The minutes from the May 24 meeting were approved as corrected. B &P-Rezoning The property is currently zoned M-1. The Moose Lodge bought the property to the east, and there is a flag lot in the rear. The petitioner will draft a development agreement, and attach to the plan for the plan commission meeting. Also a concept site plan is requested by staff,to show this property in context of other sites. Staff is advising R-2 zoning because there are duplexes, and each lot should be a minimum of 15,000 Sq. feet. Density on the comprehensive plan in a transitional neighborhood is 2.25—3.5 units per acre. There will be trails on the south side of Corneils Rd. The petitioner should dedicate a 40 ft. right of way easement from the center line of Corneils Road and a 15 utility easement in addition to the 40 feet ROW. This is scheduled for the July 11 Plan Commission. Bruguglio, Lot 2 Meyers Subdivision—Annexation The property is located on the south side of River Road, and 300 ft. east of Conover property. The north portion of this is being developed by Rush Copley and staff would like the petitioner to consider easements to allow for storm water discharge to the river. The first would be 15 feet wide parallel to the east property line, and the other 50 feet wide (and temporary)parallel to the east property line, allowing for a storm water conveyance pipe from River Rd.right of way to the river. The petitioner would like the city to replenish any trees removed during construction. 1 Joe Wywrot said if a trail was on the north side of River Road would require a 40' easement. A draft annexation agreement will be drafted. This is scheduled for the July 11 Plan Commission. Zangler—1.S Mile Review The property is off the southwest corner of Heartland Circle, and is served by Quinsey Lane. The city is recommending that the petitioner seek annexation with an R-1 zoning classification, which requires minimum lot size of 18,000 sq feet and 100 feet building setbacks. The petitioner will schedule a pre-application meeting and draft an annexation agreement. The petitioner may subdivide with 1 lot to the front, and 3 to the back. There is a possibility of an east/west street, connecting to Bruell Street to the west. There could be interest in putting a trail on top of the easement,running N-S, and extending into the Woodworth property. The petitioner should check the access easement to Quincey Lane and confirm any private streets in the subdivision. Kalant—Rezoning The existing business on Rt. 47 does not meet setback requirements for the proposed B-2 zoning. Staff is suggesting upon approval of the zoning change,this building be considered a non-conforming structure. A new building should not be built without applying for a variance. The parking lot access needs to be okayed by IDOT. The petitioner should verify the square footage of the house to calculate the number of parking stalls. There will be a 6'- 8' wide carriage walk along Rt. 47. The petitioner should prepare a site and landscaping plan before rezoning. This is scheduled for the July 11 Plan Commission. Fields of Westhaven—Preliminary Plan Bill Dunn stated the 16" stub out of Bailey Meadows should come across the site and the 16"main coming down Beecher Rd. should be extended. The sanitary comes down Beecher to the south. The transportation plan shows Beecher Rd. with a 100' right of way. All intersecting right of ways lines should have a minimum 25-foot radii. Anna Kurtzman states that this area is annexed and subject to an agreement. Fifty four lots do not meet the minimum lot requirements of the established zoning as R2 PUD, so the agreement needs to be amended. To conform, staff is advising an amendment, where all lots need to be a minimum of 12,000 sq. feet and a minimum of 80' wide. The city is asking for clarity on who maintains the landscape easement. Joe Wywrot is asking for an additional access point along Baseline Rd. He suggested moving the school site north, with a frontage on Silverton. This would give the city two points of ingress and egress. A roadway would connect Silverton with Baseline at the northeast corner of this development. Staff is recommending of an additional 5 acres for a school/park site. Bailey Meadows to the east has a 5 acre park, and a 5 acre park was planned for this development, for a total of a 10 acre park. The school district needs 15.01 acres for a 2 site. Staff is recommending the road coming west from Bailey Meadows be extended to make a natural separation between the park and school site. There is a 10' trail along the west side of(Aspen)Beecher Rd. Currently there is no proposed trail east from Baseline Rd. There is a dedicated right of way along Baseline Rd. so a trail, in lieu of sidewalk,was the direction Dave Mogle believes the city will go. There are no credits offered for improvements to Baseline Road currently in any annexation agreements. A full roadway improvement to the easement was proposed by Joe Wywrot, similar to one completed by the developer at Cannonball Estates along Faxon Road. The developer should obtain a right of way across the ComEd property going to the south along(Aspen)Beecher Rd. The developer will meet with Dr.Engler. The petitioner would like to continue without an amendment to the annexation agreement. This will be at the July 26 Plan Council meeting. Grande Reserve Unit 28—Preliminary Plan This plan contains the same number of units approved in the annexation agreement. Bill Dunn's comment#4 will be struck from the record. The developer will address Laura Haake's comments#1-4 on the final landscaping plan. Onsite buffer requirements are addressed in the annexation agreement and the developer will abide by these. Travis Miller will check the annexation agreement regarding Mill Rd. buffer landscaping and the 30' buffer yard around the storm water basin(items#5 and#6.) Regarding Anna Kurtzman's comments, Rick Murphy showed the minimum setback distance data table to staff. The design standards and setback verbiage are copied from the annexation agreement and comply with standards. The developer will add a diagram of the buildings showing the side and front yards to the plan. There are 3 parallel parking spaces north of building#17, so the total spaces equal 67 (comment#3). The developer is adding sand volleyball off Big Rock Boulevard. Sidewalks will be on one side of the street only. The developer pointed out additional parking north of buildings 11-16. In addition there is a walk through between buildings 13 and 14 connecting to the interior bikepath. The developer is open to striping this pathway. Private roads will be on private lot easements dedicated to the association. Dave Mogle would like trail in lieu of sidewalk on the south side of Mill Road,to the YMCA then across to the regional park. Funding will be researched—it could be built as part of the Mill Road project or the developer could build the trail. Joe Wywrot questioned if the annexation agreement needs to be amended because of the change in the order of the roads being constructed. Bristol Ridge Road and Freedom Place projects depleted monies in the road fund. Funding is needed for Mill Road. John Philipchuck read from the annexation agreement regarding Mill Rd. and Kennedy Rd. north of the railroad: "within 1 year of issuance of 500 building permits in Units#1,2,3,4,5; or sooner if funds in the Grande Reserve road fund are available". Currently about 150 building permits (approximately)have been issued. 3 This is scheduled for the July 11 Plan Commission. Rob Roy Falls—Annexation and Concept PUD Per Travis Miller,the staff will prepare comments on the annexation agreement for the public hearing, which is scheduled on July 11th at plan commission, and City Council on July 24. It is targeted for EDC/COW in August. Mike Cook and the developer, at this time, have no comments or discrepancies regarding Anna Kurtzman's memo. The transfer of land, 3 acres west of Beecher, is very crucial to this plan. The city needs to ok the location of the police station,which is shown too far west on this plan. Rob Roy attorneys are preparing documents regarding conveyance of this property. The developer also has reviewed documents for Rt. 34 conveyance plats and Beecher Rd. easements,prepared by Smith. Water mains will come through Kendall Marketplace. There is a 16' available near out lot 0 and a 12' on the north east side near the proposed police station area. There is a need for a pressure reducing valve station in the western part of this development, or perhaps even further west. Annexation agreements negotiated will determine the proportionate shares for the developers. There is a stub needed to Cobblestone or at the west property line extended to the south. All sanitary west of the creek will then go to the south. The pump station is not temporary, but a permanent solution should be determined. Mike Cook needs engineering information regarding stubs on Cobblestone plans, and a main connecting in Fox Hill, serving as a tributary to the lift station. Sexton offered to front fund the temporary signalization, as well as the 4 legged sign studies. Staff will make a final determination on signalization and funding and draft an agreement, which would be independent of the annexation agreements. Between out lots H and I, they proposed a right in, right out, left in to IDOT. The developer needs traffic studies reports by Cobblestone. Joe Wywrot wonders if IDOT will review all four traffic signals (west of Beecher Rd.) as one, in order to approve any one location. If so,the timing for developers' submittals to IDOT, annexation agreements, and funding become increasing important to completion of the all of the Rt. 34 corridor projects. There is a Nicor 8"gas main along Rt. 34 and an AT&T transcontinental fiber. Traffic studies must be complete before IDS are completed. The developer will check on this. The city extension of Beecher Rd. to Faxon Rd. will be an off site improvement. On site will be an extension of Faxon Rd. west, which clips the northwest corner and comes south of the tracks. The development would like an alignment sketch. This road gives an additional access to the sr. living area. There is a trail to the west of Beecher Rd. and trails coming from Cobblestone to the creek. This should cross the creek. Staff is asking for a sidewalk north of the detention,behind lots P and Q, with a trail to the shopping area. Rob Roy Club trail to the Rob Roy Creek is a possibility and will be discussed at the park board meeting. A frontage road off Beecher Rd. is shown, and Mike Cook will address the fact that this is too close to exit from the club. All roadways on site are private. Sidewalks north of Rt. 34 and 10' trail west side of Beecher will be provided. 4 The water fall is a mechanical system and the lower basin will release near the frontage road. The police station access would be on Beecher Rd. and a stub would be on the southeast corner. There is a HOA park in the age appropriate section and no credit given for that. The developer advised the interceptor sewer will remain, and no changes are being sought through YBSD. This will be presented at the July 11 Plan Commission and July 24 City Council. Step 3: For Preliminary Plans only;Park Board Planning Meeting: The Park Board makes recommendations on any Park Sites included in the development. The Park Board Planning Meeting is the fourth Monday of each month at 7:00 p.m. at the Riverfront Building, 301 E.Hydraulic Street. Step 4: Plan Commission: The Plan Commission meets the second Wednesday of each month at 7:00 p.m. in the Council Chambers at City Hall. The Plan Commission will make a recommendation for the City Council's consideration. The Plan Commission consists of 10 members appointed by the Mayor, the City Attorney and City Land Planner. This session is to discuss and consider recommendations of prior committee meetings. Step 6: City Council: The City Council meets the second and fourth Tuesdays of the month at 7:00 p.m. in the Council Chambers at City Hall. This is where all City Council voting takes place. If this project has included an annexation and/or zoning petition, a Public Hearing will be held at this time with notice given by publication. Any annexation agreement,PUD agreement or development agreement must be signed by the Petitioner prior to being voted on by the City Council. Prior to the recording of the final plat,the petitioner must pay the Administration Fee. This is equal to 1.75%of the approved engineer's estimate of construction costs of land improvements, including but not limited to all public improvements to be dedicated to the City, mass earth grading, and quasi-public improvements to be maintained by the homeowner's associations such as private storm sewer,parking areas, and trails. Step 8: Final Plat recording instructions: Once the final plat is approved by the City Council and all required documents,bonds, and letters of credit are submitted to the City,the final plat may be recorded with Kendall County. The next step is to have six paper prints made and return to the Kendall County Recorder's office for recording. Kendall County requires the mylar and four paper copies. The City of Yorkville requires that you submit two recorded paper copies to the Deputy Clerk. Any copies you may require would be in addition to these. The design should be revised to provide a septic field system or other mechanical system acceptable to the County Health Department for servicing indoor toilets, sinks, laboratory sinks, safety shower and eyewash facilities, etc. 11.A copy of the proposed well and septic plans should also be submitted to the Kendall County Public Health Department for their review and approval. 12.Signage (warning and informational) should be provided at all future roadway connection locations. Warning signage should be added to the onsite drive that dead ends into the drainage swale that runs along the north of the site. (SHEET 5) GRADING & EROSION CONTROL PLAN 13. Additional spot elevations should be added along the onsite road leading to the crusher location to demonstrate that the City grading requirements are met. (SHEET 10) DETAILS 20.A concrete curtain wall detail should be added to the plans in the proposed stormwater basin at the proposed overflow location in accordance with the City requirements. (SHEET 13) 21.IDOT Standard Detail 606201 that is referred to on sheet 7 should be added to the plans. (SHEET 13) 22.The Trench Bedding/Backfilling Cross-Section detail should be revised to specify CA-7 in lieu of CA-6. (SHEET 13) DETAILED CROSS-SECTIONS 23.The Typical Cross-Section thru Retention Basin (XS-4) should be revised to show a maximum slope of 5:1 between the 100-year HWL and the normal water level. (SHEET 14) STORMWATER MANAGEMENT REPORT 24.It appears that there is a depressional area located on the northeast corner of the site, with approximately 8.75 acres of onsite tributary area. This area should be analyzed in the existing conditions in order to determine the amount of additional volume for compensatory storage that will be required in the proposed detention basin. 25.The Engineer should clarify the storm durations used in the "Prop-Onsite" HEC-1 model. The input table states that the model was run for the 20 minute through the 12 hr events, but it appears that the peak times of the output data indicate that the 6, 12, 24, 48, and 72 hour storm events were modeled. 26.The "Manning's For Channels" swale design calculations should use the largest peak flows (critical events) from the HEC-1 models in order to determine the depth of flow through the swale. The majority of the critical events appear to be the 1-hr events. The swale calculations will be reviewed once the critical events are used. A direct connection into the existing drain tile system is not permitted. Instead, the Engineer should consider running the outlet pipe south to "Future Road A", and then east along this future ROW, to Rob Roy Creek (running parallel to the existing 24" outfall). If this option is considered, the storm sewer system should be designed for full future build out conditions of all the adjacent tributary sites, to ensure ample capacity for future situations. 29.The configuration of the restrictor manhole should be revised to show all of the multi-stage orifices placed within a baffle wall, instead of placing the 100- yr restrictor orifice plate over the outlet pipe. In addition, the invert of the 2 / 25-yr orifice should be equal to the normal water line (NWL) elevation of 640.00', the 100-yr orifice should be placed at the 25-yr high water line (HWL), and the top of the wall should be at an elevation of 644.00'. 30.The "Storm Restrictor Access Manhole" detail should be revised to show a Neenah 1530 frame or equal, instead of the Neenah 1030 frame. 31.The detention basin's overflow curtain wall should be located 6" above the HWL of the detention basin. In addition, the requested detail should indicate the curtain wall length, the depth of flow, and the total flow rate over the structure. 32.The "Temporary Water Quality Riser" detail should be revised with elevations and tag numbers specific to this site. The invert and top of pipe elevations are currently located below the NWL of the wet detention pond, and are too low to be able to drain to the outlet by gravity. - 33.Due to the materials that are proposed to be stored on site (bituminous oil, gasoline, and diesel fuel), an appropriately sized oil / gas / water separator should be placed along the storm sewer. 34.The Engineer should revise the upstream manholes, in the gravel areas of the onsite storm sewer system, as catch basins in order to prevent the first flush contaminants from reaching the detention basin. PRELIMINARY/FINAL PLAT OF SUBDIVISION 35.AII easements should be Public Utility and Drainage Easement and abbreviated as P.U.&D.U. 36.The stormwater basin should be within a Stormwater Management Easement (S.M.E.). Plan for The Shoppes South of the Fox prepared by Schoppe Design Associates, Inc. consisting of one (1) sheet dated April 27, 2007. • Aerial Exhibit for The Shoppes South of the Fox prepared by Schoppe Design Associates, Inc. consisting of one (1) sheet dated April 27, 2007. This Concept Plan is similar to the previous submittal and consequently yields similar review comments. They are as follows: 1. Coordination with the Illinois Department of Transportation (IDOT) will be required with respect to access locations and required roadway improvements along Route 71 & 126. 2. This project falls within two pressure zones (Zone #3 and Zone #4) in the City's water distribution system. Those buildings constructed at an elevation of 715.00 or below would generally fall within the lower pressure zone. As this project moves into preliminary engineering, the configuration of water mains in each of the zones will need to be carefully planned. It may be necessary to install a pressure reducing valve station within this project to separate the two zones. Alternatively, if there are relatively few buildings established below the 715.00 elevation, individual pressure reducing valves installed on each building could be considered. The City's overall water system plan projects the need for a 16-inch water main along the Route 71 frontage as well as the Route 126 frontage. The final sizing and location of water mains in this development should be determined during the preliminary engineering phase. The developer's methodology for addressing wastewater conveyance seems reasonable. It should be noted, however, that there will be competition for sanitary sewer capacity with the Edward Hospital & Health Services development located in the northwesterly quadrant of IL127 & IL71. Sanitary sewer planning and design should be further developed at the preliminary engineering phase of this development. 4. The preliminary stormwater management report should be provided as part of the preliminary engineering submittal and should include descriptive narrative and supporting calculations. A hydrologic model reflecting the condition of multiple basins linked together should be used in lieu of modeling one large basin as a sum of the smaller basins. A wetland delineation report should be provided to the City for its review. 5. The roadway system appears to include a mix of private and public roadways. The proposed alignment of Pennman Road appears to be in general conformance with the City's Transportation Plan. Design of these roadways (public and private) should be in accordance with the City's Standard Specifications for Improvements as presented in the Subdivision Control Ordinance. CONCLUSION We recommend approval of the concept P.U.D. plan and encourage the developer to address the water, sewer and transportation issues as early in the preliminary engineering process as possible. Staff notes (as outlined below) a couple of concerns that are not directly related to zoning, however, could create problems with issuing building permits. 1. There are access easements throughout the document however staff did not locate any language granting access rights. The provision for granting access needs to be included with this plat. 2. The conveyance note located north of Route 34 needs to be completed. 3. Staff reviewed a number of documents in April 2007, including several plats of conveyance. The graphic depicted on the plat of conveyance (dated 3/5/07)along Lot 1 differs from what is reflected on the Plat of Subdivision. The 3/5/07 plat of conveyance is rectangular however what is reflected on the plat of subdivision flairs at the eastern end. The two documents need to match. 4. In April staff reviewed a plat of conveyance for Lot 2 (dated 3/5/07). This conveyance is not noted on the plat of subdivision. Why not? Final PUD—Rush Copley (Revision date: 5/16/07) Staff does not recommend approval of the Final PUD for the following reasons: 1. There is an existing 20 foot wide utility easement that bi-sects this property. At least two buildings are proposed to be located on top of this easement(the parking garage and one of the retail/office buildings). Buildings cannot be located on top of utility easements. Approving the Final PUD with building locations is approving the location of the buildings. Staff understands that the applicant is aware that the utilities within this easement will need to be moved and the location of the easement modified accordingly. Until this occurs staff cannot approve the final PUD. Staff also understands that the applicant needs the final PUD approved in order to proceed with developing the site. A possible solution to this impasse might be to approve the PUD in stages(phasing). C. Wunder Rush Copley June 10, 2007 Page 2 of 2 2. In Rebecca Houseman's April 13, 2007, memo she noted that additional accessible parking spaces would be required to be located in Parking lot# 5. The applicant has made an argument that placing accessible parking stalls within this lot would be impractical and against various sections of the Illinois Accessibility Code as the stalls would not be near an accessible entrance to the hospital. Ms. Houseman made an assumption that there would be employee entrances to the hospital and/or power plant from Lot 5 and that these entrances would be designed to be accessible to the disabled. The applicant should verify the type of entrances that will be provided to the hospital and power plant. Site Signage (Revision date: 4/26/07) The applicant has noted that they need a variance from the sign code regarding the height of the main monument sign(at the northeast corner of Lot 1). The sign code states that the maximum height of a monument sign is 6 feet, measured from grade. The letter indicates that the sign is 8 feet high. The graphic shows the sign overlooking a pond and is 7 feet high from the waterline. The difference between these two documents should be clarified. Once clarified the request for the variance should be included in the staff report to the City Council so that the variance can be rolled into the final PUD approval. Final PUD Landscape Plan(Revision date: 4/26/07) Width of buffer yards were not included. Plat of Easement(Revision date: 5/16/07) Staff notes that there two documents that conflict with one another. The plat of easement is attempting to establish an easement area for a monument sign. The 5/16/07 final plat of subdivision establishes a non-easement area in the exact same location as the sign easement. As the purpose of this area is to erect a sign, and no rights are being transferred, staff believes that the plat of easement is not necessary. However, if the applicant disagrees and wishes to proceed with a separate plat of easement staff notes that the plat of easement must have easement provisions included on the plat(currently there are no provisions listed establishing rights). Staff also observes that the final plat of subdivision would need to be revised to note the separate plat of easement. Plat of Dedication(Revision date: 5/16/07) Staff has no comment regarding this document. Plat of Conveyance(Revision date: 5/16/07) Staff has no comment regarding this particular document. Staff does note however that the plat of conveyance does address item#3 in Anna Kurtzman's June 25, 2007, memo.
