The September 11 minutes were approved with one correction. PC 2008-22 CVS Pharmacy—Special Use Drive Through Andrew Kolb said 2.33 acres on the southeast corner of Hwys. 34 and 47. The retail building will be 13,225 square feet, serving the drive up pharmacy needs of clients. Following are a list of comments by staff: • Anna Kurtzman's zoning analysis show the plan meets all building and parking setback and lot coverage requirements. • The plan meets the minimum number of loading berths. • The traffic pattern along the south should indicate two-way traffic. • Title 8-Chapter 11-Section 5 refers to the directional signage applicable to the property. • The petitioner has filed a application for a sign variance which will go to the Zoning Board of Appeals in November. • Joe Wywrot would like to see the auto turn exhibits Mr. Burns will provide. • Joe Wywrot would like to see boulders, decorated rock at the monument/sign entrance to make an attractive look coming into the city. • The southern 60 feet of Lot 5 is not proposed to be used for parking or access. The developer may wish to revise the plat of subdivision before it is recorded to make better use of this area. • Pavement improvements should extend onto Lot 4 to provide circulation around the CVS building. The plan shows a strong right turn into lot 4 on the plan. • Mr. Wywrot prefers non-trafficked areas,rather than striped paving on the lot. Kurtzman SUBJECT: PC 2008-23 125 W Hydraulic (Paravola) Special Use The Department of Building Safety has reviewed the applicant's proposal to convert commercial/office spaces into residential units and offers the following comments: 1. The property is presently zoned B-3. 2. This building has a total of 6 units—three located on the lower floor and three on the 2" floor. Of these units, the three units located on the lower floor have been used with non- residential uses and the three upper units have been used residentially for many years. Several years ago the Department of Building Safety was made aware that at least one of the lower units had been converted to a residential unit without a building permit. At that time,the Department informed the owner that residential units located below the 2nd floor were not permitted and the non-conforming unit(s) was removed. 3. The applicant is seeking to convert some of the uses in the existing building from non- residential to residential. Currently the building is divided into 6 units. Three of the units, located on the upper floor, are used as apartments. The three units located on the lower floor have been, most recently, used commercially and/or as office space. The applicant is seeking to take 2 of the units on the lower level and convert them from non- residential uses to 2 apartments (thus this building would have a total of 5 apartments should the requested special use be granted). 4. Within the B-3 district residential uses are not permitted by right, but, under Sections 10- 7D-2 and 10-7C-2, single-family apartments can be allowed within business buildings if a special use has been granted, subject to the requirements of Section 10-7B-8. Section 10-7B-8 has three standards: the apartments must meet the building code, they have to be within the business building (in other words, cannot be located in a separate building on the lot), and, in the case of a business which contains more than one apartment on a second floor above a first floor business, said business is allowed to have two(2) apartments maximum. As there are three residences located on the second floor at least two businesses must be located on the first floor in order to comply with this requirement. In addition to the special use permit, the applicant is also seeking relief from this C. Wunder PC 2008-23 (125 Hydraulic) October 20, 2008 Page 2 of 2 requirement. The Zoning Board of Appeals will consider this request during their December meeting. 5. Setbacks within this zoning district are as follows: a. Front yard: 50 feet b. Interior Side yard: 20 feet c. Corner Side yard: 30 feet d. Rear yard: 20 feet 6. The building presently on this property does not meet these setbacks as the building was constructed prior to the adoption of the zoning code. Staff notes that the northwestern corner of the building and sidewalk along the western side of the building extend beyond the property line onto the South Main Street right-of-way. 7. The maximum lot coverage within the B-3 district is 50%. This property is approximately 7,693 sq ft and the building has a footprint of approximately 3,600 sq ft. Therefore the building is roughly 47% of the overall lot size and thus meets this standard. 8. Parking requirements: 90 degree angled parking stalls are to be a minimum of 8.5 feet wide by 18.5 feet deep. Dimensions of the existing parking stalls have not been provided and therefore staff cannot confirm whether these standards are in fact being adhered to. 9. Based upon the current usage of the building(3 residential units on the upper level and 3,600 sq ft of retail spaced located on the lower level) a total of 18 off-street parking spaces should be provided. A total of 14 parking spaces currently exist on this property, thus this property has a deficiency of 4 parking spaces. This is a legal, non-conforming (i.e., "grandfathered") situation. 10. The applicant is seeking to convert two of the lower units into residential units, leaving one non-residential unit. The applicant did not include in his application information related to the size of the one remaining non-residential unit. If it is assumed that each of the three units on the lower level are of equal size, the remaining non-residential unit would be approximately 1,200 sq ft. With this assumption, converting two non- residential units into residential dwellings would equate to requiring a total of 14 parking spaces. 11. While under this scenario no additional parking spaces would be required, the zoning code does require that 50%of the required parking for multi-family dwellings must be enclosed. None of the parking on this property is enclosed and as a result, the applicant is seeking a variance from this requirement. This special use request is in relation to the use of the property, not the structure of the building. There are currently 4 single-family apartments on the 2nd story of the building. The petitioner is requesting to add 2 additional single-family apartments on the 1St story of the building in addition to the existing office space on the 1st story. Staff Suggestions • Two variance requests will be necessary for the subject property in order to allow the special use requested: 1. Variance to Section 10-11-4A—the property does not provide 1 enclosed parking space per multi family dwelling unit which is a requirement of this section. This variance might also need to cover the amount of parking spaces necessary for the subject property. This second item is dependent upon the square footage of the office in the building (currently there are 14 parking spaces, 12 are needed for multi-family residential use, leaving 2 for office. For offices uses 1 space is needed per 400 sq. ft.). Staff requests the petitioner provide the square footage of the office space on the subject property. 2. Variance to Section 10-7B-8C—as the number of 2nd floor apartments on the property exceeds the number of apartments per business allowed in a business building per this section of the ordinance. Two apartments is the maximum number allowed based on only 1 business being located in the building. • The petitioner has indicated the residential use is temporary until such time as business users can be identified for the structure or the property is redeveloped. Staff recommends a time period be determined to eliminate the special use and included as a provision of the special use approval. The length of the time frame should be considered and recommended by Plan Commission, however staff suggests a period of 3-5years would be appropriate. • The property will be subject to the City's Landscape Ordinance standards for parkway landscaping and parking lot landscaping given a special use request approval. o Given the unique nature of the subject property, Staff understands it may be difficult to meet these requirements on the subject property. As a potential alternative, Staff suggests the petitioner provide off site landscaping to meet their onsite landscaping requirement at a location determined by the City. • The Land Title Survey dated 04-10-07 states, "The maximum height for any building is 80',there are no setback requirements." Both are incorrect statements. o Staff suggests that this statement be stricken from the Land Title Survey. • The Land Title Survey dated 04-10-07 gives a property address of 119 Hydraulic Street,while the petitioner's application gives 125 W. Hydraulic. Yorkville GIS data gives an address of 119-125 Hydraulic for the subject property. It is recommended the petitioner amend their submitted documents to have a uniform address for the property. • The criteria for consideration for a special use permit are listed below. Special Use Standards (10-14-6 of Zoning Ordinance) F. Standards: No special use shall be recommended by the Plan Commission unless said Commission shall find that: 1. Chapter 10-7D-4 Section D of the Zoning Ordinance states, "Where a side or rear lot line coincides with a residential district zone, a yard of not less thirty feet(30') shall be required. A transitional yard shall be maintained only when the adjoining residential district is zoned R-1 or R-2 one-family residential." The current side yard is 20'. This is considered a pre-existing non-conforming structure.
