Of Comm. Development Director Ron Diederich,Yorkville Police Guests: Dan Kramer,Attorney The meeting was called to order at 9:05 am by Joe Wywrot. The October 25 minutes were approved as corrected. Hattner Annexation and Zoning Dan Kramer stated this property is not contiguous to the city, and the potential for commercial property along Route 47 and Walker Rd. is unknown at this time. The area is in Yorkville's comprehensive plan. The diagram shows 14 acres of commercial property along Rt. 47,however the potential for as much as 28 acres of commercial may develop, and if the multi-family area is a buffer between would reduce acreage in the single family area. Travis Miller suggests that a PUD request must follow the ordinance, and the petitioner will need to submit a concept PUD plan. Northwest of the property is MPI MPI property. Land uses should be considered looking at this property as well as the Bretthauser property,which is directly west of Hattner's property. The bike trail goes down Penman Rd. to the east of the property, along the south side along Aux Sable Creek and to the west side along Rt. 47. Dedication of the bike trail/path easement would not be problematic for the petitioner. Rt. 47 will widen to the west and the ComEd right of way is on the east side of Rt. 47. Joe Wywrot suggested Mr. Kramer check on the floodplain and if Aux Sable Creek recommendations may need to be in the annexation agreement language. MPI's infrastructure could accommodate this property. MPI's annexation agreement states recaptures will be paid at final plat,per Dan Kramer's question. This will be on the agenda at the January 10 Plan Council. Step 4: Plan Commission: The Plan Commission meets the second Wednesday of each month at 7:00 p.m. in the Council Chambers at City Hall. The Comprehensive Plan, for Suburban Neighborhood, states: "Suburban Neighborhood is intended to be a residential area primarily comprised of single- family detached residences...gross density in this classification should be between 1.50 and 2.25 dwelling units per acre. Developments requesting densities above 2.0 dwelling units per acre shall illustrate compliance with the Design Guidelines of this Comprehensive Land Use Plan Update. In addition ... the developer must also demonstrate their ability to add specific improvements such as: assist with funding offsite City infrastructure improvements, integration of architectural standards that exceed the City's current standards, landscaping, and increased allocation of open space beyond City requirement. " Conceptual Development Plan A • Land uses are not consistent with the Comprehensive Plan. The Conceptual Development Plan A calls for 14 acres of commercial running the length of Route 47 with 14 acres of townhomes buffering the 51.88 acres of single family from the commercial. • The single family area has a density of 1.79 dwelling units per acre, while the townhome area has a density of 5.0 dwelling units per acre,which far exceeds the intended density of the Suburban Neighborhood Land Use. • 25' landscape buffer between commercial and townhomes and a 12.5' landscape buffer between townhomes and single family. Conceptual Development Plan B • Land uses are not consistent with the Comprehensive Plan. The Conceptual Development Plan B calls for 27.88 acres of commercial running the length of Route 47 with 14.40 acres of townhomes buffering the 37.60 acres of single family from the commercial. • The single family area has a density of 1.54 dwelling units per acre, while the townhome area has a density of 4.86 dwelling units per acre, which far exceeds the intended density of the Suburban Neighborhood Land Use. • 18.75' landscape buffer between commercial and townhomes and a 12.5'landscape buffer between townhomes and single family. Staff Suggestions: • Staff acknowledges that single family homes may not be the best use along Route 47; however the Comprehensive Plan establishes commercial nodes at major intersections with supporting residential uses in between. Staff has concern with commercial use in this location and recommends an office land use. Office buildings should be single story and consistent with the residential architectural guidelines. • The density proposed in the townhome area exceeds the suggested for suburban neighborhood. Subject: Hattner Conceptual Development Plan I have reviewed the conceptual plan for the Hattner Development dated December 21, 2007, drawn by Schoppe Design Associates, Inc., and have prepared the following comments in regards to the conceptual design: General Comments: 1) A 10' wide asphalt path must be planned outside of the 60' I.D.O.T. right-of-way for the full length of the Route 47 frontage to the edge of the property. The trail is only shown from the development entrance to the Aux Sable Creek. Between the trail and the parking area the appropriate landscape buffer yard is required. 2) The asphalt path along Penman Road must also continue the entire length of the road frontage to the edge of the property. 3) The commercial area parking lot should have bioswale islands to promote infiltration of parking lot stormwater runoff. 4) All Stormwater Management Basins shall be naturalized. 5) Clear delineation of the designate floodplain and source from where the information is obtained must be shown on the plans. 6) Aux Sable Creek is a Class A stream. Floodplain restoration will be required, including one or more of the following; de-channelization of the creek, stream bank erosion stabilization,naturalized seeding of floodplain, and a three year maintenance and management plan. 7) Due to the sensitivity of the Aux Sable Creek Watershed, additional methods for Non- Point Source Pollution prevention will be necessary. Meetings with The Conservation Foundation will be necessary to determine how the development fits with the master open space/green infrastructure plan. The proposed land use for this development, PUD flex zoning with B-3 Highway Business, transitional multi-family and single family does not conform to the current Comprehensive Plan. The Comprehensive Plan designates this entire parcel as suburban neighborhood. 2. This property is not currently contiguous to the United City of Yorkville. Therefore, annexation would be subject to this property achieving contiguity through properties to the north or when Yorkville South (MPI) becomes contiguous. Consulting Engineers Specializing in Civil Engineering and Land Surveying 3. The content of the proposed concept plan generally meets the requirements of the City's Subdivision Control Ordinance. For the sake of completeness, the existence of the ComEd property along IL 47 should be illustrated and the approximate dimensions of the overall parcel should be shown on the plan. 4. Water and sanitary sewer service are not readily available in this area of the City. It is most probable that this subdivision would need to work cooperatively with the Yorkville South development or other nearby developers to acquire these utilities. A regional wastewater pump station is planned near the area of IL Route 47 & Aux Sable Creek. The developer should contact the Yorkville-Bristol Sanitary District or its consulting engineer to obtain the most current planning documents and information regarding wastewater conveyance and treatment. 5. It appears that all buildings within this proposed development would fall in the City's Pressure Zone 3. There are some areas of the parcel that fall within Pressure Zone 4; however, these areas all appear to lay in stormwater management areas. It should be noted that City Standards call for developments to have two sources of potable water in order to maintain reliable service. 6. Improvements to IL Route 47 should be anticipated the developer. The Illinois Department of Transportation (IDOT) will have jurisdiction over the design of the access locations on IL Route 47 as well as any state highway improvements deemed necessary. 7. Similarly, the developer will be responsible for improvements to .Penman Road in accordance with City Standards. 8. The location and limits of regional bike trails should be verified with the City's Parks and Recreation Department. The relocation of ComEd facilities may impact the proposed trail location. 9. It is likely that jurisdictional wetlands will lie in the Aux Sable Creek Floodway. A wetland delineation and jurisdictional determination should be anticipated as part of the design process of this property. SUMMARY The engineering comments expressed above are routine and should be addressed and resolved through the engineering review process. The key issues regarding this concept plan are the acceptability of the land use, the probable time line for annexation and development and its dependence upon other developments to become a viable project. Kurtzman, AICP SUBJECT: Yorkville Town Center–Zoning Request PC 2007-41 The Department of Building Safety staff has reviewed the request to rezone property at the former Villas at the Preserve to B-3. (The majority of the property is zoned R-2D PUD with a portion of the property already zoned B-3. If the City desires commercial at this location then staff recommends that the application for rezoning be revised to simply request PUD. This will address concerns that staff has with a proposed concept plan(which is a separate Plan Commission case and has been reviewed and commented upon in a separate memo). To reiterate some of staff's concerns: 1. A Gas Parcel is proposed north of the Grocery Store. A gas station is not a permitted use within the B-3 zoning district. If the applicant wants to develop this lot as a gas station then they will need to apply for a special use permit. The special use could be addressed as part of the PUD. 2. The concept plan shows an internal "road" network, which will create through lots and at least one lot that is completely surrounded by"roads." These lots could create unique challenges for determining setbacks if the zoning code is strictly applied. The setbacks can be established through the PUD process, which could make the issuance of a building permit easier at the time a permit is applied for. 3. There are two signs that are being proposed along Route 71. Staff noted that signs are reviewed and approved by a separate review process and that the sign code is presently being updated. Improvements to IL Route 71 fall under the jurisdiction of the Illinois Department of Transportation and will be required of the developer. It is expected that these improvements will include the installation of traffic signals at the entrance to the subdivision as depicted on the concept plan. 8. Easements will be required to bring water and sanitary service to this parcel. Cross-access easements will also be required from the commercial property lying east of the subject parcel. Two land uses comprise the majority of the subject property, Commercial and Transitional Neighborhood. The Comprehensive Plan, for Commercial, states: "Commercial Land Use...intends to promote market-sensitive development of commercial uses within strategically located areas to efficiently, effectively, and conveniently serve the growing 1 local population while reinforcing the importance of the United City of Yorkville as a regional center." The Comprehensive Plan, for Transitional Neighborhood, states: "The Transitional Neighborhood establishes a medium-density setting that includes a mix of residential uses within master planned communities. These master planned communities can have neighborhoods of varying densities, open spaces and carefully integrated commercial uses...Transitional Neighborhood can be designed to provide intermediary space between lower density residential areas and non-residential areas allowing greater flexibility of development adjacent to areas subject to development pressures. Gross residential density ... should be between 2.25 and 3.50 dwelling units per acre. " Conceptual Development Plan A-D • The land uses substantially comply with the Comprehensive Plan, as this is a major commercial node. Staff Suggestions: ■ When the concept plan was brought before staff and the Plan Commission in July/August of 2007, concerns were raised in regards to the full access point proposed on Route 126 south of the Route 71/Route 126 intersection. This spacing was not consistent with the IDOT spacing standards and it was suggested by staff to modify the plan to comply with IDOT standards. The Conceptual PUD Plans propose two full access points along Route 126 south of Route 71. Staff recommends the spacing be a minimum of 1000' between 126/71 intersection and the northernmost access point and 1000' between the two access points proposed. ■ Staff recommends planning for a future street/access stubs to the south and west sides of Lot 14 to ensure accessibility of the Lot in the event the surrounding parcels develop with similar uses. • The west side of Lot 14 should include an area a minimum of 30 feet wide to allow for buffering of the Lot to the land uses to the east. Currently, the concept plans show a landscape buffer of 25'. • Design Guidelines from the 2005 Comprehensive Plan Update, Southern Study Area should also be required of this PUD,particularly focusing on one architectural style to serve as a cohesive element among the PUD. The more intense commercial/retail uses occurring around the two major intersections in the PUD, Route 71/Route 126 and Route 71/Proposed Penman Road could include taller buildings,potentially second/third floors and architectural elements enhancing the `nodes'. The Transitional uses along the periphery of the PUD should have a more residential character, single story and reflective of the surrounding residential architecture in conjunction with the PUD architectural character. • The density in the residential area in the southwest portion of the PUD far exceeds the desired density for Transitional Neighborhood. To offset this inconsistency, staff suggests that the architectural design guidelines be increased above the current appearance standards for the age restricted townhome development. • The Comprehensive Plan identifies Route 71 and Route 126 as "gateway corridors." Given this distinction, attention should be given to the landscaping along these routes along with providing trails/sidewalks to connect into the surrounding residential properties' networks. Based upon our review of the application and the concept plans we offer the following comments: 1. The first page of the application indicates that the applicant is seeking annexation and rezoning. The balance of the application indicates that they are also seeking PUD approval. Staff recommends that, for clarification purposes, the application be amended to include checking off on the first page a request for PUD approval. 2. The response to item 3f of the application form indicates that the applicant is seeking PUD approval with all uses allowed in the B-3, 0, R-4 and R-2. Staff notes the following: a. The zoning code is progressive, meaning that all the uses permitted in B-3 also include all the uses listed in the 0, B-1 and B-2 zoning districts and all the uses in the R-1, R-2 and R-3 are permitted in the R-4 district. b. Staff notes that there are two uses on the concept PUD plans that are not listed as permitted uses in any of the districts outlined above. Both a gas station and a day care center are listed as requiring special use permits. If these two uses are contemplated then they need to be clearly called out in the application. 3. In all four Concept PUD Plan a 99 unit assisted living facility is contemplated with 87 to 137 parking spaces shown. Yorkville does not have a specific parking ratio for assisted living facilities. Our zoning code stipulates that at least 2 parking spaces be provided per dwelling unit. The number of parking spaces should be listed as a deviation from the code along with a justification for the number being provided. 4. A day care center is shown on all four concept PUD plans, with different parking ratios. How did the applicant determine how many parking spots will be needed? 5. Plan Review United City of Yorkville, Kendall County, Illinois. Dear Mr. Wywrot: We have reviewed the following materials that were forwarded to us by the City: • Conceptual P.U.D. Plans "A", "B", "C", and "D" for Windmill Farms prepared by Schoppe Design Associates, Inc. consisting of one (1) sheet each, all dated December 21, 2007. GENERAL COMMENTS 1. The four (4) concept plans submitted for review are similar in scope and layout with each plan featuring a 99-unit assisted living facility and age restricted town homes or age targeted single-family homes in the southwest corner of the development where duplex or townhomes were shown in previous concepts. The variation in the four concept plans is seen only in the location of the assisted care facility and the layout and number of age-restricted townhomes. One option offers age-targeted single-family dwellings in lieu of age-restricted townhomes. The larger east parcel is the same for each of the current concepts and shows only minor revisions from prior concept plans. 2. One potentially important change found in each of the revised concept plans is the greater separation provided between the IL 126 & IL 71 intersection and the first full- access point on IL 71 south of IL 126. The intersection spacing has been increased from approximately 500 feet in previous submittals to approximately 740 feet in each of the current submittals. Revised traffic projections and coordination with the Illinois Department of Transportation (IDOT) will be needed to determine whether the new intersection spacing will be adequate and acceptable. All other access locations on IL Consulting Engineers Specializing in Civil Engineering and Land Surveying Mr. Joseph A. Wywrot, P.E. January 15, 2008 Page 2 of 3 126 and IL71, similarly, fall under the jurisdiction of IDOT. 3. As discussed in previous concept reviews, this project falls within two pressure zones (Zone #3 and Zone #4) in the City's water distribution system. Those buildings constructed at an elevation of 715.00 or below would generally fall within the lower pressure zone. As this project moves into preliminary engineering, the configuration of water mains in each of the zones will need to be carefully planned. It may be necessary to install a pressure reducing valve station within this project to separate the two zones. Alternatively, if there are relatively few buildings established below the 715.00 elevation, individual pressure reducing valves installed on each building could be considered. The City's overall water system plan projects the need for a 16-inch water main along the Route 71 frontage as well as the Route 126 frontage. The final sizing and location of water mains in this development should be determined during the preliminary engineering phase. 4. The developer's methodology for addressing wastewater conveyance seems reasonable. It should be noted, however, that there will be competition for sanitary sewer capacity with the Edward Hospital & Health Services development located in the northwesterly quadrant of IL127 & IL71. Sanitary sewer planning and design should be further developed at the preliminary engineering phase of this development. 5. A stormwater management report should be provided as part of the preliminary engineering submittal and should include descriptive narrative and supporting calculations. A hydrologic model reflecting the condition of multiple basins linked together should be used in lieu of modeling one large basin as a sum of the smaller basins. It will be necessary during the preliminary engineering phase for the design engineer to illustrate that stormwater release from this development can be safely conveyed to its natural outfall without creating adverse effects on the upstream or downstream properties. It should also be noted that the release of stormwater directly or indirectly into existing agricultural drain tile systems in not an acceptable methodology for managing off-site releases. 6. .A wetland delineation report should be provided to the City for its review early in the review process. 7. There appears to be sufficient access points in all areas of the development and the internal roadway network appears to be adequate for circulation through the development. The design of internal roadways whether public or private should be in accordance with the City's Standard Specifications for Improvements as presented in the Subdivision Control Ordinance. 8. The functionality of the circular parking lot at Lot 13 is questionable and will require closer study when more detailed drawings are available during preliminary engineering. Option "C" places the 99-unit assisted living facility in an area with only one access driveway. Given the nature of this facility, having only one ingress/egress point for emergency services is not advisable. This issue could be mitigated if there is a proposed connection to Country Hills Subdivision at the west limit of the access drive. The other concepts provide more ample ingress and egress routes to this facility. CONCLUSION From an engineering point of view, we find the concept plans "A", "B" and "D" acceptable, subject to IDOT's approval of the full access point south of IL Route 126 on IL Route 71. Concept "C" could also be acceptable if secondary access is provided for the assisted living facilty. Anne Lucietto welcomed the group and described how those involved in the advisory committee were chosen by the Plan Commission. All members present introduced themselves and the constituency group they are representing on the committee. Anne Lucietto gave an overview of the purpose for a comprehensive plan and the meeting schedule for the update process to the current plan. Anne Lucietto reminded the committee members to mark the dates on their calendars. The meeting schedule also shows the task of the committee at each meeting. Anne Lucietto mentioned that while it is an involved process, it does require input. Anne then went over the commitment contract between the committee members and the plan commission and the workbooks which were given to the committee members, plan commission, and elected officials. Travis Miller, Community Development Director,reviewed the tasks anticipated for each advisory committee meeting. Each meeting will typically begin with a brief presentation about the meeting topic. Then, a SWOT(strengths, weaknesses, opportunities, threats) Analysis will be performed by the committee members. In the second half of the meeting, the advisory committee members will produce goals and objectives for the meeting topic using the results of the SWOT Analysis. A question was asked if committee members would have access to the current comprehensive plan. Yes, the comprehensive plan is online and also on the CD of background information given to each member. If a member would like a hard copy, please ask Travis Miller or Stephanie Boettcher. Travis Miller then went through the progression of the Yorkville Planning Area. The 2002 Planning Area was defined from the comprehensive plan. An update of this plan for the Yorkville Planning Area south of the Fox River was completed in 2005 expanding the planning area to the south. The Current Planning Area uses the boundary delineated in the 2002 Comprehensive Plan north of the Fox River and the boundary delineated by the 2005 Comprehensive Plan Update South of the River. Due to current and proposed boundary agreements, along with annexation by the City, a new planning area was proposed by staff which addressed these changes. Plan Commission still has the ability to modify these boundaries. In general,this is the area which will be addressed in this Comprehensive Plan Update. Charley Wunder, Urban Planner, then went through the demographic and economic information. Charley mentioned that this data will be used throughout the planning process and will be particularly helpful in land use allocations, public/community facilities, and infrastructure meetings which are to come. This information given is only a highlight. The population change from 1970 shows the change of the City from a rural community to an exurban community to a more suburban community in nature. 2007 population projections are based on the number of dwelling units in the planning area and this number will be confirmed by a special census performed in the spring/summer of 2008. There are numerous techniques for population projections, however few are accurate in rapidly growing communities such as Yorkville which is why the population was projected based on dwelling units. The subsequent population projections, up to year 2012, are based on increase of dwelling units from the current developments which are under construction. These projections are optimistic due to the planning purposes of the committee. Questions: Will large scale maps be brought to every meeting? Travis Miller, answered that Greg Weber, the GIS Coordinator, will be at the majority of the advisory committee meetings and will be producing maps for each meeting topic as needed. Many of those presented today are for the Natural Resource discussion in December. Anne Lucietto mentioned the Kendall County Planning Consortium meeting whose next meeting will be held on November 15, 2007. The upcoming meeting will be discussing preserving rural character in Kendall County. Many of the topics at this bi-monthly meeting maybe pertinent to the advisory committee's discussions. Anne Lucietto will send out a list of the meetings and topics for 2008 to the advisory committee once dates have been set. Members then split among four discussion groups to complete the meeting tasks: a SWOT analysis and formulating goals and objectives. The following is a summary of the meeting tasks (SWOT analysis and goal formulation) from all four discussion groups. Natural Resources Strengths: Fox River and its tributaries, amount of undeveloped acreage and open space, topography and its provision of scenic views, existing natural features (includes forest preserves), and prime agricultural soil. Weaknesses: lack of contiguity among green/open space,use of prime agricultural land for non agricultural uses, and lack of buffering for existing natural features. Opportunities: Build upon existing legislature/programs (i.e. Protect Kendall Now plan,Ad Hoc Committee for the Environment, Rural Legacy Program, and trail planning), still early in planning process so still able to publicly obtain/retain open space, potential implementation of innovative programs (conservation design, transfer of development rights, cluster development, and conservation easements). Threats: Aquifer degradation and depleting water supply,roadway expansion/improvements to handle increased traffic, and nonconforming growth and potential development plans. Goals: 1) protect Fox River and its tributaries, 2)protect scenic views, 3)require open space standards in new developments (conservation design, cluster development,transfer of development rights,rural legacy program, and celebrating the uniqueness of each property), 4) improve communication between surrounding municipalities and county to maximize green infrastructure, open space, and proper drainage, 5)promote best management practices, and 6)preserve and enhance existing natural areas. Following the meeting tasks, Anne Lucietto announced a change in dates for the upcoming meetings, in which the committee will alternate from the 4th Wednesday of the month to the 31l Thursday of the month, in order to accommodate all those involved.
