City Council Minutes 2001 03-01-01 Special Meeting I MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF YORKVILLE. KENDALL COUNTY. ILLINOIS. HELD IN THE CITY HALL CONFERENCE ROOM. 800 GAME FARM ROAD. ON THURSDAY. MARCH 1. 2001. Mayor Prochaska called the meeting to order at 7:00 p.m. ROLL CALL Deputy City Cleric Marker called the roll. Ward I James Present Sticka Present Ward II Burd Present Kot Present Ward III Anderson Present Munns Present Ward IV Sowinski Absent Spears Present OUORUM A quorum was established. CITIZENS COMMENTS: None PUBLIC HEARINGS None COMMITTEE REPORTS ECONOMIC DEVELOPMENT COMMITTEE REPORT PC 2000 -03 YORKVILLE MARKET PLACE - Final Plat. Landscaping Plan & PUD. Mayor Prochaska asked that Attorney Kramer begin. Attorney Kramer stated that they have the latest draft of the PUD Agreement which is dated 2/28/01, and it is really the same as the one from last week except they have cleaned up the language. The only change is that the petitioner has asked to add wording that if they acquire an existing gasoline station that they could replace it with another, otherwise there are no business changes. Mayor Prochaska asked Mr. Schoppe for his comments. 1 Mr. Schoppe stated that regarding the landscaping, he has read the agreement and they have agreed to plant 300 trees and 2000 shrubs. Most of these will be planted along Landmark Drive as a screen for the back of the building. Their layout plan will be revised and then re- reviewed. Mr. Kasson stated he would work with staff to finalize plans. Mayor Prochaska asked Mr. Kasson if we are in agreement. Mr. Kasson stated that they are agreed, but they have to verify a couple of things. Mr. Fixler stated overall everything is fine. Mayor Prochaska asked if we are agreed. Mr. Fixler stated in regard to the Landscaping, yes. Alderwoman Spears asked for a clarification on page 6, regarding building code over the BOCA code. Alderman James asked for an explanation. Attorney Kramer stated this is in regard to recapture for sewer done on Walnut which is due St. Patrick's and will expires in April. Petitioner has agreed to pay the recapture even if it is after April. Mayor Prochaska asked if there was anything further on PC 2000 -03. (ORDINANCE) 2001 -7A Annroving Yorkville Market Place PUD & Modification of Consent Decree Alderman Sticka motioned and Alderman Kot seconded to approve the Planned Unit Development Agreement and Modification of a Consent Decree Concerning Real Property Owned By LaSalle Bank N.A. Successor Trustee to American National Bank & Trust Company of Chicago A/T/U /T /A Dated July 16, 1991 and known as Trust No. 114224 -09 and Dated January 19, 1993 and Known as Trust # 116521 -04 and Being Developed By TDC Yorkville, L.L.C. and Approval of Development/Economic Initiative Agreement and to authorize the Mayor and City Clerk to execute the agreement on behalf of the United City of Yorkville. On a roll call vote all City Council members present voting aye. Ayes: 7 Nays: 0 Motion carried. James- Aye / Sticka-Aye/Burd- Aye /Kot- Aye /Anderson- Aye /Munn- Aye /Spear -Aye 2 (ORDINANCE) 2001 -711 Authorize Execution of Agreement for Yorkville Market Place PUD & Economic Initiative Alderman Sticka motioned and Alderman Kot seconded to Authorize the execution of a Planned Unit Development Agreement & Development/Economic Initiative Agreement between LaSalle National Bank N.A. Successor Trustee to American National Bank & Trust Company of Chicago A/T/U /T /A Dated July 16, 1991 and Known as Trust No. 114224 -09 and dated Jan. 1993 and Known as Trust No. 16521 -04 (TDC Yorkville, L.L.C.) and the United City of Yorkville and authorize the Mayor and City Clerk to execute the agreement on behalf of the United City of Yorkville. On a roll call vote all City Council members present voting aye. Ayes: 7 Nays: 0 Motion carried James - Aye /Sticka- Aye /Burd- Aye/Kot- Aye /Anderson- Aye /Munns- Aye /Spear -Aye Mr. Fixler stated they planned to break ground in April. Alderman Sticka motioned and Aderwoman Burd seconded to adjourn. On a voice vote. All members present voting aye. Motion carried. Meeting adjourned at 7:15 PM Motion carried.
