Ordinance No.2019-32 AN ORDINANCE OF THE UNITED CITY OF YORKVILLE,ILLINOIS,APPROVING THE REZONING TO THE M-1 LIMITED MANUFACTURING DISTRICT OF THE PROPERTY LOCATED NORTH OF THE INTERSECTION OF BOOMBAH BOULEVARD AND COMMERCIAL DRIVE (Lot 15 Yorkville Business Center) WHEREAS, the United City of Yorkville (the "City") is a duly organized and validly existing non home-rule municipality created in accordance with the Constitution of the State of Illinois of 1970 and the laws of the State; and, WHEREAS, Morton Buildings, Inc. (the "Applicant") is the owner of a vacant parcel located north of the intersection of Boombah Boulevard and Commercial Drive, Yorkville, Illinois, (the "Subject Property") legally described in Section 2, and is seeking rezoning of the Subject Property from the B-3 General Business District to the M-1 Limited Manufacturing District; and, WHEREAS, the Planning and Zoning Commission convened and held a public hearing on the 8th day of May, 2019, to consider the rezoning after publication of notice and notice to property owners within five hundred(500) feet of the Subject Property; and, WHEREAS, the Planning and Zoning Commission reviewed the standards set forth in Section 10-4-1013.4 and made findings of fact and recommendation to the Mayor and City Council(the"Corporate Authorities") for approval of the rezoning; and, WHEREAS, the Corporate Authorities have received and considered the recommendation of the Planning and Zoning Commission. NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of Yorkville, Kendall County, Illinois, as follows: Section 1: The above recitals are incorporated herein and made a part of this Ordinance. Ordinance No.2019-32 Page 2 Section 2: That the Corporate Authorities hereby approve the rezoning of the Subject Property, legally described as: Lot 15 in Yorkville Business Center Unit 3, a subdivision of part of the West %i of Section 16 and part of the East 1/2 of Section 17, all in Township 37 North,Range 7 East of the Third Principal Meridian, according to the plat thereof recorded May 21, 2001 as Document Number 200100008620, in Kendall County, Illinois, PIN: 02-17-276-ON, from the B-3 General Business District to the M-1 Limited Manufacturing District. Section 3: This Ordinance shall be in full force and effect upon its passage, approval, and publication as provided by law.
