( 9:40am) The meeting was called to order at 9:00 am by Joe Wywrot. Corrections were made to the September 25, 2008 minutes. PC 2008-23 Paravola—Special Use John Paravola is asking for a special use of his building at 119 W. Hydraulic Street. Because development of the downtown has slowed, he would like to use two first floor units for residential purposes and first floor space for business use. Currently there are two apartments being rented on the second floor of the building. The petitioner is not proposing TIF funding. The building formerly housed the offices of John Loesch, and later a doctor's office. At this time, little monies would need to be invested for residential use, as there are separate meters and kitchens in each of the first floor apartments. The expense to remodel for apartment use, hopefully, will deter other downtown business owners to petition for rental use in their storefronts. There is ample parking in the front of the building for those leasing/ or hoping to lease apartments. Travis Miller suggested that,because there was little area for any potential landscaping near the building, that the city request John Paravola purchase trees for another designated downtown site. Mr. Wunder will research the prices of trees and give a cost estimate to Mr. Miller. Ms. Kurtzman pointed out that two variances are being applied for. The first variance pertains to Sectionl0-7B-8C,which states the number of 2nd floor apartments that are allowed in a business building is being exceeded. The second variance concerns Section 10-11-4A, stating 2 parking spaces are required, one of which has to be enclosed. Travis Miller and Stephanie Boettcher discussed the possibility of issuing the special use for a period of 3-5 years, with a reapplication to the City at the end of the time designated period. This would not be a permanent special use by Mr. Paravola. Mr. Miller suggested only 3-one year lease terms would be applicable for the petitioner before he would need to make a second application for a special use for this building. This will be at a public hearing at Plan Commission on Nov. 12. 1 I PC 2008-24 Burks Brothers Subdivision—Preliminary plan, Final plat The Burks' are seeking approval of a preliminary plan and final plat at 1211-1213 South Bridge (Rt. 47). Mr. Burks presented staff with an updated final plat, dated Oct. 28. Anna Kurtzman stated that the setbacks on Lots 3 & 4 setbacks need to be revised on the preliminary plan. Joe Wywrot said a separate out-lot needs to be conveyed to IDOT along Rt. 47. Joe will confirm this information with either Steve Andrews or Bob Simpson at IDOT, because Mr. Pilmer was told by IDOT this does not need to be conveyed at this time. As stated by Mr. Wywrot, ten foot wide public utility and drainage easements should be dedicated along the north side of Lots 2 and 3, the south sides of Lots 1 and 4, the east sides of Lots 3 and 4, and the west sides of Lots 1 and 2 for future utilities. He offered Mr. Burk an opportunity to ask for different easement locations, so the easement would not pass directly through the on site driveway. Mr. Burk was not convinced the easements are necessary because a use for the easements has not been determined. Joe stated the City will require the petitioner to have these easements dedicated. Per Ms. Boettcher, the current side yard of Lot 4 is 20'. This is considered a pre- existing non-conforming structure. If the lot is redeveloped it will require a 30' transitional (buffer) yard, per the landscape ordinance. This may require a shift in the building pad. This will be at the Plan Commission meeting on November 12. The meeting was adjourned at 9:45 am. These are minor differences in distances, and a more significant issue regarding a finger of land that extends north to E. Main Street. • The north back-of-curb of the pavement recently constructed along the south edge of the city's lift station property lines up with the north edge of the permanent 45-foot utility easement dedicated for sanitary sewers. In order for this roadway to transition to the future 28-foot right-of-way, a taper as shown on the attachment should be provided. A 25-foot ROW corner radius should also be provided at the SW corner of Lot 1. Revise the note regarding the future 28-foot ROW accordingly to include the taper and corner radius. • Show the existing Gawne Lane right-of-way and the side lot lines of the private lots to the west and south. • The 28-foot future public right-of-way is intended to combine with the existing 12-foot wide Gawne Lane private roadway to create a 40-foot wide public right-of-way. This 40- foot right-of-way should be named Gawne Lane. • The plat should be dated. • A separate plat should be prepared to dedicate public right-of-way for the pavement recently constructed along the south edge of the city's lift station property. Right-of-way dedication should extend from the south property line to a line 5 feet north of the existing roadway curb. The right-of-way should be identified as Gawne Lane. Plan: General • The plan should be submitted to Yorkville-Bristol Sanitary District to review with respect to the sanitary design. • The plan should be submitted to Bristol-Kendall Fire Protection District to review with respect to access and fire protection. • Due to the nature of the adjacent residential development, I recommend that sidewalks and streetlighting not be required for this development. • A tree survey should be submitted along with a landscape plan for review. • A"general notes" sheet should be incorporated into the plans to reference standards, materials, test procedures, etc. • Special details should be incorporated into the plan for trench,storm structures,water service, sanitary service, construction entrance, silt fence, etc. • Review comments may result in changes to more than one plan sheet. • An engineer's estimate of cost must be submitted for review once the plans are approved. The estimate should include earthwork, erosion control,paving,utilities, and landscaping. Sheet 1 • Provide two local benchmarks. Use NAVD 88 datum. • Revise the note under the location map by replacing the word"locating"with the word "maintaining". Sheet 3 • Two of the existing water services are not shown at their correct locations. The services for Lots 3 and 2 are 120' and 320',respectively,west of the east lot line of Lot 3. The service for Lot 1 is shown correctly. • The existing B-Box for Lot 3 would be located within the driveway, which is not allowed. Call for the B-Box to be relocated to a point north of the driveway.New copper pipe should be constructed all the way from the corporation stop so there are no joints in the service beneath pavement. The developer may wish to tap the watermain at a new location and abandon the existing water service completely. • The driveway for Lot 3 should be widened at the end to match the full width of the existing roadway. Based on the relatively steep drop-off at the south curbline,the developer should consider shifting the driveway to the north. • Show the existing end-of-roadway markers at the east end of Lot 3. Call for them to be removed and returned to the city. • All driveways should be no wider than 25 feet at the right-of-way line. A flare resulting in a width of 30 feet where the driveway meets the roadway is allowable. Revise the driveway widths accordingly. • Revise the note regarding seal coating of Gawne Lane to state that an A2 seal coat shall be applied to the entire N-S section of Gawne Lane. Add language stating that any pavement failures shall be repaired with a 4"hot-mix bituminous patch, with appropriate aggregate base repairs,prior to application of the seal coat. • Show the existing bituminous driveway to the wet well of the Bruell Street lift station. Call for a 4"bituminous patch,to run from the back-of-curb to the north side of the storm sewer trench. Sheet 4 • Due to the extreme relief across this property, I suggest that the scale of the grading plan be changed to at least 1"=20', and possibly 1"= 10'. • Call out an invert connection elevation for the storm sewer at the NW corner of Bruell& Wooddale. • There are discrepancies between the various plan sheets for the slope of the storm sewer downstream of CB #1. Review and revise accordingly. • The swale flow between Lots 1 and 2 should be intercepted with a 2' catch basin and directed to the existing drain at the SW corner of Lot 1. Grade a"bowl" around this new basin to help capture overland flow. The existing storm sewer at the SW corner of Lot 1 has a capacity of about 5 cfs, while the proposed/existing storm sewers across and east of Lot 3 only have a capacity of 2-3 cfs. The 12" storm sewer across the south side of Lot 1 should run parallel to the existing sanitary sewer to the extent possible. • Revise CB #1 to be a 2-foot diameter structure. A 4-foot structure is not necessary and a flat-top with no ability to grow grass over the top would be unsightly. • Revise the note regarding maximum driveway slope to be 10%rather than 4:1 (25%). Revise the grading plan accordingly. • We prepared a preliminary plan and profile for a future extension of Gawne Lane (a.k.a. Wooddale Drive)to see if it would fit with the proposed grading plan. The grading across Lots 1 and 2 looks OK, but changes are needed for Lot 3. The future roadway centerline could be as low as elevation 592 at the west property line, 589 directly south of the driveway, and 590 at the east property line. The north edge of pavement would be around 50 feet from the front of the garage. The garage floor elevation for Lot 3 needs to be lowered to elevation 593 to keep the driveway slope within our acceptable range of 2%to 10%. A side-load garage with a floor elevation higher than 593 should be considered. • Revise the storm sewer design for Lot 3 based on grading changes. • Darken the proposed grading contours on the north side of Lot 3. • Drainage off Lot 3 to the east is proposed to be directed to a depression on city property, which is not shown. We will evaluate this to decide if drainage to the depression is acceptable. • It appears that retaining walls are proposed to the south of all three houses. Provide top and bottom of wall elevations. Provide a special detail for the retaining walls. Sheet 5 • Identify the locations of the various cross-sections on the grading plan. Sheet 6 • Call for construction entrances to be placed at the 3 driveway entrances. The Comprehensive Plan defines Suburban Neighborhood as, "... [It is] intended to be a residential area primarily comprised of single-family detached residences... seeks to preserve existing developed areas at this density and to create new lower-density environments characterized by intimate neighborhoods and residences of distinctive design. Gross density in this classification should be between 1.50 and 2.25 dwelling units per acre. " Staff Suggestions: • The petitioner is requesting R-2 One Family Residence District. Listed below are the zoning requirements of this district. o Zoning Requirements—R-2 One Family Residence District Lot Area: Minimum 12,000 sq. ft. There is a companion request (PC 2008-26) to annex and rezone this property to R-2. Staff notes that the proposed lot configuration does not include a strip of land north of proposed lot 2. Under the current requests (PC 2008-26 to rezone to R-2 and PC 2008-27 to subdivide) there would be a strip of land that would be zoned R-2. This strip of land is part of another parcel (PIN 02-33-130-001) so this parcel would have two different zoning classifications—R-1 for the bulk of the property and a small strip zoned R-2. To avoid confusion in the future, staff is recommending that this strip be rezoned R-1. 2. All projects (regardless of a positive or negative EDC recommendation) proceed to the Committee of the Whole for discussion. Step 6: Committee of the Whole: The Committee of the Whole meets the first and third Tuesdays of the month at 7:00 p.m. in the Conference Room at City Hall. The project will be discussed in an informal atmosphere at the Committee of the Whole where no formal voting takes place. This session is to discuss and consider recommendations of prior committee meetings. Step 7: City Council: The City Council meets the second and fourth Tuesdays of the month at 7:00 p.m. in the Council Chambers at City Hall. This is where all City Council voting takes place. If this project has included an annexation and/or zoning petition,a Public Hearing will be held at this time with notice given by publication. Any annexation agreement, PUD agreement or development agreement must be signed by the Petitioner prior to being voted on by the City Council.
