 1- D regarding Sanitary District fees should be
discussed further. This parcel may not be able to be served by YBSD. If
this development is serviceable, the timing of IPF fees and Annexation
fees should be in accordance with District policies.
6. In Section 1—E and 1-F, we are not certain what motivation there might be
for the City to reimburse the legal and professional fees and costs related
to the annexation process or for the rebating of real estate taxes.
We believe the petitioner's legal counsel should revisit and edit a number of the
sections in the proposed agreement. We did not receive any of the referenced
exhibits and have, therefore, not commented on them. If you have any questions
or require additional information, please contact our office.
