The minutes were approved as presented.
New Business:
1. PW 2018-08 Snow Operations Report
Mr. Dhuse said 2,234 miles were driven in the first 3 days of a recent snow storm. There were also
some mailboxes damaged and there was a brief discussion on money paid to mailbox owners in other
towns Alderman Tarulis noted that the Post Office was backing down on a proposal to place 5-6
cluster mailboxes in new areas being built and instead will only have 2.
2. PW 2018-09 Bristol Bay Unit 3 – Maintenance Bond Release
Mr. Sanderson reported the improvements were accepted in Bristol Bay Unit 3 in January and he
recommended the release of the bonds. This moves to the consent agenda.
3. PW 2018-10 Galena Road – Transfer of Easement for Right of Way to Kendall County
The city and county had an IGA regarding improvements which also involved some funding. The city
agreed to dedicate some right of way and this is the formal dedication. It is not known when the bridge
on Galena will be closed for repairs. This moves to the consent agenda.

4. PW 2018-11 Wrigley EDP Project – Change Order No. 5
This is the finalization of the contract and the balancing change order reflects a decrease of $5,900.
Approval is recommended and this moves to the consent agenda.
5. PW 2018-12 Fountain Village – Completion of Improvements – Bid Award
Funding was obtained to complete Fountain Village punchlist items. The job was awarded to the low
bidder, Wilkinson Excavating from Somonauk, in the amount of $130,455. Since it was well below the
estimate, Mr. Sanderson recommended contract approval. The committee agreed and this item moves
to the consent agenda.
6. PW 2018-13 Caledonia Warranty Bond Period
Improvements were accepted February 2017 and a one year maintenance guarantee was provided.
Three items on the punchlist cannot be completed until the weather improves and the guarantee expires
at the end of the month. Mr. Sanderson outlined 3 options and the option chosen was for a new letter
of credit for $60,000 with an expiration date of July 1. The committee and Mr. Guerard approved of
this option and it moves to the consent agenda.
7. PW 2018-14 Kennedy Road – ITEP Authorizations Nos. 4 and 5
Mr. Sanderson said #4 was for relocation of warning signs at a cost of $770. Change order #5 was for
the addition of a power pole and street light near the park entrance at a cost of $2,343.35. This was
approved and moves to the consent agenda.
8. PW 2018-15 Federal RTP Grant – ComEd/Fox Road Trails
Ms. Willrett presented two proposals for grant applications due March 1. Public Hearings will also be
held since they are new trails. She said there is a good chance the city could receive the grants and it
will take a year for the decision. Mr. Olson added these applications “piggyback” on the ITEP
application and there is a possibility of receiving 2 grants. This moves to the Council consent agenda
on February 27th. If the city rejects the grant there is no penalty.
9. PW 2018-16 Supplemental MFT Resolution for Salt Purchase
Mr. Dhuse said the city needs more road salt since 400 tons were used in the previous week, leaving
200 tons. He wishes to purchase as much as possible since the price is good at $48.05 per ton. He
thinks the cost will increase next year. Storage is an issue, but he said it would be placed in a lean-to or
under a tarp. The committee approved and this moves to the consent agenda.
10. PW 2018-17 Route 71 – City/State Agreement
This agreement is for the eastern leg of the improvements starting at Rt. 47 to Rt. 126, but not
including the Rt. 47 & 71 intersection. Mr. Olson added this includes half of the Rt. 71 watermain
project. The cost of the watermain project will be about $200,000 less than thought. Part of the
infrastructure in Raintree Village and Fox Highland subdivisions will be used as well as other new
infrastructure to help reduce costs. The total cost will be split among various funds and done in phases.
As a side note, Alderman Funkhouser inquired if the city can receive any reimbursement for the
emergency light pre-emption service used by BKFD, but not by the Police Department. Mr. Olson said
the city had paid for it at 100% (cost $12,000) and it was an elected purchase. He said that BKFD
could be asked for reimbursement.

11. PW 2018-18 Route 71 Improvements – Water and Sewer Update
This was discussed in #10. This update includes exhibits and shows what has been done. This item
moves to the consent agenda.
12. PW 2018-19 US Route 34 Improvements (Center to Eldamain) – Noise Wall Texture and Color
Selection
The city has choices for color and texture regarding the noise and retaining walls. The walls are
needed based on an analysis from calculations that were done. After discussion, the committee
decided on the least expensive options. For the noise wall, they chose option #1 texture with buff/beige
color and the retaining wall should match the wall on Rt. 30. This moves to the consent agenda.
13. PW 2018-20 YBSD Capacity and Communications
Ms. Willrett said that YBSD had contacted her regarding the permit issues with some of the industrial
users such as Aurora Textiles. YBSD is working with the users to pre-empt equipment failure.
Recognizing the growth in Yorkville, YBSD is applying for a pre-treatment program to be able to
accept larger capacities. A staff meeting was also held with YBSD and they confirmed they are 2/3 full
with hydraulic capacity and ¾ full of biological capacity. She said population projections will be used
for future growth plans and they are looking at fee structures and other charges leading to a rate study.
That study will be shared with the city.
Ms. Willrett said the city also asked YBSD what type of users YBSD would like to see. Those users
would be agricultural, microbrewery, distilleries. High water users would be more difficult. New
technologies will be installed to improve capacity, however, they are not yet approved by the IEPA.
Quarterly update meetings with the city will be held.
Alderman Koch asked how the ADM project would have been handled if they had moved into the city.
Ms. Willrett said many industrial users haul their wastewater off-site and the cost of removal depends
on various factors. Mr. Koch asked if a holding tank could be installed on theAurora Textiles site.
Alderman Frieders emphasized that the city needs notification in cases such as Aurora Textiles which
was brought to light in a meeting last month.
Additional Business: (out of sequence)
Alderman Frieders said the road drop-off is dangerous at the curve on Cannonball by the church. He
asked if a guardrail could be installed as a visual barrier. In general, cold patching will be done this
year. In another matter, he asked if there will be a u-turn location on Rt. 34 east of Rt. 47 by the new
Salerno's. Mr. Olson believes the current turn area will remain and Mr. Sanderson will verify.
Alderman Milschewski thanked Public Works for the blinking stop sign at Heustis and Van Emmon. A
citizen had asked her if all Yorkville trucks are lettered. They are all lettered, however, some school
trucks look similar. The citizen also asked which budget pays for projects being done by Public Works
for the Parks & Rec and if gas costs are split. While salaries are not cross-coded, gas costs are split
and other costs depend on the project.
Alderman Koch reported the street light on Hawthorne Ct. works intermittently.

Old Business:
1. ADM 2017-70 Building Conditions Survey Results
Ms. Willrett reported on the old jail and Beecher Concession Stand.
A structural study was recommended for the jail which would need extensive repairs. The repairs are
TIF-eligible. Parts of the facility could not be entered due to deterioration. Staff is requesting Council
direction and would like to see a potential partnership within the community. Ms. Milschewski noted
there is an identical building in southern Illinois. She said the jail is part of Yorkville's history and she
would like to see it preserved possibly with a fundraiser. Ms. Willrett noted that a facilities manager
will soon be hired, who could study the building and possibly go out to RFP.
The Concession stand has extensive use April through October and only needs minimal maintenance
totaling $565 which staff recommends.

February 17, 2018
A full salt crew of 10 drivers were called in to salt a pass in each direction. The crew worked
from 5:00pm-7:30pm
February 21, 2018
Snow and ice were predicted, but never really came to fruition. We did have a full crew here
from 5:00am – 7:00am to salt all city streets. We only needed 3 trucks to go check all the streets,
so the rest of the crew salted sidewalks and parking lots. Once that task was completed, they
started their day early.

IDOT has determined that the proposed connection is acceptable and they have issued a draft

Summary
Approval of an engineering agreement with EEI for design and construction engineering related
to the Fox Highlands watermain improvements (Route 71 expansion).
Background
This item was discussed at the last Public Works Committee meeting. The committee reviewed
a plan from staff to save costs on Route 71-related watermain improvements but completing
improvements within the Fox Highlands subdivision. The committee also reviewed and recommended
for approval the Route 71 expansion agreement. Accordingly, EEI has submitted an engineering
agreement for our consideration for the design and construction of the Fox Highlands related part of the
project.
The attached contract contains a $29,600 fixed cost for design engineering only. Construction
engineering will be paid on an hourly basis and is estimated to cost $32,217, plus $4,480 in direct
expenses. These amounts are included in the FY 19 budget proposal. Construction will occur based on
the timing of the Route 71 expansion project, but will generally occur in mid-2018 at the start of the
expansion project.
Recommendation
Staff recommends approval of the engineering agreement with EEI for design and construction

Professional Services Agreement - Design and Construction Engineering
THIS AGREEMENT, by and between the United City of Yorkville, hereinafter referred
to as the "City" or “OWNER” and Engineering Enterprises, Inc. hereinafter referred to as
the "Contractor" or “ENGINEER” agrees as follows:
A. Services:
ENGINEER agrees to furnish to the City the following services: The ENGINEER shall
provide any and all necessary engineering services to the City as indicated on the
included exhibits. Design and Construction engineering will be provided for
approximately 1,000 linear feet of 8-inch water main improvements within the Fox
Highlands development as generally shown in Exhibit 5. Engineering will be in
accordance with all City, Standard Specifications for Water and Sewer Construction in
Illinois, Illinois Department of Transportation, and Illinois Environmental Protection
Agency requirements.
B. Term:
Services will be provided beginning on the date of execution of this agreement and
continuing, until terminated by either party upon 7 days written notice to the non-
terminating party or upon completion of the Services. Upon termination the ENGINEER
shall be compensated for all work performed for the City prior to termination.
C. Compensation and maximum amounts due to ENGINEER:
ENGINEER shall receive as compensation for all work and services to be performed
herein, an amount based on the Estimate of Level of Effort and Associated Cost included
in Exhibit 3. Design Engineering will be paid for as a Fixed Fee (FF) in the amount of
$29,600 and Construction Engineering will be paid for Hourly (HR) at the actual rates for
services to be performed, currently estimated at $32,317. Direct expenses are estimated at
$4,480. The hourly rates for this project are shown in the attached 2017 Standard
Schedule of Charges (Exhibit 6). All payments will be made according to the Illinois
State Prompt Payment Act and not less than once every thirty days.
D. Changes in Rates of Compensation:
In the event that this contract is designated in Section B hereof as an Ongoing Contract,
ENGINEER, on or before February 1st of any given year, shall provide written notice of
any change in the rates specified in Section C hereof (or on any attachments hereto) and
said changes shall only be effective on and after May 1st of that same year.

E. Ownership of Records and Documents:
ENGINEER agrees that all books and records and other recorded information developed
specifically in connection with this agreement shall remain the property of the City.
ENGINEER agrees to keep such information confidential and not to disclose or
disseminate the information to third parties without the consent of the City. This
confidentiality shall not apply to material or information, which would otherwise be
subject to public disclosure through the freedom of information act or if already
previously disclosed by a third party. Upon termination of this agreement, ENGINEER
agrees to return all such materials to the City. The City agrees not to modify any original
documents produced by ENGINEER without contractors consent. Modifications of any
signed duplicate original document not authorized by ENGINEER will be at OWNER’s
sole risk and without legal liability to the ENGINEER. Use of any incomplete, unsigned
document will, likewise, be at the OWNER’s sole risk and without legal liability to the
ENGINEER.
F. Governing Law:
This contract shall be governed and construed in accordance with the laws of the State of
Illinois. Venue shall be in Kendall County, Illinois.
G. Independent Contractor:
ENGINEER shall have sole control over the manner and means of providing the work
and services performed under this agreement. The City’s relationship to the ENGINEER
under this agreement shall be that of an independent contractor. ENGINEER will not be
considered an employee to the City for any purpose.
H. Certifications:
Employment Status: The Contractor certifies that if any of its personnel are an employee
of the State of Illinois, they have permission from their employer to perform the service.
Anti-Bribery : The Contractor certifies it is not barred under 30 Illinois Compiled
Statutes 500/50-5(a) - (d) from contracting as a result of a conviction for or admission of
bribery or attempted bribery of an officer or employee of the State of Illinois or any
other state.
Loan Default: If the Contractor is an individual, the Contractor certifies that he/she is not
in default for a period of six months or more in an amount of $600 or more on the
repayment of any educational loan guaranteed by the Illinois State Scholarship
Commission made by an Illinois institution of higher education or any other loan made
from public funds for the purpose of financing higher education (5 ILCS 385/3).

Felony Certification: The Contractor certifies that it is not barred pursuant to 30 Illinois
Compiled Statutes 500/50-10 from conducting business with the State of Illinois or any
agency as a result of being convicted of a felony.
Barred from Contracting : The Contractor certifies that it has not been barred from
contracting as a result of a conviction for bid-rigging or bid rotating under 720 Illinois
Compiled Statutes 5/33E or similar law of another state.
Drug Free Workplace: The Contractor certifies that it is in compliance with the Drug
Free Workplace Act (30 Illinois Compiled Statutes 580) as of the effective date of this
contract. The Drug Free Workplace Act requires, in part, that Contractors, with 25 or
more employees certify and agree to take steps to ensure a drug free workplace by
informing employees of the dangers of drug abuse, of the availability of any treatment or
assistance program, of prohibited activities and of sanctions that will be imposed for
violations; and that individuals with contracts certify that they will not engage in the
manufacture, distribution, dispensation, possession, or use of a controlled substance in
the performance of the contract.
Non-Discrimination, Certification, and Equal Employment Opportunity : The Contractor
agrees to comply with applicable provisions of the Illinois Human Rights Act (775
Illinois Compiled Statutes 5), the U.S. Civil Rights Act, the Americans with Disabilities
Act, Section 504 of the U.S. Rehabilitation Act and the rules applicable to each. The
equal opportunity clause of Section 750.10 of the Illinois Department of Human Rights
Rules is specifically incorporated herein. The Contractor shall comply with Executive
Order 11246, entitled Equal Employment Opportunity, as amended by Executive Order
11375, and as supplemented by U.S. Department of Labor regulations (41 C.F.R. Chapter
60). The Contractor agrees to incorporate this clause into all subcontracts under this
Contract.
International Boycott: The Contractor certifies that neither it nor any substantially owned
affiliated company is participating or shall participate in an international boycott in
violation of the provisions of the U.S. Export Administration Act of 1979 or the
regulations of the U.S. Department of Commerce promulgated under that Act (30 ILCS
582).
Record Retention and Audits: If 30 Illinois Compiled Statutes 500/20-65 requires the
Contractor (and any subcontractors) to maintain, for a period of 3 years after the later of
the date of completion of this Contract or the date of final payment under the Contract, all
books and records relating to the performance of the Contract and necessary to support
amounts charged to the City under the Contract. The Contract and all books and records
related to the Contract shall be available for review and audit by the City and the Illinois
Auditor General. If this Contract is funded from contract/grant funds provided by the
U.S. Government, the Contract, books, and records shall be available for review and
audit by the Comptroller General of the U.S. and/or the Inspector General of the federal

sponsoring agency. The Contractor agrees to cooperate fully with any audit and to
provide full access to all relevant materials.
United States Resident Certification: (This certification must be included in all contracts
involving personal services by non-resident aliens and foreign entities in accordance with
requirements imposed by the Internal Revenue Services for withholding and reporting
federal income taxes.) The Contractor certifies that he/she is a: x United States Citizen

I. Indemnification:
ENGINEER shall indemnify and hold harmless the City and City’s agents, servants, and
employees against all loss, damage, and expense which it may sustain or for which it will
become liable on account of injury to or death of persons, or on account of damage to or
destruction of property resulting from the performance of work under this agreement by
ENGINEER or its Subcontractors, or due to or arising in any manner from the wrongful
act or negligence of ENGINEER or its Subcontractors of any employee of any of them.
In the event that the either party shall bring any suit, cause of action or counterclaim
against the other party, the non-prevailing party shall pay to the prevailing party the cost
and expenses incurred to answer and/or defend such action, including reasonable attorney
fees and court costs. In no event shall the either party indemnify any other party for the
consequences of that party’s negligence, including failure to follow the ENGINEER’s
recommendations.
J. Insurance :
The ENGINEER agrees that it has either attached a copy of all required insurance
certificates or that said insurance is not required due to the nature and extent of the types
of services rendered hereunder. (Not applicable as having been previously supplied)
K. Additional Terms or Modification:
The terms of this agreement shall be further modified as provided on the attachments.
Except for those terms included on the attachments, no additional terms are included as a
part of this agreement. All prior understandings and agreements between the parties are
merged into this agreement, and this agreement may not be modified orally or in any

manner other than by an agreement in writing signed by both parties. In the event that
any provisions of this agreement shall be held to be invalid or unenforceable, the
remaining provisions shall be valid and binding on the parties. The list of exhibits is as

EXHIBIT 1
SECTION A - PROFESSIONAL DESIGN ENGINEERING SERVICES
For purposes of this Exhibit 1 and all attachments hereto, the term “contractor” shall not refer to
Engineering Enterprises, Inc., but shall instead refer to individuals or companies contracted with, to
construct or otherwise manage the project described herein. The ENGINEER shall furnish professional
design engineering services as follows:
1. The ENGINEER will attend conferences with the OWNER, or other interested parties as may be
reasonably necessary.
2. The ENGINEER will perform the necessary design surveys, accomplish the detailed design of
the project, prepare construction drawings, specifications and contract documents, and prepare a
final cost estimate based on final design for the entire system. It is also understood that if
subsurface explorations (such as borings, soil tests, rock soundings and the like) are required, the
ENGINEER will furnish coordination of said explorations without additional charge, but the
costs incident to such explorations shall be paid for by the OWNER as set out in Section D
hereof.
3. The contract documents furnished by the ENGINEER under Section A-2 shall utilize IEPA
endorsed construction contract documents, including Supplemental General Conditions, Contract
Change Orders, and partial payment estimates.
4. Prior to the advertisement for bids, the ENGINEER will provide for each construction contract,
not to exceed 10 copies of detailed drawings, specifications, and contract documents for use by
the OWNER, appropriate Federal, State, and local agencies from whom approval of the project
must be obtained. The cost of such drawings, specifications, and contract documents shall be
included in the basic compensation paid to the ENGINEER.
5. The ENGINEER will furnish additional copies of the drawings, specifications and contract
documents as required by prospective bidders, material suppliers, and other interested parties,
but may charge them for the reasonable cost of such copies. Upon award of each contract, the

ENGINEER will furnish to the OWNER five sets of the drawings, specifications and contract
documents for execution. The cost of these sets shall be included in the basic compensation paid
to the ENGINEER. Original documents, survey notes, tracings, and the like, except those
furnished to the ENGINEER by the OWNER, are and shall remain the property of the
ENGINEER.
6. The drawings prepared by the ENGINEER under the provisions of Section A-2 above shall be in
sufficient detail to permit the actual location of the proposed improvements on the ground. The
ENGINEER shall prepare and furnish to the OWNER without any additional compensation,
three copies of map(s) showing the general location of needed construction easements and
permanent easements and the land to be acquired. Property surveys, property plats, property
descriptions, abstracting and negotiations for land rights shall be accomplished by the OWNER,
unless the OWNER requests, and the ENGINEER agrees to provide those services. In the event
the ENGINEER is requested to provide such services, the ENGINEER shall be additionally
compensated as set out in Section D hereof.
7. The ENGINEER will attend the bid opening and tabulate the bid proposal, make an analysis of
the bids, and make recommendations for awarding contracts for construction.
8. The ENGINEER further agrees to obtain and maintain, at the ENGINEER’s expense, such
insurance as will protect the ENGINEER from claims under the Workman’s Compensation Act
and such comprehensive general liability insurance as will protect the OWNER and the
ENGINEER from all claims for bodily injury, death, or property damage which may arise from
the performance by the ENGINEER or by the ENGINEER’s employees of the ENGINEER’s
functions and services required under this Agreement.
9. The ENGINEER will complete the final plans, specifications and contract documents and submit
for approval of the OWNER, and all State regulatory agencies to meet the project schedule(s) as
summarized in Exhibit 4: “Anticipated Project Schedule – Fox Highlands Water Main
Improvements” dated February 28, 2018.

SECTION B - PROFESSIONAL CONSTRUCTION ENGINEERING SERVICES
The ENGINEER shall furnish professional construction engineering services as follows:
1. The ENGINEER will review, for conformance with the design concept, shop and working
drawings required by the construction Contract Documents and indicate on the drawings the
action taken. Such action shall be taken with reasonable promptness.
2. The ENGINEER will interpret the intent of the drawings and specifications to protect the
OWNER against defects and deficiencies in construction on the part of the contractors. The
ENGINEER will not, however, guarantee the performance by any contractor.
3. The ENGINEER will evaluate and determine acceptability of substitute materials and equipment
proposed by Contractor(s).
4. The ENGINEER will establish baselines for locating the work together with a suitable number of
bench marks adjacent to the work as shown in the contract documents.
5. The ENGINEER will provide general engineering review of the work of the contractor(s) as
construction progresses to ascertain that the contactor is conforming to the design concept.
(a) ENGINEER shall have authority, as the OWNER’s representative, to require special
inspection of or testing of the work, and shall receive and review all certificates of
inspections, testing and approvals required by laws, rules, regulations, ordinances, codes,
orders or the Contract Documents (but only to determine generally that their content
complies with requirements of, and the results certified indicate compliance with, the
Contract Documents).
(b) During such engineering review, ENGINEER shall have the authority, as the OWNER’s
representative, to disapprove of or reject contractor(s)’ work while it is in progress if
ENGINEER believes that such work will not produce a completed Project that conforms
generally to the Contract Documents or that it will prejudice the integrity of the design
concept of the Project as reflected in the Contract Documents.

6. The ENGINEER will provide resident construction observation. Resident construction
observation shall consist of visual inspection of materials, equipment, or construction work for
the purpose of ascertaining that the work is in substantial conformance with the contract
documents and with the design intent. Such observation shall not be relied upon by others as
acceptance of the work. The ENGINEER’s undertaking hereunder shall not relieve the
contractor of contractor’s obligation to perform the work in conformity with the drawings and
specifications and in a workmanlike manner; shall not make the ENGINEER an insurer of the
contractor’s performance; and shall not impose upon the ENGINEER any obligation to see that
the work is performed in a safe manner. Exhibit 2 - The Limitations of Authority, Duties and
Responsibilities of the Resident Construction Observer is attached to this Agreement.
7. The ENGINEER will cooperate and work closely with representatives of the OWNER.
8. Based on the ENGINEER’s on-site observations as an experienced and qualified design
professional, on information provided by the Resident Construction Observer, and upon review
of applications for payment with the accompanying data and schedules by the contractor, the
ENGINEER:
(a) Shall determine the amounts owing to contractor(s) and recommend in writing payments
to contractor(s) in such amounts. Such recommendations of payment will constitute a
representation to OWNER, based on such observations and review, that the work has
progressed to the point indicated, and that, to the best of the ENGINEER’s knowledge,
information and belief, the quality of such work is generally in accordance with the
Contract Documents (subject to an evaluation of such work as a functioning whole prior
to or upon substantial completion, to the results of any subsequent tests called for in the
Contract Documents, and to any other qualifications stated in the recommendation).
(b) By recommending any payment, ENGINEER will not hereby be deemed to have
represented that exhaustive, continuous or detailed reviews or examinations have been
made by ENGINEER to check the quality or quantity of contractor(s)’ work as it is
furnished and performed beyond the responsibilities specifically assigned to ENGINEER
in the Agreement and the Contract Documents. ENGINEER’s review of contractor(s)’

work for the purposes of recommending payments will not impose on Engineer
responsibility to supervise, direct or control such work or for the means, methods,
techniques, sequences, or procedures of construction or safety precautions or programs
incident thereto or contractor(s) compliance with laws, rules, regulations, ordinances,
codes or orders applicable to their furnishing and performing the work. It will also not
impose responsibility on ENGINEER to make any examination to ascertain how or for
what purposes any contractor has used the moneys paid on account of the Contract Price,
or to determine that title to any of the work, materials equipment has passed to OWNER
free and clear of any lien, claims, security interests, or encumbrances, or that there may
not be other matters at issue between OWNER and contractor that might affect the
amount that should be paid.
9. The ENGINEER will prepare necessary contract change orders for approval of the OWNER, and
others on a timely basis.
10. The ENGINEER will make a final review prior to the issuance of the statement of substantial
completion of all construction and submit a written report to the OWNER. Prior to submitting
the final pay estimate, the ENGINEER shall submit the statement of completion to and obtain the
written acceptance of the facility from the OWNER.
11. The ENGINEER will provide the OWNER with one set of reproducible record (as-built)
drawings, and two sets of prints at no additional cost to the OWNER. Such drawings will be
based upon construction records provided by the contractor during construction and reviewed by
the resident construction observer and from the resident construction observer’s construction
data.
12. If State Statutes require notices and advertisements of final payment, the ENGINEER shall assist
in their preparation.
13. The ENGINEER will be available to furnish engineering services and consultations necessary to
correct unforeseen project operation difficulties for a period of one year after the date of
statement of substantial completion of the facility. This service will include instruction of the
OWNER in initial project operation and maintenance but will not include supervision of normal

operation of the system. Such consultation and advice shall be at the hourly rates as described in
the attached Exhibit 6: Standard Schedule of Charges dated January 1, 2017. The ENGINEER
will assist the OWNER in performing a review of the project during the 11th month after the
date of the certificate of substantial completion.
14. The ENGINEER further agrees to obtain and maintain, at the ENGINEER’s expense, such
insurance as will protect the ENGINEER from claims under the Workman’s Compensation Act
and such comprehensive general liability insurance as will protect the OWNER and the
ENGINEER from all claims for bodily injury, death, or property damage which may arise from
the performance by the ENGINEER or by the ENGINEER’s employees of the ENGINEER’s
functions and services required under this Agreement.
15. The ENGINEER will provide construction engineering services in accordance with the periods
summarized in Exhibit 4: “Anticipated Project Schedule - Fox Highlands Water Main
Improvements” dated February 28, 2018.
If the above is not accomplished within the time period specified, this Agreement may be terminated by
the OWNER. The time for completion may be extended by the OWNER for a reasonable time if
completion is delayed due to unforeseeable cases beyond the control and without the fault or negligence
of the ENGINEER. Pursuant to Paragraph D “Changes in Rates of Compensation”, the contract shall be
designated on-going consistent with the project schedule.

SECTION C – COMPENSATION FOR ENGINEERING SERVICES
1. The OWNER shall compensate the ENGINEER for professional design engineering services in
the amount of $29,600 (FF) Fixed Fee as summarized on Exhibit 3: “Estimate of Level of Effort
and Associated Cost for Professional Engineering Services for Fox Highlands Water Main
Improvements” dated February 28, 2018.
(a) The compensation for the professional design engineering services shall be payable as
follows:
(1) A sum which does not exceed ninety percent (90%) of the total compensation
payable under Section C-1 shall be paid in monthly increments for work actually
completed and invoiced, for grant administration and for the preparation and
submission to the OWNER and/or IEPA of the construction drawings,
specifications, cost estimates and contract documents.
(2) A sum which, together with the compensation paid pursuant to Section C-1(a)(1)
above, equals one hundred percent (100%) of the total compensation due and
payable in accord with Section C-1 above, shall be due immediately after the
award of construction contract(s) is approved by the corporate authorities.
2. The OWNER shall compensate the ENGINEER for the construction administration, construction
staking, construction observation (including the Resident Construction Observer), and any
additional consultation and surveying services on the basis of Hourly Rates (HR) as described on
the attached Exhibit 6: Standard Schedule of Charges dated January 1, 2017. The estimated
values are included in Exhibit 3: “Estimate of Level of Effort and Associated Cost for
Professional Engineering Services for Fox Highlands Water Main Improvements” dated
February 28, 2018 and are estimated at $32,317 Hourly (HR).
(a) The compensation for the construction administration, construction staking, construction
observation (including the Resident Construction Observer), and any additional
consultation and surveying services shall be payable as follows:

(1) A sum which equals any charges for work actually completed and invoiced shall
be paid at least once per month.
3. The OWNER shall compensate the ENGINEER for direct expenses as identified in the contract
and as noted on Exhibit 3 at the actual cost or hourly cost for the work completed.
(1) A sum which equals any charges for work actually completed and invoiced shall be paid
at least once per month.
4. The compensation for any additional engineering services authorized by the OWNER pursuant to
Section D shall be payable as follows:
(a) A sum which equals any charges for work actually completed and invoiced shall be paid
at least once per month.

SECTION D – ADDITIONAL ENGINEERING SERVICES
In addition to the foregoing being performed, the following services may be provided UPON PRIOR
WRITTEN AUTHORIZATION OF THE OWNER.
1. Site surveys outside of the project limits and other similar special surveys as may be required.
2. Laboratory tests, well tests, borings, specialized geological soils hydraulic, or other studies
recommended by the ENGINEER.
3. Property surveys, detailed description of sites, maps, drawings, or estimates related thereto;
assistance in negotiating for land and easement rights.
4. Necessary data and filing maps for litigation, such as condemnation.
5. Redesigns ordered by the OWNER after final plans have been accepted by the OWNER and
IEPA.
6. Appearances before courts or boards on matters of litigation or hearings related to the project.
7. Preparation of environmental impact assessments or environmental impact statements.
8. Making drawings from field measurements of existing facilities when required for planning
additions or alterations thereto.
9. Services due to changes in the scope of the Project or its design, including but not limited to,
changes in size, complexity, schedule or character of construction.
10. Revising studies or reports which have previously been approved by the OWNER, or when
revisions are due to cases beyond the control of the ENGINEER.

11. Preparation of design documents for alternate bids where major changes require additional
documents.
12. Preparation of detailed renderings, exhibits or scale models for the Project.
13. Providing special analysis of the OWNER’s needs such as owning and operating analysis, plan
for operation and maintenance, OWNER’s special operating drawings or charts, and any other
similar analysis.
14. The preparation of feasibility studies, appraisals and evaluations, detailed quantity surveys of
material and labor, and material audits or inventories by the OWNER.
15. Additional or extended services during construction made necessary by (1) work damaged by
fire or other cause during construction, (2) defective or incomplete work of the contractor, and/or
(3) the contractor’s default on the Construction Contract due to delinquency or insolvency.
16. Providing design services relating to future facilities, systems and equipment which are not
intended to be constructed or operated as a part of the Project.
17. Providing other services not otherwise provided for in this Agreement, including services
normally furnished by the OWNER as described in Section E – SPECIAL PROVISIONS –
Owner’s Responsibilities.
Payment for the services specified in this Section E shall be as agreed in writing between the OWNER
and the ENGINEER prior to commencement of the work. The ENGINEER will render to OWNER for
such services an itemized bill, separate from any other billing, once each month, for compensation for
services performed hereunder during such period, the same to be due and payable by OWNER to the
ENGINEER on or before the 10th day of the following period. Payment for services noted in D shall be
at Actual Cost (AC), Fixed Fee (FF) or Hourly (HR).

SECTION E - SPECIAL PROVISIONS
1. OWNER’S RESPONSIBILITIES
(a) Provide to the ENGINEER all criteria, design and construction standards and full
information as to the OWNER’s requirements for the Project.
(b) Designate a person authorized to act as the OWNER’s representative. The OWNER or
his representative shall receive and examine documents submitted by the ENGINEER,
interpret and define the OWNER’s policies and render decisions and authorizations in
writing promptly to prevent unreasonable delay in the progress of the ENGINEER’s
services.
(c) Furnish laboratory tests, air and water pollution tests, reports and inspections of samples,
materials or other items required by law or by governmental authorities having
jurisdiction over this Project, or as recommended by the ENGINEER.
(d) Provide legal, accounting, right-of-way acquisition and insurance counseling services
necessary for the Project, legal review of the construction Contract Documents, and such
auditing services as the OWNER may require to account for expenditures of sums paid to
the contractor.
(e) Furnish above services at the OWNER’s expense and in such manner that the
ENGINEER may rely upon them in the performance of his services under this Agreement
and in accordance with the Project timetable.
(f) Guarantee full and free access for the ENGINEER to enter upon all property required for
the performance of the ENGINEER’s services under this Agreement.
(g) Give prompt written notice to the ENGINEER whenever the OWNER observes or
otherwise becomes aware of any defect in the Project or other event which may
substantially affect the ENGINEER’s performance of services under this Agreement.

(h) Protect and preserve all survey stakes and markers placed at the project site prior to the
assumption of this responsibility by the contractor and bear all costs of replacing stakes
or markers damaged or removed during said time interval.
2. Delegation of Duties - Neither the OWNER nor the ENGINEER shall delegate his duties under
this Agreement without the written consent of the other.
3. The ENGINEER has not been retained or compensated to provide design services relating to the
contractor’s safety precautions or to means, methods, techniques, sequences, or procedures
required by the contractor to perform his work but not relating to the final or completed
structure. Omitted services include but are not limited to shoring, scaffolding, underpinning,
temporary retainment of excavations and any erection methods and temporary bracing.
4. The ENGINEER intends to render his services under this Agreement in accordance with
generally accepted professional practices for the intended use of the Project.
5. Since the ENGINEER has no control over the cost of labor, materials, equipment or services
furnished by others, or over the contractor(s) methods of determining prices, or over competitive
bidding or market conditions, his opinions of probable Project Costs and Construction Costs
provided for herein are to be made on the basis of his experience and qualifications and represent
his best judgment as an experienced and qualified professional engineer, familiar with the
construction industry. The ENGINEER cannot and does not guarantee that proposals, bids or
actual project or construction cost will not vary from opinions of probable cost prepared by him.
If prior to the bidding or negotiating phase OWNER wishes greater assurance as to project or
construction costs he shall employ an independent cost-estimator.
6. Access to Records:
(a) The ENGINEER agrees to include subsections E-6(b) through E-6(e) below in all
contracts and all subcontracts directly related to project services which are in excess of
$25,000.

(b) The ENGINEER shall maintain books, records, documents and other evidence directly
pertinent to performance of Agency loan work under this Agreement consistent with
generally accepted accounting standards in accordance with the American Institute of
Certified Public Accountants Professional Standards (666 Fifth Avenue, New York, New
York 10019; June 1, 1987). The Agency or any of its duly authorized representatives
shall have access to such books, records, documents and other evidence for the purpose
of inspection, audit and copying. The ENGINEER will provide facilities for such access
and inspection.
(c) Audits conducted pursuant to this provision shall be in accordance with generally
accepted auditing standards.
(d) The ENGINEER agrees to the disclosure of all information and reports resulting from
access to records pursuant to subsection E-6(b) above, to the Agency. Where the audit
concerns the ENGINEER, the auditing agency shall afford the ENGINEER an
opportunity for an audit exit conference and an opportunity to comment on the pertinent
portions of the draft audit report. The final audit report will include the written
comments, if any, of the audited parties.
(e) Records under subsection E-6(b) above shall be maintained and made available during
performance on Agency loan work under this agreement and until three years from date
of final Agency loan audit for the project. In addition, those records which relate to any
“dispute” appeal under an Agency loan agreement, or litigation, or the settlement of
claims arising out of such performance, costs or items to which an audit exception has
been taken, shall be maintained and made available until three years after the date of
resolution of such appeal, litigation, claim or exception.
7. Covenant Against Contingent Fees - The ENGINEER warrants that no person or selling agency
has been employed or retained to solicit or secure this contract upon an agreement or
understanding for a commission, percentage, brokerage, or contingent fee, excepting bonafide
employees. For breach or violation of this warranty, the loan recipient shall have the right to
annul this agreement without liability or in its discretion to deduct from the contract price or

consideration or otherwise recover, the full amount of such commission, percentage, brokerage,
or contingent fee.
8. Covenant Against Contingent Fees - The loan recipient warrants that no person or agency has
been employed or retained to solicit or secure a PWSLP loan upon an agreement or
understanding for a commission, percentage, brokerage, or contingent fee. For breach or
violation of this warranty, the Agency shall have the right to annul the loan or to deduct from the
loan or otherwise recover, the full amount of such commission, percentage, brokerage, or
contingent fee.
9. Certification Regarding Debarment – The ENGINEER certifies that the services of anyone that
has been debarred or suspended under Federal Executive Order 12549 has not, and will not, be
used for work under this Agreement.
10. Affirmative Action – The ENGINEER agrees to take affirmative steps to assure that
disadvantaged business enterprises are utilized when possible as sources of supplies, equipment,
construction and services in accordance with the Clean Water Loan Program rules. As required
by the award conditions of USEPA's Assistance Agreement with IEPA, the ENGINEER
acknowledges that the fair share percentages are 5% for MBEs and 12% for WBEs.
11. The ENGINEER shall not discriminate on the basis of race, color, national origin or sex in the
performance of this contract. The contractor shall carry out applicable requirements of 40 CFR
Part 33 in the award and administration of contracts awarded under EPA financial assistance
agreements. Failure by the contractor to carry out these requirements is a material breach of this
contract which may result in the termination of this contract or other legally available remedies.

EXHIBIT 2
THE LIMITATIONS OF AUTHORITY, DUTIES AND RESPONSIBILITIES OF THE RESIDENT
CONSTRUCTION OBSERVER ARE AS FOLLOWS:
1. The Resident Construction Observer shall act under the direct supervision of the ENGINEER,
shall be the ENGINEER’s agent in all matters relating to on-site construction review of the
contractor’s work, shall communicate only with the ENGINEER and the contractor (or
contractor’s), and shall communicate with subcontractors only through the contractor or his
authorized superintendent. The OWNER shall communicate with the Resident Construction
Observer only through the ENGINEER.
2. The Resident Construction Observer shall review and inspect on-site construction activities of
the contractor relating to portions of the Project designed and specified by the Engineer as
contained in the Construction Contract Documents.
3. Specifically omitted from the Resident Construction Observer’s duties is any review of the
contractor’s safety precautions, or the means, methods, sequences, or procedures required for the
contractor to perform the work but not relating to the final or completed Project. Omitted design
or review services include but are not limited to shoring, scaffolding, underpinning, temporary
retainment of excavations and any erection methods and temporary bracing.
4. The specific duties and responsibilities of the Resident Construction Observer are enumerated as
follows:
(a) Schedules: Review the progress schedule, schedule of Shop Drawing submissions and
schedule of values prepared by contractor and consult with ENGINEER concerning their
acceptability.
(b) Conferences: Attend preconstruction conferences. Arrange a schedule of progress
meetings and other job conferences as required in consultation with ENGINEER and
notify those expected to attend in advance. Attend meetings and maintain and circulate
copies of minutes thereof.

(c) Liaison:
(1) Serve as ENGINEER’s liaison with contractor, working principally through
contractor’s superintendent and assist him in understanding the intent of the
Contract Documents.
(2) Assist ENGINEER in serving as OWNER’s liaison with contractor when
contractor’s operations affect OWNER’s on-site operations.
(3) As requested by ENGINEER, assist in obtaining from OWNER additional details
or information, when required at the job site for proper erection of the work.
(d) Shop Drawings and Samples:
(2) Receive and record date of receipt of Shop Drawings and samples.
(3) Receive samples which are furnished at the site by contrctor, and notify
ENGINEER of their availability for examination.
(3) Advise ENGINEER and contractor or its superintendent immediately of the
commencement of any work requiring a Shop Drawing or sample submission if
the submission has not been approved by ENGINEER.
(e) Review of Work, Rejection of Defective Work, Inspections and Tests:
(1) Conduct on-site inspection of the work in progress to assist ENGINEER in
determining if the work is proceeding in accordance with the Contract Documents
and that completed work will conform to the Contract Documents.
(2) Report to ENGINEER whenever he believes that any work is unsatisfactory,
faulty or defective or does not conform to the Contract Documents, or does not
meet the requirements of any inspections, test or approval required to be made or

has been damaged prior to final payment; and advise ENGINEER when he
believes work should be corrected or rejected or should be uncovered for
inspection, or requires special testing, inspection or approval.
(3) Verify that tests, equipment and systems start-ups, and operating and maintenance
instructions are conducted as required by the Contract Documents and in presence
of the required personnel, and that contractor maintains adequate records thereof;
observe, record and report to ENGINEER appropriate details relative to the test
procedures and start-ups.
(4) Accompany visiting inspectors representing public or other agencies having
jurisdiction over the Project, record the outcome of these inspections and report to
ENGINEER.
(f) Interpretation of Contract Documents: Transmit to contractor ENGINEER’s clarifications
and interpretations of the Contract Documents.
(g) Modifications: Consider and evaluate contractor’s suggestions for modifications in
Drawings or Specifications and report them with recommendations to ENGINEER.
(h) Records:
(1) Maintain at the job site orderly files for correspondence, reports of job
conferences, Shop Drawings and samples submissions, reproductions of original
Contract Documents including all addenda, change orders, field orders, additional
drawings issued subsequent to the execution of the Contract, ENGINEER’s
clarifications and interpretations of the Contract Documents, progress reports, and
other Project related documents.
(2) Keep a diary or log book, recording hours on the job site, weather conditions, data
relative to questions of extras or deductions, list of visiting officials and
representatives of manufacturers, fabricators, suppliers and distributors, daily

activities, decisions, observations in general and specific observations in more
detail as in the case of observing test procedures. Send copies to ENGINEER.
(4) Record names, addresses and telephone numbers of all contractor’s,
subcontractors and major suppliers of materials and equipment.
(i) Reports:
(1) Furnish ENGINEER periodic reports as required of progress of the work and
contractor’s compliance with the approved progress schedule and schedule of
Shop Drawing submissions.
(2) Consult with ENGINEER in advance of schedule major tests, inspections or start
of important phases of the work.
(3) Report immediately to ENGINEER upon the occurrence of any accident.
(j) Payment Requisitions: Review applications for payment with contractor for compliance
with the established procedure for their submission and forward them with
recommendations to ENGINEER, noting particularly their relation to the schedule of
values, work completed and materials and equipment delivered at the site but not
incorporated in the work.
(k) Certificates, Maintenance and Operating Manuals: During the course of the work, verify
that certificates, maintenance and operation manuals and other data required to be
assembled and furnished by contractor are applicable to the items actually installed; and
deliver this material to ENGINEER for his review and forwarding to OWNER prior to
final acceptance of the work.
(l) Completion:
(1) Before ENGINEER issues a Statement of Substantial Completion, submit to
contractor a list of observed items requiring completion or correction.

(2) Conduct final review in the company of ENGINEER, OWNER and contractor
and prepare a final list of items to be completed or corrected.
(3) Verify that all items on final list have been completed or corrected and make
recommendations to ENGINEER concerning acceptance.

The purpose of this memo is to provide an update as to the water main and sanitary sewer
improvements that are necessary as part of this project.
Initially, it was anticipated that the City would be responsible for over $1,250,000 worth of water
main and sanitary sewer improvements to eliminate conflicts with the new roadway
improvements. This involved the reconstruction of over 4,000 feet of water main along IL Rt 71.
The current plans for the improvements are highlighted in the attached exhibits. By working
closely with the Public Works Department, we have greatly reduced the amount of water main
that will remain within IDOT right-of-way. By removing this water main, it does now require
improvements to be constructed within the Fox Highlands development.
The current construction costs estimates are summarized below.

It should be noted that the water main and sanitary sewer work associated with the IL Rt 71
Improvements is included in IDOT’s plans and will be part of the overall roadway contract. The
plans are complete and are currently going through the permitting process with the IEPA.
The Fox Highlands water main work will have to be handled outside of the IDOT contract. We
are targeting the March Public Works Committee meeting for an engineering agreement to
include the Fox Highlands work. This work will have to be constructed in the fall of 2018 to
align with IDOT’s schedule.

for ownership and maintenance by the City.
As required by City Code, the developer will be responsible to provide a performance guarantee

Bids were received, opened and tabulated for work to be done on the 2018 Sanitary Sewer
Lining Program at 10:00 a.m., March 8, 2018. Representatives of contractors bidding the project,
the City, and our firm were in attendance. A tabulation of the bids and the engineer’s estimate is
attached for your information and record. The low bid was below our engineer’s estimate and
within the FY2019 budget.
Therefore, we recommend the acceptance of the bid and approval of award be made to the low
bidder, Innovative Underground, LLC, 312 Illini Drive, Yorkville, IL 60560 in the amount of
$102,804.00.
Note that work cannot begin until after May 1, 2018.

As requested, we investigated the possible installation of stop signs at the intersection of Sutton Street and
Windett Ridge Road. Our findings were as follows:
Currently there is no signage control at the crossing.
The intersection at Sutton Street and Windett Ridge Road has sight distance constraints at the
southwest corner of the intersection. When a house is built on the southeast corner of the
intersection, the intersection will have additional sight constraints.
The governing entity on traffic control signage is the Manual on Uniform Traffic Control Devices
(MUTCD). The manual states as follows in regards to stop sign installation:
Guidance:
Engineering judgment should be used to establish intersection control. The following factors
should be considered:
A. Vehicular, bicycle, and pedestrian traffic volumes on all approaches;
B. Number and angle of approaches;
C. Approach speeds;
D. Sight distance available on each approach; and
E. Reported crash experience.
YIELD or STOP signs should be used at an intersection if one or more of the following conditions
exist:
A. An intersection of a less important road with a main road where application of the normal
right-of-way rule would not be expected to provide reasonable compliance with the law;
B. A street entering a designated through highway or street; and/or
C. An unsignalized intersection in a signalized area.
In addition, the use of YIELD or STOP signs should be considered at the intersection of two
minor streets or local roads where the intersection has more than three approaches and where
one or more of the following conditions exist:
A. The combined vehicular, bicycle, and pedestrian volume entering the intersection from all
approaches averages more than 2,000 units per day;
B. The ability to see conflicting traffic on an approach is not sufficient to allow a road user to
stop or yield in compliance with the normal right-of-way rule if such stopping or yielding is
necessary; and/or
C. Crash records indicate that five or more crashes that involve the failure to yield the right-of-
way at the intersection under the normal right-of-way rule have been reported within a 3-year
period, or that three or more such crashes have been reported within a 2-year period.
Yield or Stop signs should not be used for speed control.

Subject: Sutton Street and Windett Ridge Road Stop Sign
The traffic volume is below 2,000 units per day and there does not appear to be an accident history.
However, due to sight distance constraints at the southwest corner of the intersection and future sight
distance constraints on the southeast corner, a stop sign is recommended for the Sutton Street approach.
It is our understanding that there may be a concern regarding speed at the intersection. This may be more
properly addressed with enforcement or if necessary traffic calming devices. We will be prepared to
discuss further at the committee meeting. If you have any questions or need additional information,

Summary
Seeking approval of a Resolution authorizing the execution of a Memorandum of Understanding
with the Chicago Metropolitan Agency for Planning for planning and technical assistance
services for the study of shared water supply service governance options in the amount of $2000.
Background
The United City of Yorkville along with the Villages of Oswego and Montgomery are
considering the construction of a water plant to serve all three communities. There are many
forms of governance for the operation of the plant. Under one scenario, one community could
own and manage the plant while selling the water wholesale to the other communities. A second
scenario has the communities creating a joint water action agency.
The municipalities applied and were awarded a Local Technical Assistance grant from
CMAP to conduct a study of governance options. CMAP is receiving funding from IEPA to use
our group as a case study for other communities who face similar issues. CMAP will
subcontract with the Metropolitan Planning Council to conduct the research.
The scope of work associated with the MOU outlines the tasks to be completed:
1. Project initiation (February 2018)
2. Research shared water supply service governance options (March-April 2018)
3. Draft and finalize shared water supply service governance options (May-June 2018)
Recommendation
Although all communities are still evaluating options for the water source, staff recommends
approval of the resolution and the expenditure of $2000 for our share of the study. The study is
primarily funded by the IEPA and the funds may not be available in the future. The
recommendations that come out of the study will allow us to move quickly in the event that the
Fox River alternate is chosen.
I would ask that this be placed on the March 20, 2018 public works committee meeting

Memorandum of Understanding between CMAP and the Village of Oswego, Village of
Montgomery and the United City of Yorkville
February 23, 2018
Please note: “LTA staff” means CMAP staff assigned to work with local governments and
community groups as part of the Local Technical Assistance program.
1. CMAP / applicant relationship
CMAP shall assign staff to work with local governments and the community as
part of the Local Technical Assistance program.
Applicant shall assign a lead person to be the main point of contact for LTA staff.
CMAP staff will report on the overall scope of work and day‐to‐day activities to
the applicant. Assigned staff are CMAP employees and CMAP is responsible for
evaluating their performance.
CMAP management, in addition to the CMAP staff assigned to the project, may
periodically check‐in (frequency to be determined based on need) with applicant.
CMAP is responsible for assigning relevant LTA staff to work on the project
(based on availability, skills, familiarity with the applicant community, and
applicant preferences).
Applicant understands that CMAP assistance is provided as a means of
advancing the implementation of the GO TO 2040 Plan as the long‐range
regional comprehensive plan for the seven‐county Chicago region, encompassing
Cook, DuPage, Kane, Kendall, Lake, McHenry and Will counties, as well as
priorities that are part of the ON TO 2050 plan that CMAP is developing.
2. Access to resources
LTA staff will have full access to CMAP data and other resources, including
specialized CMAP staff (for advanced mapping, data, outreach, communications,
or topic‐specific expertise).
The applicant will provide access to relevant staff who will need to be involved
in the project, and will ensure that they allocate sufficient time to the project.
The applicant will provide access to all relevant internal data, reports, and other
information necessary to successfully complete the project.
The applicant’s leadership (key staff, planning commissioners, board members,
other elected officials, other decision‐makers) commits to participate in the
project and allocate sufficient time at meetings (Plan Commission meetings,
council meetings, etc.) to ensure due consideration so the project is successful.

3. Demonstration of local support
Applicant’s governing board shall be required to pass a resolution supporting
the project before work will begin or in the alternative, applicant may affirm that
the governing board is aware and supportive of the project.
Formal action by the applicant’s governing board and commitment to a local
financial contribution to the LTA fund, if applicable, shall be documented
through a separate resolution and/or Intergovernmental Agreement between the
applicant and CMAP.
The applicant shall be responsible for working with CMAP to identify members
for a project steering committee or similar oversight group.
If public outreach is a component of the project, the applicant agrees to
participate in public outreach and engagement efforts; including assisting in
dissemination of project and meeting information, attending and assisting at
public meetings, and providing key stakeholder contact information.
Applicant agrees to provide an inclusive, open, safe and welcoming environment
in which to conduct meetings and outreach events.
4. Project management and review
Prior to and following enacting this MOU, CMAP and applicant will jointly
determine and document the project scope of work, timelines, public
engagement schedules, commitment of non‐staff resources by either CMAP or
the applicant, and other elements prior to beginning work. CMAP may also
request applicant assistance to establish expectations and performance goals for
the project and process.
CMAP and applicant shall jointly agree to changes to project scope or timelines;
CMAP may discontinue the project if major deviations, changes, or expansions of
scope or schedule occur.
All work performed by LTA staff must be related to the scope of work. The
majority should be directly referenced within work plan, but some indirectly
related activities are also permitted
Allocation of LTA staff to each project will vary over time based on project
timeline and work needs.
The full project scope of work is attached to this MOU as Attachment 1.
In order to maintain project progre ss and momentum, the applicant agrees to
review and provide feedback on project deliverables in a timely manner, in
accordance with the agreed upon timelines.
Applicant agrees to make best faith effort to adopt and implement the completed
plan within agreed upon timelines.

explore governance structures, funding options, decision making processes and other issues that require
intergovernmental coordination in order to make a shared water supply service work. The findings will
be summarized in a report to Oswego, Montgomery, and Yorkville and will be useful to a wider audience
contemplating similar decisions.
Tasks
1. Project initiation (February 2018)
The project team will meet with representatives of Oswego, Montgomery, and Yorkville to confirm
project goals, objectives, and timelines for this project, establish a process for working together, and
outline the specific questions the communities would like guidance on. Representatives from Oswego,
Montgomery, and Yorkville will provide the project team with recent engineering reports that have
explored water supply options, along with any pertinent, additional information necessary for
considering and evaluating shared water supply service options.
Roles:
MPC will lead the meeting and sketch out a research scope summary.
CMAP will participate in the meeting.
Deliverables: Confirmed project goals and research scope, and established plan for working together.
2. Research shared water supply service governance options (March ‐ April, 2018)
The project team will explore potential governing mechanisms, such as creating a new governing entity
or designating one municipality as the water supply developer who then sells bulk water to the others,
etc. The exploration will utilize case studies, where available, from experts within the region and nation
as well as other best practices guidance and literature.
The research will help inform key questions to be addressed, which could include: available legal
structures for shared service; decision making processes; dispute resolution; funding options; staffing
considerations; withdrawal from agreement; commitments from communities to maintain
infrastructure.
Roles:
MPC will lead this research effort and summarize findings.
CMAP will provide limited research capacity on identified, published best practices.
Deliverables: Completion of research tasks and findings.
3. Draft and finalize shared water supply service governance options (May‐June, 2018)
The project team will distill potential governance options, which will be described in a written report
that presents these options and the key components, tradeoffs, and potential next steps for proceeding.
The draft report will be shared and reviewed by the designated representatives of Oswego,
Montgomery, and Yorkville, and the project team will revise the report, as appropriate, based on
feedback received. The report will also provide a general overview for other communities that will
highlight important considerations when exploring similar structures for shared water supply service.
Roles:
MPC will write, revise, and present the report.
CMAP will provide guidance and feedback for the report, and will produce a PowerPoint slide deck
outlining the project, its process and key findings (as outlined in the report) for the communities to
use when presenting to their respective Boards.
Deliverables:
Draft report for review by Oswego, Montgomery, and Yorkville.
Discussion on draft report between project team and designated representatives of Oswego,
Montgomery, and Yorkville.

A RESOLUTION TO ACCEPT PLANNING TECHNICAL ASSISTANCE SERVICES
DELIVERED BY THE CHICAGO METROPOLITAN AGENCY FOR PLANNING
WHEREAS, the United City of Yorkville (“the City”) has applied for technical assistance
services through the Chicago Metropolitan Agency for Planning (“CMAP”), for a study of
shared water supply service governance options for Oswego, Montgomery, and Yorkville in
order to provide a sustainable, efficient, and cost-effective water supply; and
WHEREAS, the City’s request for such assistance has been recommended by CMAP as a
priority project; and
WHEREAS, CMAP has adopted the GO TO 2040 Plan as the long-range regional
comprehensive plan for the seven-county Chicago region, encompassing Cook, DuPage, Kane,
Kendall. Lake, McHenry and Will counties, is developing the ON TO 2050 Plan to be adopted in
October 2018, and is providing technical assistance as a means of advancing the plan’s
implementation and CMAP priorities; and
WHEREAS, the City and CMAP have agreed on the general contents of a Memorandum of
Understanding (“MOU”) and a Scope of Services that will guide technical assistance services to
be provided by CMAP;
NOW, THEREFORE BE IT RESOLVED BY THE UNITED CITY OF YORKVILLE:
Section 1: the United City of Yorkville supports this project to conduct a study of shared
water supply service governance options for Oswego, Montgomery, and Yorkville
in order to provide a sustainable, efficient and cost effective water supply.
Section 2: the United City of Yorkville accepts the offer of technical assistance services by
CMAP and recognizes that these services are provided for the purpose of
advancing the implementation of GO TO 2040 and other CMAP priorities.
Section 3: the United City of Yorkville agrees to pay CMAP a local financial contribution of
$2,000 to the LTA fund.
Section 4: the United City of Yorkville recognizes that provisions that govern the
administration of technical assistance services, and, if necessary, the
discontinuance of such services, are included in the Memorandum of
Understanding and Scope of Services.
Section 5: This resolution shall be effective as of the date of its adoption.

The project involves three communities combining resources to procure a sustainable water source to
support our existing and future population. The three communities are located along the Fox River
primarily in Kendall County.
7. Project Description
Please tell us what you would like to do in your community, and what assistance is needed. If you have
more than one idea, please submit a separate application for each project. Please be specific, but also
brief (less than two pages per project idea)—we simply want to have a basic understanding of what you
want to do. For plan updates please tell us how you will be building upon (or replacing) the previous
work. Program staff will follow-up with you if we need any additional information to fully understand
your proposed project.
The Villages of Oswego and Montgomery, along with the United City of Yorkville, are jointly seeking
an alternate water supply to address the dwindling ground water supply. One option is to withdraw
water from the Fox River. The 2016 Sub Regional Water Supply Study undertaken by the communities
suggests that a joint project where water is drawn by a single plant is not only viable but may be the
most cost effective option.
The communities are unsure as to the best way to create a governance structure for this
endeavor. We are aware of several options:
• Establish a JAWA independent of the communities
• Create a consortium with board membership appointed by the communities
• Identify a lead community that produces and sells bulk water to the others
• Other
The LTA would explore the pros/cons of the options so that the boards can make an informed
decision. Key issues to be addressed include the following:

IN 2014, the Villages of Oswego and Montgomery, along with the United City of Yorkville, partnered
with CMAP to research and identify potential opportunities that could be implemented to increase
our financial and operational efficiencies through working together. This study set the stage for the
current project as the communities recognize the value of working cooperatively to achieve a
common goal.
The communities followed up in 2016 with a joint study of the feasibility of utilizing Fox River water as
an alternate water supply. The study looked at construction of three plants versus a single, shared
plant. The study concludes that a shared plant is a cost effective. The question to be resolved is how
to best organize the governance structure for such a project remains.

The Village of Oswego is pleased to support the CMAP Local Technical Assistance (LTA) request
with the Village of Montgomery and the United City of Yorkville to conduct a joint study of
governance structures for a shared water treatment plant. Our three municipalities continue to
achieve new levels of efficiency through combined efforts, which have blossomed since the
2013 CMAP LTA shared services study, and we believe this LTA application will take our
partnership to the next level.
The 2013 CMAP study was the genesis of a sub-regional water supply and treatment analysis
that recommended our three communities work together to plan for a joint Fox River water
treatment facility. It is critical that our communities identify a sustainable water source since
our ground water supply is projected to deplete over the next few decades. One of the first
implementation steps outlined in the analysis is to identify a governance structure for the
shared water plant. As such, this LTA application would help our communities move closer
towards a solution to our regional water issue.

This item was requested by Alderman Frieders. He has been contacted by a county resident who
lives on the road that would like the City to improve the road through pavement rehab and more frequent
snow plowing.
The City’s 2016 inspection report is attached for your use. Relevant excerpts from the FY 19
budget proposal memo are as follows:
Unfunded capital projects
1) Baseline Road
a. One of the worst rated roads in the City. The City has been monitoring the condition of the
deck of the bridge for the past year. In the event the bridge inspection comes back
unfavorable, the City would proceed forward with closing the road. If the Route 47 north
expansion project gets funded by the state, the cost of the bridge replacement would be
heavily subsidized by the State.

a. Original estimates on the bridge repair in FY 16 came in much higher than expected, so staff
recommended closure of the bridge instead. This item was pushed along through the
remainder of FY 16, FY 17, and FY 18 because ongoing bridge inspections have not justified
total closure of the bridge. Per the Bridge Inspection Report completed in 2016, the
superstructure (surface) is in poor condition, while the substructure is in good condition. The
2016 report did not indicate an immediate need to close the bridge based on structural/safety
concerns. Inspections are scheduled once every two years, per IDOT policy, and the next
inspection will occur in summer 2018. If the inspection comes back with an issue, we would
recommend proceeding forward with bridge closure. Until then, we recommend leaving the
bridge as-is until the State expands Route 47 in the area.

1.1 SN 045‐3044 – Baseline Road over Rob Roy Creek
1. Structure Description
Built in 1966, this structure consists of a single span bridge carrying one lane of traffic in each the
eastbound and westbound direction. The structure has a total length of 30.0 feet (back to back of
abutments) and a total deck width of 26.0 feet. The substructure is skewed 5° left ahead relative to
the roadway above. The creek flows from north to south.
The superstructure consists of a 15” reinforced concrete deck slab, 1 foot high curbs and side
mounted guardrails. There are three open drains along each gutter line. No expansion joints are
present. The substructure consists of tall concrete abutments with weep holes and flared wingwalls.
There is a sheet pile retaining wall off of the northeast corner of the structure. Overhead utilities
run parallel to the direction of traffic to the south and cross the roadway near the West Abutment.
A signalized intersection is immediately to the east of the structure.
Existing plans are not available for this structure.

The northern bridge guardrail was repaired in 2012, otherwise, the repair history of the bridge is
unknown.

5. Inspection Type, Method and Equipment
This bridge is on a 24‐month inspection interval and Benesch performed the NBIS Routine
Inspection on August 10, 2016. A visual inspection was done on all elements of the bridge. Some
concrete areas were also sounded to check for delaminations. No specialized equipment was
required (e.g. snooper, ladder, etc.). Waders were worn for easier access across the creek. The
weather was sunny with an ambient temperature of 90°F.
6. Inspection Observations
The existing superstructure is in poor condition while the substructure is in good condition. The top
of slab has several full length narrow longitudinal cracks and multiple spalls with failing patches.
Many of the existing spalls are also surrounded by delaminated concrete. On the underside of the
slab, there is dampness, spalls and delamination around all six of the open deck drains, some of
which have exposed corroding rebar. Along the center of the structure, there are signs of
delaminated concrete along the length of the span (top and bottom of slab). The total area of
defects in the slab is approximately 35%; see exhibit after the Recommendations section for
additional details of slab defects. The approaching pavement adjacent to the structure is also
heavily deteriorated.
The curb along the northern edge of the structure remains damaged from the impact to the
guardrail that was originally mentioned in the 2012 inspection report. The guardrail that was
damaged has since been replaced. Approximately 20 feet of the concrete curb, measured from the
east end of the deck, is cracked with exposed rebar. The southeast corner of the curb is also spalls
with exposed rebar. There is debris accumulating at both gutter lines. A post for an object marker
sign has been knocked over in the southwest corner of the structure.
Both abutments are in good condition and the weep holes appear clear of debris. Both abutments
have hairline vertical cracks at 5’‐10’ spacing. There is dampness and rust stains on the East
Abutment at the bearing seat and leaching near the north end of the abutment. This structure does
not have a name plate.

1. Structure Description
Built in 1976, this structure consists of a large single cell elliptical corrugated metal arch culvert carrying
two lanes of east‐west traffic. The structure has a maximum cell width of 31.0 feet and maximum cell
height of 10.0 feet. The bridge roadway has a total width of 30.0 feet. There is approximately 3.0 feet of
fill above the top of the culvert with hot‐mix asphalt pavement and guardrail. The structure is not
skewed relative to the roadway. Triangular concrete thrust beams extending the full length are located
at mid‐height on the outside of the culvert. The creek flows from north to south. Overhead utilities run
parallel to the direction of traffic to the north and south.

Sediment is depositing along the east edge of the structure and there are branches slightly
impeding the flow of the creek immediately upstream of the structure. The hot‐mix asphalt
pavement is in good condition. Trees are beginning to encroach on the roadway in the northeast
corner and vegetation is obstructing the north edge of pavement and guardrail. The bridge is
missing a name plate.

Built in 1999, this structure consists of a single span bridge carrying one lane of traffic in each the
eastbound and westbound direction. The structure has a total length of 71.4 feet (back to back of
abutments) and a total deck width of 30.0 feet. The substructure is skewed 10° left ahead relative
to the roadway above. The creek flows from north to south.
The superstructure consists of ten 27” deep, side‐by‐side, PPC deck beams with side mounted type
“S1” steel rails. No wearing surface is present. The open concrete abutments have dog‐eared
wingwalls (SW and NE) and flared wingwalls (NW and SE) and riprap slopewalls. Overhead utilities
run parallel to the direction of traffic to the south.

5. Inspection Type, Method and Equipment
This bridge is on a 24‐month inspection interval and Benesch performed the NBIS Routine
Inspection on August 10, 2016. A visual inspection was done on all elements of the bridge. Some
concrete areas were also sounded to check for delaminations. A rotary percussion tool was used to
sound portions of the bottom of the deck beams and waders were worn for easier access across the
creek. The weather was sunny with an ambient temperature of 85°F.
6. Inspection Observations
The existing superstructure is in fair condition while the substructure is in very good condition. The
top of the beams have several spalls, most with exposed stirrups. Numbering the beams 1 thru 10
from north to south, Beams 4 and 5 each have a 1’x1’ spall with an exposed stirrup; Beam 8 has a
2’x width of the beam spall with two exposed stirrups; and Beam 9 has four 1’x1’ spalls with an
exposed stirrup each, another 1’x1’ spall and a 2’x width of the beam spall. Typically there is shear
key grout missing between beams and leakage and efflorescence was noted on the underside of all
of the beams. There is differential movement between a couple adjacent beams. Beam 2 is higher
than Beam 1 in the middle; Beam 3 is lower than both Beam 2 and Beam 4; Beam 7 is lower than
Beam 6; and Beam 10 is lower than Beam 9 in the east half of the bridge.
The lane lines on the structure have faded and are no longer visible. The bituminous roadway
pavement at the abutment at both ends of the bridge has been repaved since the 2014 inspection.
No issues were noted with the bridge rails, abutments, wingwall or slopewalls. The creek is impeded
by debris upstream of the structure.
7. Recommendations

1.4 SN 047‐3160 – Bristol Ridge over Blackberry Creek
1. Structure Description
Constructed in 2003, this structure consists of a two span bridge carrying one lane of traffic in each
the northbound and southbound direction. The structure has a total length of 154.4 feet (back‐to‐
back of abutments) and a total deck width of 33.2 feet. The substructure is not skewed relative to
the roadway above. The creek flows from east to west.
The superstructure consists of five W30x173 weathering steel beams with a 7½” reinforced
concrete deck. There are 30 foot long approach slabs, F‐shape parapets, guardrail in all four corners
and two scuppers per gutter line. The pier has fixed low‐profile bearings. Overhead utilities run
parallel to the direction of traffic to the west.
The substructure consists of integral abutments and dog‐eared wingwalls and a wall pier all founded
on piles. The abutments have riprap slopewalls. There is a sheet pile wall parallel to the northeast
wingwall offset approximately 5 feet from the face of the wingwall.

5. Inspection Type, Method and Equipment
This bridge is on a 48‐month inspection interval and Benesch performed the NBIS Routine
Inspection on May 23, 2016. A visual inspection was performed on all elements of the bridge. Some
concrete areas were also sounded to check for delaminations. Waders were required to access the
underside of the bridge due to water levels at the time of inspection. No other specialized
equipment was required (e.g. snooper, ladder, etc.). The weather was sunny with an ambient
temperature of 84°F.
6. Inspection Observations
The existing structure is overall in good condition. The top of deck has hairline transverse cracks
over the pier and a small spall in the middle of the roadway near the North Abutment. The
underside of the deck in the North Span has a few hairline transverse cracks. The approach slabs
have hairline diagonal and narrow longitudinal cracks. The south approach pavement has minor
cracking near the approach slab. The parapets have hairline vertical cracks at 3‐5’ spacing and the
surface is flaking off. The guardrail in the southeast corner of the structure is missing a couple of
the wood blocks between the rail and posts. Vegetation is beginning to encroach on the shoulder in
the southwest corner of the structure. No issues were noted with the scuppers, beams or bearings.
No issues were noted with the abutments, pier or wingwalls. The north slopewall is missing riprap
on the lower half of the wall. The channel in the South Span is blocked with mud build‐up and there
is a sandbar upstream of the pier.
