The meeting was called to order at 9:05 am by Joe Wywrot. June 26, 2008 minutes
were approved as written.
Star European Imports—Annexation and PUD
Mr. Oliver stated that Koziol Engineering will now be working on this project.
Jim Koziol distributed to the staff revised preliminary engineering plans.
The following is a list of questions/concerns that staff and the petitioner had for
the revised site plan.
• There is a proposed addition to the northeast side of the metal building (currently
on the site)that would be used for service/sales.
• The vehicles waiting for service or storage will be parked to the south and east of
the building.
• The cars for sale will be parked along the northern property line.
• The cars will be driven into the southeast door of the building into the bay area.
There will be 6-7 bays. There will be no drive through to the southwest of the
building.
• Staff will need a count on the total number of stalls on the property.
• There will be no more than 10 employees at the business.
• Loading and unloading will be via car carriers at the current entrances. IDOT
assured the petitioner there will be two access points, and the design of these will
be moderated.
• There is a concern regarding the property to the west, and the grading easement
that will be needed for sidewalk. Jim Koziol proposes the sidewalk will be in the
easement on the public side.
• Setbacks will be according to code and will need modification especially the side
setbacks and the curve extending onto the property line.
• The buffer yard must be 30 feet.
• Monument signs can be at 8' height. The petitioner should read the new sign
ordinance for options on building signs.
• There should be a cross access to the west, with a designated path for an ingress/
egress. Needed is an easement next to the carpet business to the west.

• The water main across the frontage on the north should be extended.
• Sanitary depths should be checked. Staff suggested the best option for sanitary
may be to extend it to McCue Street, however easements are need for this to
occur, and the petitioner has not approached land owners regarding this matter.
• The petitioner would have to obtain a variance for septic on the property.
• The fire department will need a hydrant in the retail area, and it will be place
north of the retail store in the southwest quadrant of the plan.
• The legal description on the plat of annexation does not match the description that
is attached to the application.
• The petitioner will be permitting through the county, because they wish to begin
improvements immediately. The City will be advised throughout this process, so
there will be no compliance issues when the property is annexed to Yorkville.
This is scheduled for plan council on August 28th and a Plan Commission Public Hearing
on September 10.

I have reviewed the proposed annexation agreement for Star European Imports,prepared by
Koziol Engineering Services and dated 8/15/08, and have the following comments:
• Has parking lot lighting been eliminated?The use of wall packs on buildings should be
minimized and lighting should follow the"dark sky"concept promoted by the City of
Yorkville.
• A preliminary landscape plan is needed.
• Sanitary sewer connection to the Heartland Business Center may be the only viable
alternative for sanitary service to the property. An 8"sanitary sewer exists with invert
elevations of 635.5 at McHugh/Rt.34 and 633.9 at McHugh/Farmstead. This alignment
would require offsite easements across adjacent properties,but also possible cost
participation by those adjacent property owners. A very shallow 8" sanitary sewer with an
invert elevation of 636.5 exists on the Shops at Veterans Parkway property, about 110 feet
west of the subject property.
• An existing 8"watermain is located near the NW corner of the site. This watermain needs
to be extended across the property's Rt.34 frontage.
• The piping within the septic field should be filled with solid materials such as sand,
gravel or concrete to prevent collapse from driving over.
• A preliminary grading plan is required to determine existing drainage patterns and
evaluate the proposed detention area.
• Include in the grading plan,the outfall of the proposed detention basin and the offsite
drainage.
• There are no handicapped parking spaces located on the east side of building near the
proposed addition.
• Add a note indicating that the cross access easement also allows the adjacent properties
access across the property.
This review is scheduled for the August 28th Plan Council meeting.

Comprehensive Plan Recommendation for Property
The 2002 Comprehensive Plan recommends Commercial land use for the subject property. The
Comprehensive Plan defines Commercial as,
"...to promote market-sensitive development of commercial uses within strategically located
areas to efficiently, effectively, and conveniently serve the growing local population, while
continuing the importance of the United City of Yorkville as a regional center. "
Staff Suggestions:
• The petitioner request of Planned Unit Development zoning is appropriate and will allow
special provisions beyond the B-3 zoning requirements to be applied to this property.
This zoning request should be noted on the concept plan dated August 15, 2008,as
opposed to B-3 Service Business District.
• Staff suggests B-3 Service Business District to be used as guideline for the subject
property in regards to zoning requirements. See B-3 Zoning Requirements listed below.

Lot Area: Minimum 10,000 sq. ft.
Front Yard:Minimum 50 feet
Side Yard:Minimum 20 feet
Transitional(Rear)Yard:Minimum 30 feet
Lot Coverage: Maximum 50%
Maximum Building Height:Maximum 35 feet or 3.5 stories
Parking Lot Setback:20 feet from property line
• The concept plan dated August 15, 2008 is in compliance with all of the aforementioned
requirements, except for the side yard and parking lot setback zoning requirements.
These two deficiencies are further addressed below.
• Parking requirements for motor vehicle sales— 1 space per 600 square feet of floor area.
16.2 spaces are required. Parking requirements for retail stores— 1 space per 300 square
feet of floor area. 20 spaces are required. The concept plan provides for 66 spaces for
the dealership,this does not include the amount provided in the sales area, and 21 spaces
for the retail building.
• Given the abundance of parking,the 14 spaces along the eastern part of the property and
the 17 spaces along the western part of the property can be removed in order to provide
20' side yards along the eastern and western property lines. 35 parking spaces are still
provided for the dealership meeting the parking requirements.
• On the concept plan,the parking setback requirement is not met given the proposed land
dedication along US 34. Staff recommends a waiver of this requirement based on that at
least 10' will remain between future pavement edge/curb and parking. However, if the
parking spaces along the western property line are removed, and since the car display
area could not be considered a parking lot,the 20' requirement is met.

The Department of Building Safety staff has reviewed the documents submitted for the case listed
above for compliance with the zoning code and offers the following comments:
Site Plan
1. There appears to be conflicting information with this project. The application indicates
that the petitioner is seeking to rezone the property from unincorporated B-3 to the City
of Yorkville's PUD status,however, the recently submitted geometric plan (dated

Step 3: For Preliminary Plans only;Park Board Planning Meeting: The Park Board makes
recommendations on any Park Sites included in the development. The Park Board
Planning Meeting is the fourth Monday of each month at 7:00 p.m. at the Riverfront
Building, 301 E. Hydraulic Street.
Step 4: Plan Commission: The Plan Commission meets the second Wednesday of each month
at 7:00 p.m. in the Council Chambers at City Hall. The Plan Commission will make a
recommendation for the City Council's consideration. The Plan Commission consists of
10 members appointed by the Mayor,the City Attorney and City Land Planner.

Step 5: Committee of the Whole: The Committee of the Whole meets the first and third
Tuesdays of the month at 7:00 p.m. in the Conference Room at City Hall. The project
will be discussed in an informal atmosphere at the Committee of the Whole where no
formal voting takes place. This session is to discuss and consider recommendations of
prior committee meetings.
Step 6: City Council: The City Council meets the second and fourth Tuesdays of the month at
7:00 p.m. in the Council Chambers at City Hall. This is where all City Council voting
takes place.
If this project has included an annexation and/or zoning petition, a Public Hearing will be
held at this time with notice given by publication. Any annexation agreement,PUD
agreement or development agreement must be signed by the Petitioner prior to being
voted on by the City Council. Prior to the recording of the final plat,the petitioner must
pay the Administration Fee. This is equal to 1.75%of the approved engineer's estimate
of construction costs of land improvements, including but not limited to all public
improvements to be dedicated to the City,mass earth grading, and quasi-public
improvements to be maintained by the homeowner's associations such as private storm
sewer,parking areas,and trails.
Step 8: Final Plat recording instructions: Once the final plat is approved by the City Council
and all required documents, bonds,and letters of credit are submitted to the City,the final
plat may be recorded with Kendall County. Submit the final plat mylar to the Deputy
Clerk for signatures. When all City signatures are in place,the developer or his surveyor
may take the mylar to the Kendall County Clerk for his signature. The next step is to
have six paper prints made and return to the Kendall County Recorder's office for
recording. Kendall County requires the mylar and four paper copies. The City of
Yorkville requires that you submit two recorded paper copies to the Deputy Clerk. Any
copies you may require would be in addition to these.

classification except in regards to the side (transitional)yard along the northern

• The property adjacent to lot 4 is currently zoned R-1. Chapter 10-7D-4 Section D of
the Zoning Ordinance states, "Where a side or rear lot line coincides with a
residential district zone, a yard of not less thirty feet(30') shall be required. A
transitional yard shall be maintained only when the adjoining residential district is
zoned R-1 or R-2 one-family residential." The current side yard is 20'. This
deficiency shall be considered a pre-existing non-conforming use. However, if Lot 4
is substantially redeveloped(a 25%increase in the existing building square footage or
addition of 12 parking spaces), rezoned, or request a special use permit the provision
of 30' transitional (buffer)yard will be required per the City's Landscape Ordinance.
• Staff requests the petitioner provide a 5' sidewalk running parallel to Route 47 to
connect into the existing sidewalk north and south of the property.

The Department of Building Safety Staff has reviewed the document listed above for compliance
with the Zoning Code and offers the following comments:
1. The property is presently zoned B-3, which requires a minimum lot size of 10,000 sq ft.
All four lots will meet this requirement
2. The minimum setbacks within the B-3 zoning district is as follows:
a. Front yard: 50 feet
b. Rear yard: 20 feet
c. Side yard: 20 feet
d. Transitional Side yard: 30 feet
3. In regards to setbacks, staff has the following concerns:
a. The Building Setback line for each proposed lot is required to be denoted on the plat
of subdivision.
b. The definition of lot frontage indicates that the front of the lot is adjacent to either a
public or private street. Neither lots 3 or 4 meet this definition.
c. Distances between the buildings and the proposed/existing lot lines have not been
provided and are required.
d. Staff scaled the distance between the Storage Units on Lot 4 and the northern
property line. Based upon this measurement(approximately 20 feet),the Storage
Units will not meet the minimum Transitional Side yard setback.

I have reviewed the proposed petition for re-zoning of the subject property and have the
following comments:
• The property does not have street frontage.
• The property is contiguous to the city along the southern lot line.
• Public utilities are not currently available. If water and sewer mains are extended in the
future, the property owner would need to pay his share of those costs and perhaps
dedicate easements for those utilities should he want to connect in the future.

Comprehensive Plan Recommendation for the Property
The 2002 Comprehensive Plan recommends Commercial for the property. The intent of
Commercial is:
"...to promote market-sensitive development of commercial uses within strategically located
areas to efficiently, effectively, and conveniently serve the growing local population, while
continuing the importance of the United City of Yorkville as a regional center. "
Staff Suggestions
• The petitioner is requesting a rezoning from County Agricultural zoning classification
to County M-1 zoning classification. Despite the Comprehensive Plan
recommendation, the M-1 rezoning is appropriate for the property given the existing
use of the property and the surrounding land uses, specifically northwest of the
subject property.
• Given the existing use of the property, in which vehicles are stored onsite(outdoors),
and that the property adjacent(to the south) is in a residential zone, the property
should be enclosed by a solid wall/fence at least 8' in height per the County's M-1
zoning classification.
• Seeing as the subject property does not have street frontage, an access easement shall
be provided between the adjacent parcel to the northwest and the subject property, in
order to provide access to the property from Cannonball Trail.
• Given the property does not have street frontage; a front yard will have to be
identified in order to determine the proper setbacks for the property.
• The following are the County M-1 Zoning Requirements inregards to setbacks.
• Front Yard—40' from property line(Collector Streets)
• Rear Yard—minimum 40' from property line
• Side Yard—no less than 10%of lot width,but no more than 20'
Given these requirements,the property does not meet the at least one of the required
setbacks. Dependent upon the location of the front yard,the property could be
deficient in more than one setback requirement. Given this,the property should be
considered a pre-existing non-conforming use. Staff suggests that with any
substantial redevelopment of the property(increase of 25%in square footage of the
building or an additional 12 parking spaces added to the property); the property shall
then come into compliance with aforementioned setback requirements.
• The County M-1 zoning classification is comparable to the City of Yorkville's M-1
zoning classification. The County M-1 Zoning Classification allows the following as
permitted uses:
• Automobile service station for retail sales of gasoline(Gasoline Service
Station)
• Contractor or construction such as: building, cement, electrical,
refrigeration,masonry,building,plumbing,roofing, air-conditioning,
heating and ventilating, fuel oil,with a storage of fuel oils, gas and other
flammable products limited to 120,000 gallons per tank, with total storage
on zoning lot not to exceed 500,000 gallons.
• Building equipment,building materials, lumber, coal, sand and gravel
yards, and yards for contracting equipment of public agencies, or public
utilities, or materials or equipment of similar nature.
• Cement block manufacture
• Sanitary land fill
However, these uses are considered special uses in the City's M-1 zoning
classification. The criteria to be considered for a special use permit in the City of
Yorkville are listed below.
Special Use Standards (10-14-6 of Zoning Ordinance)
F. Standards:No special use shall be recommended by the Plan Commission unless said Commission
shall fmd that:
1. The establishment,maintenance or operation of the special use will not be unreasonably
detrimental to or endanger the public health, safety,morals,comfort or general welfare.
2. The special use will not be injurious to the use and enjoyment of other property in the immediate
vicinity for the purpose already permitted,nor substantially diminish and impair property values
within the neighborhood.
3. The establishment of the special use will not impede the normal and orderly development and
improvement of surrounding property for uses permitted in the district.
4.Adequate utilities,access roads, drainage or other necessary facilities have been or are being
provided.
5.Adequate measures have been or will be taken to provide ingress or egress so designed as to
minimize traffic congestion in the public streets.
6.The special use shall in all other respects conform to the applicable regulations of the district in
which it is located,except as such regulations may in each instance be modified by the City Council
pursuant to the recommendations of the Plan Commission.(Ord. 1973-56A,3-28-74)

Loren Miller 1.5 Mile review(request to rezone from Ag to M-1)
The Department of Building Safety staff has reviewed the materials submitted for the case listed
above and offer the following comments:
1. The application indicates that the parcel number for this property is 02-16-426-010. A
review of the County's records indicates that this parcel is strictly a rectangle, and does
not include a notch as depicted on the Plat of Survey. This discrepancy should be
explained by the applicant.
2. The application indicates that the petitioner is seeking to rezone the property from
Unincorporated Kendall County Ag to Unincorporated Kendall County M-1. The City's
Future Land Use Map shows this area developing as residential not industrial.
3. The bulk standards for the City's M-1 district is as follows:
a. Front Yard: 25 feet
b. Side Yard: 10% of lot width,not to exceed 20 feet
c. Rear Yard: No setback listed
d. Lot Coverage: 60%
e. Floor Area Ratio: 0.8
4. The City's zoning code defines lot frontage as that lot line adjacent to either public or
private street. This parcel does not meet this definition. Therefore, compliance with the
City's setback standards cannot be determined at this time.
5. No legal access to this parcel is denoted in any of the paperwork provided to the City.
6. It does not appear that this site meets the City's parking requirements in that the parking
area is not paved or striped.
7. Staff was unable to determine how many parking spaces need to be provided as no
information was provided regarding the current and proposed uses of the property.
