The March 27 minutes were approved with one correction. Richard Marker&Associates—Mile and/Review The petitioner seeks county B-3 zoning classification, which is not consistent with the proposed land use of Neighborhood retail by the City's comprehensive plan. The county B-1 zoning classification is more consistent with the City's recommended land use. The County B-3 zoning allows these uses: drive thru business, financial institutions, taverns, liquor stores, gasoline service stations, and boat rental/storage, which are considered special uses in the city's zoning ordinance. The pre-annexation agreement expired in 2007. There is currently no public utility infrastructure on the property. The petitioner has no end user in mind, hopes to market the property, and thinks this piece would eventually annex to the city along with a larger piece. The petitioner had a favorable meeting with Kendall County regarding this property. Brendan McLaughlin questioned whether the petitioner would have any benefit to a re-negotiated annexation agreement for this property, but the petitioner prefers the flexibility the buyer would have for remaining in the County, or petitioning the City. The railroad right of way, along the east side of Rt. 47 and owned by ComEd, will be required to cross the property to access Route 47. Ms. Kurtzman recommends the City's setbacks and coverage in the zoning code be adopted for this property. Mr.Neyer,representing the petitioner, agreed to dedicate the right of way along Ament Road. There is no pressure zone currently in existence on this property. This will be presented at the May 14 Plan Commission. Fountainview/DTD Investments—Amendment to PUD Ms. Kurtzman stated the amendment had several references to the PUD and she questions why the petitioner is seeking straight B-3 zoning. Dan Kramer suggested the City had recommended a PUD in earlier meetings. 1 The petitioner is asking for a 33' right of way, moving the sidewalks out of the right of ways. The concern was providing the original setback of 40'. The width of the lot is the contention. The petitioner asks for a 7' reduction in the setback. There is a parking setback with a landscaping between the parking and the side walk. The commercial user wants the building to face Route 47. Ms. Kurtzman stated side yard setbacks are established for fire protection. Mr. McLaughlin suggested reducing the interior setback lines between the two interior lot lines. The petitioner will move the lot line between lots 2 and 3 further north. Joe Wywrot stated his concerns regarding Fountainview Drive. The petitioner is stating there will be a southbound stop and westbound stop,but the traffic heading east and turning left off Fountainview Drive would be free flowing. The petitioner is now waiting for a response from IDOT. The petitioner will file an amendment to the ordinance,will modify the language and have amendment language to the City by April 23. The petitioner may suggest to the City additional parking stalls on the north side of the building on Lot 3. This is scheduled for the May 14 Plan Commission. Stagecoach Crossing—Preliminary/Final Plan Ms. Boettcher stated property parking should be provided and questioned if any parking would be shared between buildings. The petitioner will provide an overlay for the City. Any petitioner on a lot with a drive-thru business must now apply for a special use, to comply with a new amendment to the zoning ordinance. Joe Wywrot said IDOT may want to gain control of the trapezoid shaped area adjoining Route 47. If this is the case, the property will need to be designated a separate lot, conveyed to the state. A cross access easement should be expanded to include an easement across Lots 5 and 7, for property to the west, and across Lot 7 to the property to the north. The property to the west is land locked, and there is a retaining wall running about 2/3 of the length of the west side. A driveway from Lot 5 is being recommended by the city, or at the least, a continuation of the drive aisle along the north side of Lot 5. The storm water maintenance documents should be contained in the homeowner covenants. The storm water detention areas are tied to lots 3 and 7, and proportionate detention area splits could be assigned to each lots. A memo with additional notes for additions to the mylar, will be due on May 2 - needed are: proportionate best management storm water accessments; a plan for maintenance of parking areas; potential assignment of the separate trapezoid lot to IDOT; and ingress/egress easements to be granted. This will be presented at the May 14 Plan Commission. Prairie Point Lot 2 B, Crimson Lane—Special Use Ms. Boettcher stated the parking spaces must all be 18.5'. The landscape median should be a minimum of 10'. All subdivided lots must be provided with proper ingress and egress. The changes will be done by the petitioner. Ms. Kurtzman stated all of Lot 2 be shown, as the northwestern section of Lot 2 will be landlocked, creating a non-buildable lot. The fence should be constructed of 2 materials similar to the primary building. The petitioner will be using constructing a masonry wall with a front gate. Joe Wywrot stated that storm water best management practices should be required of this developer. The landscaping should be incorporated in the interior landscaping areas. He recommends that the end parking stalls be protected by landscaping islands, which would mean that there would be two stalls less. To increase the number of stalls, the petitioner may share parking with the owner, PrimeAmerica. This may be the easier way to rectify the parking issue. A drive way exit potentially could be added to the west or to the north. The petitioner should demonstrate to the Plan Commission that the remainder of Lot 2 is buildable. Subject: PC2008-11 Cannonball Trails (Amendment to PUD) Project History The petitioner is requesting an amendment to the Planned Unit Development(PUD)for Cannonball Trails, formerly Courthouse Square. The original site plan,Exhibit"D" in the 2000 PUD/Annexation Agreement, shows 2 commercial buildings with approximately 16,000 sq. ft. of retail space along the southern portion of the property and 2 office buildings with a proposed 9,000 sq. ft of space along the northern portion of the property. A screening berm was placed along the northern property line to buffer the adjacent residential community and an open space element divided the commercial and office properties,making them function as separate entities. The PUD/Annexation Agreement zoned the property as O—Office District with additional specified business uses in B-1 Limited Business District and B-2 General Business District as permitted uses, see Exhibit"B" from the 2000 PUD/Annexation Agreement which is attached. Application The petitioner is requesting an amendment to the PUD with changes to the site plan and end users. The site plan has a proposed 30,636 sq. ft of commercial space, an increase of approximately 6,000 sq. ft. from the original site plan. The proposed end users include a bank, gas station, day care center, and retail space housing a drive thru business. Staff Suggestions • Financial institutions, Gasoline Service Stations,Drive Thru Businesses, and Day Care Centers, all of which are shown on the site plan dated 4-22-08, are all considered special uses. Banks and day care centers are permitted uses in Exhibit "B". However,the gasoline service station and the drive thru facility(s) should go through the special use permitting process. The criteria to be considered for a special use permit in the City of Yorkville are listed on page 3. • The 2000 PUD/Annexation Agreement states under Section 2: Zoning, "Hours of operation of any convenience store at this location shall be limited to 6:00 am to midnight." A typical gas service station/convenience store would be not compliant with this requirement. If the PUD is amended and a gasoline service station is permitted under the special use process,this statement should also be amended to reflect this change. • The 2000 PUD/Annexation Agreement states under Section 6: Signage, "The CITY agrees to allow for the following signage to be used in the development in conformance with City Ordinances: Two identification signs(one for the commercial area not to exceed 100 square feet and one for the office area not to exceed 100 square feet)." Given the property now functions as one unit these requirements should be reevaluated. Also,the site plan dated 4-22-08 shows 3 proposed signs which is not compliant with the original agreement language. It is requested the 1 petitioner provide an elevation of the signs or the sign area proposed for each sign for staff evaluation. • The 2000 PUD/Annexation Agreement states under Section 8:Planned Unit Development Zoning and Conditions,"It is the intent of the OWNER and DEVELOPER to provide additional shrubbery, landscaping or screening to the most northerly and easterly area of the parcel." The screening berm which was included in the original site plan for Courthouse Square to comply with the aforementioned requirement,has been removed and replaced with a detention pond in the northeast corner of the property. It is recommended that the petitioner reincorporate this feature into the site plan dated 4-22-08. • The 2000 PUD/Annexation Agreement states under Section 8: Planned Unit Development Zoning and Conditions,"The site plan attached is hereby modified to provide that a minimum distance of approximately 400 feet shall be maintained between the northerly property line of the subject site and the commercial center for business use shown on the subject site." The proposed site plan does not comply with this requirement as commercial uses,the day care center within 19.8' and the retail building within 275', are less than 400' from the northerly property line. Upon approval of the PUD amendment,this statement should also be amended to reflect this change. • Design Guidelines from the 2005 Comprehensive Plan Update should be considered for this project, particularly focusing on one architectural style to serve as a cohesive element. Transitional uses,namely the proposed day care center, along the northern property line which is shared with the Oak Knolls Subdivision, should have a more residential character, single story and reflective of the surrounding residential architecture in conjunction with the PUD architectural character, if it differs. • In other day care proposals,the off-street parking requirements for a day care facility were established by Anna Kurtzman, Zoning Coordinator, as 1 parking spot per employee plus 1 parking spot per 10 students. Currently, 38 spaces are proposed to serve the 9,500 sq. ft. day care facility, yet staff has not received information detailing the number of employees and students at the facility. It is requested that the petitioner provide the number of employees (teachers and administrative) and students to staff in order to confirm that the proposed parking complies with the aforementioned requirements. • The proposed parking listed on the site plan dated 4-22-08 except for the day care facility which is to be determined, is compliant with the off-street parking standards. • The site plan dated 4-22-08 proposes two full access driveways along Cannonball Trail. 10-11-3 of the Zoning Ordinance, Distance to Existing Street Intersections, states that,"Commercial driveways shall be a minimum of two-hundred(200') feet when measured from driveway edge to the nearest intersecting street right-of-way line." The first commercial driveway going north from Route 34 is 185' from the intersection, which is not complaint with the aforementioned requirement. Staff suggests the development of only one full access driveway (i.e. at the most northerly entrance along Cannonball Trail) for the property with a supplemental right in/right out entrance (i.e. at entrance along Cannonball Trail closest to Route 34). • The petitioner should provide a cross access easement onto the adjacent property to the east. 2 Special Use Standards(10-14-6 of Zoning Ordinance) F. Standards:No special use shall be recommended by the Plan Commission unless said Commission shall find that: 1. The establishment,maintenance or operation of the special use will not be unreasonably detrimental to or endanger the public health, safety,morals,comfort or general welfare. 2. The special use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purpose already permitted,nor substantially diminish and impair property values within the neighborhood. 3.The establishment of the special use will not impede the normal and orderly development and improvement of surrounding property for uses permitted in the district. 4.Adequate utilities,access roads,drainage or other necessary facilities have been or are being provided. 5.Adequate measures have been or will be taken to provide ingress or egress so designed as to minimize traffic congestion in the public streets. 6. Kurtzman SUBJECT: PC2008-11 (Courthouse Square) Request to Amend Annexation Agreement/PUD Agreement The Department of Building Safety staff has reviewed the above document for compliance with the zoning code and the terms of the original annexation agreement (adopted on August 10, 2000, as Ordinance 2000-44). Based upon our review we offer the following comments: 1. The petitioner's application indicates that they are seeking to amend the existing AA/PUD by amending the"site plan" and"special use zoning for front outlots." Staff notes that the proposed site plan does not meet the terms of the annexation/PUD agreement. Most notably it does not comply with sections 8B of the agreement (requiring a minimum 400 foot separation between building and the northern lot line) and 8D (requiring a minimum parking lot setback of 45 feet from the Route 34 right-of-way line). 2. Section 8F of the annexation/PUD agreement specifies that development of the site shall conform with Exhibits E(Landscaping) and F(Facades). As Exhibit E is significantly different from the proposed site plan, a revised landscape plan will also need to be prepared and will need to replace Exhibit E. 3. The present Exhibit F does not related to the proposed uses. As such, staff recommends that Exhibit F also be revised, or at least,the agreement be revised to acknowledge compliance with the City's Appearance Code. 4. The existing site plan(Exhibit D) denotes a cross access easement will be provided between the subject property and the property to the east. This cross access easement is missing from this site plan. 5. The application notes that the petitioner is seeking "special use zoning for front outlots." Staff notes that all the proposed uses, with the exception of the gas station and the drive thru associated with the 15,000 sq ft retail building, are already permitted via Exhibit B. The petitioner may want to amend the application to accurately reflect the special uses being sought and/or eliminate the gas station and/or drive thru. C. There are lines on the site plan that seem to indicate that the petitioner may want to eventually subdivide the property. 7. If the petitioner is considering subdividing the property then there are some aspects of the site plan that will not meet zoning requirements. Such as, a. Gas station site—a determination of front will need to be determined (based upon the lot widths along the street frontages). If the Route 34 frontage is determined to be the front of the property,then the car wash is less than 20 feet from the rear property line. If Cannonball Road is determined to be the front of the property then the car wash does not appear to meet the 10 foot side yard requirement. 8. The site plan shows the location of 3 proposed signs. The citing of signage is a separate review process and is not approved through site plan review. Staff requests that signage notations be removed from the site plan. 9. The parking table will need to be revised. It notes that the required parking ratio is 4 parking spots per 1,000 sq ft for the Kindercare facility. A determination has been previously made that, as relates to parking, daycare facilities most closely match schools and therefore the parking ratio is based upon a combination of both the number of students to be served along with the number of employees.
