EBI Consulting Project#61085150 Invitation to Comment
Our City Clerk,Jackie Milschewski, received a letter dated August 21, 2008 and
staff is meeting to make comments and/or recommendations regarding the possibility of
expanding equipment on the current cell tower site, located 300 feet west of Rt. 47,just
north of the Steinwart Audiology Business at 1411 S. Bridge Street.
The following is a list of questions/concerns that staff discussed.
• Anna Kurtzman stated that the project summary form had incorrect data. The
property consists of 1300 sq. ft., which is approximately 0.25 acre lot. The tower
sits approximately 300 feet southwest of the Garden Street and Il. Route 47
intersection.
• Jackie Dearborn checked Section 106,regarding any historical properties the site
might have had. There are no such findings. Staff suggests that the petitioner
contact the Illinois Historical Preservation Association with these findings. The
association may want to give clearance to EBI.
• If an additional antennae is added, it should have its own box, which will be
outside of the current area. The"box"is 12'x20', and called a shelter building. It
should be 5 feet from the accessory line.
• The current parcel is a section leased from Mr. Loftus and the zoning lot is 40 x
40. There is a proposed addition to the northeast side of the metal building
(currently on the site)that would be used for service/sales.
• The current tower was constructed in 2000, in Kendall County. Staff was unable
to find any building information from the county. Apparently this site had a
county address at one time. The setbacks are grandfathered in. There are no
utility line issues.
• The revised site plan should be prepared by a licensed professional, including
landscaping,property lines and setbacks all dimensioned.
• Antennae must meet Zoning Code for tower and antennae regulations.
Engineering must have certification so the structure is sound.
• Per the code, fencing around the pre-existing tower should include an opaque
screen,no less than 6' in height, equipped with an anti-climbing devise. Wooden
or chain link fencing is acceptable, shrubbery and bushes are required unless
waved.
• The shelter or box should have a minimum 6'height on the fence, up to 8'. IA
variance may be sought for an 8' fence.

• There is a cross access easement showing on the plat, from east to west on the
site. It appears that 12'may be unrecorded. This should be formalized in the
agreement with EBI.
• City staff is recommending a dust-prohibitive driveway,with paving.
• It is staff's recommendation that EBI will require a permit.
Staff recommends some clarification on the language in an agreement with EBI:
1) regarding the final plat; 2) grandfathered setbacks; 3) fence and scrub heights; 4)
landscape requirements; 5)paving; 6) and justification on the additional structure on
the site. The language would be amended and included in the Tower and Antennae
Code.
Travis Miller will address a letter from the City Clerk to Envirobusiness, Inc. and
send out the city's response.
The August 28, 2008 minutes were approved with corrections.

SUBJECT: PC 2008-22 CVS Pharmacy Special Use—Drive Thru
The Department of Building Safety staff has reviewed the above application for compliance with the
zoning code and offers the following comments:
1. The property in question is zoned B-3 with a Special Use Permit for a Planned Unit
Development.
2. On September 26, 2006, the Yorkville City Council adopted Resolutions 2006-79 and
2006-80, approving the preliminary PUD Plan and preliminary PUD plat for this
property. Attached to these resolutions are site plans that show a drive-through facility at
this corner.
3. On April 10, 2008, the Yorkville City Council adopted Ordinance 2008-24, stating that
drive-through facilities are listed as special uses within the 0 (Office) Zoning District.
Due to the progressive nature of the Yorkville Zoning Code, the special uses within the 0
district are carried forward and are also considered to be special uses within the B-3
zoning district.
4. Due to the timing of the adoption of resolutions and ordinances, it is staff's opinion that
the applicant does not need to process an application for a special use permit allowing a
drive-through facility at this location. However, in an effort to be cautious the applicant
has elected to file an application for a special use permit.
5. Staff has conducted a zoning analysis of the proposed site and has determined that it
meets all building and parking setbacks and lot coverage requirements. The site plan
meets the minimum parking requirements (both in terms of the size and number of
parking spaces to be provided) and also meets the minimum number of loading berths to
be provided. Dimensions of the loading berths are not provided on the site plan so staff is
unable, at this time,to state emphatically that the size of the loading berths comply with
the zoning code,however,based upon scaling the plans staff does not foreseen a problem
with the applicant meeting the loading berth requirements.

I have reviewed the proposed annexation agreement for CVS Pharmacy,prepared by V3
Companies and dated 1/22/08, and have the following comments:
• The special use is for a drive-through pharmacy which will have two stacking lanes.
These two stacking lanes will accommodate up to 6 vehicles. This is acceptable for this
special use. A bail-out lane is also provided.
• The traffic pattern along the south should indicate two-way traffic. Or, if this is intended
for traffic in one direction only,there needs to be signs to indicate this.
This review is scheduled for the September 25th Plan Council meeting.

Staff Suggestions:
• Through staff research the following shall be considered the criteria for stacking lanes:
Type of Drive Through Number of Spaces
Bank 6 per teller
Coffee Shop 4 per window
Dry Cleaner 3 per window
Restaurant 12 total(min.of 5 between order and pick up)
Other 5 per window
• The stacking criteria for pharmacies shall be 5 spaces per window following the requirements of
an"other"use. Given the stacking exhibit,in which 3 spaces are provided per window for a total
of 6 spaces,the subject property would be considered in conformance with the aforementioned
requirements,as over 5 stacking spaces are provided total.
• Staff requests a striping and signage plan related to the drive-thru be submitted for review.
o Signage potentially applicable to the subject property,which is exempt from the
regulations of the Sign Ordinance include: "C. Signs four(4) square feet or less in area
and five(5)feet in height or less on private property regulating on-premise traffic and
parking. I.Menu-boards accessory to a restaurant drive-up window facility provided
such signs are thirty-six(36) square feet or less in area." Title 8-Chapter 11- Section 5
• The criteria for consideration for a special use permit are listed on the following page.
Special Use Standards (10-14-6 of Zoning Ordinance)
F. Standards:No special use shall be recommended by the Plan Commission unless said Commission
shall find that:
1.The establishment,maintenance or operation of the special use will not be unreasonably
detrimental to or endanger the public health, safety,morals, comfort or general welfare.
2.The special use will not be injurious to the use and enjoyment of other property in the immediate
vicinity for the purpose already permitted,nor substantially diminish and impair property values
within the neighborhood.
3.The establishment of the special use will not impede the normal and orderly development and
improvement of surrounding property for uses permitted in the district.
4.Adequate utilities,access roads, drainage or other necessary facilities have been or are being
provided.
5.Adequate measures have been or will be taken to provide ingress or egress so designed as to
minimize traffic congestion in the public streets.
6. The special use shall in all other respects conform to the applicable regulations of the district in
which it is located,except as such regulations may in each instance be modified by the City Council
pursuant to the recommendations of the Plan Commission. (Ord. 1973-56A, 3-28-74)

I have reviewed the referenced site plan,prepared by V3 Companies and dated 1/22/08, along
with supplemental documentation and have the following comments:
• A turning movement diagram should be provided to demonstrate the ability of vehicles to
enter and exit the drive-through lanes without infringing upon opposing traffic lanes or
blocking the bail-out lane. The tight turns required to access the drive-through lanes are
also a concern. In may be necessary or advisable to shift the main entrance south and/or
modify some landscape island geometry as generally shown on the attachments. If an
entrance is shifted south, consideration should be given to using it as a common entrance
for the lot to the south.
• The "Do Not Enter" sign located in the island southeast of the drive-through lanes will
cause confusion for southbound motorists. Either different sign language or a different
sign location should be considered.
• What will be located in the two areas designated as loading berths?
• The traffic arrow indicators near the drive-through exit are backwards.
This issue is scheduled for review at the Plan Council meeting of September 25, 2008.

ANNEXATION, PLANNED UNIT DEVELOPMENT,ZONING OR SPECIAL USE REQUEST
PETITIONER ROUTE
Step 1: Petitioner must submit a completed application,fees*and all pertinent materials to the
Community Development Department a minimum of 45 days prior to the targeted Plan Commission
meeting. Petitioner is responsible for making submittals to other review agencies such as Kendall
County, Illinois Department of Transportation, Illinois Department of Natural Resources, U.S.Army Corps
of Engineers, etc.,to allow timely review by City.
*Fees: a. Annexation or Annexation and Rezoning -$250 plus$10 per acre for each acre
over 5 acres
b. Rezoning only-$200 plus$10 per acre for each acre over 5 acres
c. Special Use-$250 plus$10 per acre for each acre over 5 acres
d. Engineering Review Fees- 1.25% of the approved engineer's estimate of cost
of all land improvements,to be determined by City Engineer.
e. Planned Unit Development fee- $500
f. Engineering Review Deposit- up to 1 acre= $1,000;
over 1 acre but not over 10 = $2,500
over 10 acres, but not over 40 = $5,000
over 40 acres, but not over 100 = $10,000
over 100 acres = $20,000
g. Deposit for Outside Consultants-under 2 acres = $1,000
2 to 10 acres= $2,500

Note: Owner/Developer will be responsible for payment of recording fees and
costs, public hearing costs including a written transcription of public
hearing and outside consultant costs(i.e. legal review, land planner,
zoning coordinator, environmental, etc.). Should Owner/Developer not
pay these fees directly, they will be responsible for reimbursing the United
City of Yorkville for the aforementioned fees and costs.
Note: You must present your plan at each of the meetings below as indicated.
Step 2: Plan Council: The Plan Council meets the 2nd and 4th Thursday of the month at 9:00 a.m. in the
City Conference Room. Upon recommendation by the Plan Council, you will move forward to the Plan
Commission Meeting. Attendees to this meeting include: City Administrator, Community Development
Director, Sanitary District Director, City Engineer, Building Department Official, Emergency Medical
Representative, Public Works Director, Director of Parks and Recreation, Fire Department
Representative, and Police Chief.
Step 3: Park Board planning meeting: The Park Board makes recommendations on any park sites
included in residential developments. The Park Board Planning Meeting is the 4th Thursday of each
month at 7:00 p.m. at the Parks and Recreation Office at 201 W. Hydraulic Street.
Step 4: Plan Commission: The Plan Commission meets the 2nd Wednesday of each month at 7:00
p.m. in the Council Chambers at City Hall. The Plan Commission will make a recommendation for the
City Council's consideration. The Plan Commission consists of 10 members appointed by the Mayor, the
City Attorney and City Land Planner.

A public hearing will be held at this time for the Annexation Agreement and/or Rezoning request
or Special Use request. Notice will be given by publication by the United City of Yorkville in the
Kendall County Record and certified mail by the Petitioner to adjacent property owners within
500 ft.of the subject property no less than fifteen days and no more than 30 days prior to the
public hearing date. A certified affidavit must be filed by the petitioner with the Community
Development Department's office containing the names, addresses and permanent parcel
numbers of all property owners.
Step 5 -Economic Development Committee: The Economic Development Committee meets the 1st
Tuesday of the month at 7:00 p.m. in the Conference Room at City Hall. The project will be discussed in
an informal atmosphere where no formal voting takes place. This session is to discuss and consider
recommendations of prior committee meetings.
Step 6: City Council: A public hearing is required for annexation or PUD agreements. The City
Council meets the 2nd or 4th Tuesday of the month at 7:00 p.m. in the Council Chambers at City Hall.
A public hearing will be held at this time for the Annexation Agreement and/or Planned Unit
Development Agreement. Notice will be given by publication by the United City of Yorkville in the
Kendall County Record. A certified mailing to surrounding landowners is not required for this
public hearing. Any annexation agreement, PUD agreement or development agreement must be
signed by the Petitioner prior to being voted on by the City Council.
Step 7: City Council: The City Council meets the 2nd and 4th Tuesday of the month at 7:00 p.m. in the
Council Chambers at City Hall. This is where all City Council voting takes place.

1.1 The property that is the subject of this Application contains a total of approximately 2.33 acres and is

1.2 The Subject Property lies at the southeast corner of Route 34 and Eldamain Road in Yorkville, Illinois.
1.3 The underlying zoning classification of the Subject Property is B-3 Service Business District.

2.1 Applicant proposes to develop the Subject Property with an approximate 13,225 square foot CVS
Pharmacy building. The CVS Pharmacy will utilize a drive-through window offering(as authorized and
permitted by the United City of Yorkville under the terms and conditions of the Development
Agreement). The CVS Pharmacy will offer products, goods and services including but not limited to the
following:
a) The sale of pharmaceuticals;
b) The sale of grocery products;
c) The sale of health care and cosmetics products;
d) The sale of alcoholic beverages as otherwise allowed under the United City of Yorkville's liquor
ordinance, and subject to the procurement of a liquor license;
e) The sale of cameras and camera supplies;
f) The providing of film processing services;
g) The sale of other products and the rendering of other services customarily sold or rendered in a
full-service, modern drug store.
2.2 The Zoning Ordinance. Applicant requests a Special Use for a Drive-Through Facility. Pursuant to
Section 10-7D-2 of the Zoning Ordinance of the United City of Yorkville, special uses within the B-3
Service Business District include all special uses within the B-2 District (and by reference all special
uses within the B-1 and the 0 District). In accordance with Ordinance No. 2008-24 (the
"Ordinance"), a "Drive-Through Facility" was added as a special use to Title 10, Chapter 7 Article 2
of the United City of Yorkville Code (i.e. within the 0 Business District). Therefore, because the
special uses from the 0 district are incorporated within the B-3 Service Business District, the
Ordinance Applies to the Subject Property and the Applicant's proposed drive-through facility
requires a Special Use procedure.

III. Criteria
In accordance with Section 10-14-6 of the Zoning Ordinance of the United City of Yorkville,the following
standards apply to an Application for a Special Use
(a) The establishment,maintenance or operation of the special use will not be unreasonably detrimental to
or endanger the public health, safety,morals,comfort or general welfare.
Applicant Response: The proposed Drive-Through Facility will not be unreasonably
detrimental to or endanger the public heath, safe,morals, comfort or general welfare. The
proposed CVS Pharmacy Drive-Through will provide a tremendous convenience to the
community allowing for patrons of the pharmacy to access prescriptions without having to depart
their vehicle and enter the store. This convenience is particularly beneficial to the elderly or to
those patrons traveling with small children,where departing the vehicle is not convenient or safe.
Further,the drive-through facility provides an additional convenience during cold winter months
where traversing a parking lot may be unsafe or uncomfortable.
(b) The Special Use will not be injurious to the use and enjoyment of other property in the immediate
vicinity for the purpose already permitted,nor substantially diminish and impair property values within
the neighborhood.
Applicant Response: The proposed drive-through facility will not injurious to surrounding
property values in the immediate vicinity or within the neighborhood. The proposed CVS
Pharmacy with the proposed drive-through facility will increase the number of patrons to the
Cobblestone Corners commercial development as a whole thereby serving to increase property
values and revenues generated therefrom.
(c) The establishment of the special use will not impede the normal and orderly development and
improvement of surrounding property for uses permitted in the district.
Applicant Response: The proposed drive-through facility will not impede the normal and
orderly development of the surrounding businesses and will serve to attract new ancillary and
competing businesses to the area. -
(d) Adequate utilities, access roads, drainage or other necessary facilities have been or are being provided.

(ej Adequate measures have been or will be taken to provide ingress or egress so designed as to minimize
traffic congestion in the public streets.

(f) The special use shall in all other respects conform to the applicable regulations of the district in which it
is located, except as such regulations may in each instance be modified by the City Council pursuant to
the recommendations of the Plan Commission(Ord 1973-56A, 3-28-74).
Applicant Response: The proposed drive-through facility is set forth within an Exhibit to the
existing fully executed Development Agreement governing the Subject Property. Therefore, the
Special Use has been contemplated already by the United City of Yorkville development staff.
In all other respects,the drive-through facility conforms to the applicable regulations of the
district in which it is located.
