The February 14 minutes were approved as written. Prairie Pointe Lot 3 Crimson Lane—Special Use Permit Ms. Kurtzman questioned the petitioner regarding the use of the 0.47 narrow strip of land within Lot 3. Mr. Brown suggested with the size of the facility that his client did not need the space. On the current plan there are not enough parking spaces shown. With the administrative and teaching staff accounted for, there are 5 spaces short. No pavement should be allowed into the platted parking setback along Crimson Lane. The dumpster placement should change because it prohibits the 5 ft. wide buffer strip to be located along the perimeter of the parking lot. Stephanie Boettcher offered a correction on her memo,in that Crimson Lane, noted as an arterial roadway,is actually a collector road. Ms. Boettcher asked if parents would be signing the children in and out, and Mr. Brown assured her they would be, in his comments regarding a drop-off zone for the facility. Ms. Boettcher suggested the play area not be parallel to the road,but that the area might rather wrap-around the facility, in a potential use of the 0.47 excluded from the plan. Bill Dunn stated that the petitioner should be aware that there would be a fee for the regional run off provided by the storm water detention basin. He suggested bio-swales be in incorporated in the plan, to mitigate the storm water, reducing the rate of release. Joe Wywrot said the originally the proposed driveways along Prairie Pointe Drive were opposite each other, and f this is not the case, depending on how the lots opposite the day care on Prairie Pointe Drive develop, that the daycare's drive should be shifted to the north. Consideration of the Crimson Lane right of way must be considered. There is no gate within the fencing; the only entrance/gate is through the building. Dave Mogle, commenting regarding the safety of the children in the playground, insisted that the licensing with the state of Illinois is very stringent, and the safety of the children is paramount. There will be a side walk along public frontage on Crimson Lane. This will be presented at the Plan Commission on April 9. 1 Cross Evangelical North Campus—Annexation,Rezoning and Special Use The petitioner noted that the 2.5 acre spot would have a similar use as the other uses on the property. She suggested that design guidelines from the 2005 comprehensive plan should be incorporated in this development, and reflective of the surrounding neighborhood's architectural style. Conservation design principles, ex.bio-swales,best management practices, are suggestions for the petitioner. There should be a buffer along the far side of the develop- ment. The worship center will be 2-stories high. Zoning classification will be R-2,with setbacks 30', 10' and 40', for front, side, and rear, respectively. Joe Wywrot stated there would be a 50' right of way set back along Mill Road, and an additional 30' setback from the right of way line. Parking is prohibited in the landscape buffer. The proposed property to the south puts a driveway 250' west of the east property line. The city would like this to comply with intersection spacing, which is 400' for a collector road. The petitioner will look at moving this driveway to the west. Unit 20 Gr. Reserve is to the east of the property, and Joe Wywrot stated the would be favorable to 0 candles at the lot line, if lighting was installed in the parking area on the northeast side. The overall landscaping buffer of 30' along the north and east side of the development is suggested by city staff. The buffer behind the parking area on the east side is 5 feet. The petitioner was encouraged to contact Grande Reserve Unit 20 developers to see if the storm water basin could be enlarged to accommodate the needs of this plan. A buffer along the north side and a smaller pond, to address the neighbors' concerns, was suggested by Joe Wywrot. Dave Mogle stated the map shows that the trail runs along the south side of Mill Road. He will check on tying both church sites together, with a trail to the north of Mill. Mill Road will be marked on the map. A separate application should be filled out if engineering is needed for the project. The annexation agreement should be submitted prior to plan commission. This will be at the May 14 Plan Commission. I have reviewed the proposed petition for re-zoning of the subject property and have the following comments: • The petition is to re-zone the property from County Agricultural A-1 to County Business B-3. A site development plan, if one exists, was not submitted for review. • The property is not currently contiguous to the city. • A former railroad right-of-way, currently owned by Commonwealth Edison Company, is located along east side of Route 47 and separates the property from Route 47. Easements would need to be acquired to cross the Corn Ed property to access Route 47. • A 40-foot half right-of-way should be dedicated for Ament Road. • Public utilities are not currently available, but extensions of water and sewer mains are anticipated for the future. The property owner would need to pay his share of those costs and perhaps dedicate easements for those utilities should he want to connect in the future. • Ament Road is currently a proposed pressure zone boundary for our water system, with this property being located on the low side of the boundary. If the property were to be located in the higher pressure zone,the anticipated water pressure would vary between 75 and 95 PSI,which is too high. County B-3 (Highway Business District)Zoning is: "Intended for major retail, service and repair establishments serving a large trade area, usually the entire County or beyond and oriented to the traveling public. The trade area population served by these establishments requires easy access, although patronage is more dispersed and visits to these establishments less frequent than in the B-1 District and B-2 District. It is the intent of the B-3 District regulations that establishments desiring location along major traffic routes are grouped with appropriate and adequate access ways provided.]" Comprehensive Plan Recommendation for the Property The 2002 Comprehensive Plan Southern Study Area recommends Neighborhood Retail for the property. The intent of Neighborhood Retail is: "To provide opportunities for smaller scale, service oriented retail establishments intended to serve only the residents within the immediate area. Small-scale retail trade is further defined as land used for the purposes of serving the retail needs of neighborhoods in close proximity...The Neighborhood Retail nodes should also strictly comply with the Design Guidelines sections of this Comprehensive Land Use Plan Update to ensure attractive, coordinated retail centers are planned. " Project History A 2006 pre-annexation agreement for this property(originally part of Heartland Crossing, a larger mixed-use development)expired in September of 2007. As part of this pre-annexation agreement the City Council approved City B-3 Zoning for this property which is consistent with the County B-3 Zoning Classification. The pre-annexation agreement also contemplated public water and sanitary service for the property, as it is not currently serviced by either. Potentially, the allowable uses in the County B-3 Zoning District may not be possible on this size site, 4.93 acres,without these services. The 2006 pre-annexation agreement also required a 40' 1/2 right-of- way dedication along Ament with a 50' building setback line measured from this new right-of- way. The final Site Plan and Final Plat prepared by MeritCorp, as approved by the City of Yorkville, indicated a 66' wide right-of-way for Fountainview Road with a 30' building setback and a 10' parking setback,as measured from the North proposed right-of-way. This design exceeded the requirements as outlined in the annexation agreement,which states that the setbacks shall be measured from the centerline of the road. In a review letter prepared by Joe Wywrot, May 29,2007,a request was made to move the parking and building setbacks along Fountainview to the effective location of an 80' right-of-way and further to place the sidewalk in an easement outside the right-of-way within lot 3. This is not the understanding that that MeritCorp or the developer came away with from a February 22, 2007 Plan Council meeting. We have agreed to move the sidewalk on the North side of Fountainveiw Road outside the right- of-way in an easement as requested. We have also agreed to provide a 40' half right-of way for the South half of Fountainveiw and that the setbacks on the south side of Fountainview are to be measured from the future proposed right-of-way. The Developer contends, with regard to Lots 1 and 3,that setbacks measured from what is an effective 80 right-of-way line would render the lots useless and unusable. Therefore we are requesting that the proposed North half right-of-way of Fountainview remain at 33' wide across Lots 1 and 3 of Fountainview Subdivision as shown on the approved Plat. B. TIME OF THE ESSENCE. It is understood and agreed by the parties hereto that time is of the essence of this Agreement and that all of the parties will make every reasonable effort, to expedite the subject matter hereof. It is further understood and agreed by the parties that the successful consummation of this Agreement requires their continued cooperation. C. COVENANTS AND AGREEMENTS. The covenants and agreements contained in this Agreement shall be deemed to be covenants running with the land during the term of this Agreement and shall insure to the benefit of and be binding upon the heirs, successors and assigns of the parties hereto, including the CITY, its corporate authorities and their successors in office, and is enforceable by order of the court pursuant to its provisions and the applicable statutes of the State of Illinois. D. BINDING EFFECT AND TERM. This Annexation Agreement shall be binding upon and inure to the benefit of the parties hereto, and their successors and OWNERS of record of land which is the subject of this Agreement, assignee, lessees, and upon any successor municipal authorities of said CITY, so long as development is commenced within a period of twenty years from the date of execution of this Agreement by the CITY. One comment was for Fountainview Drive to be a 39' B-B roadway centered within an 80-foot right-of- way. • There have been various revisions and resubmittals of the proposed plat of subdivision and engineering plans. The initial submittals called for a 30' B-B roadway with a 33' half right-of-way and 30' building setback lines. We discussed the Fountainview Drive issue at length with the developer, who was reluctant to provide the 40' half right-of-way. We offered an alternative that was used in a similar situation in the Prairie Garden development;the full right-of-way could be 66' wide,but the sidewalk would be located within easements on private property and the building setbacks would be increased by 7 feet. This alternative results in the same parkway width and same building distance from the right-of-way line as an 80' right-of-way and standard setbacks. • The most recent plat and plan submitted for review calls for a 39' B-B roadway and a 33' half right-of-way. The sidewalk has been relocated into easements. The two lots with frontage along Fountainview Drive(Lots 1 and 3)are show to have different setbacks. Lot 1 (closest to Route 47)has a 50' setback,and Lot 3 has a 30' setback. These are the dimensions requested in the amendment. • I understand that IDOT has concerns about the location of the private drive that extends north from Fountainview Drive into the development. Their comments could result in significant revisions to the engineering plans and affect the individual lot dimensions. I recommend that we allow IDOT's comments to be resolved prior to approving any amendment to the existing annexation agreement. Please forward these comments to the developer. If another building is to be constructed on the remnant of Lot 2, additional watermain and sanitary sewer will need to be constructed across the Day Care property to service the remnant lot. • The initial Prairie Pointe development included bioswales and stormwater BMP's to encourage infiltration and cleansing of stormwater. We would require the same kind of design from this development. • The interior of the parking lot should have additional landscaped areas added to protect vehicles parked in the end stalls. The developer should demonstrate that a 45' fire truck can make this movement. It appears that the applicant is purchasing a portion of Lot 2 within the Prairie Pointe Subdivision for their proposed facility. Staff notes that, as illustrated on the Geometric Plan (prepared by Barrington Engineering Consultants and dated April 10, 2008)the northwestern section of Lot 2 (denoted as Lot 2A on the Geometric Plan) would be land- locked, creating a non-buildable lot. 2. Access is being proposed between Lot 1 and Lot 2B and between Lot 2B and Lot 3. Staff recommends that a cross access easement be provided between the properties to accommodate these access points. 3. The length of the parking stalls within the middle of the parking lot(adjacent to the parking island) are inadequate in length. The Zoning Code specifies that the mimimum parking stall length is 18.5 feet. 4. Dimensions between the parking area and the side lot lines are required (landscape code requires a minimum of 5 feet between the pavement and the lot line). 5. The landscape code stipulates that landscape islands be provided within parking lots having 20 or more parking spaces. These islands are to be a minimum of 190 sq ft and 10 feet wide.
